Descriptin f the cntract CONTRACT SPECIFICATIONS The wrks subject t EU financing, Lt III f the cnstructin, will be cmplementing the wrks implemented by the BiH Authrities (Lts I and II). Wrks under Lts I (cnstructin f the highway sectin crssing the BCP Bijača) and II (cnstructin f a minr part f the facilities t enable temprary brder cntrl) are nging and are planned t be cmpleted by end June The wrks subject t EU financing are related t cnstructin f functinal part f the brder crssing pint in Bijača, and nce cmpleted will enable full peratin f the BCP Bijača. These wrks includes the fllwing: Lt III: Phases 3 and 4 Phase 3 cmprises wrks n the suthern plateau f the BCP while Phase 4 cmprises wrks n the nrthern plateau f the BCP, bth including the respective buildings and installatins, as fllws: Traffic slutin including plateau, parking lts, and pedestrian areas; Landscape arrangement; External lighting; Main building fr the custms and plice fficers (passengers and freight traffic); Inspectins building (phytsanitary, market and sanitary); Building fr detailed inspectin f vehicles; Cntrl bts (brder plice and custms checks); Weighting scales (tw); Tilets fr man and wman; Central canpy; Hydr installatins (external and internal), including water supply, surface water drainage and sewage netwrks; January 2013 Page 1 f 5

2 Mechanical installatins (heating, ventilatin and air-cnditining system); Electrical installatins, high and lw vltage (i.e. electricity, lighting, telecmmunicatins, audi and vide surveillance, fire alarm, lightning prtectin installatin). 7. Number and titles f lts N, ne lt nly. TERMS OF PARTICIPATION 8. Eligibility and rules f rigin Participatin is pen t all legal persns [participating either individually r in a gruping (cnsrtium) f tenderers] which are established in a Member State f the Eurpean Unin r in a cuntry r territry f the regins cvered and/r authrised by the specific instruments applicable t the prgramme under which the cntract is financed (see als heading 22 belw). All wrks, supplies and services under this cntract must riginate in ne r mre f these cuntries. Participatin is als pen t internatinal rganisatins. The participatin f natural persns is directly gverned by the specific instruments applicable t the prgramme under which the cntract is financed. 9. Grunds fr exclusin Tenderers must submit a signed declaratin, included in the Tender Frm fr a Wrks Cntract, t the effect that they are nt in any f the situatins listed in pint f the Practical Guide t cntract prcedures fr EU external actins. 10. Number f tenders Tenderers may submit nly ne tender. Incmplete tenders, nt cvering the entire scpe f wrks will nt be cnsidered. Any tenderer may state in its tender that it wuld ffer a discunt in the event that its tender is accepted. Tenderers may nt submit a tender fr a variant slutin in additin t their tender fr the wrks required in the tender dssier. 11. Tender guarantee Tenderers must prvide a tender guarantee f 57,000 eurs when submitting their tender. This guarantee will be released t unsuccessful tenderers nce the tender prcedure has been cmpleted and t the successful tenderer(s) upn signature f the cntract by all parties. 12. Perfrmance guarantee The successful tenderer will be asked t prvide a perfrmance guarantee f 10% f the amunt f the cntract at the signing f the cntract. This guarantee must be prvided tgether with the return f the cuntersigned cntract n later than 30 days after the tenderer receives the cntract signed by the Cntracting Authrity. If the selected tenderer fails t prvide such a guarantee within this perid, the cntract will be vid and a new cntract may be drawn up and sent t the tenderer which has submitted the next cheapest cmpliant tender. 13. Infrmatin meeting and/r site visit N infrmatin meeting is planned. 14. Tender validity Tenders must remain valid fr a perid f 90 days after the deadline fr submissin f tenders. 15. Selectin criteria Ecnmic and Financial capacity: SELECTION AND AWARD CRITERIA a) The tenderer must be a registered firm r natural persns capable t carry ut the specified wrks. b) The ttal turnver in cnstructin wrks f a sle tenderer during the past three (3) years ( ) must be at least 6.0 MEUR. In the case f jint venture/cnsrtium the Lead Partner s individual ttal turnver in cnstructin wrks in the past three (3) years ( ) must be at least 3.0 MEUR, while the cnsrtium/jint venture as a whle must have turnver in cnstructin wrks f at least 6.0 MEUR in ttal fr the previus 3 years ( ); (Vl. 1; Sec.4; Frm 4.4; Financial statement ). c) Wrks in hand in cnstructin f a sle tenderer must be at least 1.0 MEUR. In the case f jint venture/cnsrtium, wrks in hand in cnstructin f at least ne (1) member f jint venture/cnsrtium must be at least 0.7 MEUR; while the cnsrtium/jint venture as a whle must have at least 1.0 MEUR cnstructin wrks in hand. (Vl. 1; Sec.4; Frm 4.4; Financial statement ) d) The sle tenderer r at least ne f the partners in a jint venture/cnsrtium must have access t sufficient credit and ther financial facilities t cver the required cash flw fr the duratin f the cntract. In any case, the amunt f credit available must be at least 1.0 MEUR. Prfessinal capacity: The key persnnel (Prject Manager, Site Manager and Electrical Engineer) must be as fllws: a) Prject Manager: shall have a University degree (BSc) (*) in civil engineering r architecture; shall have at least ten (10) years f relevant prfessinal experience in cnstructin management (i.e. managing design preparatin., cnstructin wrks r supervisin ver cnstructin wrks) b) Site Manager: shall have accmplished as a minimum a 2 year pst-secndary educatin in technical disciplines is a charted engineer ( plzen strucni ispit ) accrding t the legislatin applicable in Bsnia and Herzegvina shall have at least seven (7) years f relevant prfessinal experience in cnstructin shall have cmpleted at least ne (1) cnstructin/recnstructin prject, as a site manger, f a similar cmplexity and nature, cmparable with this particular prject ver the last 5 years (2008, 2009, 2010, 2011, 2012). c) Electrical engineer: shall have a University degree (BSc) (*) in electrical engineering; is a chartered engineer under the legislatin applicable in Bsnia and Herzegvina ("plzen strucni ispit"); shall have at least five (5) years f relevant prfessinal experience related t electrical installatins (i.e. design preparatin, supervisin ver cnstructin r cnstructin f electrical installatins f HV/LV) (*) A level f educatin which crrespnds t cmpleted university studies attested by a diplma in a subject relevant t the field cncerned when the nrmal perid f university educatin is equivalent t 4 years r mre. Technical capacity: a) In case f sle tenderer, he must have the ability t carry ut at least 70% f the cnstructin wrks by its wn means, meaning he must have rganisatinal, structure, equipment, materials, human January 2013 Page 3 f 5

4 and financial resurces, including access t the bank lans, necessary t enable him t carry ut 70% f the cntract. b) In case f cnsrtium/jint venture, the lead partner must have the ability t carry ut at least 50% f the cntract wrks by his wn means, as defined in pint a) abve. c) Other partners in a jint venture/cnsrtium (i.e. nt the lead partner) must have the ability t carry ut at least 10% f the cntract wrks by his wn means, as defined in pint a) abve. d) The sle tenderer/r at least ne f the partners in a jint venture/cnsrtium shall present its experience in implementatin, as a prime cntractr, f at least 1 (ne) cnstructin prject, physically cmpleted, f similar cmplexity and nature, ver the past 5 (five) years prir t the tender submissin deadline. The tenderer must present cpies f the respective certificate(s) f cmmissining, prvisinal r final acceptance certificate endrsed by the Supervisrs/Cntracting Authrity fr the prjects cncerned. The Cntracting Authrity reserves the right t ask fr further infrmatin. An ecnmic peratr may, where apprpriate and fr a particular cntract, rely n the capacity f ther entities, regardless f the legal nature f the links which it has with them. Sme examples f when it may nt be cnsidered apprpriate by the Cntracting Authrity are when the tenderer relies mstly n the capacity f ther entities r when it relies n key criteria. If the tenderer relies n ther entities, it must prve t the Cntracting Authrity that it will have at its dispsal the resurces necessary t perfrm the cntract, fr example by prducing an undertaking n the part f thse entities t place resurces at its dispsal. Such entities, fr instance the parent cmpany f the ecnmic peratr, must respect the same rules f eligibility and ntably that f natinality, as the ecnmic peratr. Furthermre, the tender shuld include a separate dcument prviding data n this third entity fr the relevant selectin criterin. Prf f capacity must be furnished at the request f the Cntracting Authrity. 17. Award criteria Price. 18. In case that tenderer is nt able t cllect the dssier frm the premises f the Delegatin f the Eurpean Unin t Bsnia and Herzegvina, an electrnic versin f the tender dssier including drawings (CD-ROM) will be sent by curier delivery t the address f the interested party. Tenders must be submitted using the standard tender frm included in the tender dssier, whse frmat and instructins must be strictly bserved. 5 mentining the publicatin reference shwn in item 1, at least 21 days befre the deadline fr submissin f tenders given in item 19. The Cntracting Authrity must reply t all tenderers' questins at least 11 days befre the deadline fr submissin f tenders. Eventual clarificatins r minr changes t the tender dssier will be published at the latest 11 days befre the submissin deadline n the EurpeAid website at Deadline fr submissin f tenders 12:00 Central Eurpean Time n 14 th Octber 2013 Any tender received after this deadline will nt be cnsidered. 20. Tender pening sessin 15:00 Central Eurpean Time n 14 th Octber Language f the prcedure All written cmmunicatins fr this tender prcedure and cntract must be in English. 22.
