If we are uable to meet our liabilities to our policyholders, you may be able to claim compesatio from the Fiacial Services Compesatio Scheme (FSCS). There are differet levels of compesatio, depedig o what kid of isurace you have: Compulsory isurace such as third party motor isurace, is covered for 100% of the claim. No compulsory isurace, such as home isurace, is covered for 90% of the claim. Cotract of Motor Isurace The policy, the schedule (icludig edorsemets), the certificate of motor isurace, the iformatio you gave us i the proposal form or statemet of fact ad declaratios that you have made, all form the cotract of motor isurace. Edorsemets Somethig which alters your isurace cover. Your cover will be affected by ay edorsemet that is show o the schedule. (Such edorsemets may add exclusios to the cover or require you to take actio such as fittig approved security.) More tha oe edorsemet may apply. If you do ot comply with ay edorsemets, this cotract of motor isurace may o loger be valid ad we may refuse to deal with ay claim. Excess The amout you have to pay towards each claim you make uder this cotract of motor isurace. Highway Isurace Compay Limited A isurace compay, part of the Liverpool Victoria group of compaies, authorised by the Prudetial Regulatio Authority ad regulated by the Fiacial Coduct Authority ad the Prudetial Regulatio Authority. Hire Car A Group A vehicle (1.0 litre hatchback or similar) which will be delivered to ad collected from your home address. Hire Car Compay The compay we istruct to provide you with the hire car. Hire Period The period for which we pay for the hire car for up to a maximum of 14 days. Isurace Adviser the perso or compay you purchased this isurace from. Isured Car The car(s) show o the curret schedule ad certificate of motor isurace. Isured Vehicle Ay motor vehicle isured comprehesively with Highway Isurace that appears o a curret certificate of motor isurace ad for which a premium has bee paid for car hire cover. Market Value The cost at the date of the accidet or loss of replacig the isured car, if possible, with oe of a similar make, model, age, coditio ad mileage. We will usually ask a egieer to give us advice about the market value of the isured car, refer to guides of vehicle values ad ay other relevat sources. I assessig the market value, you should cosider the amout that could reasoably have bee obtaied for the isured car if you had sold it immediately before the accidet, loss or theft. Period of Isurace The legth of time covered by this cotract of motor isurace, as show o the curret schedule ad certificate of motor isurace. Persoal Belogigs Certai property i the isured car, which you wear or use i every day life which belogs to you or ayoe travellig i the isured car. Proposal Form or Statemet of Fact The documets filled i by you, or o your behalf by a isurace adviser, or someoe else, ad all other iformatio you gave ad declaratios made at the time the isurace was arraged ad o which we have relied whe agreeig to offer this cotract of motor isurace. If you do ot give us the full iformatio requested at the start, ad tell us about chages, this cotract of motor isurace may o loger be valid ad we may refuse to deal with ay claim. Schedule Forms part of the cotract of motor isurace ad cofirms details of you, the isured car(s) ad the cover which applies. It is oe part of the cotract of motor isurace. Stadard Accessories Accessories made available for the vehicle by the maufacturer as optioal extras ad for which a receipt must be provided. Stadard accessories do ot iclude modificatios to the isured car, sigwritig or ay other accessory fitted to it ot provided by the vehicle maufacturer. Territorial Limits Eglad, Scotlad, Wales ad Norther Irelad. These limits apply to Part B oly. The geographical limits defied i this policy do ot apply to Part B of this policy. 14 CONTRACT OF MOTOR INSURANCE Bespoke Car This policy, the schedule, the certificate of motor isurace, iformatio you gave us i the proposal form or statemet of fact ad declaratios that you have made, form a legally bidig cotract of motor isurace betwee you ad Highway Isurace Compay Limited, tradig as Highway Isurace. This cotract of motor isurace is a cotract persoal to you ad you caot trasfer it to ayoe else. We agree to isure you uder the terms of this cotract of motor isurace agaist ay liability, loss or damage that occurs withi the geographical limits durig the period of isurace for which you have paid, or agree to pay, the premium. You must read this policy, the schedule ad the certificate of motor isurace together. The schedule tells you which sectios of the policy apply ad idetifies ay edorsemets. Please check all three documets carefully to make sure that they give you the cover you wat ad that you comply with all the relevat terms ad coditios, icludig ay edorsemets. It is ot iteded that the Cotracts (Rights of Third Parties) Act 1999 should cofer ay additioal rights uder this policy i favour of ay third party. Uless we agree with you to apply the laws of aother coutry, Eglish Law will apply to this cotract (uless you live i Guersey or Jersey, where Guersey or Jersey law will apply). Coolig-off Cacellatio Right We hope you are happy with the cover this policy provides. However, you have the right to cacel it withi 14 days of receivig the policy, without givig ay reaso. You may cacel usig this coolig-off period by tellig us, or your isurace adviser, i writig or by or telephoe ad cacellatio ca take effect immediately or from a later date, although it caot be backdated to ay earlier date. If you do cacel i the first 14 days usig the coolig-off cacellatio coditio, we will charge you pro rata, subject to a miimum fee of 25 + Isurace Premium Tax, for the cover provided from the begiig of the cotract util the policy is cacelled, uless we are required to make a total loss paymet uder the policy, uder which circumstaces a refud of the premium is ot payable. Cacellig your Policy (Outside the Coolig-off Cacellatio Right) You may cacel this cotract of motor isurace at ay time by tellig us, or your isurace adviser, i writig or by or telephoe ad cacellatio ca take effect immediately or from a later date, although it caot be backdated to ay earlier date. If you or someoe else has ot made a claim i the curret period of isurace, we will refud part of your premium. We will work out the refud o a pro-rata basis less a premium charge of 25 + Isurace Premium Tax to cover our admiistratio costs. Valid reasos may iclude, but are ot limited to, if: you do ot pay your premium, premium deposit or ay istalmet paymet o or before the due date; you or ayoe else covered by this isurace has ot met all the terms ad coditios of this policy; a chage i your circumstaces meas we ca o loger provide cover; we idetify misrepresetatio or fraud or ay attempt to gai a advatage uder this isurace to which you are ot etitled, see Geeral Coditio Fraud ad Misrepresetatio. you do ot provide us or your isurace adviser with ay requested documets. The isurace will ed immediately the seve days otice rus out. If you have just take out the policy or reewed it with us ad the premium is upaid, we will cacel your isurace from the start/reewal date. We will refud the balace of your premium that applies to the remaiig period of isurace uless fraud has bee idetified. If a refud is paid, a premium charge of 25 + Isurace Premium Tax to cover our admiistratio costs will be deducted from the refud. If you or someoe else has made a claim, we will cacel your cover but may ot refud ay premium. If you are payig by istalmets, you must still pay the balace of the full aual premium. If you produce a cacelled certificate of motor isurace to ay perso with the itetio of deceivig that perso ito acceptig it as geuie, you may be prosecuted. Details of ay motorig covictios, fixed pealty offeces or licece edorsemets for ay perso who may drive the car. Details of ay crimial covictios for ay perso who may drive the car. Details of ay accidets, thefts, loss or damage, regardless of blame or whether a claim was made or ot, for ay perso who may drive the car. This is ot a full list ad you should cotact your isurace adviser for advice if you are ot sure whether a chage will affect your cover. Whe you advise us of ay permaet or temporary chages to your policy durig the period of isurace which we agree to, or if you request duplicate documets, a premium adjustmet charge of 10 + Isurace Premium Tax will be made i additio to ay other chage i premium to cover our admiistratio costs. This charge is i additio to ay admiistratio fees charged by your isurace adviser. If your chage of circumstaces meas that we ca o loger provide cover, we or our authorised aget will give you otice of cacellatio, see Cacellig your Policy (Outside the Coolig-off Cacellatio Right). We will also cover you for your legal liability for damage to their property (icludig ay related idirect loss) up to 20,000,000 ad for costs ad expeses icurred up to 5,000,000. We will also isure you while the isured car is towig a carava, trailer or broke-dow car, so log as the towig is allowed by law ad the carava, trailer or broke-dow car is attached properly to the isured car by towig equipmet made for this purpose. What is ot covered Loss or damage to the isured car, carava, trailer or broke-dow car. Ay amout above 20,000,000 for damage to other people s property (icludig ay related idirect loss) ad ay amout above 5,000,000 for costs ad expeses icurred. Property belogig to (or i the care of) you or your passegers or i ay carava, trailer or broke-dow car. Death or ijury to the perso drivig or i charge of the isured car or to ay perso beig carried i or o, or gettig ito or out of, a carava or trailer. If your curret certificate of motor isurace states that busiess use is allowed, liability for death or ijury to ay employee of the perso isured, arisig durig the course of their employmet, except where eeded by law. Drivig other cars What is ot covered Legal liability uless your certificate of motor isurace states that you are covered to drive other private motor cars. Ay loss or damage to the private motor car you are drivig. Drivig without the ower s permissio. Use of a private motor car outside the geographical limits. Legal liability which is covered by ay other isurace you have to drive the other private motor car or whe you o loger have possessio of the isured car or it has bee damaged so much that it is ot worth repairig or has bee stole ad you have ot got it back. Loss or damage to ay property belogig to (or i the care of) ay driver or passeger who is makig a claim uder this Sectio. Death or ijury to the perso drivig or i charge of the other private motor car. Use of a car derived va, va, motorcycle or ay other motor vehicle that is ot a private motor car. If a replacemet car of the same make, model ad specificatio is ot available we will, where possible, provide a similar car of idetical list price. If the isurace covers more tha oe car, the No Claims Discout will apply separately for each car. You caot trasfer your No Claims Discout to ayoe else. We will reduce or remove your No Claims Discout, i accordace with the scale below, if we make ay paymet whatsoever, eve if the accidet is ot your fault, uless we get the moey back from someoe else. We may withhold the No Claims Discout i full or part if there are ay claims that have ot bee settled. 34 Part B GUARANTEED HIRE CAR Guarateed Hire Car The cover provided uder Part B oly applies if it is show o the curret policy schedule ad you have paid the additioal premium. What is covered If the isured vehicle is damaged (excludig widscree damage) ad is beig repaired by a Highway Isurace approved repairer, or is stole ad ot recovered ad the icidet occurs withi the territorial limits, we will arrage for a hire car to be delivered to, ad collected from, your home address (as described o the schedule), for your use. Whilst the isured vehicle is beig repaired by a Highway Isurace approved motor vehicle repairer, or From whe you otify us of the theft claim, util paymet has bee issued to you i settlemet of your claim, i either case ot exceedig the hire period. If, due to circumstaces beyod our cotrol we caot arrage a hire car for you, we may, at our discretio, reimburse your trasportatio costs up to a maximum of 10 per day for the hire period. 36 Part B GUARANTEED HIRE CAR CONTINUED How to obtai your Hire Car If the isured vehicle is ivolved i a icidet, accidet or is stole you must report it immediately (o later tha 24 hours) to the Cotact Cetre (UK) o ad to the Police if the isured vehicle has bee stole. We will get the hire car compay to cotact you to arrage delivery of the hire car. A fuel deposit is payable by you o receipt of the hire car. This will be refuded upo retur of the hire car provided there is o damage ad it has a full tak of fuel. If you wish to upgrade from the hire car provided, you should discuss this with the hire car compay, but you will be resposible for ay additioal cost required. Terms ad coditios The hire car will be isured uder your comprehesive motor isurace policy with Highway Isurace durig the hire period. This meas that claims arisig durig the hire period will be made uder your motor isurace policy. You must therefore comply with the geeral exclusios ad geeral coditios of your motor isurace policy durig the hire period.
