6 Defiitios Wherever these defiitios appear i this documet of breakdow cover, they will have the same meaig. Breakdow a traied, professioal motor mechaic/recovery driver or specialist professioal service provider. Breakdow The vehicle is icapable of operatio as a whole because of mechaical or electrical failure, theft or attempted theft, vadalism, accidetal damage, a flat tyre, a lack of fuel or icorrect fuellig durig the period of cover. Failure of ay parts of the vehicle to fuctio e.g. a idicator, headlight, widscree wiper or covertible roof does ot costitute a breakdow uless the failure causes the vehicle to be icapable of operatig as a whole or is likely to result i the driver beig prosecuted for usig a defective vehicle. The cover caot be used as a alterative to regular servicig or maiteace or as a way to avoid payig for repairs. Home address your permaet residece we have o record at the time of a breakdow as supplied by you. Motorail a specific Europea Rail Service for trasportig vehicles across Europe. Motorail services do ot iclude Chael Tuel rail services. Passegers occupats of the vehicle (excludig hitch hikers). Schedule forms part of your cotract with us ad icludes the period of cover, ame of the policyholder ad your level of breakdow cover. 7 Sectio A Itroductio to LV= Breakdow Cover This policy is for residets of mailad Uited Kigdom (UK), Norther Irelad, the Chael Islads ad the Isle of Ma ad etitles you to our vehicle breakdow ad recovery assistace withi the UK, the Chael Islads, the Isle of Ma or the Republic of Irelad. For Europea breakdow ad recovery assistace see Sectio G (UK & Europea Assist). We have set out the levels of cover which we provide i Sectios C to G. Importat Iformatio about your cover We will protect you agaist the cost of vehicle breakdow ad recovery assistace withi the policy period, show o your schedule, for which you pay a premium. Uless you give us a future start date your cover begis the day after you purchased the cover. Where it is ot safe to repair a fault at the roadside (for example o a motorway), we will take your vehicle to a safe locatio to carry out repairs. All costs relatig to parts ad labour remai your resposibility uless covered or agreed by us. We caot guaratee that a replacemet vehicle will be available. We will ot pay for ay extra charges relatig to specific eeds of a replacemet vehicle such as tow bars or roof racks; these requiremets are subject to availability. You must meet the terms ad coditios of the hire car compay which iclude havig a valid drivig licece, meetig the miimum age set by the hire car compay ad beig i possessio of a valid credit card. Hire cars may ot be take out of the coutry without the permissio of the hire car compay. Our breakdow ad recovery assistace does ot exted to hire cars provided uder this policy. If you have purchased the appropriate level of cover, we will oly provide help at your home address if your vehicle is icapable of operatio due to a breakdow. For help provided at your home address, our breakdow professioal will try to repair the fault. If they ca t do this, we will take the vehicle immediately to a local place of repair but you will have to pay for ay repairs. If you do ot accept immediate recovery, you will have to pay for ay further help for the same fault. Recovery caot be used as a way of avoidig repair costs. This service caot be used if the vehicle has already broke dow or was ot i a roadworthy coditio whe cover was take out. The policy covers oe permaetly amed vehicle. Movig to a lower level of cover is ot permitted durig the policy period except withi 14 days of receivig your documets. After this period reducig your level of cover ca oly be applied at reewal. However you ca amed the vehicle at ay time or icrease your level of cover, except whe the icrease of cover is at the poit of a potetial claim or if you ve already travelled to Europe ad wish to add UK & Europea Assist. 5 DOCUMENT OF BREAKDOWN COVER

9 Sectio B Vehicles For all vehicles, caravas or trailers ad motorhomes you must always carry a legal ad serviceable spare wheel or a maufacturer supplied or approved emergecy tyre iflatio kit ad equipmet ad keys for ay tyre security devices whe supplied by the maufacturer. Vehicles must be i a roadworthy coditio ad should be serviced ad maitaied i lie with maufacturer guidelies ad meet all legal regulatios icludig, if appropriate, havig a MOT certificate ad ay applicable vehicle tax. It is your resposibility to esure that all vehicles are kept i this coditio throughout the period of cover ad we may ask for proof i the evet of a dispute. The service does ot cover vehicles which, i the opiio of the breakdow professioal attedig the vehicle, were ot roadworthy or were broke dow before your policy bega. We will ot provide services for vehicles that are ot registered with us. You must tell us immediately if you chage your vehicle. Vehicle chages must be permaet ad are ot reversible. Vehicles ad ay carava or trailer that is attached to your vehicle must be registered as owed by you, or a member of your household, ad be kept at your home address as show o our records. Caravas ad trailers your cover icludes ay carava or trailer that is attached to the vehicle at the time of the vehicle breakdow, uless the breakdow occurs at your home address or withi 1¼ of a mile of that address or the locatio at which your carava or trailer is ormally stored. Caravas ad trailers must be fitted with a stadard 50 millimetre ball couplig. All caravas ad trailers must meet the requiremets of the Road Vehicles (Costructio ad Use) Regulatios Motorhomes must be a recogised make ad model which has bee coach-built for that precise purpose. Sectio C Roadside Assist If your vehicle caot be drive because of a breakdow which occurred more tha a ¼ of a mile from your home address, we will: Try to repair the fault at the roadside for up to oe hour so that you ca cotiue your jourey safely ad legally; If we caot repair your vehicle at the roadside we will trasport your vehicle, you ad up to 7 passegers that are i the vehicle at the time of the breakdow to a local place of repair or to a destiatio of your choice withi 10 miles of the breakdow; or if you have lost or broke your vehicle keys, ad a spare set is kow to be at a earby locatio, we may choose at our discretio to arrage trasportatio for you to collect the spare set istead of allocatig a breakdow professioal to atted the vehicle. 10 Exceptios to Sectio C Breakdows occurrig withi a ¼ of a mile of your home address. All labour charges other tha oe hour s labour at the roadside, ad the cost of replacemet parts ad/or other materials are your resposibility. The cost of supplyig a spare wheel ad tyre if a serviceable oe caot be provided by you. The cost of, if eeded, a specialist locksmith, body glass or tyre specialist. Aythig specified withi the Service Limitatios ad Exclusios sectio of this policy (See Sectio I). Sectio D Roadside & Home Assist If your vehicle caot be drive because of a breakdow, we will: Allow you to use the cover provided uder Sectio C (Roadside Assist) at your home address or withi a ¼ of a mile of your home address. Exceptios to Sectio D All exceptios specified i Sectio C (Roadside Assist) other tha if the breakdow occurs withi a ¼ of a mile of your home address. If you do ot accept immediate recovery followig a call out to your home address, you will have to pay for ay further help for the same fault. Aythig specified withi the Service Limitatios ad Exclusios sectio of this policy (See Sectio I). Sectio E UK Recovery If your vehicle caot be drive because of a breakdow which occurred at least a ¼ of a mile from the your home address, we will; Allow you to use the cover as specified uder Sectio C (Roadside Assist); Trasport your vehicle, you ad up to 7 passegers that are i the vehicle at the time of the breakdow to a local place of repair; or to a destiatio of your choice if the fault or damage caot be repaired at the scee of the breakdow or locally by the ed of the workig day (we will ot pay for ay other recoveries); or pay a cotributio towards labour costs followig agreemet betwee you ad us if a fault ca be repaired locally; Supply a Relief Driver if the oly able ad legal driver of the vehicle caot cotiue a jourey because of illess or ijury. Documetary proof of the illess or ijury must be supplied to us if you are ot to be charged for this service. Exceptios to Sectio E All exceptios specified i Sectio C (Roadside Assist). 11 Sectio F UK Recovery & Home Assist If your vehicle caot be drive because of a breakdow, you may: Use the cover provided uder Sectios C, D ad E at your home address or withi a ¼ of a mile of your home address; Choose oe of the followig beefits if repairs to the vehicle caot be completed by the ed of the workig day o which the breakdow occurred; a) The hire of a replacemet car (up to 1600cc) for up to 48 hours. We will pay the cost of the hire car but you are resposible for all other costs or beefits imposed or offered to you by the hire car compay. You must take up the optio of a hire car withi 48 hours of the breakdow; or b) The cost for you ad ay passegers to either cotiue the jourey or retur to your home address by our choice of alterative trasport, up to a maximum of 100 i total; or c) Pay up to 60 per perso for overight accommodatio up to a maximum of 500 at accommodatio ear the garage that is repairig your vehicle, ad up to 40 for reasoable public trasport costs to get the driver to the garage the followig day. You must sed us your claim withi 28 days for us to pay you these costs, alog with the relevat receipts. Claim for the cost for oe sigle stadard class rail ticket for you or ay authorised driver to collect the vehicle followig repair. Exceptios to Sectio F All exceptios specified i Sectios C, D ad E. If you do ot accept immediate recovery followig a call out to your home address, you will have to pay for ay further help for the same fault. Costs exceedig the moetary limits specified withi Sectio F (UK Recovery & Home Assist). A hire car ot authorised by us. Car hire i the evet of the vehicle requirig routie servicig or other repair work to correct o immobilisig faults or udergoig repair of cosmetic damage. Aythig specified withi the Service Limitatios ad Exclusios sectio of this Policy (see Sectio I). Sectio G UK & Europea Assist I additio to all the services, beefits, terms ad coditios give uder Sectios C F of this policy, those detailed i Sectios G1 G7 will also apply whe the vehicle is i the geographical limits listed below. You may have to pay for some services such as uplaed accommodatio ad claim it back from us whe you retur to the UK. The exchage rate will be based o the exchage rate at the time the claim is processed. We will aim to provide the most suitable ad cost effective solutio to your problem ad our decisio will be fial. Sectio G1 Cover before you travel If your vehicle caot be drive because of a breakdow durig the 7 days immediately precedig a pre-booked trip departure date ad repairs caot be completed before you leave, we will: Arrage ad pay a maximum of up to 800 for you to hire a replacemet car, subject to availability, with you beig resposible for all other costs or beefits imposed or offered to you by the hire car compay; or Subject to all legal ad statutory regulatios allow a temporary chage of the vehicle that is o cover to allow you to cotiue your jourey; or If your vehicle caot be repaired withi 24 hours of your origial plaed departure, we will cover the cost of rebookig your sea crossig or jourey via the Chael Tuel which was missed as a result of the icidet givig rise to a claim uder this sectio. Exceptios to Sectio G1 Ay claims resultig from a breakdow if you have purchased this cover less tha 7 days before your plaed departure date or a existig policy which expires before the ed of your trip. You must meet the terms ad coditios of the hire car compay which iclude havig a valid drivig licece, meetig the miimum age set by the hire car compay ad beig i possessio of a valid credit card. Sectio G2 Missed Motorail coectio If you fail to coect with a pre-booked Motorail service o the outward jourey because of a breakdow, we will: Pay up to 200 to store the isured vehicle at a locatio ear the Motorail depot for your trip; ad Pay the extra trasport costs of you, your passegers ad luggage to or from the Motorail depot ad the locatio of your vehicle; ad Arrage ad pay a maximum of up to 800 for you to hire a replacemet car, subject to availability, with you beig resposible for all other costs or beefits imposed or offered to you by the hire car compay. Exceptios to Sectio G2 You must meet the terms ad coditios of the hire car compay which iclude havig a valid drivig licece, meetig the miimum age set by the hire car compay ad beig i possessio of a valid credit card. Coectios to Chael Tuel trais are ot covered uder Sectio G2 (Missed Motorail coectios). Sectio G3 Roadside assistace ad local recovery If your vehicle caot be drive because of a breakdow durig your trip, we will: Try to repair the fault at the roadside so that you ca cotiue your jourey safely ad legally; or DOCUMENT OF BREAKDOWN COVER 10

13 If the fault caot be fixed at the roadside, or i circumstaces where it is ot possible or safe to try to repair a fault at the roadside (for example, o a motorway), we will trasport the vehicle, driver ad up to 7 passegers to a local place of repair. If we caot repair your vehicle by the ed of the workig day o which the breakdow occurred, we will: Arrage ad pay a maximum of up to 800 for you to hire a replacemet car, subject to availability, with you beig resposible for all other costs or beefits imposed or offered to you by the hire car compay; or Pay up to a maximum of 500 to trasport you, up to 7 passegers ad your luggage to your oward destiatio; or Pay for overight accommodatio for you ad up to 7 passegers, up to 60 per perso per ight to a maximum of 500, to cover ay additioal costs you may icur i excess of your plaed accommodatio costs. You will have to claim these costs from us o your retur. We will ot pay your plaed accommodatio costs. Exceptios to Sectio G3 You must meet the terms ad coditios of the hire car compay which iclude havig a valid drivig licece, meetig the miimum age set by the hire car compay ad beig i possessio of a valid credit card. Importat iformatio about Roadside assistace ad local recovery i Europe I some coutries if you break dow o a motorway or other major route, your call may be aswered by the police ad they may arrage for a recovery without our authorisatio. If this is the case, you may be asked to pay for the service ad you should keep the receipt ad claim it back from us whe you get back to the UK. Sectio G4 Providig spare parts If replacemet parts are ot available locally to carry out a permaet repair, we will try ad get them elsewhere. You will have to pay by credit card or debit card for the cost of the replacemet parts before we order them. We will pay all freight charges, subject to a maximum of 500 associated with gettig the parts to the local repairer. Sectio G5 Relief Driver If the oly available driver caot cotiue a jourey because of illess or ijury, we will: Provide a qualified driver to drive your vehicle ad up to 7 passegers back to your home address i the UK; or Pay ay extra costs to trasport your vehicle, up to 7 passegers ad luggage back to the UK as log as these costs are ot higher tha the market value of your vehicle. Sectio G6 Repatriatig your vehicle If your vehicle caot be drive because of a breakdow durig your trip ad your vehicle ca ot be repaired i time for your retur jourey to the UK, we will: Pay ay extra costs of trasportig you, up to 7 passegers ad luggage back to the UK; ad Pay the cost of trasportig your vehicle to your home address i the UK as log as these costs are ot higher tha the market value of the isured vehicle; or 11 DOCUMENT OF BREAKDOWN COVER

14 Pay up to 500 for someoe you choose to travel to the place of repair to drive your vehicle back to your home address i the UK. Importat iformatio about repatriatig your vehicle It ca take up to 15 workig days to arrage repatriatio of your vehicle followig our agreemet to do so. The UK market value of the vehicle will be obtaied from the Glass s Guide or a recogised equivalet. We will ot be resposible for the trasportatio of ay excise goods which come uder the jurisdictio of HM Reveue & Customs (HMRC) such as tobacco, alcohol or fuel. These items must be removed from the vehicle prior to trasportatio beig arraged ad you will be resposible for the arragemet ad the cost of a alterative method of shippig. Sectio G7 Temporary replacemet vehicle i the UK If you have to retur to the UK before your vehicle, we will: Arrage ad pay a maximum of up to 800 for you to hire a replacemet car, subject to availability, with you beig resposible for all other costs or beefits imposed or offered to you by the hire car compay; or Subject to all legal ad statutory regulatios agree a temporary vehicle swap util your vehicle is retured to the UK. Exceptios to Sectio G7 You must meet the terms ad coditios of the hire car compay which iclude havig a valid drivig licece, meetig the miimum age set by the hire car compay ad beig i possessio of a valid credit card. Exceptios to all of Sectio G UK & Europea Assist is oly effective the day after you purchased the cover. Aythig specified withi the Service Limitatios ad Exclusios sectio of this policy (see Sectio I). We will ot pay for ay of the followig: Ay bail or customs duty you must pay; Ay costs which you would have had to pay ayway if the breakdow had ot happeed; Ay costs arisig after your vehicle has bee retured to the UK irrespective of whether the vehicle requires repair; The cost of replacemet parts, labour or other materials; Costs resultig from a previously discovered fault which has ot bee repaired by a qualified techicia; Services covered by ay other isurace policy or costs which you ca claim agaist aother perso; The costs of ay services you have to pay outside the geographical limits; The costs of ay services we have ot authorised; Loss or damage to ay uaccompaied baggage or persoal belogigs we are trasportig; Ay fies awarded agaist you; ad Your vehicle s repatriatio if the costs will exceed its UK market value. 15 Sectio H Geeral coditios of service 1. You must make all requests for our breakdow ad recovery assistace immediately. We will ot accept resposibility for ay service or help that we have ot arraged. 2. You or your represetative must stay with the vehicle to make sure that the breakdow professioal has access to the vehicle. Your represetative must have your permissio to authorise ay ecessary repair or other work, which will be at your expese ad if appropriate, have your permissio to drive the vehicle. 3. This may result i the breakdow professioal takig regular breaks or the eed to operate a staged recovery where further breakdow professioals are used to share the recovery. 5. I the evet of a recovery our breakdow professioal will uload the vehicle i a safe ad appropriate place close to your chose destiatio. For example, our breakdow professioal will ot uload a vehicle o a private driveway if there is isufficiet space, a risk of groud compressio or obstacles which could make this difficult. 6. I the evet of a road traffic accidet you must cotact your motor isurace compay i the first istace to arrage recovery to esure you receive your full etitlemets. If assistace is ot available for whatever reaso, we will provide the services as show uder your cover etitlemet. 7. You must tell us if you are covered for services by ay other isurace policy or ca claim agaist aother perso. If you are covered by aother isurace policy we will ask you to iclude our ivoice i your claim agaist the other perso or agaist your other policy to recover or reduce our costs. 8. It is your resposibility to make sure that ay temporary repair that our breakdow professioals carry out is followed immediately by ay ecessary permaet repair. We will ask for proof of repair i the evet of a dispute. 9. I the evet that your paymet defaults, we will termiate your cover immediately ad seek to recover all costs icurred i providig services to you. We reserve the right to refuse service i the evet of paymet default. 10. We will ot provide assistace ad reserve the right to cacel your policy or declie cover at reewal, if you: Fail to repair the vehicle followig a call out for the same problem; Kowigly use the vehicle whe a fault has bee idetified; Fail to service ad maitai the vehicle i lie with maufacturer guidelies; Fail to obtai a valid MOT certificate if required by law; Fail to tax the vehicle if required by law; Fail to keep the vehicle i a roadworthy coditio. We will ask you to provide documetary evidece such as a MOT, Repair or Service ivoice i the evet that you fail to comply with the above coditios. Failure to supply documetary evidece will result i your policy beig cacelled. 13 DOCUMENT OF BREAKDOWN COVER

I the evet that we have provided services which are ot covered by this policy, for example we have atteded a vehicle at your home address ad the level of cover you chose did ot iclude assistace at home, or we have provided spare parts for a repair ad settlemet has ot bee made to the breakdow professioal or supplier as specified i Sectio I (Service Limitatios ad Exclusios), clause 3, we will charge you at the time of your call or we will sed you a ivoice for the amout due which should be paid withi 30 days. 12. If you have give us false iformatio o your applicatio for cover, or give us icorrect iformatio whe you asked for help, for example the vehicle does ot meet all legal requiremets or was broke dow before cover started; you will have to pay all costs which we have had to pay as a result of your false or icorrect iformatio. I such circumstaces we reserve the right to termiate your cover immediately with o refud. 13. We may oly recover a vehicle from the scee of a accidet if we have permissio from the emergecy services ivolved. 14. If there are ay differeces betwee the terms i this Policy Documet ad ay terms our breakdow professioals agreed over the phoe or i perso, these writte terms will apply. 15. We will ot provide assistace if you or ay passeger behave i a threateig or abusive maer to us or our breakdow professioals. 16. Ay diagosis by our breakdow professioal is oly provisioal; you may require a follow up diagosis by your ow repairer, at your ow cost, to determie the exact ature of the breakdow ad what work or parts are required for repairs to be completed. Sectio I Service Limitatios ad Exclusios We will ot be resposible for providig the followig: 1. The cost of ay service outside the period of cover, or where we have ot received the correct premium; 2. Breakdow ad recovery assistace o the road withi a ¼ of a mile of your home address that we have o record, uless you have paid for Roadside & Home Assist, UK Recovery & Home Assist or UK & Europea Assist cover; 3. The cost of all parts or supplies used or provided to you or for your vehicle. These will iclude: The cost of supplyig ad fittig widscrees; Labour costs i removig ad disposal of cotamiated or icorrectly mixed fuel; ad Storage charges uless we have specifically covered them uder your chose level of cover. You must pay all these costs to the breakdow professioal or supplier. 4. Ay charges icurred because your vehicle is ot carryig a legal ad serviceable spare wheel or a maufacturer supplied or approved emergecy tyre iflatio kit ad equipmet ad keys for ay tyre security devices (this does ot apply to motorcycles). 17 5. Ay fies, pealties, tolls or uclampig charges you have to pay. We will pay ay tolls if your vehicle is beig recovered at the time by oe of our breakdow professioals. 6. Accommodatio or other expeses (for example, rail or taxi charges) that you or your passegers have to pay, uless we have specifically covered them uder your chose level of cover. 7. Ay costs where specialist equipmet is eeded to move your vehicle ito a positio where we ca try to repair or trasport it. For example all charges for retrievig your vehicle from a ditch or field are your resposibility. Ay vehicle or equipmet other tha a stadard recovery vehicle would be cosidered specialist. 8. The full costs of our breakdow professioal s time if, havig called us, you employ aother breakdow professioal before our breakdow professioal arrives to repair or recover your vehicle. However, if you phoe us for help but you maage to get your vehicle goig agai, we may agree ot to charge you for our breakdow professioal s time if you cotact us immediately. 9. Breakdow ad recovery assistace for vehicles ivolved i sportig evets, icludig racig, pacemakig, speed testig, rallies, trials ad all other track based activities or practisig for ay such evets, ad those ivolved i leisure off road evets. 10. Breakdow ad recovery assistace for vehicles ivolved i hire ad/or reward uses (such as a taxi). 11. Ay loss of busiess, loss of profit, loss of reveue, loss of cotract, loss of goods or ay direct or idirect losses icurred as a result of the services provided to you uder this policy or the delay or alleged delay i providig such services. 12. Major repairs, servicig, strippig dow vehicles or reassembly (icludig repairig faulty brakes, steerig, suspesio or DIY work). 13. Recoverig a carava or trailer if it is occupied by people or livestock, ad trasportig aimals ad pets i a recovery vehicle (with the exceptio of Assistace Dogs). I these cases, the breakdow professioal s decisio is fial. 14. Ay costs you have to pay if, followig a accidet, the police have temporarily removed the vehicle to a safe locatio or local place of repair. After you have paid ay costs ad filled i the ecessary paperwork, we will recover your vehicle subject to the coditios uder Sectio H (Geeral Coditios of Service), clause Recovery if it would be dagerous or illegal for our breakdow professioal to load or trasport your vehicle. I these cases, our breakdow professioal s decisio is fial. 16. Help o garage premises which are ot our breakdow professioal s premises. 17. Trasportatio of ay excise goods which come uder the jurisdictio of HM Reveue & Customs such as tobacco, alcohol or fuel. These items must be removed from the vehicle prior to trasportatio beig arraged ad you will be resposible for the cost of that shippig. 21. Where you agree for repairs to be coducted by our breakdow professioal at their premises, we are ot resposible for the quality of repairs they udertake. The agreemet to coduct repairs is solely betwee you ad the breakdow professioal. 22. Ay losses, costs or damages which you suffer as a result of our failure to provide the services listed i Sectios C to G. 23. Ay costs other tha a tow to the earest garage or service statio if the breakdow is as a result of ruig out of fuel. 24. Ay costs icurred as a result of ot carryig a serviceable spare tyre ad wheel or approved emergecy tyre iflatio kit ad equipmet (if supplied by the maufacturer) for your vehicle, carava or trailer uless it has ot bee built by the maufacturer to support the carriage of a serviceable spare tyre. This applies equally to full size or space saver alteratives. 25. Breakdow ad recovery assistace for vehicles usig trade plates. 26. Ay assistace or call out costs where you or your spouse/parter are ot with the vehicle whe the breakdow professioal arrives at the vehicle, uless the vehicle is registered with us ad beig drive by your represetative with your permissio. I cases of the latter, your represetative must be with the vehicle whe our breakdow professioal arrives. 27. Breakdow ad recovery assistace for vehicles ot registered i the UK. 28. Ay cover or beefits if we have ot atteded the vehicle at the time of the breakdow except where you have lost or broke your vehicle keys, ad a spare set is kow to be at a earby locatio.
