Cotract of Motor Isurace The policy, the schedule (icludig edorsemets), the certificate of motor isurace, the iformatio you gave us i the proposal form or statemet of fact ad declaratios that you have made, all form the cotract of motor isurace. Edorsemets Somethig which alters your isurace cover. Your cover will be affected by ay edorsemet that is show o the schedule. (Such edorsemets may add exclusios to the cover or require you to take actio such as fittig approved security.) More tha oe edorsemet may apply. If you do ot comply with ay edorsemets, this cotract of motor isurace may o loger be valid ad we may refuse to deal with ay claim. Market Value The cost at the date of the accidet or loss of replacig the isured vehicle, if possible, with oe of a similar make, model, age, coditio ad mileage. We will usually ask a egieer to give us advice about the market value of the isured vehicle, refer to guides of vehicle values ad ay other relevat sources. I assessig the market value, you should cosider the amout that could reasoably have bee obtaied for the isured vehicle if you had sold it immediately before the accidet, loss or theft. Period of Isurace The legth of time covered by this cotract of motor isurace, as show o the curret schedule ad certificate of motor isurace. This cotract of motor isurace is a cotract persoal to you ad you caot trasfer it to ayoe else. We agree to isure you uder the terms of this cotract of motor isurace agaist ay liability, loss or damage that occurs withi the geographical limits durig the period of isurace for which you have paid, or agree to pay, the premium. You must read this policy, the schedule ad the certificate of motor isurace together. The schedule tells you which sectios of the policy apply ad idetifies ay edorsemets. Please check all three documets carefully to make sure that they give you the cover you wat ad that you comply with all the relevat terms ad coditios, icludig ay edorsemets. It is ot iteded that the Cotracts (Rights of Third Parties) Act 1999 should cofer ay additioal rights uder this policy i favour of ay third party. Uless we agree with you to apply the laws of aother coutry, Eglish Law will apply to this cotract (uless you live i Guersey or Jersey, where Guersey or Jersey law will apply). Coolig-off Cacellatio Right We hope you are happy with the cover this policy provides. However, you have the right to cacel it withi 14 days of receivig the policy or from the start date of your policy, whichever is latest, without givig ay reaso. You may cacel usig this coolig-off period by tellig us, or your isurace adviser, i writig or by or telephoe ad cacellatio ca take effect immediately or from a later date, although it caot be backdated to ay earlier date. If you do cacel i the first 14 days usig the coolig-off cacellatio coditio, we will charge you pro rata, subject to a miimum fee of 25 + Isurace Premium Tax, for the cover provided from the begiig of the cotract util the policy is cacelled, uless we are required to make a total loss paymet uder the policy, uder which circumstaces a refud of the premium is ot payable. Cacellig your Policy (Outside the Coolig-off Cacellatio Right) You may cacel this cotract of motor isurace at ay time by tellig us, or your isurace adviser, i writig or by or telephoe ad cacellatio ca take effect immediately or from a later date, although it caot be backdated to ay earlier date. If you or someoe else has ot made a claim i the curret period of isurace, we will refud part of your premium. We will work out the refud o a pro rata basis less a premium charge of 25 + Isurace Premium Tax to cover our admiistratio costs. We will ot refud ay of your premium if the cotract of motor isurace is cacelled followig a claim whether settled or ot. We, or our authorised aget, may cacel this cotract of motor isurace by givig you seve days otice i writig to your last kow address where there is a valid reaso for doig so. The isurace will ed immediately the seve days otice rus out. If you have just take out the policy or reewed it with us ad the premium is upaid, we will cacel your isurace from the start/reewal date. We will refud the balace of your premium that applies to the remaiig period of isurace uless fraud has bee idetified. If a refud is paid, a premium charge of 25 + Isurace Premium Tax to cover our admiistratio costs will be deducted from the refud. If you or someoe else has made a claim, we will cacel your cover but may ot refud ay premium. If you are payig by istalmets, you must still pay the balace of the full aual premium. If you produce a cacelled certificate of motor isurace to ay perso with the itetio of deceivig that perso ito acceptig it as geuie, you may be prosecuted. Chages to your details You must tell your isurace adviser as soo as possible if ay of the details o your proposal form or statemet of fact chage icludig: Chages made to your vehicle which improve its value, appearace, performace or hadlig. Chagig your vehicle. Chages i the way your vehicle is used. Chage of address or where you keep your vehicle. Chage of occupatio, icludig part time work. Chage i the mai user of the vehicle. Whe you advise us of ay permaet or temporary chages to your policy durig the period of isurace which we agree to, or if you request duplicate documets, a premium adjustmet charge of 10 + Isurace Premium Tax will be made i additio to ay other chage i premium to cover our admiistratio costs. This charge is i additio to ay admiistratio fees charged by your isurace adviser. If your chage of circumstaces meas that we ca o loger provide cover, we or our authorised aget will give you otice of cacellatio, see Cacellig your Policy (Outside the Coolig-off Cacellatio Right). If you do ot tell your isurace adviser of a chage we will be etitled to do oe or both of the followig: reject or reduce paymet of your claim. We will also cover you for your legal liability for damage to their property (icludig ay related idirect loss) up to 20,000,000 ad for costs ad expeses icurred up to 5,000,000. We will also isure you while the isured vehicle is towig a trailer or ay oe vehicle, so log as the towig is allowed by law ad the trailer or vehicle is attached properly to the isured vehicle by towig equipmet made for this purpose. What is ot covered Loss or damage to the isured vehicle, trailer or vehicle beig towed. Ay amout above 20,000,000 for damage to other people s property (icludig ay related idirect loss), ad ay amout above 5,000,000 for costs ad expeses icurred. We must, by law, provide this cover. If this is the oly paymet we make, your No Claims Discout will ot be affected. If the isurace covers more tha oe vehicle, the No Claims Discout will apply separately for each vehicle. You caot trasfer your No Claims Discout to ayoe else. We will reduce or remove your No Claims Discout, i accordace with the scale below, if we make ay paymet whatsoever, eve if the accidet is ot your fault, uless we get the moey back from someoe else. We may withhold the No Claims Discout i full or part if there are ay claims that have ot bee settled. If we recover all our moey, or we have good reaso to believe a third-party claim would be usuccessful, the No Claims Discout would apply agai. Sed the vehicle to a Approved Repairer, or aother repairer of your choice, if we disagree with the estimate for repairig it provided by a o-approved repairer. Treat the isured vehicle as stole if it has ot bee recovered withi 30 workig days after you reported the theft to our Cotact Cetre. It must still be missig whe we pay your claim. Have your vehicle examied by our ow or our appoited egieer. You must do the followig: Get our permissio before orderig ay ew part or accessory, ad before payig for ay trasport outside the geographical limits. Tell us straightaway if the isured vehicle is stole ad you later get it back, or discover where it is. Etirely at our discretio ad subject to paymet of the policy excess, arrage to: a) repair the damage at our Approved Repairer, we may decide to use suitable parts or accessories which are ot supplied by the origial maufacturer, or alteratively authorise repairs at a repairer of your choice subject to the provisio of satisfactory estimates, b) pay you the cost of replacig or repairig the damaged parts, icludig their fittig, or c) treat the isured vehicle as a total loss ad pay you the market value of the vehicle less the excess just before the loss or damage happeed. Pay the last kow cost show i the maufacturer s price list ad the reasoable cost of fittig if ay lost or damaged part or accessory is o loger available. Not pay the whole cost of ay repair or replacemet that leaves the vehicle i a better coditio tha before the loss or damage (you will pay part of the cost of the repair or replacemet). Not refud ay premium if the isured vehicle is writte off or there is ay claim. Settle the claim to the legal ower, up to the market value, if the isured vehicle is part of a hire-purchase or leasig agreemet, or belogs to someoe else. If ay claims or other moies are paid to you by mistake for ay reaso, or a claim has bee paid which we later fid to be fraudulet, false or exaggerated, you must repay the amout paid to us. If we have refuded ay premium followig cacellatio, we ca take ay moey you owe us from ay paymet we make. Care of the Vehicle The isured vehicle must be covered by a valid Departmet of Trasport Test (MoT) Certificate if you eed oe by law. You, or ay perso drivig or ridig the isured vehicle with your permissio, must take care to avoid loss of or damage to the isured vehicle. For example, removig it to a safe place as soo as possible if it breaks dow. You, or ay perso drivig or ridig the isured vehicle with your permissio, should also take care of the keys to the isured vehicle to prevet them beig lost or stole. You must always take the keys out of the igitio ad remove them completely whe the isured vehicle is left at ay time whatsoever (regardless of whether the vehicle is still withi your sight) ad always make sure the steerig lock is o. You should keep the isured vehicle i a locked garage if you have oe ad comply with ay garagig requiremets imposed by edorsemet. Not move, drive or ride the isured vehicle i a way likely to affect safe drivig, ridig or cotrol or i a way which could cause loss or damage to it.
