3 AMO Cnference 2018 Full & Fair Representatin at the Regin f Peel Our Ask: The Ministry f Municipal Affairs enact legislative changes, ahead f the 2022 municipal electin, t create fair and equal representatin fr the City f Bramptn at the Regin f Peel. What is the ideal reginal gvernance structure fr Bramptn and the reginal ecnmy? Bramptn residents deserve full and fair representatin at the Regin f Peel (Regin) that includes all 10 elected Cuncillrs and the Mayr. Currently, each Bramptn Reginal Cuncillr represents 98,939 residents at the Regin, cmpared t Mississauga Cuncillrs wh each represent 72,159 residents. Why is full and fair representatin imprtant fr the reginal ecnmy? Bramptn s ppulatin grwth has utpaced that f Mississauga and Caledn, reinfrcing the need fr increased representatin fr Bramptn Bramptn s current ppulatin is nearly 600,000 and is anticipated t grw t 900,000 by 2041, making Bramptn the secnd-fastest grwing city in Canada. Frm 2011 t 2016, Bramptn saw a net ppulatin increase f almst 70,000 peple, a grwth rate f 13.3%. Each day, 47 peple relcate t Peel, 38 f thse, mve t Bramptn. Equal representatin is essential t reflect ur current and future strng ppulatin and emplyment grwth. Cnsider these facts: Bramptn s lcatin in the middle f the Innvatin Super Crridr (between Waterl t Trnt), will have a significant and psitive impact n the Reginal and Prvincial ecnmies Bramptn will sn pen drs t a university that is a unique Centre fr Innvatin, a catalyst fr mre jbs, increased develpment and investment Municipal Affairs & Husing
4 AMO Cnference 2018 Key highlights Bramptn has mre than 800 health sectr businesses and agencies. This is further strengthened as a significant health and life sciences cluster is taking shape arund the new Peel Memrial Centre fr Integrated Health and Wellness. Mre than $500 millin has been invested in the 350,000 sq.ft. urgent care facility that is estimated t see mre than 40,000 visitrs annually. Businesses in this sectr are recgnizing the ptential and investing in this grwth pprtunity. The Municipal Act s requirement f a triple majrity t change the cmpsitin f Cuncil has prevented the residents f Bramptn frm having an equitable vice at Reginal Gvernment. Since 2003, many unsuccessful attempts have been made t seek full representatin: In 2003, Bramptn tk a bld step and reduced its wn Cuncil frm 17 t 11 members, 10 Cuncillrs and a Mayr, with 10 Wards t prepare fr all members t serve n Reginal and City Cuncil, like the Mississauga mdel. In 2004 Justice Adams was cmmissined by the Premier t lk at the issue f representatin at the Regin f Peel. Justice Adams recmmended full representatin at the Regin that included all 10 Bramptn Cuncillrs. Despite his recmmendatin, it did nt receive majrity supprt at Peel Reginal Cuncil During the term f Cuncil, a reginal Task Frce was frmed with the Reginal Chair and Mayrs, wh discussed this issue fr mnths. There was n cnsensus amng all three municipalities In 2013, Bramptn underwent a ward bundary review due t ppulatin grwth, and t prepare fr full representatin at Reginal Cuncil. In 2015 a third-party facilitatr was retained t wrk with the Reginal Chair and Mayrs t d a full review f the existing gvernance mdel. After a lengthy and vigrus review, the Regin s cnsultant indicated that Bramptn s prprtin f the Regin s vte share was 29%, which warranted all 10 elected Bramptn Cuncillrs have a seat at Reginal Cuncil. In 2017, Bill 68 did nt g far enugh t address disparity in reginal representatin and call fr legislative changes in advance f the 2018 Municipal Electin Municipal Affairs & Husing
5 AMO Cnference 2018 T date, nly six Cuncillrs plus the Mayr sit n Reginal Cuncil. All f Mississauga s Members f Cuncil have been sitting n Reginal Cuncil fr mre than tw decades. Bramptn is asking that the prvince initiate legislative changes t create a fair and equal representatin at the Regin f Peel Cuncil. This will be a significant step twards empwering the reginal ecnmy t meet the current and future needs f ppulatin and emplyment grwth. 6 AMO Cnference 2018 Secndary Units Right f Entry Our Ask: The Ministry f Municipal Affairs and Husing enact changes t the Building Cde Act and the Planning Act t give expanded rights f entry fr municipalities fr the purpse f inspecting secndary units and illegal multiunit dwellings. What is the Right f Entry fr secndary units in Bramptn? The City f Bramptn has plicies allwing secndary units in detached, semi-detached and twnhuse dwellings, subject t zning requirements and restrictins. Hwever, the City has a limited ability t investigate reprted illegal units t ensure they are safe. Why is the Right f Entry t secndary units imprtant? The Prvince s Strng Cmmunities Thrugh Affrdable Husing Act requires municipalities t permit secnd units in detached, semi-detached and twnhuse dwellings. Bramptn s plicies state that all secndary units must be registered with the City, which helps the City ensure that the units are safe, legal and livable. Hwever, because f restricted rights f entry under bth the Building Cde Act and the Planning Act, building inspectrs and enfrcement fficers are ften refused entry when attempting t investigate a reprted illegal dwelling unit. As a result, the inability t inspect these secndary units may pse a safety risk fr bth ccupants and first respnders. A clser lk at secndary units in Bramptn In respnse t the Prvince s Strng Cmmunities Thrugh Affrdable Husing Act, the City f Bramptn intrduced new secndary unit plicies in The City s ne-time registratin requirement ensures that secndary units meet all safety requirements under the: Municipal Affairs & Husing
7 AMO Cnference 2018 Ontari Building Cde and/r Fire Cde Electrical Safety Authrity Lcal zning by-law As f July 2018, there were a ttal f 620 legal registered secnd units in the City Registratin als helps the City identify the lcatin f secnd units. This infrmatin is shared with Bramptn Fire and Emergency Services, fr firefighters respnding t an emergency. The Right f Entry issues stems frm the City s inability t investigate illegal dwelling units. Sectin 16(1) f the Building Cde Act states, in part, that an inspectr r fficer shall nt enter r remain in any rm r place actually being used as a dwelling unless the cnsent f the ccupier is btained, the ccupier first having been infrmed that the Right f Entry may be refused and entry made nly under the authrity f a warrant issued under this Act. Sectin 49(3) f the Planning Act states, in part, that: Except under the authrity f a search warrant issued under sectin 49.1, an fficer r any persn acting under his r her instructins shall nt enter any rm r place actually used as a dwelling withut requesting and btaining the cnsent f the ccupier, first having infrmed the ccupier that the Right f Entry may be refused and entry made nly under the authrity f a search warrant. As such, when City inspectrs and/r fficers are investigating a reprted illegal secnd unit, they are ften refused the Right f Entry. If inspectrs/fficers are able t gather enugh evidence that a secnd unit exists, they may be successful in getting a warrant frm the curts, but this is very resurce intensive, and is subject t the evidence cllected and the Justice f the Peace presiding. If unsuccessful in gaining a warrant and/r entry int the dwelling, the City cannt prsecute fr illegal cnstructin/change f use r fr cmpliance with the secnd unit registratin bylaw. As a result, the City cannt cnfirm that secndary units meet the necessary requirements nted abve, which culd risk the safety f the building s ccupants and the emergency respnders dispatched t that lcatin in an emergency. Illegal secndary units add financial pressures and lead t lss in revenue t the City, Regin and Prvince. Municipal Affairs & Husing
8 AMO Cnference 2018 Residents f illegal secndary units use the existing infrastructure (water, sewer, waste cllectin services, rads, public transit, schls, libraries, recreatinal facilities etc.). Hwever, the prperty taxes fr these hmes are based nly n the assessed value f the primary dwelling and nt the secndary unit. In additin, Develpment Charges are currently exempt when adding a secndary unit. Develpment Charges are prpsed t cntinue t be exempt fr new purpse-built tw-unit husing. 9 AMO Cnference 2018 Develpment Charges (DC) Rebate Prgram Our Ask: The City f Bramptn requests the Prvince t maintain the $5 millin DC rebate cmmitment fr new purpse-built rental husing prjects in Bramptn, and expedite assciated agreements with the Regin f Peel. DC rebates will pave the way fr mre flexible, price-friendly husing ptins fr Bramptn s yung, diverse and fast-grwing ppulatin. Abut the DC Rebate Prgram In May 2018, the City f Bramptn was ne f a few municipalities t receive funding t help stimulate the develpment f purpse-built market rental buildings in the prvince. The funding allcatin cmmitted t Bramptn is $5,039,074 ver five years. The Regin f Peel has been delegated authrity t administer the prgram n behalf f the City, and it is anticipated that the Regin will enter int a transfer payment agreement with the Ontari gvernment by September 1, When the prgram is finalized, develpment charges will be required t be paid in full, prir t issuance f a building permit. Reimbursement will be administered thrugh the crdinatin f the Regin f Peel, as prgram administratr. The prgram des nt apply t affrdable rental units (i.e. units receiving funding under prvincial r federal affrdable husing prgrams such as the Investment in Affrdable Husing prgram). Benefits f the DC Rebate Prgram Flexible, affrdable husing cntinues t be a prblem in Bramptn, and thrughut Peel. Peel and Bramptn. The Average Market Rate f rental units in Bramptn in 2017 was $1,236 mnthly, acrss all bedrm types, while the current vacancy rate stands at 1.3%. The DC Rebate Prgram will benefit: Residents: Rental husing is a viable ptin fr middle-incme families, peple seeking t age in place, and yung adults wh may be experiencing financial barriers t entering the husing wnership market. Develpers: Prvide greater impetus t fcus n larger, mre mdern husing prjects that will deliver lnger-term benefits. Municipal Affairs & Husing
10 AMO Cnference 2018 Gvernments: Adequate supply f a wide variety f husing tenure types is crucial in building cmplete cmmunities. Additinal Highlights With a ppulatin f mre than 600,000 Bramptn is the secnd-fastest grwing city in Canada. Of the 47 new residents wh mve t Peel every day, 38 f them make Bramptn their hme. The rising real estate prices in Bramptn are barriers t yung adults and middle incme families entering the husing wnership market. Seeking cst-friendly husing slutins, many residents are resrting t live in illegal secnd units. Having mre affrdable rental husing ptins that are perating legally will help cater t the grwing demand fr husing. Thrughut the extensive public cnsultatin fr Bramptn s 2040 Visin in 2017, the City repeatedly heard frm residents that diversity f husing ptins is imprtant in rder t build cmplete neighburhds. The DC Rebate Prgram will help address what we have heard frm the peple f Bramptn. Based n the City f Bramptn s and Regin f Peel s current develpment charges rates, apprximately 20 units culd benefit frm the prgram, annually, if funding is applied t cver bth lcal and Reginal DCs. The City has develped eligibility criteria t guide the lcal administratin f the prgram, which was endrsed by its Cuncil n July 11, Sme f the parameters include prximity t transit, family size, tw r mre bedrm units and mre accessibility features. The City and the Regin f Peel recently held a jint infrmatin sessin (August 8) fr the develpment cmmunity t prmte interest in the prgram thrugh initial engagement. 11 AMO Cnference 2018 Husing Bramptn Our Ask: The City f Bramptn cntinues t advcate fr upper-levels f gvernment t prvide financial cntributins tward the develpment f lcal affrdable husing units. Cllabrative partnerships with all levels f gvernment and agencies will be fundamental t the success f the Husing Bramptn strategy and achievement f its gals. Why is Husing Strategy imprtant t Bramptn? In 2016, apprximately 3,250 Bramptn husehlds were n Peel Regin s Centralized Wait List, 400 Bramptn individuals benefitted frm Peel s Preventing Hmelessness Prgram, and 2,400 lcal residents accessed emergency shelters. The City f Bramptn is leading the develpment f an affrdable husing strategy, entitled Husing Bramptn, t respnd t the varying husing needs f its residents. As the Regin f Peel is a husing service manager, Bramptn s husing strategy will fcus primarily n stimulating the supply f market rental and affrdable wnership units, while strategic partnerships and advcacy effrts will supprt husing needs acrss the entire husing cntinuum. Bramptn s affrdable husing strategy will be frmed arund the fllwing fur themes, t guide prject deliverables and expectatins: Increasing Affrdable Husing Supply; Plicies and Initiatives t Encurage Husing Diversity; Cmmunicatin and Advcacy; and, Mnitring and Measuring Prgress. Develping a Husing Strategy Framewrk Husing Bramptn is a city-wide affrdable husing strategy, which will identify actin items needed t meet the varying husing needs f lcal residents. The strategy will take guidance frm prvincial and reginal plicy dcuments, in additin t the City s current Strategic Plan. The strategy will als give cnsideratin t federal husing prgrams. 12 AMO Cnference 2018 The strategy will fcus n imprving the creatin f affrdable units. Given the City s jurisdictin ver land use planning matters thrugh pwers granted by the Planning Act, the City has the greatest ability t impact the develpment f market rental and affrdable wnership units. The City will als fcus its effrts thrugh practively seeking t develp innvative partnerships and undertake extensive engagement with lcal husing prviders, cmmunity stakehlders, residents, and upper-levels f gvernment, including the Regin, t supprt the develpment f a hlistic and multi-faceted husing strategy that effectively respnds t the current and future needs f its residents. The City acknwledges the challenges with respect t minimal pprtunities fr receiving funding frm upper-levels f gvernment fr affrdable husing and having limited authrity ver the service delivery fr affrdable husing, which will be further examined as part f the strategy. The City f Bramptn is psitining itself fr the future, with an understanding that a mix and range f husing ptins is necessary fr residents t have a high quality f life. Safe and adequate husing has been lng linked t imprved health and well-being, and is fundamental t the physical, ecnmic, and scial well-being f individuals, families and cmmunities. The current husing affrdability challenges faced acrss the Greater Trnt Area necessitate an affrdable husing strategy fr Bramptn t respnd t nging increases in husing csts. Husing Bramptn will be a Made-in-Bramptn apprach fr respnding t husing challenges that reflect the lcal cntext and unique qualities f the City s neighburhds. City f Bramptn Between 2016 and 2041, Bramptn s ppulatin is anticipated t grw by 50%, t nearly 900,000. As husing prices increase, affrdability will cntinue t remain a challenge fr residents: Bramptn has ne f the lwest median ages amng Canada s largest cities, with an average age f Husehld cmpsitin sets Bramptn apart frm ther municipalities. As f 2016, 49% f the City s husehlds cntained fur r mre peple. Apprximately 12% f all units Municipal Affairs & Husing
13 AMO Cnference 2018 are cmprised f multi-family husehlds, including multi-generatinal families, in cmparisn t the Peel Regin and natinal averages f 8%, and 2%, respectively. Bramptn s senirs ppulatin cntinues t experience steady grwth. In 2016, 22% f the City s ppulatin was 55 years r lder, ttaling 66,270. The City is als very diverse. Apprximately 52% f the City s ppulatin is freign-brn, representing 234 different ethnicities. Regin f Peel Regin f Peel is the lcal husing service manager, addressing a wide spectrum f needs alng the entire husing cntinuum, including the prvisin f supprtive husing, rent subsidies, and incentives fr affrdable husing develpments. The Regin has versight f ver 47 nn-prfit husing prviders. 18,539 individuals accessed emergency shelters in 2017 within Peel Regin. Centralized husing waitlist is 13,597 individuals, r 6.5 years (3,432 are Bramptn residents). Within Bramptn alne, there are currently 172 shelter/ transitinal beds, and 3,386 scial husing units.
