1 Europen Trety Series - No. 171 Protocol mending the Europen Convention on Trnsfrontier Television * Strsourg, 1.X.1998 The memer Sttes of the Council of Europe nd the other Prties to the Europen Convention on Trnsfrontier Television, opened for signture in Strsourg on 5 My 1989 (hereinfter referred to s "the Convention"), Welcoming the fct tht the enlrgement of the memership of the Council of Europe since 1989 hs led to the development nd implementtion t the pn-europen level of the legl frmework provided for under the Convention; Considering the mjor technologicl nd economic developments in the field of television rodcsting s well s the ppernce of new communictions services in Europe since the doption of the Convention in 1989; Noting tht these developments cll for revision of the provisions of the Convention; Bering in mind, in this regrd, the doption y the Europen Community of Directive 97/36/EC of the Europen Prliment nd of the Council of 19 June 1997 mending Council Directive 89/552/EEC on the co-ordintion of certin provisions lid down y lw, regultion or dministrtive ction in memer sttes concerning the pursuit of television rodcsting ctivities; Considering the urgent need to mend certin provisions of the Convention in order to develop coherent pproch to trnsfrontier television etween this instrument nd the directive, s underlined in the Declrtion on Medi in Democrtic Society dopted y the ministers of the Sttes prticipting in the 4th Europen Ministeril Conference on Mss Medi Policy (Prgue, 7-8 Decemer 1994) nd in the politicl Declrtion of the 5th Europen Ministeril Conference (Thessloniki, Decemer 1997); Wishing to further develop the principles emodied in the Council of Europe recommendtions on the drwing up of strtegies to comt smoking, lcohol nd drug dependence in co-opertion with opinion-mkers nd the medi, on the right to short reporting on mjor events where exclusive rights for their television rodcst hve een cquired in trnsfrontier context nd on the portryl of violence in the electronic medi, which hve een dopted within the frmework of the Council of Europe since the Convention ws dopted, Hve greed s follows: (*) Since its entry into force on 1 Mrch 2002, this Protocol forms n integrl prt of the Convention (ETS No. 132). 2 Article 1 The word "juridiction" in Article 8, prgrph 1, nd in Article 16, prgrph 2, in the French text, shll e replced y the word "compétence". Article 2 The word "dvertisements" in Article 15, prgrphs 3 nd 4, in the English text, shll e replced y the word "dvertising". Article 3 The definition of "Brodcster" in Article 2, prgrph c, shll e worded s follows: "c "Brodcster" mens the nturl or legl person who hs editoril responsiility for the composition of television progrmme services for reception y the generl pulic nd trnsmits them or hs them trnsmitted, complete nd unchnged, y third prty;" Article 4 The definition of "Advertisement" in Article 2, prgrph f, shll e worded s follows: "f "Advertising" mens ny pulic nnouncement in return for pyment or similr considertion or for self-promotionl purposes, which is intended to promote the sle, purchse or rentl of product or service, to dvnce cuse or ide, or to ring out some other effect desired y the dvertiser or the rodcster itself;" Article 5 A new prgrph g reding s follows shll e inserted in Article 2: "g "Tele-shopping" mens direct offers rodcst to the pulic with view to the supply of goods or services, including immovle property, rights nd oligtions in return for pyment;" Article 6 Article 2, prgrph g, shll e renumered to Article 2, prgrph h, nd shll hve the folllowing wording: "Sponsorship" mens the prticiption of nturl or legl person, who is not engged in rodcsting ctivities or in the production of udiovisul works, in the direct or indirect finncing of progrmme with view to promoting the nme, trdemrk, imges or ctivities of tht person." Article 7 The following text shll replce Article 5: "Article 5 Duties of the trnsmitting Prties 1 Ech trnsmitting Prty shll ensure tht ll progrmme services trnsmitted y rodcster within its jurisdiction comply with the terms of this Convention. 2 For the purposes of this Convention, rodcster within the jurisdiction of Prty is: 2

3 rodcster who is deemed to e estlished in tht Prty ccording to prgrph 3; rodcster to whom prgrph 4 pplies. 3 For the purposes of this Convention, rodcster shll e deemed to e estlished in Prty, hereinfter referred to s the "trnsmitting Prty", in the following cses: c d the rodcster hs its hed office in tht Prty nd the decisions on progrmme schedules re tken in tht Prty; if rodcster hs its hed office in one Prty ut decisions on progrmme schedules re tken in nother Prty, it shll e deemed to e estlished in the Prty where significnt prt of the workforce involved in the pursuit of the television rodcsting ctivity opertes; if significnt prt of the workforce involved in the pursuit of the television rodcsting ctivity opertes in ech of those Prties, the rodcster shll e deemed to e estlished in the Prty where it hs its hed office; if significnt prt of the workforce involved in the pursuit of the television rodcsting ctivity opertes in neither of those Prties, the rodcster shll e deemed to e estlished in the Prty where it first egn rodcsting in ccordnce with the system of lw of tht Prty, provided tht it mintin stle nd effective link with the economy of tht Prty; if rodcster hs its hed office in Prty ut decisions on progrmme schedules re tken in Stte which is not Prty to this Convention, or vice-vers, it shll e deemed to e estlished in the Prty concerned, provided tht significnt prt of the workforce involved in the pursuit of the television rodcsting ctivity opertes in tht Prty; if, when pplying the criteri of prgrph 3 of Article 2 of Directive 97/36/EC of the Europen Prliment nd of the Council of 19 June 1997 mending Council Directive 89/552/EEC on the co-ordintion of certin provisions lid down y lw, regultion or dministrtive ction in memer Sttes concerning the pursuit of television rodcsting ctivities, rodcster is deemed to e estlished in memer Stte of the Europen Community, tht rodcster shll lso e deemed to e estlished in tht Stte for the purposes of this Convention. 4 A rodcster to whom the provisions of prgrph 3 is not pplicle is deemed to e within the jurisdiction of Prty, so-clled trnsmitting Prty, in the following cses: c it uses frequency grnted y tht Prty; lthough it does not use frequency grnted y Prty it does use stellite cpcity ppertining to tht Prty; lthough it uses neither frequency grnted y Prty nor stellite cpcity ppertining to Prty it does use stellite up-link situted in tht Prty. 5 If the trnsmitting Prty cnnot e determined ccording to prgrph 4, the Stnding Committee shll consider this issue ccording to Article 21, prgrph 1, indent, of this Convention, in order to determine this Prty. 6 This Convention shll not pply to television rodcsts intended exclusively for reception in Sttes which re not Prty to this Convention, nd which re not received directly or indirectly y the pulic in one or more Prties." 3

4 Article 8 Article 8 shll hve the following wording: "Article 8 Right of reply 1 Ech trnsmitting Prty shll ensure tht every nturl or legl person, regrdless of ntionlity or plce of residence, shll hve the opportunity to exercise right of reply or to seek other comprle legl or dministrtive remedies relting to progrmmes trnsmitted y rodcster within its jurisdiction, within the mening of Article 5. In prticulr, it shll ensure tht timing nd other rrngements for the exercise of the right of reply re such tht this right cn e effectively exercised. The effective exercise of this right or other comprle legl or dministrtive remedies shll e ensured oth s regrds the timing nd the modlities. 2 For this purpose, the nme of the progrmme service or of the rodcster responsile for this progrmme service shll e identified in the progrmme service itself, t regulr intervls y pproprite mens." Article 9 The following text shll replce Article 9: "Article 9 Access of the pulic to informtion Ech Prty shll exmine nd, where necessry, tke legl mesures such s introducing the right to short reporting on events of high interest for the pulic to void the right of the pulic to informtion eing undermined due to the exercise y rodcster within its jurisdiction of exclusive rights for the trnsmission or retrnsmission, within the mening of Article 3, of such n event." Article 10 A new Article 9is, worded s follows, shll e inserted: "Article 9is Access of the pulic to events of mjor importnce 1 Ech Prty retins the right to tke mesures to ensure tht rodcster within its jurisdiction does not rodcst on n exclusive sis events which re regrded y tht Prty s eing of mjor importnce for society in such wy s to deprive sustntil proportion of the pulic in tht Prty of the possiility of following such events y live coverge or deferred coverge on free television. If it does so, the Prty concerned my hve recourse to the drfting of list of designted events which it considers to e of mjor importnce for society. 2 Prties shll ensure y pproprite mens, respecting the legl gurntees grnted y the Convention for the Protection of Humn Rights nd Fundmentl Freedoms s well s, where pproprite, the ntionl constitution, tht rodcster within their jurisdiction does not exercise the exclusive rights purchsed y tht rodcster following the dte of entry into force of the Protocol mending the Europen Convention on Trnsfrontier Television in such wy tht sustntil proportion of the pulic in nother Prty is deprived of the possiility of following events which re designted y tht other Prty, vi whole or prtil live coverge, or where necessry or pproprite for ojective resons in the pulic interest, whole or prtil deferred coverge on free television s determined y tht other Prty under prgrph 1, respecting the following requirements: 4

5 c d e f the Prty implementing the mesures referred to in prgrph 1 shll drw up list of ntionl or non-ntionl events which re considered y tht Prty s eing of mjor importnce for society; the Prty shll do so in cler nd trnsprent mnner in due nd effective time; the Prty shll determine whether these events shll e ville vi whole or prtil live coverge, or where necessry or pproprite for ojective resons in the pulic interest, whole or prtil deferred coverge; the mesures tken y the Prty drwing up the list shll e proportionte nd s detiled s necessry to enle other Prties to tke mesures referred to in this prgrph; the Prty drwing up the list shll notify the list nd the corresponding mesures to the Stnding Committee, the time limit for which shll e fixed y the Stnding Committee; the mesures tken y the Prty drwing up the list shll e within the limittions of the guidelines of the Stnding Committee referred to in prgrph 3 nd the Stnding Committee must hve given positive opinion on the mesures. Mesures sed on this prgrph shll pply only to those events pulished y the Stnding Committee in the nnul list referred to in prgrph 3 nd to those exclusive rights purchsed fter the entry into force of this mending Protocol. 3 Once yer the Stnding Committee shll: pulish consolidted list of the enlisted events nd corresponding mesures notified y Prties in ccordnce with prgrph 2e; drw up guidelines to e dopted y mjority of three qurters of the memers in ddition to the requirements listed up in prgrph 2 to e in order to void differences etween the implementtion of this Article nd tht of corresponding Europen Community provisions." Article 11 Prgrph 1 of Article 10 shll hve the following wording: "1 Ech trnsmitting Prty shll ensure, where prcticle nd y pproprite mens, tht rodcster within its jurisdiction reserves for Europen works mjority proportion of its trnsmission time, excluding the time ppointed to news, sports events, gmes, dvertising, teletext services nd tele-shopping. This proportion, hving regrd to the rodcster's informtionl, eductionl, culturl nd entertinment responsiilities to its viewing pulic, should e chieved progressively, on the sis of suitle criteri." Article 12 Prgrph 4 of Article 10 shll hve the following wording: "4 The Prties shll ensure tht rodcster within their jurisdiction does not rodcst cinemtogrphic works outside periods greed with the rights holders." 5

6 Article 13 A new Article 10is reding s follows shll e inserted: "Article 10is Medi plurlism The Prties, in the spirit of co-opertion nd mutul ssistnce which underlies this Convention, shll endevour to void tht progrmme services trnsmitted or retrnsmitted y rodcster or ny other legl or nturl persons within their jurisdiction, within the mening of Article 3, endnger medi plurlism." Article 14 The heding of Chpter III shll red s follows: "Advertising nd tele-shopping" Article 15 Article 11 shll hve the following wording: "1 Advertising nd tele-shopping shll e fir nd honest. 2 Advertising nd tele-shopping shll not e misleding nd shll not prejudice the interests of consumers. 3 Advertising nd tele-shopping ddressed to or using children shll void nything likely to hrm their interests nd shll hve regrd to their specil susceptiilities. 4 Tele-shopping shll not exhort minors to contrct for the sle or rentl of goods nd services. 5 The dvertiser shll not exercise ny editoril influence over the content of progrmmes." Article 16 Article 12 shll hve the following wording: "Article 12 Durtion 1 The proportion of tele-shopping spots, dvertising spots nd other forms of dvertising, with the exception of tele-shopping windows within the mening of prgrph 3, shll not exceed 20% of the dily trnsmission time. The trnsmission time for dvertising spots shll not exceed 15% of the dily trnsmission time. 2 The proportion of dvertising spots nd tele-shopping spots within given clock hour shll not exceed 20%. 3 Windows devoted to tele-shopping progrmmes rodcst within progrmme services which re not exclusively devoted to tele-shopping shll e of minimum uninterrupted durtion of 15 minutes. The mximum numer of windows per dy shll e eight. Their overll durtion shll not exceed three hours per dy. They must e clerly identified y opticl nd coustic mens. 4 For the purposes of this rticle, dvertising shll not include: 6

7 nnouncements mde y the rodcster in connection with its own progrmmes nd ncillry products directly derived from those progrmmes; nnouncements in the pulic interest nd chrity ppels rodcst free of chrge." Article 17 Article 13 shll hve the following wording: "Article 13 Form nd presenttion 1 Advertising nd tele-shopping shll e clerly distinguishle s such nd recognisly seprte from the other items of the progrmme service y opticl nd/or coustic mens. In principle, dvertising nd tele-shopping spots shll e trnsmitted in locks. 2 Advertising nd tele-shopping shll not use suliminl techniques. 3 Surreptitious dvertising nd tele-shopping shll not e llowed, in prticulr the presenttion of products or services in progrmmes when it serves dvertising purposes. 4 Advertising nd tele-shopping shll not feture, visully or orlly, persons regulrly presenting news nd current ffirs progrmmes." Article 18 The following text shll replce Article 14: "Article 14 Insertion of dvertising nd tele-shopping 1 Advertising nd tele-shopping shll e inserted etween progrmmes. Provided the conditions contined in prgrphs 2 to 5 of this rticle re fulfilled, dvertising nd teleshopping spots my lso e inserted during progrmmes in such wy tht the integrity nd vlue of the progrmme nd the rights of the rights holders re not prejudiced. 2 In progrmmes consisting of utonomous prts, or in sports progrmmes nd similrly structured events nd performnces contining intervls, dvertising nd tele-shopping spots shll only e inserted etween the prts or in the intervls. 3 The trnsmission of udiovisul works such s feture films nd films mde for television (excluding series, serils, light entertinment progrmmes nd documentries), provided their scheduled durtion is more thn forty-five minutes, my e interrupted once for ech complete period of forty-five minutes. A further interruption is llowed if their scheduled durtion is t lest twenty minutes longer thn two or more complete periods of forty-five minutes. 4 Where progrmmes, other thn those covered y prgrph 2, re interrupted y dvertising or tele-shopping spots, period of t lest twenty minutes should elpse etween ech successive dvertising or tele-shopping rek within the progrmme. 5 Advertising nd tele-shopping shll not e inserted in ny rodcst of religious service. News nd current ffirs progrmmes, documentries, religious progrmmes, nd children's progrmmes, when their scheduled durtion is less thn thirty minutes, shll not e interrupted y dvertising or tele-shopping. If their scheduled durtion is thirty minutes or longer, the provisions of the previous prgrphs shll pply." 7

8 Article 19 The heding of Article 15 nd prgrphs 1 to 2, of this rticle shll hve the following wording: "Article 15 Advertising nd tele-shopping of prticulr products 1 Advertising nd tele-shopping for tocco products shll not e llowed. 2 Advertising nd tele-shopping for lcoholic everges of ll vrieties shll comply with the following rules: they shll not e ddressed prticulrly to minors nd no one ssocited with the consumption of lcoholic everges in dvertising or tele-shopping should seem to e minor;" Article 20 In the French text, Article 15, prgrph 2, su-prgrphs to e, shll e worded s follows: " ils ne doivent ps ssocier l consommtion de l'lcool à des performnces physiques ou à l conduite utomoile; c d e ils ne doivent ps suggérer que les oissons lcoolisées sont dotées de propriétés thérpeutiques ou qu'elles ont un effet stimulnt, sédtif, ou qu'elles peuvent résoudre des prolèmes personnels; ils ne doivent ps encourger l consommtion immodérée de oissons lcoolisées ou donner une imge négtive de l'stinence ou de l soriété; ils ne doivent ps souligner indûment l teneur en lcool des oissons." Article 21 A new prgrph 5 reding s follows shll e inserted in Article 15: "5 Tele-shopping for medicines nd medicl tretment shll not e llowed." Article 22 Article 16 will hve the following wording: "Article 16 Advertising nd tele-shopping directed specificlly t single Prty 1 In order to void distortions in competition nd endngering the television system of Prty, dvertising nd tele-shopping which re specificlly nd with some frequency directed to udiences in single Prty other thn the trnsmitting Prty shll not circumvent the television dvertising nd tele-shopping rules in tht prticulr Prty. 2 The provisions of the preceding prgrph shll not pply where: the rules concerned estlish discrimintion etween dvertising nd teleshopping trnsmitted y rodcster within the jurisdiction of tht Prty nd dvertising nd tele-shopping trnsmitted y rodcster or ny other legl or nturl person within the jurisdiction of nother Prty ; or 8

9 the Prties concerned hve concluded ilterl or multilterl greements in this re." Article 23 Prgrph 1 of Article 18 shll red s follows: "1 Progrmmes my not e sponsored y nturl or legl persons whose principl ctivity is the mnufcture or sle of products, or the provision of services, the dvertising nd tele-shopping of which re prohiited y virtue of Article 15." Article 24 A new prgrph 2 reding s follows shll e inserted in Article 18: "2 Compnies whose ctivity includes, inter li, the mnufcture or sle of medicines nd medicl tretments my sponsor progrmmes y promoting the nme, trdemrk, imge or ctivities of the compny, to the exclusion of ny reference to medicines or specific medicl tretment ville only on medicl prescription in the trnsmitting Prty." Article 25 Prgrph 2 of Article 18 shll e renumered to prgrph 3. Article 26 A new Chpter IVis reding s follows shll e inserted: "Chpter IVis Progrmme services devoted exclusively to self-promotion or teleshopping Article 18is Progrmme services devoted exclusively to self-promotion 1 The provisions of this Convention shll pply muttis mutndis to progrmme services devoted exclusively to self-promotion. 2 Other forms of dvertising shll e llowed on such services within the limits estlished y Article 12, prgrphs 1 nd 2. Article 18ter Progrmme services devoted exclusively to tele-shopping 1 The provisions of this Convention shll pply muttis mutndis to progrmme services devoted exclusively to tele-shopping. 2 Advertising shll e llowed on such services within the limits estlished in Article 12, prgrph., Article 12, prgrph 2, shll not pply." Article 27 The lst sentence of prgrph 4 of Article 20 shll e deleted nd prgrph 7 of Article 20 shll hve the following wording: "7 Suject to the provisions of Article 9is, prgrph 3, nd Article 23, prgrph 3, the decisions of the Stnding Committee shll e tken y mjority of three-qurters of the memers present." 9

10 Article 28 Article 21 shll e supplemented s follows: "f give opinions on use of rights under Article 24is, prgrph 2c. 2 In ddition, the Stnding Committee shll: c drw up the guidelines referred to in Article 9is, prgrph 3, in order to void differences etween the implementtion of the provisions of this Convention concerning ccess of the pulic to events of mjor importnce for society nd tht of corresponding Europen Community provisions; give n opinion on the mesures tken y Prties which hve drwn up list of ntionl or non-ntionl events which re considered y those Prties s eing of mjor importnce for society in ccordnce with Article 9is, prgrph 2; pulish once yer consolidted list of the enlisted events nd corresponding mesures notified y Prties in ccordnce with Article 9is, prgrph 2e." Article 29 Two new prgrphs 5 nd 6, reding s follows, shll e inserted in Article 23: "5 However, the Committee of Ministers my, fter consulting the Stnding Committee, decide tht prticulr mendment shll enter into force following the expiry of period of two yers fter the dte on which it hs een opened to cceptnce, unless Prty hs notified the Secretry Generl of the Council of Europe of n ojection to its entry into force. Should such n ojection e notified, the mendment shll enter into force on the first dy of the month following the dte on which the Prty to the Convention which hs notified the ojection hs deposited its instrument of cceptnce with the Secretry Generl of the Council of Europe. 6 If n mendment hs een pproved y the Committee of Ministers, ut hs not yet entered into force in ccordnce with prgrphs 4 or 5, Stte or the Europen Community my not express their consent to e ound y the Convention without ccepting t the sme time the mendment." Article 30 A new Article 24is, reding s follows, shll e inserted: "Article 24is Alleged uses of rights conferred y this Convention 1 When the progrmme service of rodcster is wholly or principlly directed t the territory of Prty other thn tht which hs jurisdiction over the rodcster (the "receiving Prty"), nd the rodcster hs estlished itself with view to evding the lws in the res covered y the Convention which would hve pplied to it hd it fllen within the jurisdiction of tht other Prty, this shll constitute n use of rights. 2 Where such n use is lleged y Prty, the following procedure shll pply: the Prties concerned shll endevour to chieve friendly settlement; if they fil to do so within three months, the receiving Prty shll refer the mtter to the Stnding Committee; 10

11 c hving herd the views of the Prties concerned, the Stnding Committee shll, within six months of the dte on which the mtter ws referred to it, give n opinion on whether n use of rights hs een committed nd shll inform the Prties concerned ccordingly. 3 If the Stnding Committee hs concluded tht n use of rights hs occurred, the Prty whose jurisdiction the rodcster is deemed to e within shll tke pproprite mesures to remedy the use of rights nd shll inform the Stnding Committee of those mesures. 4 If the Prty whose jurisdiction the rodcster is deemed to e within hs filed to tke the mesures specified in prgrph 3 within six months, the ritrtion procedure set out in Article 26, prgrph 2, nd the ppendix of the Convention shll e pursued y the Prties concerned. 5 A receiving Prty shll not tke ny mesures ginst the progrmme service concerned until the ritrtion procedure hs een completed. 6 Any mesures proposed or tken under this rticle shll comply with Article 10 of the Convention for the Protection of Humn Rights nd Fundmentl Freedoms." Article 31 Article 28 shll hve the following wording: "Article 28 Reltions etween the Convention nd the internl lw of the Prties Nothing in this Convention shll prevent the Prties from pplying stricter or more detiled rules thn those provided for in this Convention to progrmme services trnsmitted y rodcster deemed to e within their jurisdiction, within the mening of Article 5." Article 32 Prgrph 1 of Article 32 shll hve the following wording: "1 At the time of signture or when depositing its instrument of rtifiction, cceptnce, pprovl or ccession ny Stte my declre tht it reserves the right to restrict the retrnsmission on its territory, solely to the extent tht it does not comply with its domestic legisltion, of progrmme services contining dvertising for lcoholic everges ccording to the rules provided for in Article 15, prgrph 2, of this Convention. No other reservtion my e mde." Article 33 In Article 20, prgrph 2, Article 23, prgrph 2, Article 27, prgrph 1, Article 29, prgrphs 1 nd 4, Article 34 nd in the closing formul, the words "Europen Economic Community" re replced y "Europen Community". Article 34 This Protocol shll e open for cceptnce y the Prties to the Convention. No reservtion my e mde. 11

12 Article 35 1 This Protocol shll enter into force on the first dy of the month following the dte on which the lst of the Prties to the Convention hs deposited its instrument of cceptnce with the Secretry Generl of the Council of Europe. 2 However, this Protocol shll enter into force following the expiry of period of two yers fter the dte on which it hs een opened to cceptnce, unless Prty to the Convention hs notified the Secretry Generl of the Council of Europe of n ojection to its entry into force. The right to mke n ojection shll e reserved to those Sttes or the Europen Community which expressed their consent to e ound y the Convention prior to the expiry of period of three months fter the opening for cceptnce of this Protocol. 3 Should such n ojection e notified, the Protocol shll enter into force on the first dy of the month following the dte on which the Prty to the Convention which hs notified the ojection hs deposited its instrument of cceptnce with the Secretry Generl of the Council of Europe. 4 A Prty to the Convention my, t ny time, declre tht it will pply the Protocol on provisionl sis. Article 36 The Secretry Generl of the Council of Europe shll notify the memer Sttes of the Council of Europe, the other Prties to the Convention nd the Europen Community of: the deposit of ny instrument of cceptnce; ny declrtion of provisionl ppliction of this Protocol in ccordnce with Article 35, prgrph 4; c ny dte of entry into force of this Protocol in ccordnce with Article 35, prgrphs 1 to 3; d ny other ct, notifiction or communiction relting to this Protocol.
