4 1.0 INTRODUCTION The fllwing are detailed descriptins f standard activities and functins inherent in delivering prfessinal Quantity Surveying () services. In essence, this dcument defines the wrk set aside fr persns registered as Quantity Surveyrs in the specified categries f registratin The cntents f this dcument describe standard services which are generic t mst Built Envirnment prjects. There is ften a lack f cmprehensin f the wrk perfrmed by Quantity Surveyrs. This is t the general detriment f the cnstructin industry macr ecnmy and the micr-ecnmy f the individual prjects in terms f prfitability / feasibility, cst management and value fr mney derived by clients f the industry. Identificatin f wrk fr persns registered in terms f Sectin 18 f Act 49/ ptimises the applicatin f scarce, highly-skilled human resurces, - minimises a client s financial risk, - prmtes best value fr mney spent, - prtects the Public Sectin 26 f the Act requires SACP t make recmmendatins t the Cuncil fr the Built Envirnment (CBE), regarding the wrk identified in terms f subsectin (2) and prhibits a persn nt registered in terms f this Act t perfrm any kind f wrk identified fr any categry f prfessinal registered in terms f this Act. 2.0 DEFINITIONS Built Envirnment refers t the functinal field in which registered persns practice. The Built Envirnment includes all structures that are planned and/r erected abve r undergrund, as well as the land utilised fr the defined purpses and the prvisin f supprting infrastructure. Quantity surveying is the prvisin f expert, prfessinal services and advice n cnstructin prcurement, cntracting and csts. Quantity surveyrs are trained, experienced specialists wh have acquired cmprehensive knwledge f cnstructin prcurement and cntracting methds, finance and ecnmics. They advise, cllabrate and c-perate with members f ther Built Envirnment Prfessins. T prtect their clients interests, Quantity surveyrs: advise n cnstructin prcurement methds and evaluatin f tenders, cntracting strategies and cnditins f cntract advise n and prvisin f cnstructin cst planning, cst analysis and cst cntrl f prjects advise and undertake value engineering and life cycle csting exercises and estimatin f replacement cst fr insurance purpses undertake financial feasibility ( viability / prfitability) studies t predict pssible rates f return n cmmercial investment prjects prepare and cmpile prcurement dcumentatin including tender, pricing and cntract data, bills f quantities / activity schedules / schedules f rates and ther tender dcuments including main-, subcntract and specialist services agreements evaluate tenders and make recmmendatins n suitability and pricing f tenders and reprt findings accrdingly manage all the financial aspects f cnstructin prjects including the preparatin f valuatins fr payment certificates in rder t ensure that prjects are cnstructed within apprved budgets prepare valuatin f variatins t the scpe f wrk including negtiatin f rates and prices and the preparatin and cnclusin f financial final accunts with main- and subcntractrs advise n cntractual matters including reslutin f cntractual claims and disputes act as principal agents in terms f cnstructin cntracts Quantity Surveyr is a persn wh is registered as such in terms f the Quantity Surveying Prfessin Act, 2000 (Act N. 49 f 2000, as amended) Wrks means all wrk executed r intended t be executed in accrdance with a cnstructin cntract. 19 August 2011 Page 4 f 28

5 Principal Agent means a persn r entity appinted by a client, and wh has full authrity and bligatin t act n behalf f that client in terms f a cnstructin cntract. Principal Cnsultant means a persn r entity appinted by a client t manage and administer the services f all ther cnsultants appinted t prvide prfessinal services n a specific prject. Cntractr means any persn r legal entity entering int a cntract with a client fr the executin f the wrks r part theref f a specific prject. Nminated Sub-cntractrs are specialist- and ther sub-cntractrs wh are nminated by a Principal Cnsultant t execute wrk r supply and fix any gds in terms f a specific cntract. Selected Sub-cntractrs are specialists and ther sub-cntractrs wh are selected by a cntractr in cnsultatin with a Principal Cnsultant t execute wrk r supply and fix any gds in terms f a specific cntract. Dmestic Sub-cntractrs are specialists and ther sub-cntractrs wh are selected and appinted by a cntractr t execute wrk r supply and fix any gds in terms f a specific cntract. Direct Cntractrs are cntractrs appinted by a client t execute wrk ther than the wrks related t a specific cntract. Suppliers are persns r entities appinted by a client t supply gds and prducts fr incrpratin int the wrks related t a specific cntract. Cnstructin Prgramme is an apprpriately detailed prgramme fr the wrks related t a specific cntract, which is used fr mnitring the prgress f thse wrks and indicates the lgical sequence and duratin f all activities t be cmpleted by the cntractrs, sub-cntractrs and suppliers. Cntract prgramme is a cnstructin prgramme fr the wrks related t a specific cntract, agreed between the cntractr and the Principal Agent. The Suth African Cuncil fr the Quantity Surveying Prfessin means the Suth African Cuncil fr the Quantity Surveying Prfessin established as a juristic persn by sectin 2 f the Quantity Surveying Prfessin Act, 2000 (Act N. 49 f 2000, as amended), and SACP has the same meaning. Quantity Surveying Prfessin Act means the Quantity Surveying Prfessin Act, 2000 (Act N. 49 f 2000, as amended). Quantity Surveying Wrk means the wrk identified under sectin 4 f this Identificatin f Wrk fr Quantity Surveyrs dcument. Imprper Cnduct cntemplated in sectin 27(3) f the Quantity Surveying Prfessin Act, 2000, as amended), means failure t cmply with the cde f cnduct fr registered persns. Public means any persn r grup f persns wh is, r whse envirnment is either directly r indirectly affected by any quantity surveying activity, r by an utcme r influence f a quantity surveying activity, r by a service prvided in terms f quantity surveying activity, which may impact n the health, safety and interest f such persn r grup f persns 19 August 2011 Page 5 f 28

6 Substantially Practise means regularly and cnsistently executing r perfrming quantity surveying wrk identified in sectin 4 f this Identificatin f Wrk fr Quantity Surveyrs dcument, charging prfessinal fees fr such wrk and accruing prfessinal respnsibility t a client r an emplyer fr the perfrmance f such wrk and related functins. The Cuncil fr the Built Envirnment means the juristic persn established by sectin 2 f the Cuncil fr the Built Envirnment Act, 2000 (Act N 43 f 2000) Sectin 26 f the Act requires SACP t make recmmendatins t the Cuncil fr the Built Envirnment (CBE), regarding the wrk identified in terms f subsectin (2) and prhibits a persn nt registered in terms f this Act t perfrm any kind f wrk identified fr any categry f prfessinal registered in terms f this Act. 3.0 GOALS AND OBJECTIVES The gal f this dcument is t make recmmendatins t the CBE regarding the wrk that is t be Identified fr the quantity surveying prfessin. The bjective f identifying this wrk is t verify cmpetence f registered quantity surveyrs t achieve the fllwing requirements f the Quantity Surveying Prfessins Act t: cmply with legislative requirements, prtect the public by defining the wrk that each registratin categry f the quantity surveying prfessinals can undertake, prtect the envirnment and prmte effective envirnmental management, prmte the sustainability f the develpments, prvide a framewrk fr the identificatin f wrk and the demarcatin f identified wrk between prfessinals, prvide an effective and efficient mechanism fr addressing and recgnising verlaps and duplicatin between wrk identified by different prfessins, ensure that where wrk is t be carried ut by different categries f prfessinals, there are clear and transparent ways f determining the categry f prfessinal t carry ut the wrk, and prmte the transparency and accuntability f the identificatin f wrk prcess 19 August 2011 Page 6 f 28

7 4.0 GENERAL INFORMATION: WORK TO BE PERFORMED BY PERSONS REGISTERED IN TERMS OF ACT 49/ Descriptin f the Quantity Surveying Prfessin Quantity Surveying cmprises a variety f services perfrmed by prfessinal cnsultant Quantity Surveyrs appinted by clients wh wish t invest in prperty develpments r undertake built envirnment cnstructin prjects. Quantity surveyrs ffer prfessinal advice t clients, architects, engineers and ther service prviders n all financial and cntractual matters arising frm built envirnment cnstructin prjects frm inceptin t clse ut. Quantity Surveyrs have a full understanding f varius systems and methds f cnstructin, specialised services and installatins, cnstructin materials, plant (machinery) and labur as well as the many frms f cntract and sub-cntract agreements available fr use in the cnstructin industry. Quantity surveyrs are als cmpetent t advise their clients and ther cnsultants regarding alternative prcurement and cntracting strategies, methds f cnstructin, material, life cycle csts, value engineering alternatives and valuatins f structures fr insurance r ther purpses Prfessinal quantity surveying wrk is undertaken by specialist, frmally educated prfessinals with specific training and experience that prvides a special range f skills that are applied t a wide range f prblem-slving situatins, predminantly related t prject csts and cnstructin cntracts 4.2 Nature and Types f Prjects The nature and types f prjects t be implemented in terms f the Identificatin f Wrk fr Quantity Surveyrs registered in terms f the Quantity Surveying Prfessin Act 2000 (Act N 49 f 2000) shall be all cnstructin wrk within the Built Envirnment. 4.3 Applicatin f the Prvisins f this Dcument The prvisins f this dcument shall be applicable in respect f :- 1. Any quantity surveying wrk perfrmed within the brders f the Republic f Suth Africa (RSA), whether r nt the intended utcme f such wrk is t be executed utside the RSA 2. Any persn wh is nt rdinarily resident in the Republic f Suth Africa, but wh perfrms quantity surveying wrk within the RSA 4.4 Prject Wrk Stages Typical cnstructin prjects cmprise the fllwing Prject Wrk stages: Inceptin: Prject initiatin and briefing: establishing the client s requirements and preferences, assessing user needs and ptins, appintments f cnsultants, establishing the prject brief including prject bjectives, pririties, cnstraints, assumptins, aspiratins and strategies Cncept and Viability: Preparing and finalising the prject cncept in accrdance with the brief including the scpe, scale, character, frm, functin and preliminary prgramme and viability f the prject Design Develpment: Develping the apprved cncept t finalise the design, utline specificatins, cst plan, financial viability and prgramme fr the prject 19 August 2011 Page 7 f 28

8 Dcumentatin and Prcurement Preparing the cnstructin and prcurement dcumentatin, cnfirm and implement the prcurement strategies and prcedures fr effective and timeus prcurement f necessary resurces fr the executin f the prject Cnstructin Preparatin and c-rdinatin f the prcedures and dcumentatin t facilitate practical cmpletin f the wrks; managing, administering and mnitring the cntracts and prcesses, including the preparatin and c-rdinatin f the prcedures and dcumentatin t facilitate practical cmpletin f the wrks Clse Out Fulfilling and cmpleting the prject clse-ut including the preparatin f the necessary dcumentatin t facilitate effective cmpletin, handver and peratin f the prject The generic scpe f Wrk that a prfessinal quantity surveyr may undertake in each f the abve Stages is identified in Annexure B. and the cmpetencies required t carry ut such wrk is utlined in Annexure A and C. 4.5 General Ntes As these stages might verlap, the Standard Services stated in sectin 4 f this Identificatin Of Wrk fr Quantity Surveyrs dcument, may be required t be undertaken during any ne Of the Prject Wrk Stages The rder f the Standard Services des nt necessarily reflect the actual sequence f implementatin. 19 August 2011 Page 8 f 28

9 5 QUANTITY SURVEYING WORK IDENTIFICATION OF WORK TO BE PERFORMED BY QUANTITY SURVEYORS I.E. Tw categries are currently recgnised viz. Prfessinal Quantity Surveyr (Pr) and Candidate Quantity Surveyr (Ca). See Annexures A and C Sectin 18(3) states that a persn wh is registered in the categry f candidate must perfrm wrk in the quantity surveying prfessin nly under the supervisin and cntrl f a prfessinal f a categry as prescribed. Refer Annexure A fr Assessment f Prfessinal Cmpetence which clearly illustrates the aspects that differentiates the cmpetencies between Prfessinal Quantity Surveyr (Pr) and Candidate Quantity Surveyr (Ca) Sectin 26(3)(a) states that a persn wh is nt registered in terms f this Act, may nt perfrm any kind f wrk identified fr any categry f registered persns. Hwever sectin 26(4) states clearly that this may nt be cnstrued as prhibiting any persn frm perfrming wrk identified in terms f sectin 26, if such wrk is perfrmed in the service f r by rder f and under the directin, cntrl, supervisin f r in assciatin with a registered persn entitled t perfrm the wrk identified and wh must assume respnsibility fr any wrk s perfrmed. 6.2 Imprper Cnduct Sectin 27(3) states that all registered persns must cmply with the cde f cnduct and failure t d s cnstitutes imprper cnduct. 19 August 2011 Page 11 f 28

12 7 OVERLAPS: WORK WHICH PERSONS REGISTERED IN TERMS OF OTHER LEGISLATION WISH TO PERFORM IN CONTRAVENTION OF THAT WORK BEING RESERVED FOR PERFORMANCE BY PERSONS REGISTERED IN TERMS OF THE QUANTITY SURVEYING PROFESSION ACT 2000 (ACT NO 49 OF 2000) Sectin 26(1) f the Quantity Surveying Prfessin Act states that the identificatin f the type f quantity surveying wrk which may be perfrmed by persns registered in any f the categries referred t in sectin 18, shuld include wrk which may fall within the scpe f any ther prfessin regulated by the prfessins Act referred t in the Cuncil fr the Built Envirnment Act, It therefre pre-suppses that there may be verlaps amngst the prfessins registered under the varius Built Envirnment Cuncils. The CBE Plicy Framewrk n Identificatin f Wrk recgnises these ptential verlaps and suggests that the issue f verlaps be reslved by the prfessins. Any persn wh substantially practices quantity surveying wrk shuld register with the SACP The fllwing verlaps have been agreed in assciatin with the ther relevant Cuncils.
