The successful prpser must be an Equal Opprtunity Emplyer. The successful prpser must btain Dunkirk s apprval prir t utilizing a subcntractr in rder t perfrm the requirements f this RFP. Prpsals (ne riginal and fur cpies) must arrive and be received by the City f Dunkirk n later than March 27, 2015 at 3:00 p.m. EST. All prpsals shall be submitted t: Dunkirk City Clerk, 342 Central Avenue, Dunkirk, New Yrk N prpsal will be cnsidered which is nt accmpanied by all required infrmatin detailed hereinafter, and all prpsals must be signed by an authrized individual. Prpsals must be received n r befre the time and date specified. Prpsals received after the time specified will nt be cnsidered and will be returned unpened. The successful prpser shall be required t prvide insurance f the type and in the amunts as apprved by the City s Department f Law and shall be required t execute a Cntract, all subject t the apprval and directin f the Dunkirk Cmmn Cuncil. The successful submissin, r submissins, as apprved by the Dunkirk Cmmn Cuncil and cnsistent with the terms f a written agreement with the City, will be prvided n a cntract, as-needed basis such services as are required frm time-t-time by the City as belw described, upn terms and cnditins further detailed in a written Cntract with Dunkirk. A prpsal that is in the pssessin f Dunkirk may be altered by a sealed letter bearing the signature r name f the authrized persn, prvided it is received PRIOR t the due date. Fax, , telephne r verbal alteratins will nt be accepted. A prpsal that is in the pssessin f Dunkirk may be withdrawn by the vendr up t the time f the due date. Evaluatin Criteria. Prpsal meeting the requirements utlined in this RFP shall be given due cnsideratin. The selectin f a vendr shall be based n Dunkirk s evaluatin f the entire submitted prpsal. Dunkirk reserves the right t seek any clarificatins needed t determine the mst qualified submittal and/r require crrectin f arithmetic r ther apparent errrs fr the purpse f assuring a full and cmplete understanding f a prpser s prpsal and/r t determine cmpliance with the requirements f the slicitatin.

3 A cntract may be awarded t the prpser whse prpsal achieves the highest evaluatin, and nt slely n the basis f price. Award and Cntract Infrmatin. The prpser agrees that shuld their firm be awarded a cntract, prpser will nt discriminate against any persn wh perfrms wh hereunder because f age, race, clr, sex, creed, sexual rientatin, natinal rigin r disability. The prpser expressly warrants t Dunkirk that it has the ability and expertise t perfrm its respnsibilities hereunder and in s ding shall use the highest standards f prfessinal wrkmanship. Dunkirk reserves the right t reject any r all prpsals, t waive any infrmality r technical defect in the prpsals, r t award the cntract in whle r in part, if deemed t be in the best interest f Dunkirk t d s. Explanatins f Dunkirk s decisins shall nt be required except as therwise prvided by law. The successful prpser will be required t enter int and sign an Agreement r Agreement f Services (Cntract) with Dunkirk with reasnable adjustments acceptable t Dunkirk. This RFP and the respnse f the successful prpser may becme part f the Cntract and will be in effect fr the duratin f the Cntract. The Cntract language will cntrl ver any cnflicting language cntained within the RFP. The successful prpser will nt cmmence any wrk until a valid Cntract has been executed by bth the prpser and Dunkirk. Qualificatins. Each prpser shall submit a statement f the prpser s qualificatins, experience, rganizatin, equipment and facilities available t adequately prvide the service and material necessary t fulfill the minimum specificatins fr this RFP, unless therwise specified in the scpe f wrk. Prpsals shuld prvide the fllwing: qualificatins, relevant experience, accmplishments in the field, educatin/training/certificatins, insurance (including wrkers disability and wrkers cmpensatin), details f prpsed fee requirements and structure, brief statement as t the reasns the vendr believes t be best qualified. Dunkirk shall have the right t take such steps as it deems necessary t determine the ability f the prpser t perfrm bligatins under the Cntract, and the prpser shall furnish t Dunkirk all such infrmatin and data fr this purpse as may be requested. Dunkirk reserves the right t reject any prpsal where an investigatin f the available evidence r infrmatin des nt satisfy the Cntract that in its sle discretin, the prpser is

4 qualified t prperly carry ut the terms f the Cntract. The City reserves the right t engage ne r mre cntractrs t undertake such services within its wn discretin, and t assign wrk in the manner it sees fit, in its sle discretin. Details. Dunkirk is sliciting prpsals frm qualified vendrs capable f prviding certain Cde Cmpliance Abatement, Lawn Mwing/Yard Services n an as-needed, cntract basis, fr the 2015 seasn. The abatement includes the mwing f grass/weeds greater than six (6) inches in height. Abatement requests will be made n a per-site authrizatin basis frm the City s Building Inspectr s Office. The general scpe f duties and respnsibilities f the required assistance and services includes, but is nt necessarily limited t, prviding: Mwing all established grasses and vegetatin (excluding shrubs, trees, heavily wded area, and reasnably-maintained garden areas); Services capable f cmpleting several jbs in a timely manner n a per-call basis; Services capable t handle several jbs cnsisting f extremely tall grass/weeds; Availability f equipment, persnnel and skill requisite t prvide the services in a gd, wrkmanlike and timely manner, including the ability t service requests fr wrk n ungraded lts, steep slpes and/r fields; fr wrk n lts with grass/weeds in excess f six inches (6 ) in height; fr wrk n lts with hedges in excess f fur feet (4 ) in height, with trimming remval; Mwing f vegetatin in/arund structures t a neat appearance with grass height f three inches (3 ) r less; Remval and prper dispsal f all trash and debris in subject lts Clearing f sidewalks, alleys r adjacent public rights-f-way f trimmings and clippings; Submit invices t the City in an efficient and timely manner as requested by the Building Inspectr s Office; and, Such ther and further related duties as agreed upn. The successful applicant(s) will be required t undertake the duties and respnsibilities in a prfessinal and gd-and-wrkman-like manner, with general directin by the City.
