2 REQUEST FOR PROPOSAL CONSTRUCTION ENGINEERING & SURVEY FOR THE 2019 CONSTRUCTION SEASON The City f Devils Lake intends t execute ne cst plus fixed fee cntract requiring mnthly billings with the chsen Cnsultant t cmplete cnstructin engineering, survey, material testing and inspectin fr the city s dwntwn revitalizatin prject. The prject cnsists f cncrete pavement repair; mill, verlay & seal cat; curb, gutter & sidewalk; lighting, signal and landscape imprvements within ur dwntwn district. A cmplete cpy f the plans and specificatins are available frm the City r n the Nrth Dakta Department f Transprtatin (NDDOT) website. Plans fr the prject were develped under a separate cntract with Kadrmas, Lee and Jacksn, Inc. The prject is funded using Federal funds thrugh the Nrth Dakta Department f Transprtatin. A cmplete set f plans and specificatins, as well as assciated prject CADD files will be prvided t the selected firm. The City reserves the right t assign wrk phases and have the Cnsultant selected perfrm any additinal wrk nt currently assigned. Prject wrk items may be added r remved frm the cntract by wrk authrizatin r supplementary agreement. INTRODUCTION The City f Devils Lake will engage the services f a qualified engineering Cnsultant t perfrm cnstructin engineering wrk such as surveying, sampling and testing f materials, inspectin, measuring, ensuring ADA cmpliance, cmputing pay quantities and cntract administratin fr its dwntwn street and sidewalk rehabilitatin prject. Cnsultants submitting prpsals must be qualified t perfrm all f the cnstructin engineering and prject administratin activities identified abve and/r required by the NDDOT fr federally funded cnstructin prjects. Prject wrk items may be added r remved frm the cntract by wrk authrizatin r supplementary agreement. Interviews will be cnducted tentatively within 30 days frm the due date f this prpsal. ADMINISTRATION & INSPECTION The selected Cnsultant will be respnsible fr all cnstructin inspectin, material testing and survey t verify the cntractr s wrk is perfrmed accrding t the gverning specificatins, plans, and special prvisins including the prvisins f the Department s Standard Specificatins fr Rad and Bridge Cnstructin, Materials Sampling and Testing Manual, and Cnstructin Recrds Manual. The Cnsultant s material sampling and testing persnnel must be certified under the apprpriate State Testing Qualificatin Prgram. The selected Cnsultant shall prvide a Registered Engineer t directly supervise all aspects f the cnstructin engineering related t this prject as required by Title 28 f the Nrth Dakta Administrative Cde. The Registered Engineer shall act as the Prject Engineer and be the primary cntact fr the City related t the prject. The selected Cnsultant will prepare the required engineering and administrative dcuments and recrds as required by the NDDOT fr Federal aid prjects. The selected Cnsultant shall prvide a wrk frce adequate t perfrm the wrk necessary t meet the Cntractr s wrk schedule and ensure the wrk is cmpleted accrding t the plans, specificatins and applicable ADA requirements. The Cnsulting Engineer s Prject Manager assigned t the prject shall be capable f reading and interpreting prject dcuments fr prper executin f the prject in accrdance with the plans and specificatins and applicable cdes. 3 The Cnsulting Engineer s survey crew assigned t the prject shall be capable f reading and interpreting prject plans and specificatins in rder t place survey cntrls fr the prper executin f the prject. The Cnsultant shall perfrm all cnstructin layuts and reference staking necessary fr the accurate cntrl and cmpletin f the prject. The survey crew prvided will be required t have the ability t perfrm all wrk activities required fr the prject, such as: perfrming cnstructin surveys (i.e. excavatin limits, cncrete radway and sidewalk remval and replacement quantities, ADA cmpliance review and field staking, etc.) staking cnstructin cntrl lines and grades staking fr establishing radway and sidewalk crss slpe and grade taking field measurements t establish quantities fr accurate pay estimates; cmmn excavatin lcatins, sub-cut and calculate quantities lcating reference pints as required staking cnstructin and permanent signs, and verifying new sign supprt lengths prir t cntractr rdering material prviding grade cntrl fr the trimmer and verifying trimmer wrk prviding blue tp grades fr intersectin radway repair perfrming minr adjustment t the grade lines t accmmdate changes made by field persnnel verifying and adjusting grades at existing tie in-pints preparing final as built plans. The Cnsultant selected will be required t designate a survey crew cntact persn wh shall keep in daily cntact with the Prject Manager s representative and the Cntractr. A diary f wrk requested, wrk cmpleted, cmments, daily weather, daily wrk hurs, and survey persnnel n the prject each day shall be made and submitted t the Prject Engineer n the first wrking day f the fllwing week. Any questins r cncerns regarding the survey r prject plans will be brught t the attentin f the City representative. The Cnsultant s Prject Engineer shall answer all questins the Cntractr r the City may have cncerning the cnstructin surveying. MATERIALS SAMPLING & TESTING Cnsultant s material sampling and testing persnnel must be certified under the Apprpriate State Testing Qualificatin Prgram t meet NDDOT requirements. All Material testing and prject data will becme the prperty f the City upn cmpletin f the final submittal. Acceptance f all material shall be as specified in Sectin 106 f the NDDOT Standard Specificatins fr Rad and Bridge Cnstructin manual, plan ntes, special prvisins, and the NDDOT Materials Sampling and Testing Manual. Where the Department's Specificatins r Special Prvisins require that materials meet AASHTO, ASTM, AWPA r ther Specificatins, the latest Specificatins tgether with all interim Specificatins which have been printed and distributed befre the date f the invitatin fr bids shall apply. The Cnsultant selected will be required t designate a cntact persn wh shall keep in daily cntact with the Prject Engineer s representative and the Cntractr. A diary f wrk requested, wrk cmpleted, cmments, daily weather, daily wrk hurs, and testing persnnel n the prject each day shall be made and submitted t the Prject Engineer n the first wrking day f the fllwing week. 4 Precnstructin: Phase I shall include but nt be limited t cnducting the precnstructin meeting, mbilizatin, initial materials testing, and develping a City apprved scpe f wrk and hurs fr Phase II based n the cntractr s schedule and prpsed methd f peratins. The Prject Engineer will have 14 days, frm the date the precnstructin meeting is cmpleted t secure an apprved scpe f wrk and hurs fr Phase II. A preliminary scpe f wrk and hurs fr Phase II shall be prvided by the Cnsultant within 7 days f cmpletin f the precnstructin meeting. Pending the City apprval f the Phase II scpe f wrk and hurs cmpleted in Phase I, the City may authrize the Engineer t perfrm Phase II and any additinal wrk nt currently assigned r cmpleted in Phase I. Cnstructin: Phase II shall, as applicable, include but nt be limited t, cnstructin engineering and inspectin, cnstructin survey, sampling and testing f materials, measuring and cmputing pay quantities, cntract administratin, review and ensuring ADA cmpliance, claims, plan revisins, shp drawings, preparing and submitting final dcumentatin, and prject clseut. Phase II will be cnsidered cmplete upn final inspectin and prject acceptance by the City Engineer. Phase II may als include develping a City apprved scpe f wrk and hurs fr Phase III if needed. Dispute Reslutin: Phase III shall, as applicable, include but nt be limited t activities addressing extended cntract dispute reslutin resulting in arbitratin. PROPOSED SUB CONSULTANT REQUEST Sub Cnsultant firms that have been cntacted and agree t be listed n the Prime Cnsultants Prject Prpsal fr wrk with the City must submit riginal frm and ne cpy t be attached t the Prime Cnsultants Prpsal. This frm is used fr infrmatinal purpses nly. See the NDDOT web site fr frm SFN ( PRIME CONSULTANT REQUEST TO SUBLET The successful Cnsultant will be required t include the attached Prime Cnsultant Request t Sublet frm fr each Sub cnsultant listed n the cntract prir t executin f the cntract. The frm assures that the cntract between the Prime cnsultant and all Sub cnsultants cntains all the pertinent prvisins and requirements f the prime cntract with the City f Devils Lake. See the NDDOT web site fr frm SFN ( CONSULTANT PROJECT MANAGER DESIGNATION REQUIREMENT (See attached prject list) Definitin f Cnsultant Prject Manager: The Cnsultant Prject Manager shall be an Engineer r Senir Level Technician with sufficient experience t make engineering decisins in the field and versee the prject n a daily basis. Duties f Cnsultant Prject Manager: The Cnsultant Prject Manager shall be under the directin f the designated Prject Engineer. The Cnsultant Prject Manager must be nsite daily during the cntractr s cre wrking hurs. The Cnsultant Prject Manager has immediate charge f the engineering aspects f the cnstructin prject. The Cnsultant Prject Manager is respnsible fr the activities and efficiency f all cnsultant persnnel assigned t the prject, and fr versight f the actual cnstructin t assure cntract cmpliance. The Cnsultant Prject Manager shuld be invlved with the initial phases f the prject, if pssible, as early as the Pre Cnstructin Cnference stage. After the prject becmes active, the Cnsultant Prject Manager shall: Page 4 f 8

5 1. Oversee all field inspectin t ensure the prject is cnstructed in accrdance t the plans, standards, and specificatins fr the prject 2. Instruct, train, and supervise Cnsultant persnnel 3. Oversee and apprve: a. Prject recrds, b. Prgress reprts, c. Determinatin f pay quantities, and d. Prmpt payment t the Cntractr 4. Be respnsible fr regular Cnsultant safety meetings and enfrcement f safety plicies fr all Cnsultant and Sub Cnsultant emplyees All design and prject data will becme the prperty f the City upn cmpletin f the final submittal. Cnsultants shall carry ut applicable requirements f 49 CFR Part 26 in the slicitatin, award, and administratin f USDOT-assisted cntracts. Failure by the Cnsultant t carry ut these requirements is a material breach f the cntract, which may result in the terminatin f the cntract r such ther remedy as the recipient deems apprpriate. TITLE VI/NON-DISCRIMINATION AND ADA Title VI assures that n persn r grup f persns may, n the grunds f race, clr, natinal rigin, sex, age, r disability, be excluded frm participatin in, be denied the benefits f, r be therwise subjected t discriminatin under any and all prgrams r activities administered by the Department. The tw paragraphs abve apply t every cnsultant n the prject, including every tier f sub cnsultant. It is the Cnsultant s, r Sub Cnsultant s respnsibility t include the tw abve paragraphs in every subcntract. EVALUATION AND SELECTION PROCESS Page 5 f 8

6 Cnsultants interested in perfrming the wrk must submit 5 hard cpies f their prpsal and ne electrnic cpy in PDF frmat. Bth the hard cpies and electrnic cpy must be submitted prir t the date and time listed n the cver f this RFP t be cnsidered. Any late prpsals will nt be cnsidered. Page 6 f 8

The pages f the cver letter will nt be cunted as a part f the pages. Als include the individuals address belw each signature n the cver letter. The prpsal pages shall be numbered and must be limited t 5 pages in length. Prpsals that exceed the page length requirement will nt be cnsidered. This sectin shuld cntain the Cnsultants apprach and specific plan fr cmpleting the cnstructin engineering, survey, material testing and inspectin fr the prject. Cnsultant shuld als prvide specific infrmatin related t Cnsultant s plan t keep City persnnel, businesses, adjining prperty wners and the public infrmed f prject cnstructin peratins. Prpsal shall als identify Cnsultant s plan t crdinate interpretatin f prject plans and adjustment f prject plans (if required) develped by a separate cnsulting engineering firm. The Cnsultant s prpsal shall include an appendix. The appendix may include updated Federal frm 330 if yu d nt have ne n file with CAS. The pages in the appendix will nt be cunted as a part f the pages. The appendix shall include the fllwing in this rder: Appendix A A staffing plan identifying the key prject persnnel (including titles, educatin, certificatins and wrk experience) and the respective rles and respnsibilities fr the prject. Appendix B A General QC/QA Plan which cvers the Cnsultant s prcess fr ensuring checks and reviews are being cnducted t ensure quality and standards are being met. Appendix C Sub Cnsultants and assciated activities t be cmpleted by the Sub Cnsultants. Attach sublet frms fr each sub at the end f this sectin. Each prpsal will be evaluated by a selectin cmmittee cnsisting f the City staff members and/r representatives. The City reserves the right t limit the interviews t a minimum f three Cnsultants whse prpsals mst clearly meet the RFP requirements. Cnsultants nt selected t be interviewed will be ntified in writing. Selectin will be n the basis f the fllwing weighted criteria: Weight 10% i. Past perfrmance 10% ii. Ability f prfessinal persnnel 10% iii. Willingness t meet time and budget requirements 10% iv. Lcatin 10% v. Recent, current, and prjected wrklads f the persns and/r Cnsultants Page 7 f 8

DBE: Up t 5 pints may be awarded fr gd faith effrts t utilize DBE s in case f tied scres Maximum ttal weight is 100 pints. 5 additinal pints maybe awarded fr gd faith effrts t utilize DBE s in the event f a tie. Cnsultants are strngly encuraged t use DBE sub cnsultant services where applicable. The prpsal must cntain a list f any tasks that may be let t sub cnsultants shuld the Cnsultant be awarded the cntract. It must als cntain the specific gd faith effrts made by the Cnsultant, t achieve DBE participatin, in the areas intended fr sub-cnsulting. Cnsultant interviews will include questins regarding gd faith effrts (see 49 CFR Part 26, Appendix A: Guidance Cncerning Gd Faith Effrts, Paragraph IV. A-H) t achieve DBE participatin. DBE participatin will be a cnsideratin during the negtiatin stage f each cntract. RIGHT OF REJECTION The City f Devils Lake reserves the right t reject any r all prpsals. DISCLOSURE OF PROPOSAL At the cnclusin f the selectin prcess, the cntents f all prpsals will be subject t Nrth Dakta's Open Recrds Law and may be pen t inspectin by interested parties. Any infrmatin included in the prpsal that the prpsing party believes t be a trade secret r prprietary infrmatin must be clearly identified in the prpsal. Any identified infrmatin recgnized as such and prtected by law may be exempt frm disclsure. RISK MANAGEMENT FOR PROFESSIONAL SERVICES The Risk Management Appendix/Addendum will be incrprated int the agreement between the City and the Cnsultant. AUDIT Cnsultants prpsing t d wrk fr the City must have a current audit rate n lder than 12 mnths frm the clse f the Cnsultant s Fiscal Year. Cnsultants that d nt meet this requirement will nt qualify t prpse r cntract fr City prjects until the requirement is met. Cnsultants that have submitted all the necessary infrmatin t the City and are waiting fr the cmpletin f the audit will be qualified t submit prpsals fr wrk. Infrmatin submitted by a Cnsultant that is incmplete will nt qualify. Out f state Cnsultants can submit a current accepted FARS audit rate frm a cgnizant agency. Under certain cnditins the City may ffer a Safe Harbr Rate f 110% t Cnsultants that d nt have a cmpliant rate. PROJECTS MAY BE ADDED OR WITHDRAWN SUBJECT TO THE AUTHORIZATION AND AVAILABILITY OF FEDERAL FUNDS. Page 8 f 8
