1 LIVING CARE - CRITICAL ILLNESS INSURANCE Product Disclosure Sheet (Please read this Product Disclosure Sheet before you decide to take out this insurance. Be sure to also read the general terms and conditions.) 1. What is this product about? This plan pays the Insured Person a lump sum specified in the policy schedule if such Insured Person is diagnosed with any of the Critical Illness specified in the policy provided that the Critical Illness suffered by the Insured Person is the first incident of Critical Illness, subject to the Insured Person surviving for not less than fourteen (14) days after such diagnosis. 2. Who is eligible? Any Malaysian from age 19 to 60 and is renewable up to 65 years old. Dependent children (unmarried & unemployed) must be 30 days and under the age of 19 or up to the age of 23 for those who are registered as full time students at a recognised educational institution in Malaysia. 3. What are the coverages? Premium rates are not guaranteed. Factors which lead to increase in premium are your claims experience, medical inflation and our overall experience in underwriting this Critical Illness Insurance. 2

3 5. What are the fees and charges that I have to pay? Premium is based on your age, plan and subject to underwriting requirements of the insurance company. What you have to pay in addition to the premium Amount Stamp Duty RM Goods and Services Tax (GST) 0% of premium What is included in the premium Commission to the insurance intermediary (if any) Amount 15% of premium (individual policy) 10% of premium (group policy) 6. What is the Period of Cover and Renewal Option? The Policy shall become effective as of the date stated in the Schedule. The Policy Anniversary shall be one year after the effective date and annually thereafter. On each such anniversary, this Policy is renewable at the premium rates in effect at that time as notified by the Company. A notice of 30 days will be given should any premium rate be increased. Factors contributing to the increase of renewal premium are your age and your claims experience. Renewal will not be invited once you attain the maximum age limit of this product. This Policy is renewable at the option of the policyholder subject to terms, conditions and termination at each of the anniversary of the Policy date. Application for change of benefits to a higher plan can only be made on renewal and is subject to acceptance by the Company. 7. What are some of the key terms and conditions that I should be aware of? a) Duty Of Disclosure Consumer Insurance Contract Pursuant to Paragraph 5 of Schedule 9 of the Financial Services Act 2013, if you are applying for this Insurance wholly for purposes unrelated to your trade, business or profession, you have a duty to take reasonable care not to make a misrepresentation in answering the questions in the Proposal Form and you must answer the questions fully and accurately. Failure to take reasonable care in answering the questions may result in avoidance of your contract of insurance, refusal or reduction of your claim(s), change of terms or termination of your contract of insurance. You are also required to disclose any other matter that you know to be relevant to our decision in accepting the risks and determining the rates and terms to be applied. Non-Consumer Insurance Contract Pursuant to Paragraph 4(1) of Schedule 9 of the Financial Services Act 2013, if you are applying for this Insurance for purposes related to your trade, business or profession, you have a duty to disclose any matter that you know to be relevant to our decision in accepting the risks and determining the rates and terms to be applied and any matter a reasonable person in the circumstances could be expected to know to be relevant, otherwise it may result in avoidance of your contract of insurance, refusal or reduction of your claim(s), change of terms or termination of your contract of insurance. This duty of disclosure for Consumer and Non-Consumer Insurance Contract shall continue until the time the contract is entered into, varied or renewed. You also have a duty to tell us immediately if at any time after your contract of insurance has been entered into, varied or renewed with us, any of the information given in the Proposal Form is inaccurate or has changed. b) You should provide sufficient and accurate information to us or our intermediary to enable us to advise you on the Medical and Health insurance which suits your needs. c) Pre-Existing Illness Pre-existing Illness shall mean disabilities that existed before the Effective date of Insurance that the Insured Person has reasonable knowledge of. An Insured Person may be considered to have reasonable knowledge of a pre-existing condition where the condition is one for which:- the Insured Person had received or is receiving treatment; medical advice, diagnosis, care or treatment has been recommended; clear and distinct symptoms are or were evident; or its existence would have been apparent to a reasonable person in the circumstances. 3

4 d) Cooling-Off Period If this Policy shall have been issued and for any reason whatsoever the Insured Person shall decide not to take up the Policy, the Insured Person may return the Policy to the Company for cancellation provided such request for cancellation is delivered by the Insured Person to the Company within fifteen (15) days from the date of issue of the Policy. The Insured Person is entitled to Unless renewed, the coverage will cease on expiry date and the insurance company shall strictly not be liable for any expenses that take place after the expiry date. You are advised to keep the receipt as proof of payment of premium. It may not be advantageous to switch insurance policy / insurer because you may be subjected to new terms and conditions of the new policy or of the new insurer. e) Survival Period This refers to the duration of 14 days from (and including) the date of diagnosis of the Critical Illness after the Waiting Period of the Insured Person. f) Juvenile Lien Upon diagnosis of critical illness covered prior to the Insured Person attaining the age of 5 years old, the benefit payable shall be reduced by the percentage of the juvenile lien in accordance with the following table: Age attained at diagnosis Percentage of claims payable 0 to less than 2 years 20% 2 to less than 3 years 40% 3 to less than 4 years 60% 4 to less than 5 years 80% Note: This list is non-exhaustive. Please refer to the policy contract for the full list of terms and conditions under this policy. 8. What are the General Exclusions under this policy? This Policy does not cover:- The Company shall not be liable in respect of any of the Critical Illnesses directly or indirectly contributed by the following, and no Benefit shall be payable if: i. The signs or symptoms of the Critical Illnesses are manifested prior to or: (a) Within the Waiting Period of sixty (60) days for: - Angioplasty and Other Invasive Treatments for Major Coronary Artery Disease; - Cancer; - Coronary Artery By-Pass Surgery; - Heart Attack; - Other Serious Coronary Artery Disease; or (b) Within the Waiting Period of thirty (30) days for all other Critical Illnesses. ii. The Critical Illness arises from a Pre-Existing Condition which existed prior to the risk commencement date or reinstatement date of the Insured Person whichever is later. iii. The Critical Illness, which in the Company s opinion, was caused directly or indirectly by the existence of Acquired Immune Deficiency Syndrome (AIDS) or by the presence of any Human Immunodeficiency Virus (HIV) infection. The Company reserves the right to require the Insured Person to undergo a blood test for HIV as a condition precedent to acceptance of any claim. The exception is when there is Full Blown AIDS or HIV due to Blood Transfusion, as defined in the Policy. For the purpose of this Policy: a) the definition of AIDS shall be that used by the World Health Organization in 1987, or any subsequent revision by the World Health Organization of that definition; b) infection shall be deemed to have occurred when blood or other relevant test(s) indicate, in the Company s opinion, either the presence of any Human Immunodeficiency Virus or Antibodies to such Virus. iv. Any Critical Illness diagnosed due, directly or indirectly, to a Congenital Defect or Disease. v. Any Critical Illness caused by self-inflicted injury, while sane or insane. vi. Any Critical Illness resulting directly from alcohol or drug abuse. 4

5 vii. Death of the Insured Person within the Survival Period following the date of diagnosis of any Critical Illness. viii. Any Critical Illness consequent upon War or any act of war, declared or undeclared, criminal or terrorist activities, active duty in any armed forces, direct participation in strikes, riots and civil commotion or insurrection. ix. Any Critical Illness caused directly or indirectly by ionising radiation or contamination by radioactivity from any nuclear fuel or nuclear waste from process of nuclear fission or from any nuclear weapons material. x. It is condition precedent to the Company s liability that any person covered in this Policy shall not in any way, directly or indirectly, be involved in any of the following occupations or duties: a) Airline crew, Army personnel, Ship crew and/or workers on board vessels; b) Occupations involving diving, oil-rig platform and/or offshore work (non-administrative); c) Occupations involving work at heights exceeding 30 feet above ground or floor level or underground; d) Occupations involving manual work in hazardous places such as shipyard, dockyard, airplane hangar and oil refinery; and e) Doctors and/or Nurses Unless applications for coverage for such occupations from persons insured had been received and approved by the Company in writing. Note: This list is non-exhaustive. Please refer to the policy contract for the full list of exclusions under this policy. 9. What do I need to do if there are changes to my contact details? It is important that you inform us of any change in your contact details to ensure that all correspondences reach you in a timely manner. 10. How do I make a claim? By notifying us within 30 days of any occurrences and submitting the claim form, medical report, original itemised bills, receipts and other relevant claims documents. 11. Pastikan anda juga telah membaca terma dan syarat am.) 1. Apakah produk ini? Pelan ini membayar Orang Yang Diinsuranskan sejumlah amaun yang dinyatakan dalam jadual polisi jika Orang Yang Diinsuranskan itu disahkan menghidap mana-mana penyakit kritikal yang dinyatakan di dalam polisi dengan syarat Penyakit Kritikal yang dialami oleh Orang yang Diinsuranskan adalah kejadian pertama Penyakit Kritikal, tertakluk kepada Orang yang Diinsuranskan yang masih hidup tidak kurang daripada empat belas (14) hari selepas diagnosis tersebut. 2. Siapa yang layak? Semua rakyat Malaysia yang berumur 19 hingga 60 tahun dan boleh diperbaharui sehingga umur 65 tahun. Anak-anak di bawah tanggungan (bujang dan tidak bekerja) mestilah berumur 30 hari dan di bawah 19 tahun atau sehingga berumur 23 tahun bagi mereka yang masih menuntut di institusi pengajian yang diiktiraf di Malaysia. 3. Apakah perlindungan/manfaat yang diberikan? 8 Premium hendaklah dibuat sebelum perlindungan berkuatkuasa. Kadar premium adalah tidak terjamin. Faktor-faktor yang menyebabkan peningkatan premium adalah pengalaman tuntutan anda, inflasi perubatan dan pengalaman keseluruhan kami dalam pengunderaitan insurans Penyakit Kritikal. 5. Apakah yuran dan caj yang saya perlu bayar? Apa yang anda perlu bayar sebagai tambahan kepada premium Jumlah Duti Setem RM Cukai Barangan dan Perkhidmatan (CBP) 0% daripada premium Apa yang termasuk dalam premium Komisen yang dibayar kepada pengantara insurans (jika ada) Jumlah 15% daripada premium(polisi individu) 10% daripada premium (polisi kumpulan) 6. Apakah Tempoh Perlindungan dan Pilihan Pembaharuan? Polisi akan berkuatkuasa mengikut tarikh yang dinyatakan pada Jadual Polisi. Ulang Tahun Polisi adalah satu tahun selepas tarikh kuatkuasa dan setiap tahun berikutnya. Pada setiap ulang tahun, polisi boleh dibaharui pada kadar premium yang berkuatkuasa pada masa itu seperti yang diberitahu oleh Syarikat. Notis 30 hari akan diberikan sekiranya mana-mana kadar premium dinaikkan. Faktor yang menyumbang kepada peningkatan premium pembaharuan adalah umur anda dan pengalaman tuntutan anda. Pembaharuan tidak akan dijemput sekiranya anda mencapai had umur produk ini. Polisi boleh dibaharui mengikut pilihan pemegang polisi tertakluk kepada terma dan syarat dan penamatan pada setiap ulangtahun tarikh Polisi. Permohonan untuk mengubah manfaat kepada pelan yang lebih tinggi hanya boleh dilakukan pada pembaharuan dan tertakluk kepada penerimaan oleh syarikat pada masa pembaharuan. 7. Apakah terma dan syarat utama yang saya harus ketahui? Anda harus memberikan maklumat yang lengkap dan tepat kepada kami atau pengantara kami untuk membolehkan kami menasihati anda tentang Insurans Perubatan dan Kesihatan yang sesuai dengan keperluan anda. a. Kewajipan Pendedahan Kontrak Insurans Pengguna Menurut Perenggan 5 daripada Jadual 9 Akta Perkhidmatan Kewangan 2013, jika anda memohon insurans ini sepenuhnya untuk tujuan yang tidak berkaitan perdagangan, perniagaan atau profesion anda, anda mempunyai kewajipan untuk mengambil langkah yang munasabah untuk tidak salah nyata dalam menjawab soalan-soalan dalam Borang Cadangan ini. Anda dikehendaki menjawab soalan-soalan dalam Borang Cadangan ini dengan lengkap dan tepat. Kegagalan untuk mengambil langkah yang munasabah dalam menjawab soalansoalan, mungkin mengakibatkan pembatalan kontrak insurans anda, keengganan atau pengurangan gantirugi, perubahan terma atau penamatan kontrak insurans anda. Anda dikehendaki untuk mendedahkan apa-apa perkara lain yang anda tahu akan mempengaruhi keputusan kami dalam menerima risiko dan menentukan kadar dan terma yang dikenakan. Kontrak Insurans Komersial Menurut Perenggan 4(1) Jadual 9 Akta Perkhidmatan Kewangan 2013, jika anda memohon insurans ini untuk tujuan yang berkaitan dengan perdagangan, perniagaan atau profesion anda, anda berkewajipan untuk mendedahkan apa-apa perkara yang anda tahu akan mempengaruhi keputusan kami dalam menerima risiko dan menentukan kadar dan terma yang dikenakan, dan apa-apa perkara yang munasabah yang boleh dijangka, jika tidak ia boleh menyebabkan pembatalan kontrak insurans, keengganan atau pengurangan ganti rugi, perubahan terma atau penamatan kontrak insurans anda. Kewajipan pendedahan untuk Kontrak Insurans Pengguna dan Kontrak Insurans Komersial hendaklah diteruskan sehingga kontrak insurans anda dimeterai, diubah atau diperbaharui dengan kami. Anda juga mempunyai kewajipan untuk memberitahu kami dengan serta-merta jika pada bila-bila masa selepas kontrak insurans anda ditandatangani, diubah atau diperbaharui dengan kami, apa-apa maklumat yang dinyatakan dalam Borang Cadangan ini tidak tepat atau telah berubah. 3

9 b. Penyakit Sedia Ada Penyakit Sedia Ada bermaksud hilang upaya yang wujud sebelum tarikh berkuatkuasa insurans dimana Orang yang Diinsuranskan mengetahui sewajarnya. Orang yang Diinsuranskan dianggap mengetahui sewajarnya keadaan sedia ada itu apabila:- Orang yang Diinsuranskan telah atau sedang menerima rawatan; nasihat perubatan, diagnosis, jagaan atau rawatan telah disyorkan; gejala yang jelas dan tepat atau telah dilihat dengan nyata; atau Kewujudannya dapat diperhatikan dengan jelas bagi orang yang mengalami keadaan itu. c. Tempoh Ihsan Jika Polisi ini telah dikeluarkan dan atas apa-apa alasan, Orang yang Diinsuranskan membuat keputusan untuk tidak mengambil Polisi itu, Orang yang Diinsuranskan itu boleh mengembalikan Polisi itu kepada Syarikat untuk pembatalan dengan syarat permohonan untuk pembatalan diserahkan oleh Orang yang Diinsuranskan kepada Syarikat dalam tempoh lima belas (15) hari dari tarikh pengeluaran Polisi. Orang yang Diinsuranskan itu layak menerima pulangan penuh premium yang telah dibayar tolak perbelanjaan perubatan yang ditanggung oleh Syarikat untuk mengeluarkan Polisi tersebut. Perlindungan akan tamat pada tarikh luput dan syarikat insurans tidak akan bertanggungjawab terhadap sebarang perbelanjaan yang terlibat melainkan jika polisi diperbaharui. Anda dinasihatkan supaya menyimpan resit sebagai bukti pembayaran premium. Penukaran polisi insurans atau syarikat insurans mungkin tidak membawa manfaat kerana anda mungkin tertakluk kepada terma dan syarat baru yang dikenakan oleh polisi baru atau syarikat insurans baru. d. Tempoh Hayat Ertinya tempoh 14 hari dari dan termasuk tarikh diagnosis Penyakit Kritikal selepas Tempoh Menunggu. e. Lien Juvenil Apabila didiagnosis menghidap Penyakit Kritikal yang dilindungi sebelum Orang yang Diinsuranskan mencapai umur 5 tahun, manfaat yang terbayar akan dikurangkan mengikut peratusan Lien Juvenil seperti yang ditunjukkan dijadual dibawah: Umur semasa didiagnosis Peratusan daripada jumlah yang dibayar 0 hingga kurang daripada 2 tahun 20% 2 hingga kurang daripada 3 tahun 40% 3 hingga kurang daripada 4 tahun 60% 4 hingga kurang daripada 5 tahun 80% Nota: Senarai ini bukannya senarai yang lengkap. Sila rujuk kepada kontrak polisi untuk senarai penuh bagi terma dan syarat di bawah polisi ini. 7. Apakah pengecualian utama di bawah polisi ini? Polisi ini tidak melindungi:- Syarikat tidak akan bertanggungjawab terhadap mana-mana daripada penyakit kritikal yang secara langsung atau tidak langsung disumbangkan oleh yang berikut, dan tidak Manfaat akan dibayar sekiranya : i. Tanda-tanda atau gejala Penyakit Kritikal ditunjukkan sebelum atau : (a) Dalam Tempoh Menunggu enam puluh ( 60 ) hari untuk : - Angioplasti dan Rawatan Pembedahan Lain untuk Penyakit Major Arteri Koronari ; - Kanser ; - Pembedahan Bypass Arteri Koronari; - Serangan Jantung; - Lain-lain Penyakit Arteri Koronari yang serius; atau (b) Dalam Tempoh Menunggu tiga puluh (30) hari untuk semua penyakit kritikal yang lain. ii. Penyakit Kritikal berlaku daripada Keadaan Sedia Ada yang wujud sebelum tarikh permulaan risiko atau tarikh pengembalian semula bagi Orang yang Diinsuranskan yang mana kemudian. 4

Penyakit Kritikal, yang pada pendapat Syarikat, telah disebabkan secara langsung atau tidak langsung oleh kewujudansindrom Kurang Daya Tahan Penyakit (AIDS) atau dengan kehadiran mana-mana Virus Kurang Daya Tahan Penyakit ( HIV).Syarikat mempunyai hak untuk meminta Orang yang Diinsuranskan untuk menjalani ujian darah bagi HIV sebagai syaratduluan kepada penerimaan apa-apa tuntutan. Pengecualian adalah apabila terdapat Full Blown AIDS atau HIV akibat pemindahan darah, seperti yang ditakrifkan di dalam Polisi. Untuk tujuan Polisi ini : a) definisi untuk AIDS hendaklah sebagaimana yang digunakan oleh Organisasi Kesihatan Sedunia pada 1987, atau apa-apa semakan selepas itu oleh Organisasi Kesihatan Sedunia untuk definisi tersebut; b) jangkitan hendaklah dianggap terjadi apabila darah atau ujian lain yang berkaitan menunjukkan, pada pendapat Syarikat, sama ada kehadiran mana-mana Virus Kurang Daya Tahan Penyakit atau Antibodi untuk virus sedemikian. iv. Sebarang Penyakit Kritikal didiagnosis disebabkan, secara langsung atau tidak langsung, kepada Penyakit atau PenyakitKongenital v. Sebarang Penyakit Kritikal yang disebabkan oleh kecederaan diri sendiri yang disengajakan, ketika waras atau tidak waras. vi. Sebarang Penyakit Kritikal yang berpunca secara langsung daripada alkohol atau penyalahgunaan dadah. vii. Kematian Orang Yang Diinsuranskan dalam Tempoh hayat selepas tarikh diagnosis sebarang Penyakit Kritikal. vii. Sebarang Penyakit Kritikal akibat daripada Peperangan atau sebarang tindakan perang, diisytiharkan atau tidak diisytiharkan,aktiviti jenayah atau pengganas, bergiat cergas dalam manamana angkatan bersenjata, penyertaan secara langsung dalam mogok, rusuhan dan kekecohan awam atau pemberontakan. ix. Sebarang Penyakit Kritikal yang disebabkan secara langsung atau tidak langsung oleh radiasi pengionan atau pencemaran radioaktif daripada apa-apa bahan api nuklear atau sisa nuklear daripada proses pembelahan nuklear atau daripada apa-apa bahan senjata nuklear. x. Ia adalah syarat terdahulu kepada liabiliti Syarikat bahawa mana-mana orang yang dilindungi di dalam Polisi ini hendaklahtidak dalam apa-apa cara, secara langsung atau tidak langsung, terlibat dalam apa-apa pekerjaan atau tugas-tugas berikut: a) anak-anak kapal Syarikat Penerbangan, anggota Tentera, anak-anak kapal dan / atau pekerja atas kapal; b) Pekerjaan yang melibatkan menyelam, platform pelantar minyak dan / atau kerja luar pesisir ( bukan pentadbiran ); c) Pekerjaan yang melibatkan kerja-kerja pada ketinggian melebihi 30 kaki di atas tanah atau lantai aras atau bawah tanah; d) Pekerjaan yang melibatkan kerja manual di tempat-tempat berbahaya seperti limbungan kapal, limbungan, bangsal kapal terbang dan kilang penapisan minyak; dan e) Doktor dan / atau Jururawat. Kecuali permohonan perlindungan untuk pekerjaan itu daripada orang yang diinsuranskan telah diterima dan diluluskan oleh Syarikat secara bertulis. Nota: Senarai ini bukannya senarai yang lengkap. Sila rujuk kepada kontrak polisi untuk senarai penuh bagi pengecualian di bawah polisi ini. 8. Bolehkah saya membatalkan polisi saya? Anda boleh membatalkan polisi dengan memberikan notis bertulis kepada pihak kami dengan syarat tiada tuntutan dibuat dalam tahun polisi semasa. Anda akan menerima bayaran balik premium selepas ditolak premium dikenakan pada kadar jangka pendek syarikat bagi tempoh polisi yang telah berkuatkuasa. 9.
