1 MACHINERY INSURANCE Product Disclosure Sheet (Please read this Product Disclosure Sheet before you decide to take out this insurance. Be sure to also read the general terms and conditions.) 1. What is this product about? This policy provides insurance cover for plant, machinery and mechanical equipment at work, at rest or during maintenance operations. 2. What are the covers / benefits provided? This policy provides cover against unforeseen and sudden physical loss or damage to machines from cases such as defects in casting and material, faulty design, faults at workshop or in erection, band workmanship, lack of skill, carelessness, shortage of water in boiler, physical explosion, tearing apart on account of centrifugal force, short circuit, storm or from any other cause not specifically excluded. 3. What is the Period of Cover and Renewal Option? Duration of cover is usually for one year. You need to renew your insurance policy annually. 4. How much premium do I have to pay? The premium you have to pay may vary depending on the sum insured, occupation or nature of business, building construction, insured property, claims experience etc. Sum Insured : RM Rate applicable : % The estimated total premium : RM 5. What are the fees and charges I have to pay? What are some of the key terms and conditions that I should be aware of? a) DUTY OF DISCLOSURE Pursuant to Paragraph 4(1) of Schedule 9 of the Financial Services Act 2013, if you are applying for this Insurance for a purpose related to your trade, business or profession, you have a duty to disclose any matter that you know to be relevant to our decision in accepting the risks and determining the rates and terms to be applied and any matter a reasonable person in the circumstances could be expected to know to be relevant, otherwise it may result in avoidance of your contract of insurance, refusal or reduction of your claim(s), change of terms or termination of your contract of insurance. The above duty of disclosure shall continue until the time your contract of insurance is entered into, varied or renewed with us. You also have a duty to tell us immediately if at any time after your contract of insurance has been entered into, varied or renewed with us any of the information given in the Proposal Form (or when you applied for this insurance) is inaccurate or has changed. b) You must ensure that your sum insured always be the New Replacement Value of the machinery. This includes the value of the new items, customs duties, transportations and erection costs. c) If the sum insured is less than the amount required to be insured at the time of loss (i.e. under-insurance), you are deemed to be self-insuring the difference. The average condition will apply in the event of a claim. Every item if more than one shall be subject to this condition separately. d) Contribution condition If at the time any claim arises under the Policy there is any other insurance covering the same loss, damage or liability, we shall not be liable to pay or contribute more than its rateable proportion of any claim for such loss, damage or liability. 2 e) GOODS AND SERVICES TAX (GST) CLAUSE - Please ensure that you have taken consideration of this GST when you decide on the amount to be insured in your policy: GST CLAUSE The amount of premium payable by You for this Policy includes an amount on account of the GST on the premium. When We pay a claim, Your GST status will determine the amount We pay. When You are: (a) Non-GST registered person, We will pay in full (including 6% GST) up to sum insured/limit of liability or the other limits of insurance cover. (b) GST registered person, We will pay (excluding 6% GST) up to sum insured/limit of liability or the other limits of insurance cover. You are to claim Your Input Tax Credit entitlement from the Royal Malaysian Customs Department directly. You must advise Us of Your correct entitlement to an Input Tax Credit on Your Premium and the correct entitlement to an Input Tax Credit on each item of the property to be insured. Definitions under the Section on Glossary:- GST means goods and services tax and has the meaning assigned to it in the Goods and Services Tax Act 2014 ( GST Act ). Registered person means a person who is registered under Part IV of the GST Act and a non registered person shall mean a person who is not registered under the GST Act. Input Tax means the GST incurred on any purchase or acquisition of goods and services by a taxable person for the purpose of making a taxable supply in the course or furtherance of business. Input Tax Credit means the input tax claimable by a registered person. Note: This list is non-exhaustive. Please refer to the policy contract for the full list of terms and conditions under this policy. 7. What are the major exclusions under this policy? This policy does not cover losses, such as:- a) Loss or damage to exchangeable tools, machinery parts which suffer a high rate of wear and tear. b) Loss or damage as a direct consequence of the continual influence of operation. c) Loss or damage due to fire and allied perils, flood, collapse of building, landslide. d) Loss or damage for which a supplier, contractor or repairer is responsible either by law or under contract. e) Consequential loss or liability of any kind. f) War and kindred risks. g) Consequence of nuclear reaction, nuclear radiation or radioactive contamination. Note: This list is non-exhaustive. Please refer to the policy contract for the full list of exclusions under this policy. 8. Can I cancel my policy? You may cancel your policy at any time by giving written notice to us. Upon cancellation, any refund premium would be based on the conditions as stated in the policy contract. 9. What do I need to do if there are changes to my contact details? It is important that you inform us if there are changes in your contact details to ensure that all future correspondences reach you in a timely manner. 10. Where can I get further information? Apakah perlindungan / faedah yang disediakan? Polisi ini memberikan perlindungan terhadap kerugian fizikal yang tidak dijangka dan secara tiba-tiba atau kerosakan kepada mesin-mesin dari kes-kes seperti kecacatan dalam tuangan dan bahan, reka bentuk bermasalah, kesilapan di bengkel atau semasa pembinaan, hasil kerja buruk, kekurangan kemahiran, kecuaian, kekurangan air dalam dandang, letupan fizikal, lusuhan disebabkan daya emparan, litar pintas, ribut atau daripada apa-apa sebab lain yang tidak dinyatakan secara khusus. 3. Apakah Tempoh Perlindungan dan Pembaharuan Pilihan? Tempoh perlindungan biasanya selama satu tahun. Anda perlu memperbaharui polisi insurans anda setiap tahun. 4. Berapakah premium yang saya perlu bayar? Premium yang anda perlu bayar mungkin berbeza bergantung kepada jumlah yang diinsuranskan, pekerjaan atau jenis perniagaan, pembinaan bangunan, harta yang diinsuranskan, pengalaman tuntutan dan lain-lain. Apakah terma dan syarat utama yang saya harus ketahui? a) KEWAJIPAN PENDEDAHAN Menurut Perenggan 4(1) Jadual 9 Akta Perkhidmatan Kewangan 2013, jika anda memohon insurans ini untuk tujuan yang berkaitan dengan perdagangan, perniagaan atau profesion anda, anda berkewajipan untuk mendedahkan apa- 3 apa perkara yang anda tahu akan mempengaruhi keputusan kami dalam menerima risiko dan menentukan kadar dan terma yang dikenakan dan apa-apa perkara yang munasabah yang boleh dijangka, jika tidak ia boleh menyebabkan pembatalan kontrak insurans, keengganan atau pengurangan ganti rugi, perubahan terma atau penamatan kontrak insurans anda. Kewajipan pendedahan diatas hendaklah diteruskan sehingga kontrak insurans anda dimeterai, diubah atau diperbaharui dengan kami. b) Anda perlu memastikan bahawa jumlah yang diinsuranskan sentiasa bersamaan Nilai Penggantian Baru kepada jentera. Ini termasuk nilai barang-barang yang baru, duti kastam, pengangkutan dan kos pembinaan. c) Jika jumlah diinsuranskan yang dinyatakan dalam Jadual kurang daripada amaun yang dikehendaki untuk diinsuranskan pada masa berlakunya kerugian (iaitu terkurang insurans), anda dianggap menginsuranskan diri sendiri untuk perbezaannya. Syarat purata akan diguna apabila tuntutan dibuat. d) Syarat Caruman - Jika ketika berlaku sebarang tuntutan di bawah Polisi ini dan terdapat insurans lain yang melindungi kerugian, kerosakan atau liabiliti yang sama, kami tidak akan bertanggungjawab untuk membayar atau menyumbang lebih daripada perkadaran setimpal bagi sebarang tuntutan bagi kerugian, kerosakan atau liabiliti tersebut. 5 e) Fasal Cukai Barangan dan Perkhidmatan (CBP) - Sila pastikan bahawa anda telah mengambil pertimbangan CBP ini apabila anda membuat keputusan mengenai jumlah yang diinsuranskan dalam polisi anda: FASAL CBP Jumlah premium yang perlu dibayar oleh Anda bagi Polisi ini termasuk jumlah CBP yang dikenakan pada premium. Status CBP Anda akan menentukan jumlah Kami bayar keatas tuntutan. Apabila Anda adalah: (a) orang tidak berdaftar dibawah CBP, Kami akan membayar sepenuhnya (termasuk 6% CBP) sehingga kepada jumlah diinsuranskan / had liabiliti atau had lain perlindungan insurans. (b) orang berdaftar dibawah CBP, Kami akan membayar (tidak termasuk 6% CBP) sehingga jumlah diinsuranskan / had liabiliti atau had lain perlindungan insurans. Anda hendaklah menuntut secara langsung Kredit Cukai Input yang layak daripada Jabatan Kastam Diraja Malaysia. Anda hendaklah memaklumkan kepada Kami kelayakan Kredit Cukai Input Anda yang betul atas Premium Anda dan kelayakan Kredit Cukai Input yang betul pada setiap item harta yang diinsurans. GLOSARI:- CBP" bermaksud cukai barangan dan perkhidmatan dan mempunyai erti yang diberikan kepadanya dalam Akta Cukai Barangan dan Perkhidmatan 2014 ("Akta CBP"). "Orang berdaftar" bermaksud seseorang yang didaftarkan di bawah Bahagian IV Akta CBP dan orang tidak berdaftar bermaksud seseorang yang tidak didaftarkan di bawah Akta CBP. "Cukai Input" bermaksud CBP yang ditanggung ke atas sebarang pembelian atau perolehan barangan dan perkhidmatan oleh orang yang dikenakan cukai bagi maksud membuat suatu pembekalan bercukai bagi meneruskan perniagaan. "Kredit Cukai Input" bermaksud cukai input yang boleh dituntut oleh orang berdaftar. Nota: Senarai ini bukannya senarai yang lengkap. Sila rujuk kepada kontrak polisi untuk senarai penuh bagi terma dan syarat di bawah polisi ini. 7. Apakah pengecualian utama di bawah polisi ini? Polisi ini tidak melindungi kerugian tertentu seperti: a) Kerugian atau kerosakan kepada alat boleh ditukarkan, bahagian-bahagian jentera yang mengalami kadar yang tinggi haus dan lusuh. b) Kerugian atau kerosakan akibat langsung daripada pengaruh berterusan operasi. c) Kerugian atau kerosakan disebabkan oleh kebakaran dan peril-peril berkenaan, banjir, keruntuhan bangunan, tanah runtuh. d) Kerugian atau kerosakan dimana pembekal, kontraktor atau pembaiki bertanggungjawab sama ada oleh undangundang atau di bawah kontrak. e) Kerugian turutan atau liabiliti dalam apa jua bentuk atau perihalan f) Perang dan risiko berkaitan g) Akibat tindak balas nuklear, radiasi nuklear atau pencemaran radioaktif Nota: Senarai ini bukannya senarai yang lengkap. Sila rujuk kepada kontrak polisi untuk senarai penuh bagi pengecualian di bawah polisi ini. 8. Bolehkah saya membatalkan polisi saya? Anda boleh membatalkan polisi anda pada bila-bila masa dengan memberi notis bertulis kepada kami. Selepas pembatalan, sebarang bayaran balik premium akan berdasarkan pada syarat-syarat seperti yang dinyatakan dalam kontrak polisi. 9. Apakah yang harus saya lakukan jika terdapat perubahan dalam butiran peribadi saya?
