1 MARINE CARGO INSURANCE Product Disclosure Sheet (Please read this Product Disclosure Sheet before you decide to take out this insurance. Be sure to also read the general terms and conditions.) 1. What is this product about? Marine Cargo insurance covers the transportation of goods from one place to another by sea, air or land against loss of or damage caused by a wide range of perils. 2. What are the covers / benefits provided? Marine Cargo insurance covers the risks of loss of or damage to the goods insured during transportation. The most commonly used clauses are:- Institute Cargo Clauses (C) Coverage available: Fire or explosion Vessel or craft being stranded, grounded, sunk or capsized Overturning or derailment of land conveyance Collision or contact of vessel, craft or conveyance with any external object other than water Discharge of cargo at a port of distress General average sacrifice Jettison Institute Cargo Clauses (B) Coverage of Institute Cargo Clauses (C) above plus: Earthquake, volcanic eruption or lightning Washing overboard Entry of sea, lake or river water into vessel craft hold, conveyance, container or place of storage Total loss of any package lost overboard or dropped whilst loading onto, or unloading from, vessel or craft Institute Cargo Clauses (A) Coverage of Institute Cargo Clauses (B) above plus accidental damage unless excluded under the Exclusion Clause Extension War as provided in the Institute War Clauses (Cargo) and Strikes as provided in the Institute Strikes Clauses (Cargo) are extensions cover in conjunction with the same Shipment. 3. What is the Period of Cover and Renewal Option? Insurance effected under Institute Cargo Clause commences when the goods are first moved in the warehouse or at the place of storage for the purpose of the immediate loading into or onto the carrying vehicle or other conveyance for the commencement of transit, continues during the ordinary course of transit and terminates either on completion of unloading from the carrying vehicle or other conveyance in or at the final warehouse or place of storage at the destination named in the contract of insurance, on completion of unloading from the carrying vehicle or other conveyance in or at any other warehouse or place of storage, whether prior to or at the destination named in the contract of insurance, which the Assured or their employees elect to use either for storage other than in the ordinary course of transit or for allocation or distribution, or when the Assured or their employees elect to use any carrying vehicle or other conveyance or any container for storage other than in the ordinary course of transit or on the expiry of 60 days after completion of discharge overside of the subject-matter insured from the oversea vessel at the final port of discharge, whichever shall first occur. 2 4. How much premium do I have to pay? The premium that you have to pay may vary depending on the description of the goods, method of packing, vessel used, claim experience, destination, amount insured. The premium rate is applied to the insured value Sum Insured : RM Rate applicable : % The estimated total premium that you have to pay is : RM 5. What are the fees and charges I have to pay? What you have to pay in addition to the premium Amount Goods and Services Tax (GST) 6% of premium Stamp Duty RM What is included in the premium Commission paid to the insurance intermediaries (if any) Amount Up to 15% of premium 6. What are some of the key terms and conditions that I should be aware of? a) DUTY OF DISCLOSURE Consumer Insurance Contract Pursuant to Paragraph 5 of Schedule 9 of the Financial Services Act 2013, if you are applying for this Insurance wholly for purposes unrelated to your trade, business or profession, you have a duty to take reasonable care not to make a misrepresentation in answering the questions in the Proposal Form and you must answer the questions fully and accurately. Failure to take reasonable care in answering the questions may result in avoidance of your contract of insurance, refusal or reduction of your claim(s), change of terms or termination of your contract of insurance. You are also required to disclose any other matter that you know to be relevant to our decision in accepting the risks and determining the rates and terms to be applied. Non Consumer Insurance Contract Pursuant to Paragraph 4(1) of Schedule 9 of the Financial Services Act 2013, if you are applying for this Insurance for purposes related to your trade, business or profession, you have a duty to disclose any matter that you know to be relevant to our decision in accepting the risks and determining the rates and terms to be applied and any matter a reasonable person in the circumstances could be expected to know to be relevant, otherwise it may result in avoidance of your contract of insurance, refusal or reduction of your claim(s), change of terms or termination of your contract of insurance. This duty of disclosure for Consumer and Non-Consumer Insurance Contract shall continue until the time the contract is entered into, varied or renewed. You also have a duty to tell us immediately if at any time after your contract of insurance has been entered into, varied or renewed with us, any of the information given in the Proposal Form is inaccurate or has changed. b) Excess - An excess is the amount which you will have to pay when you make a claim under your policy. Any excess which may apply to your policy will be deducted from any payments we make on your claim. c) You must inform us if the goods insured is shipped on deck and not put in containers. Otherwise, it is understood that the goods are shipped under deck. d) Conditions of Goods - Please be advice that if the goods insured are used/ second-hand. Otherwise, it is understood that the goods insure are brand new. e) Claims Experience - Please be advice that the claims experience is important for underwriting consideration during the risk assessment. Note: This list is non-exhaustive. Please refer to the policy contract for the full list of terms and conditions under this policy. 2

3 7. What are the major exclusions under this policy? This policy does not cover:- Loss damage or expense attributable to wilful misconduct of the Assured Ordinary leakage, loss in weight or volume, or ordinary wear and tear of the subject matter insured Loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject matter insured; Loss damage or expense caused by Inherent vice or nature of the subject matter insured Loss damage or expense arising from unseaworthiness of vessel or craft, unfitness of vessel, craft, container or conveyance for the safe carriage of the subject-matter insured Loss damage or expense caused by delay, even though the delay be caused by a risk insured against Loss damage or expense caused by insolvency or financial default of the owners, managers, charterers or operators of the vessel Deliberate damage to or deliberate destruction of the subject matter insured or any part thereof by the wrongful act of any person or persons Loss damage or expense directly or indirectly caused by or arising from the use of any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter War & Strikes Note : This list is non-exhaustive. Please refer to the policy contract for the full list of exclusions under this policy. 8. Can I cancel my policy? You may cancel your policy by giving written notice to be substantiated with evidence that the shipment has been cancelled by buyer/supplier to the insurance company. Upon cancellation, you are entitled to a refund premium. 9. What do I need to do if there are changes to my contact details? It is important that you inform us if there are changes in your contact details to ensure that all future correspondences reach you in a timely manner. 10. Where can I get further information? Pastikan anda juga telah membaca terma dan syarat am.) 1. Apakah produk ini? Insurans Kargo Marin melindungi pengangkutan barang-barang dari satu tempat ke tempat lain melalui laut, udara atau darat terhadap kehilangan atau kerosakan yang disebabkan oleh pelbagai bahaya. 2. Apakah perlindungan/faedah yang disediakan? Insurans Kargo Marin melindungi risiko kerugian atau kerosakan kepada barangan yang diinsuranskan semasa pengangkutan. Fasal yang paling umum digunakan ialah: - Institute Cargo Clauses (C) Pelindungan yang disediakan: Kebakaran atau letupan Kapal atau kraf terkandas, tersadai, tenggelam atau terbalik Pengangkutan darat yang terbalik atau terbabas, Perlanggaran atau sentuhan kapal,kraf atau kenderaan dengan objek luaran selain daripada air Pemunggahan kargo dari kapal di pelabuhan yang berlaku kekecohan Pengorbanan purata am Pembuangan muatan bagi mengurangkan bebanan kapal Institute Cargo Clauses (B) Liputan Institute Cargo Clauses (C) di atas serta: Gempa bumi, letupan gunung berapi atau kilat Terjatuh ke laut akibat badai Kemasukan air laut, tasik atau sungai ke dalam kapal kraf memegang, alat pengakutan, kontena atau tempat simpanan Jumlah keseluruhan mana-mana pakej hilang ke laut atau terjatuh semasa memuatkan ke dalam atau pemunggahan dari kapal atau kraf. Institute Cargo Clauses (A) Liputan Institute Cargo Clauses (B) di atas serta dengan kerosakan yang tidak disengajakan melainkan dikecualikan di bawah Fasal Pengecualian. Lanjutan Perang yang diperuntukkan dalam Institute War Clauses (Cargo) dan mogok seperti yang diperuntukkan dalam Institute Strikes Clauses (Cargo) adalah lanjutan meliputi semasa penghantaran yang sama. 3. Apakah Tempoh Perlindungan dan Pembaharuan Pilihan? Institute Cargo Clauses Perlindungan bermula apabila barangan itu mula berpindah di dalam gudang atau di tempat penyimpanan untuk tujuan memuatkan serta-merta ke dalam atau kepada kenderaan yang membawa atau kenderaan lain untuk memulakan transit, sambung semasa perjalanan biasa transit dan berakhir sama ada : Apabila selesainya pemunggahan dari kenderaaan barangan atau kenderaaan lain di atau pada gudang terakhir atau tempat penyimpanan di destinasi dinamakan dalam polisi ini. Apabila selesainya pemuggahan dari kenderaaan barangan atau kenderaan lain di atau pada mana-mana gudang atau tempat penyimpanan yang lain, sama ada sebelum atau di destinasi dinamakan dalam polisi ini yang mana dipilih untuk diguna oleh Pihank Yang Diinsuranskan atau perkerja mereka sama ada untuk disimpan selain daripada dalam perjalanan transit biasa atau untuk pembahagian atau pengedaran atau Apabila Pihak Yang Diinsuranskan atau perkerja mereka memilih untuk mengguna mana-mana kenderaan barangan atau kenderaan lain bagi mana-mana kontena untuk penyimpanan selain daripada dalam perjalanan transit biasa atau Apabila tamatnya 60 hari selepas selesainya pemuggahan subjek berkenaan diinsuranskan dari kapal luar negeri yang tiba ke pelabuhan pemunggahan terakhir. 5 4. Berapakah premium yang saya perlu bayar? Premium yang anda perlu bayar mungkin berbeza bergantung kepada perihal barang-barang, kaedah pembungkusan, vesel yang digunakan, pengalaman tuntutan, destinasi, jumlah diinsuranskan. Kadar premium digunakan untuk jumlah yang diinsuranskan. Jumlah Diinsuranskan : RM Kadar yang dikenakan : % Anggaran jumlah premium yang perlu anda bayar ialah : RM 5. Apakah yuran dan caj yang saya perlu bayar? Apa yang anda perlu bayar sebagai tambahan kepada premium Jumlah Cukai Barangan dan Perkhidmatan (CBP) 6% daripada premium Duti Setem RM Apa yang termasuk dalam premium Komisen yang dibayar kepada pengantara insurans (jika ada) Jumlah Sehingga 15% daripada premium 6. Apakah terma dan syarat utama yang saya harus ketahui? a) KEWAJIPAN PENDEDAHAN Kontrak Insurans Pengguna Menurut Perenggan 5 daripada Jadual 9 Akta Perkhidmatan Kewangan 2013, jika anda memohon insurans ini sepenuhnya untuk tujuan yang tidak berkaitan perdagangan, perniagaan atau profesion anda, anda mempunyai kewajipan untuk mengambil langkah yang munasabah untuk tidak salah nyata dalam menjawab soalan-soalan dalam Borang Cadangan ini. Anda dikehendaki menjawab soalan-soalan dalam Borang Cadangan ini dengan lengkap dan tepat. Kegagalan untuk mengambil langkah yang munasabah dalam menjawab soalan-soalan, mungkin mengakibatkan pembatalan kontrak insurans anda, keengganan atau pengurangan gantirugi, perubahan terma atau penamatan kontrak insurans anda. Anda dikehendaki untuk mendedahkan apa-apa perkara lain yang anda tahu akan mempengaruhi keputusan kami dalam menerima risiko dan menentukan kadar dan terma yang dikenakan. Kontrak Insurans Komersial Menurut Perenggan 4(1) Jadual 9 Akta Perkhidmatan Kewangan 2013, jika anda memohon insurans ini untuk tujuan yang berkaitan dengan perdagangan, perniagaan atau profesion anda, anda berkewajipan untuk mendedahkan apaapa perkara yang anda tahu akan mempengaruhi keputusan kami dalam menerima risiko dan menentukan kadar dan terma yang dikenakan, dan apa-apa perkara yang munasabah yang boleh dijangka, jika tidak ia boleh menyebabkan pembatalan kontrak insurans, keengganan atau pengurangan ganti rugi, perubahan terma atau penamatan kontrak insurans anda. Kewajipan pendedahan untuk Kontrak Insurans Pengguna dan Kontrak Insurans Komersial hendaklah diteruskan sehingga kontrak insurans anda dimeterai, diubah atau diperbaharui dengan kami. Anda juga mempunyai kewajipan untuk memberitahu kami dengan serta-merta jika pada bila-bila masa selepas kontrak insurans anda ditandatangani, diubah atau diperbaharui dengan kami, apa-apa maklumat yang dinyatakan dalam Borang Cadangan ini tidak tepat atau telah berubah. b) Lebihan - Polisi ini mungkin tertakluk kepada lebihan. Lebihan adalah jumlah yang anda perlu menbayar apabila anda membuat tuntutan di bawah polisi anda. Sebarang lebihan yang boleh dikenakan kepada polisi anda akan ditolak daripada mana-mana pembayaran yang kami buat pada tuntutan anda. c) Anda dikehendaki memaklumkan pihak kami jika barangan diinsuranskan diangkut di atas geladak dan bukannya dalam kontena. Jika tidak, ia akan difahamkan bahawa barangan diinsuranskan diangkut dalam geladak. d) Keadaan Barangan - Sila memberitahu bahawa jika barangan yang diinsuranskan adalah barangan terpakai. Jika tidak, ia difahami bahawa barang diinsuranskan adalah baru. e) Pengalaman Tuntutan - Harap maklum bahawa pengalaman tuntutan adalah penting untuk pertimbangan pengunderaitan dalam penilaian risiko. 6 7. Apakah pengecualian utama di bawah polisi ini? Polisi ini tidak melindungi: Kerugian, kerosakan atau perbelanjaan yang disebabkan oleh salah laku sengaja daripada Pihak Yang Diinsuranskan Kebocoran biasa, kehilangan berat atau jisim biasa, kehausan dan keusangan biasa pada subjek yang diinsuranskan Kerugian, kerosakan atau perbelanjaan yang disebabkan oleh ketidakcukupan atau ketidaksesuaian pembungkusan atau persediaan pada subject diinsuranskan. Kerugian, kerosakan atau perbelanjaan yang disebabkan oleh keburukan sedia ada atau sifat subjek yang diinsuranskan Kerugian, kerosakan atau perbelanjaan yang timbul dari ketidaksesuaian kapal atau kraf untuk belayar dan ketidaklayakan kapal, kraf, kontena atau kenderaan untuk mengangkut subjek diinsuranskan Kerugian, kerosakan atau perbelanjaan disebabkan oleh kelewatan walaupun disebabkan oleh risiko yang diinsuranskan Kerugian, kerosakan atau perbelanjaan yang disebabkan oleh ketaksolvenan atau keingkaran kewangan oleh pemilik pengurus penyewa atau pengendali kapal Kerosakan yang disengajakan atau pemusnahan subjek yang diinsuranskan Kerugian, kerosakan atau perbelanjaan timbul dari penggunaan mana-mana senjata atau peralatan perang yang menggunakan pembelahan atom atau nuclear dan/atau gabungannya atau lain-lain reaksi yang serupa ataur kekuatan atau bahan radioaktif.
