1 City f Glden Cuncil Memrandum T: Frm: Thrugh: The Hnrable Mayr and City Cuncil Dan Hartman, Public Wrks Directr Jasn Slwinski, City Manager Date: December 3, 2015 Subject: IGA amendment with CDOT - US 6 and 19 th interchange Backgrund: The city apprved an Intergvernmental Agreement (IGA) with CDOT in May f 2014 t accept RAMP funding and prceed with design f the US 6 and 19 th Street. That agreement set bligatins and respnsibilities fr the prject. As we have prceeded with design we have accumulated a number f additins, clarificatins and changes that need t be adpted in an amendment t the IGA. The amendment restates sme f the items, which have already been cmpleted, and things that are in prcess. Things that have been cmpleted: Cmpletin f IGA with CDOT Cnsultant selectin apprval CMGC selectin Public input meetings Preliminary Design and review with CDOT and FHWA Final Design apprval and determinatin f cmpliance with all apprpriated design standards and requirements Submissin and apprval f traffic cntrl and phasing plan t CDOT Things that were ur bligatin in the riginal IGA which are in prcess: CMGC subcntractr bids and submissin f Guaranteed Maximum Price ( GMP ) Apprval f bids and GMP by City and CDOT Things that this amendment clarifies: Ownership/Maintenance respnsibility

2 Snw plwing Envirnmental dcumentatin Things that this amendment changes Cnstructin materials testing (this was riginal ging t be dne by CDOT) Adds a requirement that is we change things n the lid in the future we must have a structural engineering analysis and review and cncurrence t the change by CDOT Fiscal Impact: There will be cst assciated with the City cntracting with a Engineering firm t d cnstructin management, materials and cmpliance testing, but it is within the prject budget, and will likely cst less than having DCOT materials d the testing. Cmmunity Impact There is n cmmunity impact

3 RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GOLDEN APPROVING AN AMENDMENT TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF GOLDEN AND THE COLORADO DEPARTMENT OF TRANSPORTATION TO DEFINE THE RESPONSIBILITIES OF EACH PARTY UNDER THE RAMP PROJECT FOR CONSTRUCTION OF AN INTERCHANGE AT US 6 AND 19 TH STREET WHEREAS; the City f Glden and the Clrad Department f Transprtatin CDOT have cncluded a Memrandum f Understanding abut imprvements alng the US 6 and SH 93 crridr; and WHEREAS; the City has been granted a Respnsible Acceleratin f Maintenance and Partnerships (RAMP) grant f $20 millin fr cnstructin f an interchange at US 6 and 19 th Street; and WHEREAS; the City has budgeted and cmmitted $4 millin dllars t the prject; and WHEREAS; the Clrad Schl f Mines has cmmitted t the City by separate agreement $1 millin fr the prject; and WHEREAS; the City and CDOT entered int an Inter Gvernmental Agreement thrugh Reslutin 2344 which define respnsibilities each party has under the RAMP prject; and WHEREAS; intersectin, and the City and CDOT have cmpleted the design and pricing fr cnstructin f the WHEREAS; the City and CDOT want t amend the IGA t clarify wnership, maintenance and cnstructin respnsibilities. Therefre, be it reslved by the City Cuncil f the City f Glden, Clrad: 1. That the City Of Glden agrees with the amendments t the IGA, and apprves the city signing the amendment. 2. The amendments t the Intergvernmental Agreement between the Clrad Department f Transprtatin and the City f Glden are apprved in substantially the frm as attached heret. 5 Reslutin N Page US 6 and 19 th Street Interchange IGA Scpe f Wrk Amendment US 6 and 19 th St. Intersectin Grade Separatin Prject Descriptin: The prject will prvide a grade separated interchange at the intersectin f US Highway 6 and 19 th Street in the City f Glden at abut US Highway 6 MP 273. The prject will lwer US 6 and cnstruct a bridge ver it, with cnnecting ramps t 19 th Street. The prject will include a significant prtin f bridge that will be dedicated t cmmunity cnnectivity fr pedestrians, bikes and will prvide a calm park like cnnectin. The prject will als prvide any needed nise mitigatin that will be needed t meet the 55dB standard f the city. The interchange als represents a speed limit transitin pint frm 55mph t 45mph traveling westbund n US 6. Currently US 6 has 4 thrugh lanes, but the bridge will be designed t accmmdate the pssibility f tw additinal lanes, ne in each directin in the future. The prject will include public input meetings regarding design, and will seek significant cmmunity and stakehlder input n design f ramp intersectins with 19 th street, pedestrian and bike cnnectivity, livability cmpnents and general aesthetics. The City plans, and is authrized by CDOT, t use the Cntract Manager-General Cntractr ( CMGC ) cntracting methd t cmplete design and cnstructin, as cntemplated by Sectin f the Glden Municipal Cde. The prject will include the fllwing wrk items t be cmpleted by the City; Cmpletin f IGA with CDOT Cnsultant selectin apprval CMGC selectin Public input meetings Preliminary Design and review with CDOT and FHWA Final Design apprval and determinatin f cmpliance with all apprpriated design standards and requirements Submissin and apprval f traffic cntrl and phasing plan t CDOT CMGC subcntractr bids and submissin f Guaranteed Maximum Price ( GMP ) Apprval f bids and GMP by City and CDOT Cnstructin management including QA/QC testing and dcumentatin as required by CDOT Budget and Expense tracking including maintenance f cntrls and dcumentatin fr all payments fr Cnstructin, Design, Testing and ther prject eligible expenses. Certificatin f substantial cmpletin, final cntract clsure and warranty administratin The City will be the respnsible agency fr designing and cnstructing the prject. The city will include CDOT designated representatives as part f the prject team. The fllwing is a list f maintenance respnsibilities fr during and after cnstructin n the areas within the prject limits. Additinally there are envirnmental dcumentatin requirements that are detailed belw. Prject Infrastructure Ownership/Maintenance Respnsibility: CDOT: US Highway 6 and Interchange within CDOT ROW Radway and ramp surfaces Interchange lighting Radway and Ramp light ples and fixtures

Walls included are between US 6 Milepsts t City f Glden: 19 th Street and Lid pedestrian Facilities and Landscaping All paved areas including radway, bicycle, and recreatin surfaces All permanent signing and striping All recreatin facilities including shelters, benches, and picnic tables All Heavy and Light Landscaping area plants/grass and irrigatin systems All ersin cntrl measures All drainage including inlets, pipes, curb and gutter, and grundwater seepage pipes until they reach the CDOT maintained facilities n US 6 Electrical irrigatin cntrllers Electrical lights lcated abve the surface f the bridge / lid including street, sidewalk, bike path lighting, bllards, landscape luminaires, clumn lighting, and illuminated signage. Sign arch and pilasters, including supprt attachments t the bridge US Highway 6 and Interchange within CDOT ROW Median landscape including median cver material (patterned cncrete). All landscaping within the prject limits including landscaping area trees/plants/grass and irrigatin systems/cntrllers Maintenance f structural wall aesthetics Pedestrian bx culvert carrying the westbund ff ramp ver the pedestrian path; Structure Number E-16-WI at US 6 Milepst Pedestrian underpass walls F-15-BO, F-15-BN, and F-15-BP All architectural cmpnents assciated with the bridge r walls, specifically but nt limited t: Welcme t Glden Signage and Supprt System, any architectural facing assciated with structure walls, architectural walls adjacent t the bridge abutments, bridge railing and fencing Prvide reasnable access fr CDOT t maintain the structural cmpnents as needed. Water quality pnd Snw Remval: CDOT US 6 and Ramps Oppsing ramp access requires the CDOT snw plw t drive n 19 th Street t the rundabut and back. Access is required, but plwing will nt be expected n that stretch f 19 th City f Glden

7 Reslutin N Page 5 19 th Street and all pedestrian facilities within interchange All radway, sidewalk, and bike path surfaces Any remval n recreatinal facilities Envirnmental Cmmitments/Dcumentatin Grundwater Sampling Glden asserts that the grundwater sampling cmpleted during precnstructin is sufficient t characterize water quality, and the pllutant cncentratins meet bth grundwater and surface water standards. In lieu f mre sampling prir t cnstructin, Glden has elected t pay fr any future permitting and treatment f dewatering, if such water is fund t require treatment, bth during and after cnstructin. It is understd by bth CDOT and the City f Glden that the Bridge Lid is nt and will nt be designated as a 4(f) Resurce. Sectin 4(f) f the US Department f Transprtatin Act f 1966 (49 US Cde [USC] Sectin 303 and 23 USC Sectin 138) mandates that the Secretary f Transprtatin shall nt apprve any transprtatin prject requiring the use f publicly wned parks, recreatin areas, wildlife and waterfwl refuges, r significant histric sites, regardless f wnership. CDOT and the City f Glden therefre agree t nt seek and ultimately ppse any actin that might result in the designatin f any part f 19 th Street that lies within the limits f the CDOT Right f Way as ptential Sectin 4(f) prperty. Bth parties cnsider the lid and its cmpnents t be an expansin f the existing transprtatin facility. Any subsequent impact f this transprtatin facility will nt be cnsidered a Sectin 4(f) use as defined in 23 Cde f Federal Regulatins (i). Glden shall ensure that the Cntractr cmplies with all envirnmental laws, regulatins, apprvals, and cnditins required fr the prject. Befre final cnclusin f the Prject and 45 days prir t Prject cmpletin, the Cntractr/City f Glden shall submit t CDOT a final memrandum stating that all f the envirnmental mitigatin cmmitments listed in Table 4. Summary f Impacts and Mitigatin fr the Prpsed Actin f the Categrical Exclusin (See US Highway 6 and 19 th Street Interchange, Nvember 2015, included in the Reference Dcuments) have been dcumented and fulfilled, alng with a summary detailing any f the envirnmental Best Management Practices that were used n the Prject. The mem shuld be addressed t Belinda Arbgast (CDOT Regin 1 Senir Envirnmental Planner at ). This summary f cmpletin will be reviewed by CDOT and frwarded t FHWA fr Acceptance befre Prject clse-ut can ccur. Miscellaneus Agreements Cnstructin Oversight Rles and Respnsibilities: Glden has elected t administer this prject and will be in respnsible charge during cnstructin. An updated frm 1243 has been agreed upn and is included in this IGA amendment. Due t the maintenance/wnership respnsibility that CDOT has fr the Bridge and wall structures n the US highway system, the City f Glden, althugh in respnsible charge f the Prject, will cnsult with the CDOT Prject Manager n any decisins affecting CDOT wned facilities. Changes t Lid Pedestrian Facilities

8 Reslutin N Page 6 Any changes t features r pedestrian facilities n lid that vary frm the final cnstructin plans, including re-grading f landscaping berms, are nt allwed withut a structural analysis and cncurrence with CDOT Staff Bridge. The City f Glden wuld be respnsible fr any cst assciated with change requests fr the entire life f the structure.
