6 Terms and conditions of Labour Contract 1. The contract shall remain in force for a period of one year from the date of awarding the contract and shall automatically come to end on expiry of the said period on midnight, unless extended on the same charges and terms and conditions agreed mutually. Contractors have to mobilize the work within 15 days from the date of awarding the order of work. 2. You have to provide deposit or bank guarantee from any nationalized bank for security deposit as per annexure. The bank guarantee/security deposit will be returned after 90 days of completion of contract and submission of all payment documents. 3. It is mandatory to follow all the rules and acts of government like Factories Act 1948, Contract Labour Act, Workmen s Compensation Act, Payment of Bonus Act, Minimum Wages Act, and Provident Fund Act, ESI Act and all other relevant rules and regulations issued by Government from time to time. Implications of any violation of any act will have to be compensated by you along with penalty as decided by Competent Officer of Banas Dairy. 4. As per Labour Contract Act, you have to take licence for all the workers working under this contract and also have to pay the wages applicable under the Act. 5. You have to execute the agreement on Non Judicial Stamp paper of Rs 100/- (Rupees Hundred). 6. The payment for this contract will be paid on every month as per rate mentioned in Annexure. 7. You have to carry out the assigned job as per direction of Asst.Manager(Production) or officer assigned by Union. 8. You have to carry out the assigned job in prescribed time by keeping sufficient number of labour as per the requirement and also instruction of department head. 9. Your workers should maintain hygienic condition while working. 10. Your workers should also maintain personal hygiene. 11. You will provide healthy workers who should be free from communicable diseases. 12. You have to pay the wages to the worker every month before 7 th of calendar month any you have to submit the payment register for inspection. 13. You have to deduct the amount of Provident Fund/ESI from each worker engaged by you and deposit to the respective organization. The proof of deposited amount should be submitted with your bill. Any implications of violation in this regard will have to be compensated by you along with penalty as decided by Competent Officer of Banas Dairy. Stamp & Signature

7 14. The contractor or his supervisor has to remain present at the job place during working hours. He has to plan for smooth operation and if any fault is found then the union will penalize as deemed fit by management for the same and no excuse or objection will be considered for such negligence. 15. You will provide ESI no & ESI card to all workers. 16. You will engage workers above 18 years of age. 17. You will get your labour medically examined periodically at your expenses as per requirement of organization. 18. Labour will not be allowed chewing of Gutka/Tobacco, smoking cigarette/bidi, drinking liquor /intoxicants in premises. 19. Labour will not do any activity that may damage the property of union, if any damages are done loss of damage and penalty will be recovered from you. 20. All the terms and conditions mentioned in the tender, agreement and work instruction should be binding to contractor. In case of any dispute, Managing Director of Banas Milk Union, Palanpur, will be sole Arbitrator and his decision will be binding on both parties. 21. No transfer of the contract in another name is permitted. 22. For any fault, disobedience or unlawful act of your labour, you will be responsible to bear the consequent loss, penalty, fine and compensation as the case may be. 23. You will provide the Identity card & uniform to all workers/supervisors. 24. If any labour does theft of dairy product/consume dairy product, the penalty will be 10 times the cost of product. 25. If your work or conduct is found unsatisfactory or you are found disinterested in performing the contract, the contract is liable to be terminated within 24 hours without any further notice in public interest and security deposit will be forfeited. 26. The contractor shall not change the workers frequently since it will affect the daily working operations. 27. The Jurisdiction of any dispute will be court of Palanpur Banaskantha District, Gujarat State. 28. Any point of time if management feels that there is a breach of terms and conditions of contract, contract will be terminated before the end of contract without any notice or reason and total security deposit will be forfeited. 8 29. The labor will not be allowed to carry mobile phone or any other device used for listening music or any other device. 30. Contractor should have PAN number as per Income Tax Act. 31. Dairy authority will deduct income tax as per provision of Income Tax Act Conditional tender will not be acceptable. 33. Labour Contractor will be solely responsible for any accident to their personnel and you will take insurance policy as per the Workmen s Compensation Act. The contractor shall submit the copy of insurance policy to organization 34. In case of any dispute arising out of this contract, decision of Managing Director, Banas Dairy, Palanpur will be final and abiding to both parties. 35. In case the total volume of packing is less than 50,000 litres per day the Union may consider the request for payment to the contractor as per daily wages basis (subjected to the duly attested attendance sheet for the said day by the admin dept. of the union.) For this, bidders have to quote minimum daily wages unskilled manpower rate as prescribed in the rate list along with the offer. Stamp & Signature

9 Annexure I Scope of Work The work entrusted to the Milk/Buttermilk/Dahi packaging contractor. 1. Supply of crates to crate washer from the unloading dock. 2. Transfer the packaging material from store to production. 3. Segregation of dirty crates for manual cleaning. Manual cleaning shall be carried to the satisfaction of shift in-charge. 4. Loading of the crates on crate washer. Broken crates, if any, are to be segregated and transferred to godown. 5. The worker should see the smooth operation of crate washer. He should see that all the spray nozzles are working. He should clean the crate washer after operation. 6. To arrange the pouches in the crates after counting the number of pouches as per the instructions of the shift in-charge of section. 7. Contractor will keep extra person on packaging line to provide the reliever to maintain the continuous operation. 8. To remove leaky pouches during operation. 9. The contractor shall be responsible for the number of pouches to be filled in the crates. 10. Only good sealed pouches are to be transferred in the crates after drop and peel test of pouch time to time. 11. The worker will see that under-weight/over-weight pouch or pouch without proper coding will not be allowed to keep in crates going to market. 12. Any mischief in stacking variant wise milk, the contractor will be penalized and in case of frequent mistakes, contract will be terminated. 13. The contractor will keep the record of crates in cold store and same will be used for billing. 14. The worker should maintain the hygienic condition of plant. Stamp & Signature

10 15. He will cut open the leaky pouch and transfer the milk to process section, he will also clean and wash the leaky pouch. 16. He will transfer the cut open pouch / wastage from packaging material etc. to scrap yard after completion of shift. 17. General cleaning and maintenance of machines, floor, drains, milk trolleys, trays, conveyers etc. to be performed as directed by shift in-charge. 18. Any other work related to the packaging operation shall be performed as per verbal instructions of shift in-charge. 19. Workers working in plant should wear uniform / protective clothes, caps and masks. 20. Workers should maintain personal hygiene like clean clothes, cut hair, cut nails and clean hands. 21. Workers will carry out any other work as per contingent or other requirements on the instructions of shift in-charge. Stamp & Signature

11 Annexure-II Scope of Work The work entrusted to the Dahi/Lassi cup filling. 1. For packing of dahi, packaging material to be brought from the packing stores and placed at packing machine. 2. Supply cases/crates to the machine. 3. Segregation of dirty crates for manual cleaning. Manual cleaning shall be carried out to the satisfaction of the shift in-charge. 4. Provide the packing cups and foil lids to rotary filling machine. 5. Remove the defective cups/leaky cups and cups without coding. 6. Print the packing details properly on carton. 7. Place the number of cups in crates/carton as per instruction of the shift in-charge. 8. Only sound seal cups are to be transferred to the crates/carton. Weighing and coding of cups is to be monitored continuously. 9. Under weight or over weight and cups without coding are to be segregated. 10. Under weight and leaky cups to be cut open and dahi is to be drained in can and transferred to process section and empty cups to be transferred to scrap yard. 11. 12 Annexure lll Scope of work Paneer Manufacturing 1. You will arrange following operations through your labor. a. Cleaning of paneer vats. b. Cleaning of paneer hoops. c. Filling of hoops with paneer. d. Transfer the hoops for pressing station. e. De-hoop the paneer blocks and transfer to cooling vat. f. Transfer the cool blocks to cutting table. g. Cutting of paneer blocks to 200Gm/500Gm/1Kg h. Packing of paneer blocks in packs as instructed by plant officer. i. Transfer paneer packs to vacuumed machine. j. Transfer packs to Sterilizer. k. Transfer the packs from sterilizer to cold Room. l. Transfer the packs to carton as per instruction by plant officer. m. Transfer the paneer from cooling room to cold store. n. Stack all the cartons in the cold store. o. Clean all the equipments and floor area. Stamp & Signature

13 Annexure IV Scope of work Loading and Unloading Work: You will arrange following operations through your labor- 1. Unloading of New Crates 2. Unloading of packing material 3. Unloading of Chemicals 4. Unloading of Powder Bags 5. Unloading of miscellaneous materials required for dairy operations

14 Earnest Money Deposit & Security Deposit 1) Contractor will have to submit Demand Draft in favor of "Banaskantha District Cooperative Milk Producers Union Ltd. ", payable at Palanpur, towards Earnest Money Deposit (EMD) for Rs. 1,00,000 (One Lac) to organization's Account section. Tender shall be accepted in sealed envelope only on presenting receipt of deposition of DD towards EMD. If rates not approved, the EMD shall be refunded to bidder within 30 days of award of contract to any bidder. If bidder is selected for awarding contract, EMD shall be converted in to security deposit. No tender form shall be accepted without producing original receipt of EMD. 2) If the rates are approved and bidder is selected for awarding contract, bidder shall submit Bank Guarantee of Nationalized Bank of Rs. 5,00,000/- (Rs. Five lac) as security deposit in favor of Banas Dairy. Total security deposit shall be comprising of EMD Rs. 1,00,000 (One Lac) and Bank Guarantee Rs. 5,00,000/- (Rs.Five lac). EMD converted in to security deposit shall be interest free. Banas Dairy shall not pay any interest on Security Deposit during or after the contract. 3) Security Deposit will be refunded after successful completion of the contract and on submitting written application along with notarized indemnity bond in favor of Banas Dairy, Palanpur on stamp paper of requisite amount. Security Deposit shall be refunded only after the documents, registers; challans are submitted as demanded by the organization and to organization's satisfaction. If the agency fails to submit documents as demanded by organization satisfactorily within 90 days of completion of contract, Bank Guarantee shall be invoked. If any time, management finds that, contractor has not paid any dues to their personnel, or has not worked as per the terms and conditions of contract or there is breach of contract, management will terminate the contract without giving notice. And in such eventuality Bank Guarantee shall be invoked and total security deposit will be forfeited. Stamp & Signature

15 Rates Contractor will pay the wages as per the minimum wages (applicable as per The Factories Act), PF, bonus and leave as per the rules. While quoting the rates you have to consider all statutory liabilities like Minimum Wage, PF, Leave with wages, Bonus, Gratuity, retrenchment compensation, insurance, uniform etc. In addition to this, you should also consider cost of supervision. 16 Loading and Unloading : Sr no Category Rate Per Kg /no Service Taxes will be paid extra and reimbursed after production of service Tax payment challan. Approved rates shall be adjusted with increase/ decrease equivalent to percentage (%), increase/ decrease in minimum wages (Basic+ DA) whenever applicable.
