6 Terms and Conditions of House-keeping & Sanitation Contract 1. The contract shall remain in force for a period of one year from the date of awarding the contract and shall automatically come to end on expiry of the said period on midnight, unless extended on the same charges and terms and conditions agreed mutually. Contractors have to mobilize the work within 15 days from the date of awarding the order of work. 2. You have to provide deposit or bank guarantee from any nationalized bank for security deposit as per annexure. The bank guarantee/security deposit will be returned after 90 days of completion of contract and submission of all payment documents. 3. It is mandatory to follow all the rules and acts of government like Factories Act 1948, Contract Labour Act, Workmen s Compensation Act, Payment of Bonus Act, Minimum Wages Act, and Provident Fund Act, ESI Act and all other relevant rules and regulations issued by Government from time to time. Implications of any violation of any act will have to be compensated by you along with penalty as decided by Competent Officer of Banas Dairy. 4. As per Labour Contract Act, you have to take licence for all the workers working under this contract and also have to pay the wages applicable under the Act. 5. You have to execute the agreement on Non Judicial Stamp paper of Rs 100/- (Rupees Hundred). 6. The payment for this contract will be paid on every month as per rate mentioned in Annexure. 7. You have to carry out the assigned job as per direction of Officer assigned by Union. 8. You have to carry out the assigned job in prescribed time by keeping sufficient number of labour as per the requirement and also instruction of department head. 9. Your workers should maintain hygienic condition while working. 10. Your workers should also maintain personal hygiene. 11. You will provide healthy workers who should be free from communicable diseases. 12. You have to pay the wages to the worker every month before 7 th of calendar month any you have to submit the payment register for inspection. Stamp & Signature
7 13. You have to deduct the amount of Provident Fund/ESI from each worker engaged by you and deposit to the respective organization. The proof of deposited amount should be submitted with your bill. Any implications of violation in this regard will have to be compensated by you along with penalty as decided by Competent Officer of Banas Dairy. 14. The contractor or his supervisor has to remain present at the job place during working hours. He has to plan for smooth operation and if any fault is found then the union will penalize as deemed fit by management for the same and no excuse or objection will be considered for such negligence. 15. You will provide ESI no & ESI card to all workers. 16. You will engage workers above 18 years of age. 17. You will get your labour medically examined periodically at your expenses as per requirement of organization. 18. Labour will not be allowed chewing of Gutka/Tobacco, smoking cigarette/bidi, drinking liquor /intoxicants in premises. 19. Labour will not do any activity that may damage the property of union, if any damages are done loss of damage and penalty will be recovered from you. 20. All the terms and conditions mentioned in the tender, agreement and work instruction should be binding to contractor. In case of any dispute, Managing Director of Banas Milk Union, Palanpur, will be sole Arbitrator and his decision will be binding on both parties. 21. No transfer of the contract in another name is permitted. 22. For any fault, disobedience or unlawful act of your labour, you will be responsible to bear the consequent loss, penalty, fine and compensation as the case may be. 23. You will provide the Identity card & uniform to all workers/supervisors. 24. If any labour does theft of dairy product/consume dairy product, the penalty will be 10 times the cost of product. 25. If your work or conduct is found unsatisfactory or you are found disinterested in performing the contract, the contract is liable to be terminated within 24 hours without any further notice in public interest and security deposit will be forfeited. 8 26. The contractor shall not change the workers frequently since it will affect the daily working operations. 27. The Jurisdiction of any dispute will be court of Palanpur Banaskantha District, Gujarat State. 28. Any point of time if management feels that there is a breach of terms and conditions of contract, contract will be terminated before the end of contract without any notice or reason and total security deposit will be forfeited. 29. The labor will not be allowed to carry mobile phone or any other device used for listening music or any other device. 30. Contractor should have PAN number as per Income Tax Act. 31. Dairy authority will deduct income tax as per provision of Income Tax Act Conditional tender will not be acceptable. 33. Labour Contractor will be solely responsible for any accident to their personnel and you will take insurance policy as per the Workmen s Compensation Act. The contractor shall submit the copy of insurance policy to organization 34. In case of any dispute arising out of this contract, decision of Managing Director, Banas Dairy, Palanpur will be final and abiding to both parties. Stamp & Signature
9 Annexure I Scope of Work House-keeping & Sanitation Contract 1) House-keeping contractor shall be responsible for house keeping and sanitation work of administrative building and dairy plant premises as per details in Annexure-1. 2) All cleaning chemicals for the floors and toilets will be provided by us. 3) Housekeeping contractor shall provide trolleys for carrying garbage. 4) Housekeeping contractor shall provide trained staff for cleaning and sanitation. 5) Cleaning, sweeping, mopping and wiping of floors, staircase on daily basis from Monday to Sunday or as required by Officer-In-charge. Cleaning activity shall start in the morning at 7.00 AM so as to complete all the dusting / cleaning / mopping work before 9.00 A.M. 6) Thorough cleaning of all toilets using required detergent by putting naphthalene balls and air purifier in all urinals, wash basins and WC area. 7) Cleaning and dusting of entire furniture, partitions, wooden cabin walls, railings, doors, windows, venetian blinds, racks, sofas, computers, telephones, curtains, wall mounted fans etc. with dry/wet cloth, feather brush and duster. 8) Clearing of any chokings in the drainages, manholes etc. 9) Cleaning of glass panels used in building / infrastructure. Proper arrangements on the cost of agency to be done by contractor for cleaning all glass panels on regular basis. 10) Proper registers/records for the jobs carried out on daily, weekly, fortnightly and monthly basis will be maintained by the supervisor of the bidder and will be countersigned by the officer-in-charge at regular intervals and finally at the end of each month. 11) House-keeping contractor will ensure that all cobwebs are removed. 12) Housekeeping contractor will transfer the garbage to designated place. 13) Dairy will pay as per actual attendance of labour irrespective of holiday and festivals. 14) Workers will carry out any other work as per contingent or other requirements on the instructions of shift in-charge. 10 Annexure-II Scope of Work Supply of Skilled/Unskilled Labor 1) Labor contractor shall supply Skilled/Unskilled labor as and when required. 2) The Labour Contractor shall supply ITI, Driver, and Graduate with knowledge of computer in Skilled Labour as and when required. 3) The skilled labour will be used for technical/supervision job. 4) The Unskilled labor required for shifting of raw material or any general purpose work. 5) The Skilled/Unskilled labour is to work as per instruction of shift in-charge. 6) The attendance and working hours record will be maintained by the production staff and the same will be sent to labor contractor every month. 7) The labor contractor will be paid as per attendance record of dairy. 8) Dairy will pay wages as per actual attendance based on approved days of Skilled/Unskilled Labour irrespective of holidays and festivals. 9) The Skilled/Unskilled labor should abide by the general terms and conditions mentioned in the contract. 11 Earnest Money Deposit & Security Deposit 1) Contractor will have to submit Demand Draft in favor of "Banaskantha District Cooperative Milk Producers Union Ltd. ", payable at Palanpur, towards Earnest Money Deposit (EMD) for Rs. 1,00,000 (one lac) to organization's Account section. Tender shall be accepted in sealed envelope only on presenting receipt of deposition of DD towards EMD. If rates not approved, the EMD shall be refunded to bidder within 30 days of award of contract to any bidder. If bidder is selected for awarding contract, EMD shall be converted in to security deposit. No tender form shall be accepted without producing original receipt of EMD. 2) If the rates are approved and bidder is selected for awarding contract, bidder shall submit Bank Guarantee of Nationalized Bank of Rs. 2,00,000/- (Rs. two lac) as security deposit in favour of Banas Dairy. Total security deposit shall be comprising of EMD Rs. 1,00,000 (one lac) and Bank Guarantee Rs. 2,00,000/- (Rs.two lac). EMD converted in to security deposit shall be interest free. Banas Dairy shall not pay any interest on Security Deposit during or after the contract. 3) Security Deposit will be refunded after successful completion of the contract and on submitting written application along with notarized indemnity bond in favour of Banas Dairy, Palanpur on stamp paper of requisite amount. Security Deposit shall be refunded only after the documents, registers, challans are submitted as demanded by the organization and to organization's satisfaction. If the agency fails to submit documents as demanded by organization satisfactorily within 90 days of completion of contract, Bank Guarantee shall be invoked. If any time, management finds that, contractor has not paid any dues to their personnel, or has not worked as per the terms and conditions of contract or there is breach of contract, management will terminate the contract without giving notice. And in such eventuality Bank guarantee shall be invoked and total security deposit will be forfeited. Stamp & Signature
12 Rates Contractor will be pay the wages as per the minimum wages (applicable as per the Factories Act), PF, bonus and leave as per the rules. While quoting the rates you have to consider all statutory liabilities like Minimum Wage, PF, Leave with wages, Bonus, Gratuity, retrenchment compensation, insurance, uniform etc. In additions to this you should also consider cost of supervision. Please give your rates actual per day of Skilled/Unskilled Labour irrespective of holiday and festival for following work.
