2 14. Exemption from submission of EMD: a. Parties registered with any of the following agencies/bodies as per Public Procurement Policy for Micro & Small Enterprises(MSE) Order 2012 are exempted categories from payment of EMD provided that the registration certificate issued by any one of these below mentioned agencies must be valid as on close date of tender. Micro, Small or Medium Enterprises who have applied for registration or renewal of registration with any of these agencies/bodies but have not obtained the valid certificate as on close date of tender are not eligible for exemption. i. District Industries Centre(DIC) ii. Khadi and Village Industries Commission (KVIC) iii. Khadi and Village Industries Board iv. Coir Board v. National Small Industries Corporation(NSIC) vi. Directorate of Handicraft and Handloom vii. Udyog Aadhar Memorandum (UAM) viii. Any other body specified by Ministry of MSME Note: Against UAM, copy of acknowledgement generated online shall be acceptable b. PSUs (Central & State) and JVs of IOCL are exempted from submission of EMD. A copy of the EMD instrument or exemption certificate in case of exempted categories shall be uploaded along with clear scanned copies of required documents to substantiate the claim towards their credentials along with the tender documents in the appropriate link. Tenderers not paying EMD or not uploading valid exemption certificate or scan copy of BG on or before tender submission end date and time will be summarily rejected. This is a single bid system i.e Price Bid Only. The tenderer should upload the following documents along with the price bid as per requirement of IOCL: 1. About the firm Details of the firm including address, type of firm, etc. and any other relevant details. 2. Deviation, New Conditions A confirmation letter from the firm stating that there is no deviation from the Terms and Conditions mentioned in the tender documents and that the firm has not put in any new condition and that they agree to the Terms and Conditions in the tender documents in Toto. 3. EVALUATION CRITERIA: a) The bidders have to quote in percentage above/ below the estimate in the BoQ (Price Bid). b) The bidder will also have to quote the applicable tax payable by the bidder as service provider and by IOC under reverse charge mechanism, if any in the space provided in credential bid. c) The tender shall be financially evaluated on overall lowest quoted cost to IOCL including tax liability under reverse charge mechanism in case the bidder is a partnership firm or proprietorship concern. d) IOCL reserves the right to negotiate with the L-1 bidder and finalize the L-1 rate. e) Evaluation criteria in case of tie i.e. identical rates quoted by more than one party: (i) In case of tie between two or more bidders at L-1 bidders shall be asked to submit discount bid in terms of percentage discount over previous quoted amount in a sealed envelope after taking the approval of the component authority. Above exercise shall currently be an officer activity outside the e-portal. (ii) The sealed envelope shall be opened jointly by one member from tendering group and one from finance. The bidders while seeking revised bids shall be advised to witness the opening of sealed envelopes. (iii) In case there is a tie again, the bidder with the highest turnover worked out to three decimal points in any of the last three years as submitted against Turnover criteria shall be considered as L1 bidder. (iv) In the event of bidder submitting turnover documents for only one or two years, L1 shall be decided on the basis of turnovers submitted. 16. ACCEPTANCE CRITERIA A. Ranking of the tenderers i.e. L-1, L-2, L-3 etc. shall be decided on minimum financial outgo to IOCL by considering the rates quoted by the bidders. IOC shall issue Letter of Intent (LOI) to L-1 bidder only. B. In case rates offered by L-1 bidders are not acceptable to IOC then IOC has the discretion to negotiate with L-1 bidder and in such cases negotiations/counter offer exercise shall be carried out to arrive at a reasonable mutually agreed rate. It may also be noted that negotiations will not be conducted with the bidders as a matter of routine. However, Corporation reserves the right to conduct such negotiations. C. In case, the rate quoted by more than one bidders result in identical amount received towards the tender, then, i) In case of tie between two or more bidders at L-1 bidders shall be asked to submit discount bid in terms of percentage discount over previous quoted amount in a sealed

OTHER POINTS: 1) Tenderers to please note the above schedule for Pre-Bid Conference wherein all the clarifications, if any, with regard to Technical/ Commercial conditions shall be given. Tenderers are advised to ensure that their queries must reach office of the Corporation at least two working days in advance for this purpose. The editable soft copy of the queries may also be sent on address given in press release / tender documents. Tenderers may also note that after the clarifications are given in Pre Bid conference, no further deviation shall be permitted and all decisions taken by IOCL in the pre-bid conference shall be binding on all bidders. PQ criteria for MSEs: 18.1 A uniform relaxation of 15% in PQ Criteria on Turnover and Similar works as per the following shall be as under: a) Turnover requirement for MSE shall be 51% of estimated cost (Annualized if period more than 1 year) as against 60% for other bidders. b) 1 order, 2 orders and 3 orders requirements against similar works shall be for 42.05%, 34% and 25.5% of the estimated cost respectively as against 50%, 40% and 30% respectively against 1 order, 2 orders and 3 orders for other bidders. c) The above relaxation shall only be applicable for procurement of goods produced and services rendered by Micro and Small Enterprises and the relaxation to MSEs shall not be applicable for works contracts. For claiming Purchase preference as MSE, the bidders registration shall cover the tendered item. The registration certificate submitted must also specify the category of enlistment as Micro or Small enterprise. d) The relaxation shall be subject to meeting the quality and technical specifications of the tendered items. 19. PQ Criteria for Startups (MSEs or others) 19.1 There shall be no requirement of PQ Criteria against Similar Work and Turnover subject to meeting quality and technical specifications of the tendered items The procurement from Startups shall be taken up through the development/trial order route for which specific guidelines exist Definition of startup shall be in line with that published vide Gazette notification No DL33004/99 dated i.e. an entity shall be considered as a Startup: a) if it is incorporated as a private limited company (as defined in the Companies Act,2013) or registered as a partnership firm (registered under section 59 of the Partnership Act,1932) or a limited liability partnership (under the Limited Liability Partnership Act,2008) in India, and b) up to seven years from the date of its incorporation/registration; however, in the case of Starups in the biotechnology sector, the period shall be up to ten years from the date of its incorporation/registration; and

6 c) If its turnover for any of the financial years since incorporation/registration has not exceeded Rupees 25 crores; and d) If it is working towards innovation, development or improvement of products or processes or services or if it is a scalable business model with a high potential of employment generation or wealth creation. Provided that any such entity formed by splitting up or reconstitution of a business already in existence shall not be considered a Startup Further, in order to obtain benefits, a start-up so identified under the above definition shall be required to submit a certificate of an eligible business from the Inter-Ministerial Board of Certification The above relaxation shall be applicable for procurement of goods produced and services rendered and the relaxation shall not be applicable for works contracts The above relaxation for MSEs and Startups shall not be applicable to items/services which are critical in nature; Items related to public safety, health, critical security operations and equipments etc shall be considered as critical items/services.
