1 BOARD OF COUNTY COMMISSIONERS SARPY COUNTY, NEBRASKA RESOLUTION LEVY ALLOCATION FY WHEREAS, Sectin (Reissue 2009) f the Revised Statutes f Nebraska grants authrity fr the cunty bard t review and apprve r disapprve the levy request f all plitical subdivisins subject t this subsectin; and, WHEREAS, the belw listed duly cnstituted fire districts and agricultural sciety are subject t the prvisins f Sectin (Reissue 2009); and, WHEREAS, the belw listed fire districts and agricultural sciety submitted t the Sarpy Cunty Bard f Cmmissiners their preliminary request fr levy allcatin fr FY n r befre August 1, 2010; and, WHEREAS, the Cunty Assessr has prvided certified valuatins; and, WHEREAS, the final allcatin f levy shall nt relieve the plitical subdivisins frm cmplying with ther applicable budgetary rules, regulatins and prcedures. NOW, THEREFORE, BE IT RESOLVED BY THIS BOARD OF COUNTY COMMISSIONERS THAT the fllwing FINAL ALLOCATION OF LEVY AUTHORITY fr FY is hereby apprved and in cmpliance with Sectin (4)(Reissue 2009) shall nt be changed after September 1, 2010 except by agreement between bth the cunty bard and the gverning bdy f the plitical subdivisin whse final levy allcatin is at issue and THAT the Cunty Clerk shall frward a cpy f this reslutin t the chairpersn f the gverning bdy f each f these plitical subdivisins. 3 Fire Districts & Ag Sciety Levy Allcatins Bard Apprved The fllwing Sarpy Cunty plitical subdivisins are required by State Statutes (Revised) Sectin (3) t submit a preliminary request fr levy allcatin t the Cunty Bard n r befre August 1st. Eastern Sarpy Cunty Suburban Fire Prtectin District Gd Luck Suburban Fire Prtectin District Gretna Rural Fire District Papillin Rural Fire District Springfield Rural Fire District Sarpy Cunty Ag Sciety (Millard Suburban Fire Prtectin District must submit their request t Duglas Cunty; hwever, the district has prvided a cpy t Sarpy Cunty.) The afrementined entities cmplied with their statutry requirements and thse preliminary levy requests were presented t yu n July 27, The Assessr certified the final valuatins n August 16, The Cunty Bard is required t make final levy allcatins t the abve entities n r befre September 1,2010. Once the final levy allcatins are made, the abve entities cannt change their allcatin except by agreement between bth the Cunty Bard and the gverning bdy f the plitical subdivisin whse final levy is at issue. Sectin , Subsectin (3) and (4), f the Nebraska Statutes are herewith quted fr yur infrmatin. "(3) On r befre August 1, all plitical subdivisins subject t cunty, municipal, r municipal cunty levy authrity under this sectin shall submit a preliminary request fr allcatin t the cunty bard, city cuncil, village bard, r cuncil that is respnsible fr levying such taxes. The preliminary request f the plitical subdivisin shall be in the frm f a reslutin adpted by a majrity vte f members present f the plitical subdivisin's gverning bdy. The failure t make a preliminary request shall preclude such plitical subdivisin frm using prcedures set frth in sectin t exceed the final levy allcatin as determined in subsectin (4) f this sectin." "(4) Each cunty bard, city cuncil, r village bard shall (a) adpt a reslutin by a majrity vte f members present which determines a final allcatin f levy authrity t its plitical subdivisins and (b) frward a cpy f such reslutin t the chairpersn f the gverning bdy f each f its plitical subdivisins. N final levy allcatin shall be changed after September 1 except by agreement between bth the cunty bard, city cuncil, r village bard which determined the amunt f the final levy allcatin and the gverning bdy f the plitical subdivisin whse final levy allcatin is at issue. 4 The entities receiving levy allcatins frm this Bard must still abide by all ther budgetary prvisins f statutes; i.e., lid limitatins, hearings and publicatins. The attached analysis, using certified valuatins fr 2010, is prvided fr yur review and preparatin fr making the levy allcatins t the abve subdivisins. A cpy f the reslutin n which yu will vte is prvided. (Nte: Duglas Cunty levies are n their Tuesday, August 31 st agenda.) It is anticipated that representatives frm sme f the abve plitical subdivisins will be present at the Tuesday, August 31 st Bard meeting.
