Name of work:- OPERATION AND MAINTENANCE OF SEWAGE TREATMENT PLANT AT KENDRIYA VIHAR COMPLEX FROM TO Cost of each tender document is Rs.500/-(Rupees Five hundreds only). Copies of tender documents can be purchased from the Administrative officer, KVAOA on any day during office hours by payment of cash. The filled in tenders can be deposited with the Administrative officer, KVAOA up to 1500 hrs on 20 th December, 2016 along with Earnest money Deposit (EMD) of Rs.10,000/- in the form of cheque/ D.D in favour of KVAOA. The tenders received will be opened by the Office Bearers of KVAOA at 1500 hrs, on the same day i.e. 20 th December, 2016 in the presence of those renderers who wish to be present. EMD of the successful tenderer will be retained and that of all others will be returned. Further new genuine /Original Spares only should be used as that of The original Manufacturers / Make of the pumps /machines. Contractor - 5 -
6 ANNEXURE-II GENERAL CONDITIONS 1. The Kendriya Vihar Complex built by Central Government Employees Welfare Housing Organization at Bellary Road, Yelahanka consists of 603 residential flats in 8 blocks, with the diesel generator and pump rooms, Community Center, parks and sewage treatment plant etc. The required facilities at the complex are provided by the Kendriya Vihar Apartments Owners Association (KVAOA) through its Management Committee of elected representatives of the members. 2. The contractor will obtain PF and ESI numbers from the authorities concerned within one month, if not already obtained and remit the amount by due date. In case the payment towards the following statutory charges given below claimed from government are not remitted to the authorities concerned in respect of all labourers including additional labourers as applicable and documentary proof to this effect is submitted to OWNER by 30 th of the following month, further payment towards such statutory charges will be stopped and the payment made on the previous month on this account will be recovered from the contractor s bill: i. PF (if applicable) ii. ESI iii. Any other payment as required as per Labour Act/Labour Dept. 3. The contractor shall obtain a valid license under the Contract Labour(R&A) Act 1970 and rules framed there under before the commencement of the work and continue to hold it till the completion on the contract. Similarly the owner shall also register the establishment with the concerned registering officer as per the rules. 4. A separate room will be allotted to the contractor for stocking of tools and implements provided to him for use inside the establishment. 5. The contractor will arrange for the services enumerated above by employing/deploying sufficient No. in the manner that it provides efficient and regular services. The age of the employees should not be less than 18 years. 6. The Contractor shall maintain following registers as per the Contract Labour (Regulation and Abolition) Act 1970 i. Register of workmen as per form XIII of Rule 75 ii. Employment cards as per form of Rule 76 iii. Muster roll register as per form XVI of Rule 78 iv. Register of wages as per form XVII of Rule Any other register/records required by Labour Authorities from time to time shall be maintained by the Contractor. 8. The contractor on receiving any complaint shall attend to it and complete the job immediately to the full satisfaction of the Owner. 9. In case of exigencies of services the contractor s personnel may be required at times even on a holiday and Sunday for which advance notice of 24 hours will be given to the Contractors and payment will be made as per the applicable rate. 10. The Contractor shall not be entitled to any additional payment during the tenure of the contract except on account of revision of minimum wages. In the event of revision of minimum wages to labourers/ supervisors, it shall be paid by the owner through contractors as per rules
7 11. The agreement shall be liable for termination on giving one-month s notice by either side. During the period of notice both the parties shall continue to discharge their duties and obligations notwithstanding the above. In case the services provided by the contractor are not satisfactory or if irregular services are provided even after two written intimations, it will be open to the owner to terminate the contract without any further notice and in such an event the Contractor is liable to pay all incidental expenditure including the expenditure involved in maintaining the services continued during the interim period till new contract is finalized and in the event of default the owner is at liberty to make necessary deduction in this regard from the Security deposit held The Contract shall remain valid for a period of twelve months from 1 st January On expiry of the terms, both the parties may renew the contract on mutual consultation on the terms and conditions as mutually agreed to up to a period of one year. 13. All personnel and their bag and baggage connected with contract shall be liable for a physical check both at the time of entry into the campus and passing out at Security gate. 14. The contractor shall provide identity badges which will, however, be authenticated by the owner. The identity badges shall be handed over to the OWNER when no more required for any personnel on/or after completion of contract/employment with the Contractor. 15. Any theft or breakages caused by the contractor s personnel shall be borne by the contractor. The contractor will not allow or permit the labourers to participate in any trade union activities or agitation inside the premises of the OWNER 16. The Contractor shall submit his bill on first working day of each month. No advance payment will be made. The owner shall pay the amount of monthly bill by cheque in the name of firm and not to his personal. As such the contractor shall own the full responsibility for regular payment of wages to his personnel. The disbursement of wages by contractor shall be made inside the campus in the presence of representative of the owner. Contractor shall visit Kendriya Vihar complex in person at least once in a month and meet President, KVAOA or his authorised representative for general appraisal. 17. Notice showing rates of wages, hours of work etc shall be submitted to the Office of the Labour Enforcement Officer (Central) Bangalore under intimation to the owner and the same shall be displayed on the notice board in the establishment within 7 days from day of concluding contract agreement. 18. If the work is found unsatisfactory in a particular period and not up to the expected standards, an amount, which the owner may determine, shall be deducted from the contractor s bill. The decision of the owner in this regard shall be final. 19. The contractor shall comply with the provisions of the Payment of Wages Act 1934, Minimum wages Act 1948, Employment Liability Act Workmen s Compensation Act 1923, Factory Act 1948, Industrial Disputes Act 1947, Maternity Benefits Act 1961, and the Contract Labour (Regulations and Abolition) Act 1970 or the modifications thereof and other laws relating thereto and the Rules made there under from time to time. It is the sole responsibility of the Contactor to ensure full compliance of all statutes, rules & guidelines relating to his contracted work and the workforce employed. 20. The owner shall not be responsible for any injury or loss of life of any workers of the contractor that may take place while on work. Any compensation or expenditure towards treatment for such injury or loss of life shall be the sole responsibility of the contractor. 21. Any question/disputes or difference arising under the contract shall be referred to the Sole Arbitration of an arbitrator appointed by the President, KVAOA
8 22. In case of failure on the part of the contractor to provide labourers on any working day, the owner can have the option to engage the labourers and pay their wages from the monthly contractual amount without any reference or recourse to the later s expenses. 23. The contractor shall be responsible to conduct surprise checks of his staff meant for the above services and also for their punctuality and behavior. 24. The Shop and Establishment Act of Govt. of Karnataka will govern all the members of work force. Required ESI contributions, PF and bonus as required under different laws shall be carried out by the contractor. 25. If the attendance of the labour falls short than the required number, proportionate amount for the number of days that fall short to the minimum number an amount equal to one day shall be deducted from the monthly bills. Similarly, if the work is found unsatisfactory and below the expected standards in a particular area or areas, proportionate charges determined by the President, will be deducted from the contractor s monthly bill. The decision of the owner in this regard shall be final. 26. Risk & Cost: in case the services provided by the contractor are not satisfactory or if irregular services are provided even after two written intimations, it will be open to the Owner to terminate the contract without any further notice and the owner will be at liberty to go in for a fresh contract with any other party at the risk and cost of the contract. 27. The contractor has to execute an agreement with KVAOA, in a stamp paper of Rs.50/-(Rupees fifty only) incorporating the conditions as enumerated in the annexure the rate schedule of the Tender document. 28. The earnest money remitted along with the tenders will be refunded immediately to the unsuccessful tenders, while that of the accepted tenderer will be retained by the KVAOA and refunded on completion of the contractual period. 29. The contractors should fill up their rates in the schedule Annexure I and sign all the pages of the document before submitting. SPECIAL CONDITIONS 30. To Operate and maintain the Sewage Treatment Plant in the following shifts by deploying the following personnel :- Two Nos. Operators one each spread over in the Second & Third shifts respectively. 31. The Supervisor should Monitor/Maintain the following:- Recording flow meter & energy meter readings. Operation & preventive maintenance of the Sewage Treatment Plant. 32. The Contractor shall be responsible to ensure that the STP is always manned by either an Operator or Supervisor. 33. Cost of consumables (oil, grease, gasket etc) required for operation and maintenance of the S T Plant shall be borne by the contractor. Only cost of major spares and major repairs/and servicing Jobs including replacements will be borne by the owner. 34. The process control of the S T Plant (viz., maintaining MLSS Sludge re-circulation ratio, loading rate, etc.,) as necessary to ensure compliance of the Treated sewage meeting the consent requirements as prescribed by KSPCB is the responsibility of the Contractor
9 35. To maintain the Logbook and other Documents as required and also to present it during the inspection of Karnataka State Pollution Control Board Officials. 36. Critical Activities including Servicing, Overhauling of any machinery of the ST Plant and breakdown works of any machineries etc. in the ST Plant are to be supervised by the responsible Engineer of the Contractor. 37. To provide technical support/trouble shooting during plant breakdown/non-conformance of effluent quality. 38. The person who is a qualified Environmental Engineer or any Senior Environmental engineer should visit the plant at least three a month, to monitor the overall performance of the plant. A Record of all such visits should be maintained and shown to the Owner in the 1 st week of every month. 39. Monthly analysis of the treated effluent should be carried out from a recognized and Authorised Laboratory and the analysis report should be submitted to KVAOA / designated Authority. 40. The Contractor will arrange for the services enumerated above by employing or deploying safaiwallas/taskforce in sufficient numbers in the manner that it provides efficient and regular cleaning of Equalization tank if necessary. 41. That the contractor will be responsible to employ adequate number of personnel required, and tomake payments to such employees regularly as per existing instruction and regulations provided to such employees. The contractor shall employ and position a minimum required force of semi-skilled personnel for achieving a clean and dust free environment at all times. 42. The Owner at his discretion reserves the right to Award Contract in this Tender without including PART B portion of Offers/Tenders without assigning any reason thereof.however all the Tenderers are required to quote for this portion (PART-B) of work also, as called for in the RATE SCHEDULE. 43. The contractor will be responsible for cleaning and sludge removal of Raw Water Pump Pit,Equalization Tank,Clarifier Tank and Filter Tank regularly and present the records of such activities to the Managing Committee for necessary action. 44. The Contractor is expected to maintain necessary liaison with KSPCB and keep the KVAOA Managing Committee informed of such interactions for any action to be taken at Owner s end. 45. In addition, the Contractor should accept such other conditions as mutually agreed upon between KVAOA and the Contractor, at the time of entering into the contract
