Units. 1. The The Registrar, Khwaja Moinuddin Chishti Urdu, Arabi-Farsi University payable at Lucknow invites sealed bids in two parts (1) Technical Bid (2) Financial Bid from eligible bidders for Operation & Maintenance services for Centralized A.C. Plant as per details given here under: Description Qty. Place Operation & Maintenance of Centralized A.C. Plant Make:- Trane Screw Chiller 03 units (Each Unit of 400 TR) Khwaja Moinuddin Chishti Urdu, Arabi-Farsi University, Lucknow. Note: The tenderer is free to inspect the A.C. Plant/Units in case they feel so before bidding for it. 2. Proposals are invited for most competitive rates for Operation & Maintenance Services of aforementioned A.C. units. 3. Eligibility (1) Valid Manufacturer's/authorized Dealership/authorized service provider of AC/ Registered 'A' Class Electrical Contractor with U.P. PWD. (2) Eligible firms having experience of providing service of at least 05 yrs working with Central/State/ Local Govt./ Semi Govt. Offices & Other reputed Sectors. (3) The agency should have turnover of not less than Rs. 50 lac p.a. Supporting document(s) i.e. audited copy of balance sheet and profit & loss A/c to be enclosed. (4) Proposals without supporting documents shall be treated as non-responsive. 4. Bid Price a. The contract shall be for the items as described above. Corrections, if any, shall be made by crossing out, initialing, dating and re-writing. b. All duties, taxes and other levies payable by the contractor under the contract shall be included in the total price/ rate offered. c. The rate quoted by the bidder shall be fixed for the duration of the contract and shall not be subject to adjustment on any account. 5. Each tenderer shall submit only one tender on the format enclosed as Annexure-I of tender document and the firm has to offer one rate only.

4 &4& 6 Validity of tender The tender shall remain valid for a period not less than 60 days after the deadline date specified for submission. 7 Evaluation of tender The Tender must be in Two Parts e.g. (1) Technical Bid & (2) Financial Bid. Both sealed bids must be kept in a separate sealed envelope that should be super scribed Bid for Operation & Maintenance Contract of A.C. Plant/ Units. (i) Technical Bid The Technical bid must contain: (1) Proposal must include details of Operation & Maintenance services provided: a) Name of the Client b) Eligible firms offering to provide experience of at least 05 yrs working with Govt./ various State/ Central Govt. Offices/ Semi Govt. Offices & Other Sectors. c) Copy of the audited Balance Sheet and profit & loss A/c (in Support of the turnover) for last three years. d) Copy of income tax return for last three years e) The tendering firms have to give a declaration to the effect that they have not been Black Listed or their business dealings with the Government bodies have not been banned. f) Experience atleast five of works done/completed in Govt./Semi Govt./ University and such agency. (2) Earnest money of Rs. 10,000/- in the form of Demand draft/banker s Cheque in favour of Finance Officer, Khwaja Moinuddin Chishti Urdu, Arabi-Farsi University payable at Lucknow. (3) PAN, TAN & TIN No. of firm. (4) Registration Certificate issued by the Service Tax Department. Note: The financial bid of short-listed firms will be opened only when the firm qualifies in the Technical bid. (ii) Financial Bid The evaluation committee shall evaluate the financial bid on the basis of most competitive rates. The Registrar, KMCUAFU herein after referred to as the Purchaser will evaluate and compare the tenders, separately determined to be substantially responsive i.e. which are: (a) Lowest (b) Are properly signed; and (c) Conform to the General instructions and other terms and conditions that have been mentioned in the Tender Document. (d) The Financial bid will include for both cost i.e. Operation & Maintenance of A.C. Plant. 8. Award of Contract Contract will be awarded to the tenderer whose tender has been determined to be substantially responsive and who has offered the lowest evaluated tender price. Tender may also be offered at viable rates. The successful tenderer will have to sign a contract within 05 days of issuance of notification of award of contract for providing Repair/ Operation &

5 &5& Maintenance services at the quoted price. No upward revision in prices shall be allowed during the period of contract. 8.1 Notwithstanding the above, The Registrar, Khwaja Moinuddin Chishti Urdu, Arabi-Farsi University payable at Lucknow reserves the right to accept or reject any tender and to cancel the tendering process and reject all tenders at any time prior to the award of contract without assigning reason whatsoever. 8.2 The bidder whose tender is accepted will be notified of the award of contract by the KMCUAFU, Lucknow prior to expiration of the tender validity period as per clause 6 of the Tender Document. 9 Schedule of Completion The completion time for repairing of A.C. plant in case of major fault shall be 3-5 days from the date of issuance of the work order/award of contract. 10 Payment 1. The Charges of operational contract shall be paid monthly after completion of the month against receipt of Invoice/Bill and its verification from the officer concerned. 2. For AMC no advance payment will be made in general. However 25% advance can be given on the request of tenderer against the bank guarantee. 11 Warranty Normal commercial warranty/guarantee as given by the manufacturer shall be applicable to the goods supplied with respect to Repair & Maintenance. 12 Cost of tendering The tenderer shall bear all costs associated with the preparation and submission of its tender, and The Registrar, Khwaja Moinuddin Chishti Urdu, Arabi-Farsi University payable at Lucknow hereinafter referred to as "the Purchaser", will in no case be responsible or liable for these costs, regardless of the conduct or outcome of the tendering process. 13 Earnest Money 13.1 The tenderer shall have to furnish as part of his tender, an earnest money in amount of Rs. 10, /- valid for 3 months in favour of Finance Officer, Khwaja Moinuddin Chishti Urdu, Arabi-Farsi University payable at Lucknow in the form of Bank Draft/ Banker s Cheque of a scheduled Bank. The tender without earnest money will be rejected as non-responsive The earnest money may be forfeited : (a) If a tenderer withdraws its tender during the period of tender validity specified in clause -6 of the Tender Document; (b) In case of a successful tenderer, if the tenderer fails: (i) To sign the Contract within 05 days of issuance of notification of award. (ii) To furnish Performance Security within 05 days in accordance with notification of award, valid for 15 months Un-successful tenderer's earnest money will be discharged/returned as promptly and as soon as possible but not later than 30 days after expiration of the period of tender validity prescribed by the purchaser The successful tenderer's earnest money will be discharged upon signing the Contract, and the tenderer would be required to furnish Performance Security indicated under clause-14 of the document.

6 &6& 14 Performance security 14.1 Within 05 days of the receipt of notification of award from the Purchaser, the successful tenderer shall furnish the Performance Security of 10% of the Contract Value valid for 15 months, favouring Finance Officer, Khwaja Moinuddin Chishti Urdu, Arabi-Farsi University payable at Lucknow in the form of Bankers Cheque/ Demand Draft of a scheduled Bank Failure of the successful tenderer to satisfactorily provide the services shall constitute sufficient ground for the cancellation of contract and forfeiture of the performance security. 15 Maintenance Services: This will be a comprehensive Operational and Annual Maintenance Contract (AMC) which would include: 15.1 The firm will make sure to keep the plant in operational condition intact at all time The firm will depute technically sound personnel to maintain the A.C. system and routine visit & cheek-up by engineer & foreman The firm will carry out preventive measures of A.C. system/ Units as per standard schedule of maintenance The firm will repair/replace refrigerant controls, electrical parts of the panel as and when required, free of cost The firm will carry out varnishing; greasing; and servicing of motors connected to the air conditioning system/units, as and when required, free of cost The firm will provide spare parts and consumables such as gas and oil whenever required for replacement during normal wear and tear, free of cost The firm will repair/replace the compressors, motors, during the event of failure, free of cost The firm will carry out gas charges of the system during the leakage of the same (F-22 to be provided), free of cost The firm will repair/replace controls such as filters, driers, expansion, valves, solenoid valves etc. in the event of failure, free of cost The firm will carry out routine cleaning of package units; condensers etc. as and when required, free of cost The firm will carry out varnishing; greasing; and overhauling of pumps as and when required along with repair/replacement of the bearings, free of cost The firm will carry out rewinding of motors during their burnouts, free of cost The firm will check and rectify electrical faults of panel including rectification of the interlocking arrangements, free of cost The firm will keep the units in perfect running condition during the period of contract. 16. The agreement will be for one year. Contract period may be extended for further subsequent years depending upon the requirement and with mutual agreement.

The Purchaser reserves the right to terminate the operation; maintenance and repairs contract at any time without assigning any reasons and the service provider cannot claim any compensation in this respect. 18 We look forward to receiving your tender and thank you for your interest in this Work of University. 19 You are requested to provide your offer latest by 17:00 hours on Late/ delayed tenders received at our end due to any reason whatsoever will not be accepted under any circumstances. The Annual Rate Contract concluded as a result of this Tender Inquiry shall be governed by the Terms & Conditions and other relevant instructions as contained in this Tender Document& the annexure(s) therein. 2. The price/rates quoted should be indicated in words as well as in figures. 3. Tenders qualified by such vague and indefinite expressions such as subject to prior confirmation, subject to immediate acceptance etc. will be treated as vague offers and rejected accordingly. 4. Tenderer may note that if the date of tender opening given in this Tender Document is declared to be a holiday, the tender shall be opened on the next working day at the same time. 5. Tendering firms are at liberty to be present or authorize a representative to be present at the opening of the tender at the time and date as specified in the Schedule. The name and address of the representative authorized to attend the opening of the tender on behalf of a tendering firm should be indicated in the tender. The representative so deputed should also bring with him a letter of authority from the firm for having been authorized to be present at the time of opening of tender. The name and address of permanent representative of the firm, if any, should also be indicated in the tender. 6. Representatives of firms who have not submitted the tender or representatives not possessing authority letter from the tenderers or outsiders shall not be allowed to attend the tender opening process. 7. Authorized Signatory/ Signing of Tender: Individual signing the tender or other documents connected with contract must specify the capacity in which the tender documents are signed as: a.) a sole proprietor of the concern or constituted attorney of such sole proprietor; b.) a partner of the firm, if it be a partnership firm, in which case he must have authority to execute contracts on behalf of the firm and to refer to arbitration disputes concerning the business of the partnership either by virtue of the partnership agreement or by a power of attorney duly executed by the partners of the firm. 8.
