Sealed tenders are invited from manufacturer/firms/agencies/experienced contractors for award of Annual Maintenance Contract of Voltas AC Plant Model No.WCDR 120 OMNT (2 Nos.) and ACDS 33 DMN -1 No. alongwith Air Handling Units/FCUs/Air Washers and allied accessories etc., installed in the Office of the Council. The tenders should be submitted to the Secretary, Medical Council of India, Pocket-14, Sector-8, Dwarka, New Delhi in the prescribed format, which may be obtained from the Office of the Council on any working day upto 04/05/2018 at 400 p.m. on payment of Rs.500/- (non refundable) by way of Pay Order/Demand Draft in favour of Secretary, Medical Council of India, payable at New Delhi. The tenders may also be downloaded from the Council s website i.e. and the downloaded tenders should accompany a Pay Order/Demand Draft of Rs.500/-. Duly filled in tender documents with an earnest money of Rs.10,000/- by way of Pay Order/Demand Draft in favour of Secretary, Medical Council of India, payable at New Delhi may be submitted to the Council Office upto 07/05/2018 at 1100 a.m.. The technical bid will be opened on the same day i.e. on 07/05/2018 at 1130 a.m. in the Office of the Council. The Commercial Bid of the successful bidders, who will qualify the requirements of Technical Bid will be opened thereafter. Medical Council of India (1)

2 The Terms and Conditions of the tender are as follows. TERMS AND CONDITIONS The tenderers shall have to fulfill the following terms & conditions - 1. The manufacturer/firm/agency/contractor should be presently rendering their services for operating and maintaining of similar type of works, in the Govt. sector or large reputed private sector enterprises for atleast two years satisfactorily and also their average annual turnover shall not be less than 10 lacs in the last three consecutive financial years for carrying out the similar nature of work particularly operation and maintenance of AC Plants. 2. Experience Certificate issued by Govt. Organization/large reputed private sector enterprises for having done the AMC work of AC Plants should be enclosed alongwith the tender. (i) Technical Bid Containing various documents as per Annexure-I and superscribed Technical Bid will be opened first and if any of the specifications are not matching with the Council s requirements, the offer will be rejected and no representation will be entertained, whatsoever, and their commercial bid will not be opened at all. Technical Bid should not contain any rates. Please mention full address, name of contract person, Tel. No. and , etc. as per Annexure-I. (ii) Commercial Bid The envelop of Commercial Bid will be opened only of those Tenderers who qualify in Technical Bid and whose specifications are accepted and matched with the requirements of the Council. 3. Tenders duly singed by Authorized Signatory with name & designation to be submitted in TWO separate envelopes, duly sealed. 4. The rates quoted by the tenderer for AMC should be valid for a period of one year from the date of acceptance. 5. The tenderers are required to submit their tender along with a Pay Order/Demand Draft of Rs.10,000/- (Rupees Ten Thousand only) drawn in favour of Secretary, Medical Council of India, New Delhi as Earnest Money, which will be refunded to the unsuccessful tenderers without any interest thereon. Name of the firm, telephone number and AMC for AC may be written on the reverse side of Demand Draft. 6. The EMD of successful tenderer will be kept as Performance Security deposit. The same will be refunded on completion of contractual period successfully and after two months from the payment of last bill. Medical Council of India (2)

3 7. Forfeiture of EMD and Security Deposit i. In case the successful tender fails to enter into agreement within 7 (Seven) days of receipt of communication of acceptance of tender from this office. ii. In case the ontractor fails to take up the work within the specified period and fails to complete the work within the stipulated period. iii. Unsatisfactory service. 8. Tenderers shall have to submit the copy of GST Registration certificate. Copies of PAN number and experience certificate of the company shall also be enclosed. 9. Secretary, MCI reserves the right to reject or accept any or all the tender, wholly or partly, without assigning any reasons thereto. 10. Each page of the tender has to be signed by the tenderer and over-writing, overtyping or erasing of the figures are not allowed and shall render the tender invalid. 11. Even after awarding the said AMC Contract, the Council reserves the right to terminate the same, if the services of the Contractor are not found satisfactory. 12. The service Engineer should reach the site within two hours of time of communication of fault reported. 13. The Service Engineer should visit in the first week of every month for preventive maintenance and obtain service report. 14. The faults should be rectified within a time period of 24 hours, after report. 15. No transportation charges, traveling charges, labour charges etc., will be paid extra. Engaging labour is at the cost of the contractor. No extra payment for any kind of spares, consumables will be paid which is included in the AMC and the tenderer has to attend any kind of problem including problem in compressor. 16. Delay if any in rectification of fault after the specified period will be penalized at the rate of Rs.500/- per day subject to a maximum of 20% of the billed amount claimed for the quarter without prejudice to further action. 17. The components replaced should have guarantee/warranty as prescribed by the Manufacturer. Any faults occurred during the warranty/guarantee period, shall be attended by the tenderer free of cost including components. Only Genuine spares of reputed manufacturer should be used for repairs. 4 18. The contractor should ensure proper care while handling the equipment. In case of any damage caused to the AC unit or to any other equipment or damages caused due to utilization of sub-standard spares, the cost of the damage will be recovered from the contractor. 19. The AMC bill should be submitted by the contractor after completion of every quarter and the same should be submitted within three weeks of particular quarter ending. 20. Contractor shall observe all the relevant rules concerning to his workmen employed by him in carrying out the work and pay any compensation to the workman payable under The workmen s Compensation Act, 1923 for injuries or dis-abilities or death caused in the process of execution of the work. The MCI is in no way will be responsible for the labour/any other person employed by contractor for carrying out of work. 21. Arrangement of necessary tools, instruments and other necessary, items for operation, maintenance and servicing work will be the sole responsibility of the contacting agency. 22. The successful tenderer shall execute an agreement on a stamp paper of Rs.100/ The tender is valid for a period of one year which may be extended further on satisfactory completion of one year of AMC, on the basis of review at the end of the year. MCI is free to withdraw/add AMC for any number of units due to changes in technical requirements at any point of time during the AMC period for which the payment shall be adjusted proportionately. 24. Conditional tender is liable for rejection. Fluctuation in rate of spares during the tender in operation will not be permitted. 25. Force Majeure At any time during the period of contract performance in whole or in part by either party or any obligation under this contract shall be prevented or delayed by reason of any war or hostility, acts of public enemy, civil commotion sabotage, fires, flood, explosion, epidemics, quarantine restriction, strikes, lockouts, or act of God (hereinafter referred to as events) provided notice of happenings of any such eventuality is given by either party to other within 21 days from the date of occurrence thereof neither party shall be reason of such event be entitled to terminate this contract nor shall either party have such claim for damages against the other in respect of such non-performance and work under the contract shall be resumed as soon as practicable after such event may come to an end or cease to exist and the decision of the MCI as to whether the work have been so resumed or not shall be final or conclusive provided further that if the performance in whole or Medical Council of India (4)

5 part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 60 days either party may at his/its option terminate the contract. 26. ARBITRATION In the event of any question, dispute or difference arising under this agreement or in connection therewith except as to matter the decision of which is specifically provided under this agreement the same shall be referred to sole arbitration of MCI or any other person appointed by MCI. Contractor will have no objection in any such appointment that the arbitrator so appointed is an employee of MCI or he has to deal with matter to which the agreement relates or that in course of his duties as a MCI employees he has expressed his views on all or any of the matters in dispute. The adjudication of such arbitrator shall be governed by the provisions of the Arbitration and Conciliation Act 1996 or any statutory modification or re-enhancement there of or any rules made thereof. The venue of arbitration proceedings shall be Office of MCI or such other places as the arbitrator may decide. The arbitrator may from time to time, with the consent of both the parties, enlarge the time frame for making and publishing the award, subject to aforesaid arbitration and conciliation Act 1996 and the rule made thereunder, any modification thereof for the time being in force shall be deemed to apply to the arbitration proceeding under this clause. 27. Termination of Contract The Secretary, MCI may without prejudice to any other remedy for breach of contract may terminate the contract in whole or in part in case i) If the contractor fails to take up the work within specified period or any extension thereof granted by MCI. ii) iii) If the contractor fails to perform any other obligation under terms and conditions of the contract. MCI may also by giving written notice and without compensation to the contractor terminate if the contractor becomes unwilling, bankrupt or otherwise insolvent without affecting its right of action or remedy. 28. Set off Any sum of money due and payable to the contractor (including security deposit refundable to him/her) under this contract may be appropriated by MCI and set off the same against any claim of MCI for payment of sum of money arising out of this contract or under any other contract made by contractor with MCI. Interested parties may send their sealed tender addressed to the Secretary so as to reach on or before 07/05/2018 upto 1100 a.m. which will be opened at 1130 a.m. on the same Medical Council of India (5)

7 SPECIFICATION 1. Periodical inspection and service of the plant once in a month as detailed below - Checking the air conditioning system, comprising of the refrigeration plant, air distribution network, condenser and their respective motors. Lubrication of all bearings whenever found necessary. Adjusting belt tension/replacement of drive belts when found necessary in belt driven components. Checking/rectifying of alignment of couplings in direct driven components. Inspection/rectification of the safety and operating controls for proper operation. Checking and Replacement of pre filters for the air handling units when clogged or dirty. Leak testing and rectifying the same in the refrigeration system. Measuring the efficiency of all the units and bringing them to specification level. 2. Checking the plant components for normal running conditions and rectifying if faulty. 3. Attending of break-down calls and trouble diagnosis whenever called for. 4. Preventive maintenance works, as found necessary such as Cleaning of condenser water tubes in water cooled systems or cleaning of Condenser of coil fins air cooled systems. Cleaning of cooling coil fins. 5. Repairs and overhauling of the components of the plant including replacement of parts. 6. Essential replacement of spares will be provided by the Council. 7. Refilling of consumables like refrigerants gas and oil material will be supplied by the Council. 8. Any other preventive maintenance and break down work required to keep the A/C Plant in good satisfactory conditions during the AMC period. Medical Council of India (7)

10 Annexure II COMMERCIAL BID RATES FOR ANNUAL MAINTENANCE CONTRACT OF AC PLANT With reference to tender No. MCI/TENDER/AC/2018, we M/s. understood the contents of the tender and agree to the terms and conditions therein. We are quoting the following rates for the AMC of your AC Plant. S. Description of Work No. 1. 11 GENERAL CONDITIONS OF CONTRACT 1. The Contactor shall inspect and examine the Site and its surrounding and shall satisfy himself before submitting his tender as to the nature of the Site, the quantities and nature of works and material necessary for providing the services. 2. The Contractor shall be deemed to have satisfied himself before tendering as to the Correctness and sufficiency of his tender for the works and of the rates and prices quoted in the Schedule of Quantities, which rates and prices shall except as otherwise provided, cover all his obligations, under the contract and all matters and things necessary for the proper completion and maintenance of the Works, SECURITY DEPOSIT Security deposit shall be 10% of the accepted tender cost and shall be deposited by the contractor within ten (10) days of receipt of the letter of intent/notification of acceptance of the tender by him. The earnest money deposited shall be converted in initial security deposit. All compensation or other sums of many payable by the contractor under the terms of this Contract or any other Contract or any other account whatsoever may be deducted from the security deposit. Refund of Security deposit Security deposit shall be refundable without interest to the Contractor on certifying in writing that the AMC period of 12 months has been completed satisfactory. Security Deposit will be forfeited in the even if the contract offered in full or in part of not being fulfilled by the Tenderer/Contradictor. LABOUR a) The Contractor shall employ its labour in sufficient numbers to maintain the required rate of progress and of quality of ensure workmanship of the degree specified in the Contract and to the satisfaction of the Engineer-in-Charge. The Contractor shall not employ in connection with the Works any person who has not completed eighteen year of age. b) All the workers or employees deployed by the contractors shall be considered the employees of contractor and Council shall not have any liability what so ever in nature in regard to such workers/employees. c) The Contractor shall pay to labour employed by him directly wages not less than fair wages as per Minimum Wages Act. Fair Wage means wages, which shall include wages for weekly day of rest and other allowances whether for time or piece work, after taking into consideration prevailing market rates for similar employment in the neighborhood but shall not be less than the minimum rates of wages fixed under the payment of Minimum Wages Act. d) The Contractor shall in respect of labour employed by him or his sub-contractor comply with or cause to be complied with the Contractor Labour Regulation in regard to all matters provided therein. 12 e) The Contractor shall comply with the provisions of the payment of Wages Act, 1936, Minimum Wages Act, 1948, Employers Liability Act, Workmen s Compensation Act, 1923, Industrial Disputes Act, 1947, Maternity Benefit Act,1970 or any modification thereof or any other law relating thereto and rules made there under from time to time. f) The Contractor shall indemnify and keep indemnified the Council against. i. Any claim arising out of third pay loss/ damage to life or property caused by/ during execution of work. ii. Any claim arising out of loss/ damage to the workmen engaged by the contractor during execution of the work. iii. Any claim due to non-compliance of applicable PF / Labour laws, regulatins, etc. PAYMENT TERMS Quarterly payment shall be made after completion of a quarter against the bill. Quarter shall mean three months. Statutory taxes likes income tax, contract tax/ GST tax etc. as applicable in the state shall be deducted from the payment. INCOME TAX/WCT/GST Income tax including surcharge if any, at the prevailing rates shall be deducted from the Contractor s bills as per the provision of Income Tax Act. The Contractor shall ascertain from the concerned commercial tax department regarding applicability of Works Contract Tax/GST/TIN. Necessary deductions will be made from the contractor s bill as applicable. REVIEW OF CONTRACT The performance of the firm shall be reviewed every quarter and if the performance is not found satisfactory, the contract will be terminated by giving 15 days notice. TOOLS AND PLANTS The required tools and plants for carrying out the work shall have to be arranged by the Contractor at his cost and no tools will be arranged by the Council. The Contractor shall keep all required tools at site. OTHERS TERMS & CONDITIONS During this period the contractor will be liable for 01 overhauling of plant along with operation during the period of contract. The overhauling is supposed to be carried out at the start of the season/contract/during the winter shutdown period. Plant may be kept shut only on Sundays/ Holidays. The Contractor should deploy adequate number of skilled/semi-skilled persons for operating the plants. The operators are to be competent and have experience in handling Air-conditioning Plants. 13 Experience of workmen. The skilled operator should have at least 05 years of experience in operation and maintenance of Central AC Plant of Similar type. Any part taken out for repairing or changing or for any other purpose must be authorized by engineer in charge by valid gate pass. A logbook is to be maintained for keeping record of parts taken out returned back for record purpose The Council shall supply the consumable materials and spare parts. Any material supplied by the contractor should be of best quality and compatible with the AC plant, that has to be certified by the Engineer In-charge before use of the same in the plant. Scrap generated out of replacement or during work is to be handed over to the Council against written documentation. The contractor will be liable to handover the plant in running condition with all the equipment serviceable at the end of contract or termination of contract. Supervision of personnel provided by the Contractor shall be his responsibility. The Contractor shall ensure the quality of joy performed by his personnel and in case of any complaint; the Contractor shall have to replace the concerned personnel. The Council shall not be responsible for payment of wages an d/ or any other emoluments to the personnel/workers of the Contractor so deployed and it shall be the sole responsibility of the Contractor to make payment to the said personnel/worker in time and the Contractor shall at all time keep the Council indemnified against any claim from its personnel/workers in this regard. All records, documents under various statutory provisions including ESI/PF/Disbursement of monthly Wages shall be maintained by the Contractor and shall be open for inspection by the an authorized representative of the Council and Government Agencies. The service provider shall at his own risk and cost ensure that his employees deployed to carry out the work of MCI are insured against all attendant risks that may be associated with the job. Due to unprecedented rain if water enters central Air Conditioning plant room etc. the draining out of water and keeping the plant room clean and dry is the responsibility of the contractor. The Contractor shall employ only adult trained, efficient and responsible staff with good health and sound mind for operation and maintenance of the Central AC Plant. TIMING OF OPERATION OF THE PLANT OPERATION DEPLOYMENT 1. Timing of Operation As per requirement from 0930 hours to 1800 hours or equivalent hours. It may be required to run the plant beyond normal hours or on other non-working days due to exigencies of work. 2. Deployment of Operators Contractor should deploy sufficient numbers of manpower to complete the overhauling/repairing and maintenance jobs during the contract period and provide suitable number of skilled/semi-skilled staff or operation and maintenance of the plant. 14 PANELTY 3. Prior intimation will be given to the contractor for carrying out operation outside the office hours mentioned above Rs.500/- per day shall be deducted from the payment if complaints are not attended within the given period of time or within 12 hrs. from the time of lodging the intimation. After carrying out the repair, the service personnel shall submit the service report. MAINTENANCE OF RECORDS- The Contractor has to maintain the following records- a) Attendance Register of the Staff b) Daily/weekly/monthly preventive and overhaul maintenance register cum-log book. c) Inspection Register. All the above mentioned Registers shall be checked by the engineer in-charge/or by authorized representative of the Council. FACILITY TO BE PROVIDED BY THE COUNCIL The Council will provide the following free of cost to the Contractor a) Electricity for operation and repair/maintenance of Plant. b) Water CONTRACT PERIOD The period of contract will be one year from the date of award of work and may be extended further depending upon the satisfactory performance and on the same rates, terms and conditions. However, decision of the Secretary shall be final in this case. SAFETY CLAUSE The contractor shall ensure necessary safety measures in compliance with standard norms and practices for operation and maintenance of AC Plant. Medical Council of India (14)

15 PLANTS OPERATION SPECIFIC DUTIES OF OPERATORS. a) Routine operation of the system as per requirement. b) Seasonal starting and stopping of the system as per requirement. c) Taking all required readings regularly, maintaining the logbook record up to date with observations, if any. d) Operations like pump down, removing and charging refrigerant, purging, leak testing, evacuation and dehydration etc. e) Cooling water and chilled water system leakage detection in the plant. f) All other routine inspection to ensure smooth running of the plants as well as those which are otherwise related to satisfactory plant operations, viz., safety related checks. g) Performing all the operations according to standard methods, without damaging other working parts of the system.. h) Maintaining operation logbook for the inspection of Engineer in-charge. i) Taking adequate insurance cover against all risks for the persons deployed by the contractor.
