3 1. INSTRUCTIONS TO THE TENDERERS 1.1 The tenders shall be submitted online through e tendering process only. No tender will be accepted manually or through fax etc. 1.2 The tender form will be available online only. No tender form shall be sold/issued manually from any of the office of the MCED. 1.3 The tender document will be uploaded / released on Govt. of Maharashtra e- tendering website The tenderer is required to download the tender document from this website as per the schedule of activities for online tender document download. 1.4 The tenderer has to pay the cost of the tender document by a online drawn in favor of MCED Kolhapur. At Kolhapur. To download the tender document from the website, the tenderer is required to fill the details of the demand draft he has drawn towards the cost of the tender documents. The tender documents downloaded without filling the details of the demand draft of tender cost shall not be considered as valid tender document. 1.5 At the time of downloading the tender, the tenderer has to fill the details of demand draft towards the cost of the tender documents and generate e-receipt. If e-receipt is not generated, then tenderer will not be able to upload the tender document and the MCED will not be responsible, if the tenderer fails to upload the tender document due to non generation of e-receipt. 1.6 The tenderer is required to download the tender document within the schedule of activity for online tender document download. After expiry of the date and time for tender document download, the MCED shall not be responsible for any failure on the part of tenderer for not downloading the document within the scheduled time even though he has paid the cost of the tender to the MCED. In such case, the cost of the tender paid by the tenderer shall not be refunded. 1.7 During the activity of bid preparation, the tenderer is required to upload all the documents mentioned in the terms & conditions of the technical bid by scanning the documents and uploading it in the PDF format or Zip file. This activity of uploading the documents as well as preparation of commercial bid and other Appendices enclosed with the tender, shall be completed within the schedule given for bid preparation. The tenderer will not be able to submit the technical as well as commercial documents after closing of bid preparation as per time schedule. 1.8 After bid preparation, the tenderer is required to submit the bid again during the activity of submission of bid without which the tender will not be submitted. 1.9 Tenders submitted online will be opened on the schedule date before the participants. At the time of opening of the technical bid the tenderer should bring all the original documents which had been uploaded along with the technical bid so that same can be verified at the time of opening of technical bid, if required by the tender opening committee. If the tenderer fails to produce the original documents at the time of opening of technical bid then the decision of the committee taken on the basis of document uploaded will be final and binding on the tenderer As the tenders are invited online, tenderers are required to upload tender as per the schedule given. The MCED is not responsible for failure on the part of tenderer to upload tender within the time schedule. Sify Nex Tenders on telephone nos ,56 & (Extn.25/26) Tenderers are requested to go carefully through the process of e-tendering given on the website, to avoid disqualification of their tender on any ground The tenderer is required to pay tender processing fee of Rs per tender to e-tendering agency, M/s. Sify Nex Tenders, at the time of filing of their tender through e-payment i.e. through net banking. Details of different modes of online payment to e-tendering service provider is as per Appendix No.10. Non payment of fees will result in non submission of the tender and MCED will not be responsible if the tenderer is not able to submit their offer due to nonpayment of processing fees to the e-tendering agency Any amendment to the tender will be placed on the e-tendering website of the Govt. of Maharashtra. The tenderer will not be communicated separately regarding the amendment. The tenderer should download the amendment. The signed and sealed copy of amendments shall be uploaded during uploading of technical bid as it is being a part of technical documents. However, if the tenderer fails to upload these amendment,then it will be presumed that the tenderer has quoted his/ her rates by taking the note of these amendments. 2 SUBMISSION OF THE TENDER The tender is divided in two parts and required to be submitted online only. Technical Bid (PART I) - Contains technical information such as details of programme, terms & conditions of the tender, documents required to be submitted to become qualified for opening of commercial bid. Commercial Bid (PART II ) - Contains price bid to be filled in by the tenderer. 3. A. TECHNICAL BID( PART I) Technical bid shall contain following documents. These documents shall be in the form of PDF files / scanned image, if required in Zip file. These documents needs to be digitally signed by the tenderer and uploaded in the technical bid during online bid preparation stage. a) EARNEST MONEY DEPOSIT :The Tenderer is required to deposit Rs.5,000/- as Earnest Money through online payment gateway. No EMD will be accepted manually henceforth. Earnest Money will be refunded without any interest to the unsuccessful tenders after award of contract. b) Only MTDC/IATA/ITDC approved agency can apply. c) Minimum 5 years of experience in arranging Study tours within India and outside India. d) Branch office in Keral & Tamilnadu State will be preferred. e) Copy of registration certificate i.e.shop Act or any Govt.organisation. f) Copy of PAN card in the name of firm in case of Partnership or Private Limited Company or in the name of Proprietor in case of Proprietary firm.. g) Copy of GST Number. h) Last three years Balance Sheet duly certified by CA. N.B. : If any of the documents from the compulsory documents as mentioned above at a to h are not uploaded in the technical bid ( Part I ), such tender will be treated as invalid Tenderers submitting insufficient information and / or not fulfilling tender conditions and / or not accepting conditions specified in the tender shall be liable for Seal & signature of the tenderer 4

5 disqualification and Price Bid submitted by such tenderers in Envelope II shall not be opened. 3.(B). COMMERCIAL BID ( Part II) (1) The commercial bid shall contain price for the services. The tenderer is required to quote the price online in the given format. The price quoted in the commercial bid subject to following terms & conditions :- i )The rates shall be quoted separately for service to be provided including Transportation, Travel insurance, Octroi / LBT, entry tax, and GST as applicable. ii) The rate quoted should be valid upto (2) SPECIAL TERMS & CONDITIONS OF THE TENDER. (i) The tenderer will be required to execute an agreement on Rs.100/- stamp paper in the prescribed format of the MCED duly notarized (ii) The payment will be made in three phases as follows :- (a) 50% payment will be released before one week of commencement of tour. (b) (c) 25% payment will be released after commencement of tour. 25% on completion of tour.(if there is no any complaint from participants regarding tour services) 4. GENERAL TERMS & CONDITIONS 4.1 PRICE VARIATION : No Price variation on any account (statutory or otherwise) shall be admissible during the currency of the contract or thereafter. Tenderer shall have to to complete the work as per contract. 4.2 ACCEPTANCE OF TENDER : MCED reserves the right to accept any tender which has been determined to be substantially responsive. 4.3 AGREEMENT & SECURITY DEPOSIT : Tenderer accepting the contract is required to a) Submit Performance Bank Guarantee on Nationalized Bank for the 20% value of order placed valid for the one year with 6 months claim period i.e upto completion of warranty. b) Execute the agreement in the prescribed format on Rs.100/- Stamp Paper valid for one year from the date of Supply Order. 4.4 VALIDITY OF THE OFFER : The validity of the offer shall be up to The validity of this tenders can be further extended if required with the consent of tenderes. 4.5 JURISDICTION : Seal & signature of the tenderer 5

6 As the tender is floated and finalized by MCED at Regional Office Kolhapur if any legal dispute arising out of this tender, First discuss the issues with Regional Officer Kolhapur and then go to Courts in Kolhapur will have exclusive jurisdiction. 4.6 RECOVERY OF DUES : Whenever any claim arises for the payment by reason of default by the tenderer, MCED shall be entitled to recover such amount by apportioning expenditure (in whole or part) any amount retained by MCED. 4.7 GUARANTEE/ WARRANTY : The tenderer should ensure to provide the services to the participants in tour at best quality guarantee. 4.8 SCOPE OF TOUR: o 1 st day :Tour starts from Kudal (at pm) Sindhudurg District to Ernakolum (3.00pm) Pick up from Railway Station and drop at hotel Ernakolum, Stay at Ernakolum. o 2 nd day: Visit to Govt. Offices at Ernakolum and travel from Ernakolum to Allapi after 5.30 pm and stay at Allapi. o 3 rd day : Industrial Visit (coir Training Institute ),Coir Cluster visit Cherthala and after 3 pm site seen travel from Allapi to Kanyakumar Night journey (after pm) o 4 th day: Visit to Tourism places at Kanyakumari and stay at Kanyakumari o 5 th day: Start travelling from Kanyakumari to Trivendrum in the morning and visit to Coir Machinery manufacturer and Coir related Industries and site seen at Trivendram : stay at Trivendrum o 6 th day: Start return journey for Sindhudurg District before noon. MCED shall be entitled to deduct/recover the amount of liquidated damages/penalty as mentioned in clause no. 4.5 above from the current bill payable to the contractor or any other amount due as payable to him against this or any other amount due as payable to him against this or any other contract from MCED or from any of the Govt. consignee. OR To cancel the contract and to take the service from elsewhere on contractor s account at the entire risk and cost of the contractor. In addition to this, to take any other action as may be deemed necessary including blacklisting of the contractor, forfeiture of security deposit, encashment of Bank Guarantee etc GOVT. DIRECTIVES : All specific govt. directives concerning Govt. Purchase Programme as have been issued from time to time shall be applicable irrespective of the fact that it has not been incorporated in this tender specifically RISK PURCHASE : The contractor fails to provide services within the period fixed for such work or at any time repudiates the contract before the expiry of such period, the MCED is entitled to cancel the contract and re-asign the services required at the risk and cost of the defaulting contractor. In the event of such a risk for services to defaulting contractor shall be liable for any loss which the MCED may sustain on Seal & signature of the tenderer 6

7 that account provided the services required, or if there is an agreement to procure the services, such agreement is made, in case of default to services the within six months from the date of such default and in case of repudiation of the contract before the expiry of the aforesaid delivery, within six months from the date of cancellation of the contract FORCE MAJEURE CLAUSE : If, at any time, during the continuance of this contract the performance in whole or in part by either party of any obligation under this contract shall be prevented of delayed by reason of any war, hostility, acts of the public enemy, civil commotion, sabotage, fires, floods, explosions epidemics, quarantine restriction, strikes, lock-outs or acts of God (hereinafter referred to as events ), provided notice of happening of any such eventuality is given by either party to the other within 21 days from the date of occurrence thereof,neither party shall by reason of such event, be entitled to terminate this contract nor shall either party have any claim for damages against the other in respect of such non performance or delay in performance; and deliveries under the contract shall be resumed as soon as practicable after such event has come to an end or ceased to exist, and the decision of the MCED as to whether the deliveries have been so resumed or not, shall be final and conclusive, provided further that if the performance in whole or part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 60 days, either party may at its option terminate the contract PROVIDED ALSO that it the contract is terminated under this clause, the purchase shall be at liberty take over from the contract at a price to be fixed by the MCED which shall be final all unused, undamaged and acceptable materials bought out components and stores in course of manufacture in the possession of the contractor at the time of such termination or such portion thereof as the MCED may deem fit accepting such material, bought out components and stores as the contractor may with the concurrence of the MCED elect to retain MCED reserves the right to accept or reject any or all tenders without assigning any reason whatsoever and the decision of MCED in this regard shall be final and binding on all tenderers. 8 ANNEXURE-II TOUR PACKAGE ARANGEMENT OF STUDY TOUR AT KERAL, TAMILNADU FOR JOURNALIST & OFFICERS OF COIR PROJECT OF SINDHUDURG DISTRICT 6 days 5 nights Sr. Details of Services Required Rates (including all taxes) a. Railway Tickets (AC 3-tire from Kudal to Ernakolam and return for 50 persons (Age Group 40-60). During Travelling Lunch,Tea,Break-fast should be provided Veg/Non Veg as required b. Tea, Snacks-(Veg-Non Veg),Lunch,Dinner (Veg-Non Veg) For 5 days - 50 persons. c. Transportation/Travelling arrangement pick up(on arrival) from Railway Station Ernakolam to drop (at Departure from Keral tour) at Railway Station. Vehicle /Bus should be made available for 50 person for 5 days travelling to study tour places i.e. Allepey,Kovalam, Ernakulam, Trivendram, Kanyakumari. The vehicle shouled be made available from during at 8 am to 8 pm d. Travel Insurance of 50 persons. Remarks Tour Package Cost (6 days and 5 nights) Note: 1. All prices should be including all taxes(e.g.gst) etc. 2. Co-ordinator :,one local persons should be made available during 5 days at Keral for escort services. 3.The rates are valid upto Seal & signature of the tenderer 8
