1 CITY OF ELK GROVE CITY COUNCIL STAFF REPORT AGENDA ITEM NO. 8.7 AGENDA TITLE: Adopt resolution dispensing with competitive bidding and authorizing the City Manager to execute an agreement with CDW Government for the purchase of Microsoft Office Professional Plus software licenses for the Elk Grove Police Department in an amount not to exceed $95,000 through a cooperative purchasing agreement MEETING DATE: October 8, 2014 PREPARED BY: DEPARTMENT HEAD: Nicole York-Singh, Management Analyst Robert Lehner, Chief of Police RECOMMENDED ACTION: Staff recommends that the City Council adopt a resolution dispensing with competitive bidding and authorizing the City Manager to execute an agreement with CDW Government for the purchase of Microsoft Office Professional Plus software licenses for the Elk Grove Police Department in an amount not to exceed $95,000 through a cooperative purchasing agreement. BACKGROUND INFORMATION: The Police Department currently has 126 sworn officers and 75 non-sworn personnel. Each desktop and portable computer is currently running Microsoft Office 2007; this software is now over six years old. As part of a planned department-wide software replacement plan, each desktop is scheduled to be updated with Microsoft Office Professional Plus. This 1

2 Elk Grove City Council October 8, 2014 Page 2 of 2 upgrade is consistent with best management practices and will allow for improved compatibility with other City Departments. If approved, this purchase shall be made pursuant to Elk Grove Municipal Code Sections (B)(4) and , which provide an exception to the competitive bidding process when the purchase is processed through a cooperative purchasing agreement with another public agency whose procurement process is consistent with that of the City of Elk Grove. The Department will utilize federal General Services agreement (GSA) #SLP W, whereby the most competitive pricing for this particular commodity has been secured by this cooperative purchasing organization. FISCAL IMPACT: There is sufficient funding identified in the Police Department s Fiscal Year capital outlay budget for this purchase. ATTACHMENTS: 1. Resolution 2. Contract 2

3 ATTACHMENT 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK GROVE DISPENSING WITH COMPETITIVE BIDDING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH CDW GOVERNMENT FOR THE PURCHASE OF MICROSOFT OFFICE PROFESSIONAL PLUS SOFTWARE LICENSES FOR THE ELK GROVE POLICE DEPARTMENT IN AN AMOUNT NOT TO EXCEED $95,000 THROUGH A COOPERATIVE PURCHASING AGREEMENT WHEREAS, the Police Department currently has 126 sworn officers and 75 nonsworn personnel using desktop and portable computers; and WHEREAS, the current software in use, Microsoft Office 2007 is over six (6) years old; and WHEREAS, as part of a planned department-wide software replacement plan, each desktop and portable computer is scheduled to be updated with Microsoft Office Professional Plus; and WHEREAS, updating software is consistent with best management practices and will allow for improved compatibility with other City Departments; and WHEREAS, this purchase will be made pursuant to Elk Grove Municipal Code Section which provides an exception to the competitive bidding process when the purchase is processed through a cooperative purchasing agreement with another agency whose procurement process is consistent with the City of Elk Grove; and WHEREAS, the federal Department of General Services Administration (GSA) has secured the most competitive pricing for this particular commodity; and WHEREAS, the Police Department has sufficient funding in its Fiscal Year capital outlay budget for this purchase; and WHEREAS, the City Council may dispense with competitive bidding under the Elk Grove Municipal Code, where, as here, the purchase is processed through a cooperative purchasing agreement with another public agency. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk Grove hereby dispenses with competitive bidding and authorizes the City Manager to execute an agreement with CDW Government for the purchase of Microsoft Office Professional Plus software licenses for the Elk Grove Police Department in an amount not to exceed $95,000 through a federal General Services Administration cooperative purchasing agreement.
