Sherwood 6.3 Appointment of Auditors Recommendation: THAT the Council of the Township of Centre Wellington hereby appoints KPMG the auditors of the Corporation to hold office until the completion of the next annual meeting of the shareholders of the Corporation, or until a successor is appointed, at such remuneration as may be fixed by the Board of Directors and the Board of Directors is hereby authorized to fix such remuneration. 7. RFT #22-17 for the replacement of structure 9-WG to MTM-2 Contracting Inc. of Milton in the amount of $943, excluding the HST and inclusive of contingency allowance in the amount of $25, RFT #21-17 for the replacement of culvert structure 32-WG to Reeves Construction Limited of Mount Forest in the amount of $227, excluding the HST and inclusive of contingency allowance of $15, AND THAT the funding for these two projects be amended as outlined in Corporate Services Report COR-31. Summary: The estimate of total project cost over budget for all four (4) of the subject tenders materially exceeds the approved capital budget. This is partly because of a high volume of municipal and Provincial road and bridge construction activity, driven in part by Federal and Provincial capital grants. The attached Appendix 'A' is a summary of the four tenders, showing action and timing. Report: The subject tenders were advertised on the Township of Centre Wellington Web Site ( and on the approved Web Site ( Request for Tenders #20-17 and #22-17 The scope of work is described as follows: Page 3 of 13

4 1. Request for Tender #20-17 is for the removal of the existing bridge structure 10- P located on the 4th Line East over the Irvine Creek in the former Township of West Garafraxa, and construction of an 11.2 metre span semi-integral abutment bridge with pre-stressed concrete box beams. 2. Request for Tender #22-17 is for the removal of the existing bridge structure 9- WG located on the 7th Line over the Irvine Creek in the former Township of West Garafraxa, and construction of a 12.9 metre span semi-integral abutment bridge with prestressed concrete box beams. The attached map (Appendix 'B') shows the location of the two bridges (9-WG is in the upper right hand corner, and 10-P is in the lower left hand corner). As indicated on the map, both bridges are closed. Further, structure 8-WG located to the north of 9-WG is weight restricted. Closure of 8-WG combined with the existing closure of 9-WG would make the properties located between the two bridges inaccessible by motor vehicle. The completion date of work for both tenders is prior to November 24,, with all inwater work commencing after July 1,. Bids were submitted by the firms in the amounts as listed below (prices exclude the HST, and include contingency allowance of $35,000/$25,000 for #20-17/#22-17 respectively). #20-17 Bridge Structure 10-P: 1. Reeves Construction Limited (Mount Forest) $733, (price as submitted; $733,515.00) 2. Xterra Construction Inc. (Kitchener) $927, McLean Taylor Construction Limited (St. Mary's) $947, Ontario Ltd. o/a Bronte Construction (Oakville) $993, (price as submitted; $998,244.40) 5. Sierra Bridge Inc. (Woodstock) $1,096, ($1,121,840.60) #22-17 Bridge Structure 9-WG: 1. MTM-2 Contracting Inc. (Milton) $943, ($655,140.00) 2. Finnbilt General Contracting Limited (Stratford) $1,133, Sierra Bridge Inc. (Woodstock) $1,166, (price as submitted; $1,176,283.90) Ontario Ltd. o/a Bronte Construction (Oakville) $1,194, The bids were checked for errors and omissions by staff, and mathematical errors were found in the bids as indicated above with the prices as submitted in brackets. The attached schedule 'C' is a financial analysis of the low bids received from Reeves Construction Limited and MTM-2 Contracting compared with the approved capital budget. As the analysis shows, there is sufficient funding available to award the low bid for one of the two tenders. Page 4 of 13

5 Based on the foregoing, it is recommended that Request for Tender #22-17 for the replacement of structure 9-WG be awarded to the lowest responsive and responsible bidder; MTM-2 Contracting Inc. of Milton in the amount of $943, Request for Tender #21-17 The scope of work is for the replacement of culvert structure 32-WG located on the third Line in the former Township of West Garafraxa, and includes: Supply, assembly and installation of a 3 890mm (span) by 2 690mm (rise) structural plate pipe arch Removal of the existing structure Supply, assembly and installation of new culvert, structural backfilling and steel beam guiderail The location of culvert structure 32-WG is almost one concession below the top right of the attached map (Appendix 'B'), south of Metz in the former Township of West Garafraxa. The completion date for all works is by no later than October 15,. The following six (6) firms submitted a response in the amounts as listed below (prices exclude the HST, and include contingency allowance in the amount of $15,000.00): 1. Reeves Construction Limited (Mount Forest) $227, Wellington Construction Contractors Inc. (Palmerston) $232, (price as submitted; $232,124.85) 3. Cox Construction Limited (Guelph) $246, Xterra Construction Inc. (Kitchener) $254, Drexler Construction Limited(Rockwood) $285, Capital Paving Inc. (Guelph) $364, The tenders were checked for errors and omissions by staff. A minor mathematical error was found in the bid submitted by Wellington Construction Contractors Inc.. The price as submitted is in brackets. The attached financial analysis (Appendix 'D') shows a breakdown of the low bid received from Reeves Construction Limited compared to budget, and recommended funding of the excess of estimated cost over budget in the amount of $139, Request for Tender #17-17 The scope of work is for the reconstruction of Princess Street from the Grand River to Church Street (Elora), and for the construction of watermain on Wellington Drive from Cuthbert Street to Cuthbert Street (Elora), the locations for which are as shown on the attached map (Appendix 'E'). 6 The contractor is required to maintain one lane of two way traffic at all times on Mill Street East, and to reopen Mill Street East to two lanes of traffic at the end of each working day, or use temporary traffic control signals. Princess Street, and Wellington Drive may be closed to through traffic. Local access, access for emergency vehicles, and business access including pedestrian access to businesses is to be maintained at all times. The completion date for all works on Wellington Drive is by September 1,, and for Princess Street is by November 1,. The following two (2) firms submitted a response in the amounts as listed below (prices exclude the HST, and include contingency allowance in the amount of $80,000.00): 1. Drexler Construction Limited (Rockwood) $1,394, (price as submitted; $1,394,907.00) 2. Steed and Evans Limited (St. Jacobs) $1, The tenders were checked for errors and omissions by Triton Engineering. A minor mathematical error was found in the bid submitted by Drexler Construction Limited. The price as submitted is as shown in brackets. The attached Financial Analysis (Appendix 'F') shows a breakdown of the low bid received from Drexler Construction compared to budget. As the analysis shows, the estimated total project cost of the low bid exceeds project funding of $1,095,000 by $525,129. The tender has been cancelled, and staff will review for an appropriate time to reissue. Financial Implications: See discussion above.
