Cntext 1.1 The Eurpean Health Insurance Card Strybard Cmpetitin 2014 is a cmpetitin inviting interested cntestants t submit a strybard and accmpanying synpsis n the Eurpean Health and Insurance Card (hereafter EHIC ) by the Eurpean Cmmissin s Directrate General fr Emplyment, Scial Affairs and Inclusin (hereafter the Eurpean Cmmissin ). 1.2 EHIC is a free card issued by natinal health insurance prviders in each cuntry. It allws users t access publically-prvided healthcare during a temprary stay in any EU Member State as well as Iceland, Nrway, Liechtenstein and Switzerland allwing them t take advantage f exactly the same cnditins as peple insured in that cuntry. Fr mre infrmatin abut the card, visit the website: The cmpetitin website is hsted n (hereinafter the Website ). 1.4 The cmpetitin will be pen until the 17th f August, 2014, midnight, CET. 1.5 The Eurpean Cmmissin is lking fr a synpsis and a strybard that present a stry thrugh sketches in chrnlgical sequence. The stry and images shuld reflect the idea behind the Eurpean Health Insurance Card and cnvey at least ne f the fllwing messages: Expect the unexpected (when n hliday r travel in Eurpe) EHIC is fr free (sme websites / cmpanies are charging citizens t btain a card that is and will remain in fact free f charge). Raise awareness f EHIC amng dctrs and medical facilities (fcus n thse giving rather than receiving healthcare). 2. General guidelines t participate in the cmpetitin 2.1 The cmpetitin is pen t citizens aged 18 and ver frm any EU Member State as well as Iceland, Nrway, Liechtenstein and Switzerland. If under the age f 18, a parent r a legal guardian must sign the entry frm. Participants cannt be legal entities. 2.2 The entry must cnsist f: A cmplete and signed entry frm (available n the Website) A cpy f a valid ID dcument A synpsis that may nt exceed 250 wrds in English r French r German language A strybard that must respect the fllwing: Have between 6 and 16 illustrated panels Tell a stry that features the Eurpean Health Insurance Card Include a descriptive written summary underneath each scene, explaining what the scene is abut in in English r French r German language 3

Only cmplete entries will be cnsidered. 2.5 Only ne entry will be allwed per registratin frm. 2.6 By entering the cmpetitin, each participant grants free, perpetual, irrevcable, nn-exclusive license t the Eurpean Cmmissin, fr their entry. The Eurpean Cmmissin reserves the right t use, reprduce, amend, adapt, alter, publish, distribute and view the submitted strybard and synpsis n the Eurpean Cmmissin's websites and any ther media channels. 3. Apprval 3.1 All the entries will be reviewed by a jury that will be cmpsed f independent audi-visual prfessinals and representatives f the Eurpean Cmmissin. They will select three finalists and their entries will then be published n the website. At this stage a public vte will determine the winner, secnd and third place, with peple chsing their favurite finalist and the mst vtes being awarded first prize. 3.2 The jury will be lking fr an imaginative and exciting stry that is bth clear and cmprehensible. They will als cnsider whether the entry is cmpliant with the guidelines utlined in these Terms and Cnditins. The jury undertakes t examine and select the 3 finalists within a reasnable time. 4. Prizes 4.1 The winning authrs will be rewarded with the fllwing amunts f mney: Eur 1.500,00 fr the winner; The verall winning cncept will be will als be develped, adapted and prduced int a vide, which will be used t prmte the Eurpean Health Insurance Card. 4

5 Eur 1.000,00 fr secnd place; Eur 500,00 fr the third place. 4.2 The prizes are as stated and are nn-transferable and cannt be exchanged. N cash r credit alternatives will be ffered, if due t circumstances beynd the prmter's cntrl the prmter is unable t prvide the stated prize(s) f equal r higher value. 4.3 The Eurpean Cmmissin reserves the right nt t select any entry frm amngst thse sent during the cmpetitin and the authrs cannt, in any event, claim r expect any frm f payment r cmpensatin whatsever. 4.4 The entry frm accmpanied by a phtcpy f a valid identificatin dcument and any further dcument which may be requested must be prvided t the Eurpean Cmmissin in rder fr the submissin t be validated. 4.5 The Eurpean Cmmissin reserves the right nt t develp, adapt and prduce int a vide any f the strybards submitted. 5. Management f explitatin rights 5.1 All the wrks which enter this cmpetitin shall be submitted t these Terms and Cnditins. 5.2 Upn payment f the cmpensatin in terms f article 4.1 f these Terms and Cnditins, any and all rights f explit the selected strybards and synpsis shall be deemed t have been assigned t the Eurpean Cmmissin and/r its assignee, withut any limitatins f time. These rights include but are nt limited t rights f reprductin, rights t shw in public, right t derive ther wrks therefrm, transmissin t the public, making vides available t the public, distributin, translatin, hire and lending in every frm and with any means nw available r which will becme available in the future and with the right t assign t third parties. 5.3 The authrs f the selected strybards and synpses undertake t sign the dcuments and t fulfil any requirement which the Eurpean Cmmissin and/r its assignee, at its discretin shall deem necessary in rder t exercise, prtect r enfrce any right given by the Terms and Cnditins fr participating in the cmpetitin. 6. Limitatin f liability The Eurpean Cmmissin des nt assume any respnsibility with respect t any technical malfunctin f the hardware r sftware, interruptin t the Internet cnnectin, failed, incrrect, inaccurate, incmplete, illegible, damaged, lst, delayed, incrrectly addressed r intercepted registratin by users, r any ther registratin by users which fr any reasn was nt received by the Eurpean Cmmissin, electrnic cmmunicatins f any ther kind which were delayed r any ther technical prblem linked t the registratin by users and t the uplad f the strybards in the curse f this initiative. Likewise, the Eurpean Cmmissin des nt give users any guarantee f prper functining f the Website and f the prgrams frming part theref. 5

6 7. Exclusins 7.1 Entries which the Eurpean Cmmissin, at its sle and unquestinable discretin, shall deem t be unsuitable fr publicatin may be excluded. Als, the Eurpean Cmmissin reserves the right t prhibit access t the Website t thse users which have been held liable fr any illegal deed. By way f example, the Eurpean Cmmissin reserves the right t exclude wrks which cntain material which is in breach f third party rights (breach f industrial/intellectual prperty rights), culd be cnsidered discriminatry based n race, and/r religin and/r natinality; is vilent, prngraphic r f a sexual nature; is defamatry; incites hatred; cntains reference t alchl, drugs r illegal substances; is cntrary t law r cntains reference t ill-treatment f animals. 7.2 Als n cnsideratin shall be given t entries which fall utside the theme, d nt cmply with the frm and cntent required and described in detail in the brief f the cmpetitin and in these Terms and Cnditins. Users wh use fraudulent means r means which are in breach f the nrmal develpment f the cmpetitin and users wh, as an example but nt limited t, hinder the registratin prcess by ther users, manipulate the prper functining f the Website, r manipulate the public vte, r, in any ther way breach the Terms and Cnditins, may als be excluded frm taking part in the cmpetitin. The Eurpean Cmmissin reserves the right t prceed, as deemed pprtune and in line with current laws in frce, t limit and curtail any actin aimed at circumventing the applicable system. Any fraud r attempted fraud shall be duly reprted in terms f law. 7.3 Emplyees and immediate relatives f emplyees f the Eurpean Institutins (this includes Managing Authrities, Intermediate Bdies, Jint Technical Secretariats, etc.) r any ther persn cnnected with this cmpetitin are excluded frm participatin. Participants cannt be legal entities. 8. Warranties and indemnificatin 8.1 By participating in the cmpetitin, participants represent and warrant: That the strybards and synpses submitted by them d nt cntain any material which is in breach f the rights, pleas and claims f third parties whether financial r persnal (ref. t Law 633 f 1941, t Law N. 196 f 2003 and ther applicable laws and regulatins); That they have btained frm all persns appearing and/r present n the strybards all the required authrizatins and releases in accrdance with these Terms and Cnditins including with respect t Law N. 196/2003 and/r ther applicable cpyright laws, that they will, upn request by the Eurpean Cmmissin, prvide the relative evidentiary dcumentatin within 5 days frm request; that they have btained written authrisatin frm the parents and persns having parental authrity fr strybards which shw minrs r disabled persns; That the strybards and synpses d nt cntain any material which, in terms f current laws in frce, cnstitutes advertising material r is in any case illegal in terms f current laws r regulatins; That the strybards are freely and legally explitable in accrdance with the prvisins f these Terms and Cnditins, that the participant is the authr f 6

7 the wrk and the nly hlder f the rights f explitatin therefre, r that he has acquired the authrisatin f all the persns having any such rights theren, having prperly fulfilled any requirement and/r satisfied any right even f a financial nature, pertaining t the relevant right-hlders. Participants cannt use the wrk f anther right-hlder withut his explicit cnsent. That they are fully aware that any liability, including criminal liability, with respect t each wrk lies with the user that has submitted the entry. 8.2 Users agree t hld harmless and indemnify the Eurpean Cmmissin and its third parties assignee, frm claim r legal actin (including reasnable legal expenses) cnnected t r deriving frm the use f the entries submitted by them r the rights assigned in accrdance with the Terms and Cnditins and the breach f the representatins and warranties set in these Terms and Cnditins. 8.3 Users declare that they are fully aware that the participatin t the cmpetitin des nt give rise t any inherent right r t any frm f cnsideratin. 8.4 The Eurpean Cmmissin reserves the right at any time and frm time t time withut any liability whatsever, t mdify r discntinue, temprarily r permanently this cmpetitin, with r withut prir ntice t Participants. 9. Privacy Persnal data cllected within the scpe f this initiative shall be treated in terms f the Privacy Statement available n the Website. The prcessr f the data is the Eurpean Cmmissin and Tipik, which will be wrking with the Eurpean Cmmissin t prmte, prepare and carry ut the cmpetitin. 10. Acceptance Participants t the cmpetitin declare that they accept and agree with these Terms and Cnditins in full. 7
