1 Terms of Reference(ToR) for Outsourcing of Biomedical Waste Management Services, DHH Kendrapara 1. Along with the Application following Document will submitted as bellow. (a) NGO/ Farm/ Company/ Trust Registration Number. (b) Valid Labor License. 2. The tender cost will be Rs (Five hundred only) in shape of Demand draft in any nationalized bank in favour of Rogi Kalyan Samiti, DHH Kendrapara. 3. Local bidder will be give preference 4. All the workers engaged by the outsourcing agent shall have uniform. 5. All staffs of the organization shall bear photo identity card during the period of work, which shall be duely signed by the CDMO of the concerned hospital and representative of the organization. 6. All the personnel to be engaged by the organization should be covered under the statutory government regulations framed from time to time. 7. The contractor will abide by all the rules and regulations relating to labour laws, accident, workmen compensation act, workmen insurance, ESI, PF, etc.. This will be the sole responsibility of the contractor. The hospital authority will not be a party at any stage to any kind of dispute relating to the above. In case of any liability arises due to non performance by the contractor, under no circumstances, the hospital authority shall be liable for the same. 8. Successful bidder will submit Rs 10, security deposit (Refundable) in shape of Demand Draft in any nationalised Bank. 9. Any damage/ pilferage to the hospital property due to mishandling, carelessness of the contractor or his workmen will be recoverable from the contractor s bill and all materials issued to the contractor shall be his sole responsibility during the period of the contract. 10. The contractor should depute a qualified and dedicated staff to manage the waste management activity in the hospital and will coordinate in executing the same with the waste management committee of the hospital and be responsible for supervision of the work.

2 11. Agency will be responsible for collection, transportation, dispose of general waste by coordination of Kendrapara Municipality. 12. All the employees will have to be covered under insurance against any personal accidents and the hospital authority will not be liable for payment of any compensation on that account. 13. During execution of work, the contractor should follow all standard norms of safety measures / precautions to avoid accidents/ damages to men, machines and buildings, etc.. On non performance to this clause suitable fines as decided by the Hospital Authority will be imposed. 14. Agency will provide all protective material & immunised for handling of BMW like Apron, Gum Boot, Mask, Cap, Rubber utility gloves, Hepatitis B, TT Injection. 15. Service provider will collect the segregated waste from the Waste generating point before 8 A.M. of every day and put the new colour coded polythene at the generating point. 16. The shredder & Autoclave will be functional by the agency & it will be operated by a supervisor cum Operator. it also repair in his own cost. 17. Temporary storage at health care unit shall be designated coloured containers with cover. Each bag shall be labelled as per the Schedule III & IV of the BMW(H&M) Rules The coloured containers shall be strong enough to withstand any possible damage that may occur during loading, transportation or unloading of such containers. These containers shall also be labelled as per the schedule III of the rules. Sharps shall be collected in the Puncture proof Container (PPC). The person responsible for collection of biomedical waste shall also carry a register with him to maintain the records such as name of the generation point, type and quantity of waste received, signature of the authorized person, day and time of collection, etc. 18. The collection and transportation of bio-medical waste shall be carried out in a manner so as to avoid any possible hazard to human health and environment. The timing of collection of the waste can be fixed after discussing with the waste management committee of the concerned hospital.

3 19. The final monthly triplicate bill will submit with consolidated report 1 st week of next month with monthly waste report. 20. Service provider s person shall not claim any type of compensation/ absorption/ regularization/ benefit (Health related also) of service from this office under Industrial dispute Act, 1947 & Contract labor act The service provider s person shall not consume alcohol, betel, smoking during the duty hour. 22. The person s any type of misconduct found the will agency must change the person. 23. This office will maintain the attendance register. The agency will prepare duty list & submit this office in the last week for next the month. Absent of duty not allowed at any cost the alternative arrangement of duty should be maintained by the agency with communication to this office. 24. The agency must submit the name of contact person with mobile number (24 hours functional) which will may contact in emergency condition. 25. The contract will period for one year & it can be renewable with the satisfactory performance. 26. As per the provisions of Biomedical Waste (Management and handling) Rules 1998, waste falling in most of the categories can be treated in systems based on non-burn technologies. Such waste account for about 90% of the total waste streams in a health care unit. It is mandatory to impart incineration/ deep buriel (depending upon the population of town) to anatomical and other types of waste falling under categories 1 and 2. Therefore an incinerator of adequate capacity to cater only categories 1 and 2 waste shall be installed (if secured landfill

4 is not available, category 5 may also be incinerated.) The waste falling under category 5 i.e. discarded medicines, cytotoxic drugs and category 10 i.e. chemical wastes (solid) can be disposed in a secured landfill. 27. Log book: A log book shall be maintained for each treatment equipment installed at the site and shall include the following: o The weight of each batch. o The categories of waste as per the rules. o The time, date and duration of each treatment cycle and total hours of operation. o The complete details of all operational parameters during each cycle. o Site records: Site records shall include the following: o Details of construction or engineering works. o Maintenance schedule, breakdowns/ trouble shootings and remedial actions. o Emergencies o Incidents of unacceptable waste received and the action taken. o Details of site inspections by the officials of the regulatory agency and necessary action on the observations. o Daily, monthly and annual summery records of all the above shall be maintained and made available at the site for inspection whenever required by an authorised officer of regulatory agency. 28. In event of any dispute arise in the clause of agreement both the parties will resolve the matter mutual understanding & negotiation. 29. All legal disputes subject to jurisdiction of Kendrapara court only.
