1 TENDER SCHEDULE FOR MAN-POWER SUPPLY CONTRACT IN GANDHAMARDHAN REGION, OMC LTD. FOR THE YEAR (w.e.f. 1/08/2017 to 31/03/2018) TCN No.10/OMC/ROG/2017 Dtd.27/06/2017 Sealed quotations are invited form experienced agencies for supply of different category of manpower fulfilling the eligibility criteria as given below in two parts i.e. part-i Technical Bid as per Annexure-I and Part-II Price bid as per Annexure-II. The sealed offer will be received up to 12:00 noon on 20 th July 2017 at Personnel Section of our Regional office, Gandhamardan Iron Ore Mines, Suakati and at the office of A.G.M.(M), at H.O. through Tender Box kept for the purpose. The Tenderer can also send their Tender with all documents through Regd. Post/Courier which should reach at us before 12:00 noon on 20 th July Tender will be opened on 22 nd July at 10:00 A.M. at our Conference Hall of Regional office at Gandhamardan, Suakati. Eligibility Criteria:- 1. The Agency/Bidder should have the following valid documents in the name of it s establishment. i) EPF Code No. (Copy to be submitted) ii) iii) iv) Service Tax Regd. No. (Copy to be submitted) PAN (Copy to be submitted) Labour License (Copy to be submitted) 2. Experience at least 2 years in similar type of work (Documentary evidence such as Work Order, Agreement and Performance Certificate of the Organization where engaged). 3. Turnover of the bidder from the similar work shall be at least 50% of the estimated annual work value of Rs.85,000,00/-(Rupees eighty five lakh) only (Approximately) on any financial year during last 03 Financial Years. Scope of work: - Supply of Un-skilled, Semi-skilled & Skilled man-power for different work as per our requirement, by the Labour Supply Agencies. Deployment of required no. of manpower through the Labour Supply Agency for cleaning and sweeping, cutting of bush, survey work, electrical maintenance work, supervision work, canteen management as well as Guest House Attendants., Cooks, Civil construction work, Camp repairing & maintenance work, attending of different misc. official work in mines and offices, supply of water, messenger work and Data Entry work etc. Category of different types of manpower may be defined or reference may be given where it has been defined. 2 Period of work: - Initially, the execution of contract shall be for a period of 10(Ten) months to Based on satisfactory performance and with prior approval of Competent Authority, the contract shall be extended annually for further two years at same rate terms and conditions at the discretion of Management. EMD/ISD:- The Agency is required to deposit EMD an amount of Rs.1,00,000/-(Rupees one lakh) only (Excluding service charges) estimated as per annual requirement of the Region in shape of Pay Order/Bank Draft from any Scheduled Bank in favour of O.M.C. Ltd. payable at Bank of India, Suakati and State Bank of India, Keonjhar. EMD of unqualified bidder (not qualifying in Technical Bid) shall be refunded along with sealed price bid within 07(seven) days. EMD of un-successful bidder (bidder qualified in Technical Bid but not successful in Price Bid) shall be refunded within 07 (seven) days of the opening of the price bid excluding L-2 bidder which shall be refunded with 07 (seven) days of placement of Work Order. EMD of successful shall be adjusted against the demand of ISD. The successful bidder shall be required to deposit 5% of the work value (including service charge) less EMD before Agreement. Amount of ISD shall be refunded to the Agency after successful completion of contract. Sale of Tender Documents:- Tender papers will be available in the OMC Regional office, Gandhamardan and can be purchased by any interested Tenderer from the said office on payment of cost of tender paper of. Rs.500/-(Rupees five hundred) plus VAT of Rs. 25/- = Rs.525/-(Rupees five hundred twenty-five) only which may have been specified in the Tender Schedule as well as the same can also be downloaded from the O.M.C. website. Price to be quoted:- The Tenderer should quote only Service Charges as % (percentage) in the price bid which will be over and above the minimum wages plus VDA as per Minimum Wages Act of Govt. of India payable to each category of man-power plus employer s PF contribution borne by him. Payment Clause:- (i) No advance payment will be considered. (ii) The monthly bill will be submitted by the Agency at respective Mines/Camp/Regional office as per Rule-4A of Service Tax for the engagement of man-days. The monthly wages sheets and EPF deposit documents, evidence of Bank payment are to be submitted and verified by the Authorized Officer concerned. Before release of monthly bill, Income Tax as applicable will be deducted from the bill of the Agency. (iii) The VDA enhanced by the Govt. of India from time to time if any will be paid during execution of contract.

3 (iv) (V) Service Tax as applicable under reverse mechanism will be claimed by the Service Provider in the bill which will be paid extra. The evidence of the Service Tax deposit will be produced by the agency with the bill for verification. The Agency shall pay monthly remuneration to the individual concerned manpower through RTGS/NEFT/Core banking method by 10 th day of the succeeding month. The Agency shall instruct the Bank concerned to disclose the information of above payment to O.M.C. Hence, payment to the Agency by OMC for each category of man-power would be:- a) Minimum Wages plus VDA of each category. b) Employer s PF contribution on a above. c) Service charges as a percentage (%) finalized during tender on (a+b). d) Service Tax as applicable on (a+b+c) to be deposited by Agency. Other Terms & Conditions: a) The successful Tenderer shall have to enter into an agreement with OMC Ltd., Bhubaneswar. b) If the successful bidder fails to enter agreement or does not accept the work order, the EMD will be forfeited. c) The contractor shall have to keep adequate man-power to meet the requirement and replacement. d) The contractor shall have to maintain all statutory registers and records as per Central Labour Laws applicable to the mines and produce the same before inspecting authorities as & when required. e) The contractor shall be responsible for payment of wages and other dues as may be applicable to his workers as per Mines Act and Rules, Minimum Wages Act, Payment of Wages Act, Bonus Act, Gratuity Act, Provident Fund Act, Workmen s Compensation Act and MB Act, 1961 and Rules framed by Govt. of India and as will be amended from time to time. f) Ten(10)% of the total monthly bill value shall be held up towards the final dues of the Workers, which shall be released during the disbursement of final dueson completion of the contract.

4 g) The contractor has to provide accommodation to his staff and workers. h) Civil and criminal liability for any act of supplied labourer shall be the responsibility of the Agency. i) In no case any escalation in service charge will be allowed during the contract period. j) The amount of ISD of the Agency shall be forfeited in case he does not attend the work properly. No interest shall be due and paid on the amount of EMD/ISD deposited by the Agency. k) Transport facilities to work site for the mazdoors will be arranged by the Agency at its own cost. l) The OMC Management reserves the rights to cancel the contract at any time, without assigning any reason thereof by giving one month s notice. m) The Agency/Contractor should extend all possible co-ordination for execution of the desired work with OMC Management (to the In-charge of the work). n) Sub-letting of work in whole or part cannot be made/assigned to any other Agency/Person whatsoever. o) Not-withstanding anything contained in any clauses, the OMC Ltd. reserves the right to withhold any of the dues payable under this contract or adjust the same against any dues recoverable from the agencies under any other Agreement or otherwise and similarly any dues not recovered under this agreement shall be subject to recovery from any other dues payable to the Agency under any Agreement/Contract or otherwise and the decision of OMC Ltd. shall be final. p) The management reserve the rights not to accept the lowest rate if found below workable rate. Penalty:- In case bidder fails to supply the required number of man-power, penalty shall be imposed upon the Agency and shall be deducted from the monthly 5% of Service Charges applicable for any short supply of man-power.
