1 Board of School Education Haryana NOTICE INVITING TENDER Sealed tenders are hereby invited from experienced service providers for providing the Signal Silencer / Jammer to block voice/image transmission of both incoming transmission of the information through Mobile/Cell phone/wifi/bluetooth/other Electronic devices etc. during HTET/other examinations conducted by the Board. Sr. No. Description Period of Service 1. Providing services for Signal Silencer/Jammer to stop transmission of the information through Mobile/ Cell phone /Wi-fi/Bluetooth/any type of Electronic Device Signal Silencer during HTET/other examination conducted by the Board on dates: & The schedule of bidding will be as follow: Last Date & Time of Submission Date & Time of Opening , 14:00 hrs , 15:00 hrs. 2 Years extendable to additional 2 years based on performance Eligibility Criteria/Term & Conditions 1. a) The bidder should be a Company/Firm/Consortium of companies or Firms registered (minimum 3 year old) in India. b) Adequate experience of providing satisfactory services of such types of assignments in the relevant field to educational institutions or other related organizations during last 3 years (Supported by work order/ client satisfaction report). Permission, if any, required, for the installation of the equipments at different places from the local authority/competent authority to be arranged by the awardee itself. c) The Minimum Annual Financial Turnover should be 50 Lakhs or more in any of the last three financial years (Supported by Financial statements, Balance Sheet duly certified by the Chartered Accountant), etc. ( , and ). d) Agency must be registered with appropriate statutory authorities as required under law for taxation etc. and must enclose copy of the same. e) The agency must enclose a Demand Draft for `5000/- (Rupees five thousand only) (non-refundable) towards cost of tender document in favour of "Secretary, Board of School Education Haryana along with the Offer. f) Agency should not have been black listed by any Firm / Organization / School / Board / University / Institution etc. Undertaking in this regard to be submitted by tenderer. g) Earnest money One lac should be deposited along with tender documents in separate envelope marked as Earnest Money in shape of Demand Draft in favour of Secretary, Board of School Education Haryana, payable at Bhiwani. The earnest money shall be refunded (without interest) within one month after successful completion of the work. h) The Secretary, Board of School Education Haryana, Bhiwani reserves the right to cancel/reject in full or any part of the tender without assigning any reason. i) All disputes, differences and claims arising of pursuant to or touching the contract shall be referred to the sole Arbitrator, Chairman, Board of School Education Haryana, Bhiwani or his nominee. j) In case the date of issue / receipt of tenders is declared / happens to be a public holiday, the tenders will be issued / received on the next working day. k) Conditional Tenders will be rejected. l) The Company shall be solely responsible for the payment of all taxes and duties etc. However, Income tax will be deducted by the the Board as per the provision of Income tax Act/Rules in force. m) Tender can be terminated for future by both of the parties in writing by giving notice of 30 days. n) Firm will not sublet the work further.

Scope of Work To install, commission and operationalise the required Number of Signal Silencer to block all the transmissions (sending and receiving) of Mobile/ Cell Phone/ other Electronic Devices in the Examination Centres on the day of examination, as per the requirement: i. The installation of Signal Silencer should be made at least one day in advance from the scheduled date of examination and or in such a way that the Signal Silencer are required to be functional for 1½ hours before the scheduled time of commencement of the examination and ½ hour after the completion of the examination. ii. To organize and provide required manpower to install the Jamming Devices at the Centres. iii. To provide uninterrupted service of Signal Silencer along with back-up of Signal Silencer and ensure proper working of Signal Silencer during the conduct of examination. iv. During the period of examination, Jammer facility shall not be interrupted due to any technical fault, etc., and the Agency shall take due care of functioning of Signal Silencer with adequate backup of Signal Silencer during the conduct of written examination and as per the time period mentioned in the Work Order of respective assignments. v. Power supply back will be arranged by the firm during the stipulated time. The above scope of work also includes the following in addition to above: a) The bidder will have to ensure that sufficient no. of Signal Silencer are supplied to block inward and outward communication from cell phone services in the examination centre i.e. CDMA / GSM / 3G / 4G /Wi-fi/Bluetooth /Any Other Electronic Devices etc., b) The bidder will have to ensure that the Signal Silencer provided work properly, during the entire duration of the examination in the Centres without any technical fault /power failure. c) The bidder will have to install industry standard Mobile / Cell Phone Signal Silencer in the Centre. d) The bidder shall ensure up gradation of Jammer service to include additional spectrum or technologies during contract at no extra cost. The bidder will have to ensure to block the required band width / signals without fail. e) A General agreement on the attached performa will be made for a period of agreement and separate work order to deploy services will be issued before exam. Note:- The sole responsibility to ensure the Jamming of electronic device ie mobile/cellphone/bluetooth/any other electronic device in the examination hall will lie on the firm only. The firm will also submit a certificate regarding frequencies jammed during the examination after completion of the examination. The bidder will be sole responsible to fulfill all the legal requirement to get NOC/clearance from all the concerned departments, what so ever to provide mobile jamming services for the HTET or other examination. 3. Procedure for submission of Tenders: The following procedure shall be adopted for submission and opening of tenders. The sealed envelopes shall be submitted as follows: Envelope No. 1: This envelope must be marked as Envelope No. 1 on the right hand top corner. This envelope shall contain two parts. Part-I: Shall contain only the Earnest Money Deposit and will be opened first. If the Earnest Money Deposit is not found to be in accordance with the procedure prescribed then the other sealed envelope containing Part-II shall not be opened and as such the tender submitted by the tenderer shall not at all be considered. Part-II: Containing the covering letter depicting Technical Bid will then be opened in case of such tenderers whose Earnest Money Deposit is in order. These will be scrutinized and comments/conditions which have financial implications will be evaluated. Comments/ conditions may be discussed with the tenderer, if deemed necessary. If required, a meeting in respect of technical bids shall be held on notified date, time and place.

3 Envelope No. 2 : Containing the Sealed price bid will be opened either on the same day or on a subsequent date which will be duly intimated to the tenderers. The price bid will be opened only of those agencies who meet the technical requirements of the tender document. The above said two envelopes shall be kept in one sealed envelope and submitted in the Secretary, Board of School Education, Bhiwani on or before upto 14:00 Noon. Bid not on the prescribed performa (Annexure-II) without requisite details/ EMD and received after the closing date and time of Bid will be summarily rejected. 4. The Secretary, Board of School Education, Bhiwani does not bind himself to accept the lowest or any other tender and reserves to itself the authority to reject any or all the tenders received without the assignment of any reason. 5. Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable to rejection. 6. The Secretary, Board of School Education, Bhiwani reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted. 7. Payment Terms:- I. The payment will be made after the successful completion of particular examination and after 30 days of submission of invoice by the bidder. II. On award of work, the bidder will be required to submit security deposit 10 % in the form of FDR/Demand Draft /Bank guarantee in favour of Secretary, Board of School Education, Bhiwani for the period of contract which will be refundable (without any interest) on successful completion of the given assignments and service paper. III. The security deposit along with earnest money is liable to be forfeited wholly or partially if any deficiency is found in the services or bidder fails to fulfill any agreed terms and conditions. The decision of Secretary, Board of School Education, Bhiwani shall be final & binding on the bidder in this regard. 8. The bid for the works shall remain open for acceptance for a period of One month from the date of opening of price bid. No tender, submitted, can be withdrawn after last date of submission 9. Each tenderer shall submit only one tender; either by him or as partners in a joint venture. A tenderer who submits or participates in more than one tender for same work will be disqualified. 10. Interpretations, corrections and changes to the Tender Documents shall be made by Addendum, if required. 11. Each Tenderer shall ascertain prior to submitting his Tender that he has received all Addenda issued and he shall so acknowledge their receipt in his Tender. 12. The bidder has to provide successful completion certificate regarding Frequencies jammed during the Examination of each centre on the prescribed performa. 13. Within 7 days of the receipt of notification of award from the the successful firm shall furnish the performance security 10 % of the contract amount in the form of Bank Guarantee or any short term deposit endorsed in the name of the Secretary, along with contract documents for agreement (annexure -IV ) on the stamp paper of Rs Penalty and Deductions : II. I. The time schedule has to be strictly adhered as the examination related work is highly time bound. In case of failure at the Centre on the part of the agency or on part of equipments failures, it shall be liable to pay penalty as per given below:- Four time will be deducted as rate quoted by the firm in case of failure of Jammers at the centre. In case the agency is not able to execute the job to the entire satisfaction of the BSEH, the Performance Security submitted by the firm shall be liable to be forfeited in whole or part as per decision of the Secretary,, which shall be final and vendor may be blacklisted. 7 ANNEXURE-II Board of School Education, Haryana Financial Bid for Providing services in Examination Centres of the Board of School Education, Haryana in identified cities across the country Mobile / Cell Phone Jammers on Rental Basis NOTE: TO BE SEALED SEPARATELY. Please refer the scope of work and other terms and conditions with regard eligibility conditions mentioned in the tender documents while quoting the rates. The number of candidates at each examination centres varies from 250 to 350 approximately. Normally candidates are sitting in a room (OR) more in a big hall. Amount should be indicated in words also. Board of School Education, Haryana will not be responsible for loss/damages of any equipment installed at the examination centres and the Agency will be fully responsible for safety and security of its equipments/infrastructure. 9 Annexure IV Contract Form/Agreement This A g r e e m e n t entered into the.. day o f between the Board of School Education Haryana, Bhiwani (here in after called B.S.E.H. which expression shall include its successors and Assignees) through its Secretary of the one part and M/S.. (Name of the firm, agency, company) incorporated under the companies Act, 1956(hereinafter referred to as the Company which expression shall include its successors and Assignees) on the other part. Whereas the B.S.E.H. in desirous to providing the Signal Silencer / Jammer to block voice/image transmission of both incoming transmission of the information through Mobile/Cell phone/wi-fi/bluetooth/other Electronic devices etc. during HTET, as per the Scope of work and has accepted a bid of the company which has agreed to undertake the said jobs, on term and conditions contained in the relevant Bid Document and thus the rates quoted in the Financial Bid. Now this Agreement witnesses as follows: 1. In this Agreement work and expressions shall have the same meanings as one respectively assigned to them in the Term and Conditions of Contract of Bid Document. 2. All the pages of the Bid Document shall be deemed to form and be read and construed as part of this Agreement. 3. The obligations of B.S.E.H. and of Company separately are to be completely taken care of. 4. Term and Conditions sent with the tender and accepted by the Company will form a part of this agreement in addition to other condition of the agreement. 5. The rates quoted for various works by the Company as listed in the Financial Bid document and accepted by the B.S.E.H. are as attached. The approved rates for various works should be signed by the Company with this contract. 6. Schedule of Payments shall be made on the basis of actual amount and quality of works done as per the Term and Conditions of Bid Document.. 7. E.M.D., Performance Securities etc are to be submitted by the Company and to be treated/disposed by B.S.E.H. appropriately as per Bid Document. 8. The Company shall be solely responsible for the payment of all taxes and duties etc. However, Income Tax will be deducted at source by the B.S.E.H. as per the provision of Income Tax Act/Rules in force. 9.
