3 Tender Document for Potted plants ECZO, Patna GENERAL TERMS AND CONDITIONS OF THE CONTRACT Life Insurance Corporation of India, East Central Zonal Office, Patna propose to invite Sealed Tenders from registered / reputed Agencies for Maintenance of Indoor/Outdoor Potted Plants at Zonal Office Jeevan Deep and Zonal Guest House Jeevan Jyoti buildings, Exhibition Road, Patna. The general terms and conditions will form part of the tender to be submitted by the tenderer to LIC of India, herein after termed as Corporation. 1. Potted plants: a) Watering and putting manure in the plants shall be done by the agency/its workers. The Agency shall maintain all the plants by watering (daily/alternate days), cleaning, pruning, trenching, cleaning of leaves/pots, manuring, putting the potted plants under the Sunshine, planting of seasonal and Indoor Plants and spraying of insecticides etc on a weekly basis. The number of potted plants, as of now is around 200 which may vary by +20%. b) The Agency shall deploy regular workers with knowledge in gardening and expenditure on this shall be borne by the agency. c) Damaged and defective plants will have to be removed and it has to be brought to the notice of the office for immediate replacement of the same. d) The payment will be made only in respect of those plants which are found satisfactory. e) Replacement of any pot broken due to negligence of the Agency/its workers will be borne by the Agency. f) The Agency and/or its workers shall be responsible to place the potted plants at the locations specified by LIC of India/its officials and no extra charge whatsoever shall be payable by for this. 2. Tenure of the Contract:- The contract shall initially be for a period of one year from date of awarding the contract which may, on satisfactory performance, be extended with the same agency at the discretion of the Corporation by another year on the same terms & conditions. 3. LIC of India reserves the right to terminate the contract at any stage without assigning any reasons. 4. Adherence to Statutory Obligations:-The Agency shall follow all rules/regulations in force and it will be its sole responsibility to abide by the provisions of the following Acts as to the workers engaged by him for performance of the service. a) Child Labour Abolition & Rehabilitation Act, 2006 b) Labour & employment Act 1972 c) Workmen Compensation Act 1923 d) Industrial Employment (Standing Orders) Act 1946 e) Contract Labor (Regulation & Abolition) Act 1970 f) The Minimum Wages Act 1948 g) Employees Provident Fund Act 1952 h) The Employees State Insurance Act 1948 i) Any other Act or Legislation which may govern the nature of Contract / or essential/ mandatory to the contract which may be introduced later on by appropriate authorities Failure by the Agency/firm to comply with any statutory requirements and/or terms & conditions of the contract during the currency of the contract period will result in termination of the contract and any punitive/legal consequences thereof shall be borne by the Agency. 1 Signature with seal of Authorised person from Agency of potted plants

Monthly Payment to the Agency:-LIC of India shall pay the amount mentioned in the Contract subject to statutory deduction(s).notwithstanding the Annual Contract Value, in the event of additional requirements or reduced requirements, the amount of monthly payment (before statutory deductions) shall be revised upwards/downwards by LIC of India as the case may be. Any change with regard to the Contract Value will be required to be made at the time of extending the contract in accordance with Para 2 above. 6. Disputes & Differences: In case of any dispute between the two parties, the same shall be referred to the Zonal Manager (I/C), LIC of India and his/her decision will be final and binding on both the parties. 7. Safety Precautions: The selected service provider shall take all the necessary precautions and safeguard to Corporation s property. 8. Safety of the workers of service provider: (a) The selected service provider shall carry out the entire work having full regard for the safety of the workers working at site. (b) All safe practices shall be strictly adhered to by the selected service provider like providing gloves when handling sharp objects, gardening implements etc. (c) The selected service provider shall educate all his workmen regarding following safe working practices and also provide first aid boxes to its workmen. (d) If in spite of observing safe methods, in case of any unfortunate incidence, the selected service provider shall bear all such expenses or claims towards treatment or compensation of its workmen. (e) The Corporation shall not be responsible for any injury or loss of life occurring during the performance of duties in the premises to any personnel deployed by the selected service provider. (f) Any compensation or expenditure towards treatment for such injury or loss of life shall be borne by the selected service provider. 9. Payment to the Agency: The selected service provider will be paid on monthly basis only through NEFT/ RTGS for the services rendered during the particular month. The Agency shall submit the bill for the month for the contracted amount latest by 7 th of the following month. Income Tax at the prevailing rate will be deducted from the payment due to agency as per rules. 10. Deficiency in Service:-In case of deficiency in service such as substandard or dry plants, poor maintenance, LIC of India shall also impose a of the relevant monthly bill and shall recover it from bills presented to it by the Agency. 11. Termination of Contract :-(i) The contract may be terminated by either party by giving three months notice. Where the contract is sought to be terminated by the Agency, LIC of India shall black-list the Agency (ii) Security Deposit if any, shall stand forfeited where the Agency has given notice of less than 3 months to LIC of India for terminating the contract (iii) In addition to termination of contract by either parties by giving notice as aforesaid, LIC of India reserves the right to terminate the contract if a) The contracted Agency abandons the work, there is/are deficiency/ies in the service provided or b) The contracted Agency assigns or sublets the work in whole or in part thereof, or c) The contracted Agency becomes bankrupt or insolvent or goes into liquidation or is ordered to wind up or has a receiver appointed on its assets or d) The contracted Agency fails to adhere to the agreed schedule of the work and/or fails to perform its obligations as per the terms of the contract, or e) The information submitted by the contracted Agency in the Tender is found to be incorrect, or f) If during the currency of the contract, the quality of plants is not found satisfactory and the contracted Agency persistently disregards the instructions issued by the Corporation in this regard. 2 2Signature with seal of Authorised person from Agency of potted Plants

Agency should be based in and around Patna and should have been in the business of maintaining potted plants in the offices in and around Patna for the last three years. The address and other details shall be provided along with the application for tender. 13. The agency should have experience of rendering similar services to any PSU, PSU Bank, Public Sector Insurance Companies, Public Sector Financial Institutions, Reputed Private Cos, Multi-national Companies during the last 3 Financial Years in and around Patna. 14. Certified copies of work orders issued by any other offices (described at 12 above) to the agency for maintenance of potted plants are required to be submitted. 15. Certified copies of PAN, PF Registration under Provident Fund Act, ESIC Act, GST Registration and valid Licences under Shops & Establishment, Contract Labor Act, are required to be submitted 16. Sealed tenders are hereby invited for Maintenance of Potted Plants in the enclosed annexure. Kindly quote your rates for the desired services listed in the annexure hereto and submit duly filled in and signed with your official seal in a sealed cover marked with Tender No. and date in our Tender Box on or before within 3 pm with a non-refundable Tender Fee of Rs.100/-(Rupees one hundred only) in cash for said Tender deposited at cash counter at our office ( Monday to Friday 10 am to 3 pm & Saturday 10 am to pm ) or DD in favour of Life Insurance Corporation of India payable at Patna. Duly filled in Tender Forms must be accompanied with Earnest Money Deposit/Token Amount of Security Deposit of Rs.1, 000/- (one thousand) only through DD in favour of Life Insurance Corporation of India payable at Patna. EMD/Token amount of Security Deposit of unsuccessful bidders will be refunded without interest within one month from the date of finalization of the tender. Applications received without non-refundable Tender fee of Rs.100/- will not be considered. 17. Duly filled in Tender along with all relevant documents mentioned above shall be placed in one sealed envelope and marked on top as Application for Tender For Maintenance of Indoor /Outdoor Potted Plants with the name, address and telephone number of the Agency at the bottom of the cover on the left. The sealed cover prepared in the manner mentioned above should reach us on or before PM on at the address mentioned below:- The Secretary (OS), LIC of India, East Central Zonal Office, E&OS Deptt. Jeevan Deep 5 th Floor Exhibition Road, Patna In the event of failure of the agency to submit all the related documents in the manner as prescribed, the application will be deemed as non-responsive and disqualified from the tender. 19. Tender received late on account of any reason whatsoever will not be entertained. LIC of India shall not be responsible for non-receipt and/or delay in receiving applications sent by the Agency through post, courier. 20. The sealed cover referred at Sl. No.17 above shall be opened at A.M. on in LIC of India Zonal office, Jeevan Deep building (5 th Floor) in presence of the applicants/ their authorized representatives, if they choose to remain present at the time of opening the TENDER. 6 Tender Document for Potted plants at ECZO, Patna 21. The rates quoted shall be valid for a period of 120 days commencing from the date of tender. 22. LIC of India reserves the right to call for missing/ additional requirements or otherwise from the applicant at the time of analysis of the applications received in response to this tender notice 23. LIC of India has the right at any stage of the tender process or anytime thereafter to cancel the whole process without giving any notice or assigning any reason and shall not be bound to accept the lowest tender. Vendors will however be notified in writing of the cancellation and LIC of India reserves the right to accept or reject any or all the applications. The decision of LIC of India in this regard shall be final and binding on all. LIC of India may at its discretion, amend/modify the conditions and/or extend the deadline for submission of application for tender at any time prior to the last date for submission. LIC of India may, for any reason or in response to a clarification requested by a prospective vendor, before tender may modify the terms & condition(s) and it shall be binding on all concerned. 24. Provisions relating to IRDAI:- (i) In terms of provisions of Section 33(3) of The Insurance Laws (Amendment) Act,2015, Insurance Regulatory and Development Authority of India (IRDAI), is authorized to verify all such books of account, register, other documents, data base in the custody of the contractor in respect of this contract outsourced by the LIC of India. It shall be the duty of the service provider to provide such documents, statements, information as may be required by IRDAI and within such time as may be specified by IRDAI. (ii) In terms of provisions of Section 33(4) of The Insurance Laws (Amendment) Act, 2015, Insurance Regulatory and Development Authority of India (IRDAI), if it considers expedient to do so, may direct any person hereinafter referred to as Investigating Officer, to make an investigation as specified under Sec.33(1) or carry out an inspection as specified under Section 33(2) of The Insurance Laws (Amendment) Act, 2015, who may examine on oath any Manager, Managing Director or Other Officer of the service provider or contractor where the services are outsourced by LIC of India (iii) The service provider agrees to abide by the regulations, if any, notified by IRDAI during the currency of the agreement in connection with Outsourcing of services by Insurers.
