2 TENDER DOCUMENT FOR 3G Broadband Internet Data Card Dongle & Services INVITATION TO BID Quotations / bids in Sealed & Subscribed Cover are hereby invited from Services Providers and it s Authorised Partners for providing 3G Broadband Internet Data Card Dongle & Services for 2 years. The format for Rate Schedule / Price Bid / Quotation is enclosed herewith as per Annexure-1. 3 General Terms & Conditions: 1. Last date for submission of completed & sealed bids shall be 17:45 hrs on by Registered Post / Speed Post or by hand on the following address. CGM IT I.T Department India Infrastructure Finance Company Limited Kasturba Gandhi Marg, New Delhi Completed bids not received by the above mentioned due date & time and not received by Registered Post or Speed Post or by hand shall be rejected and not considered. 3. Rates quoted shall be inclusive of all other taxes, levies, charges, etc. Only Service taxes can be charged extra, as applicable. 4. Costs such as all India Roaming charges shall be built-up or provided free in the rates quoted. 5. Rates quoted shall be uniform across all circles. 6. Bidders shall not mention riders for minimum number of connections for quoted rates. 7. Rates quoted shall be valid for a period of two years from date of finalization of tender. 8. The 3G Broadband Data Card Dongles shall be provided free of cost to IIFCL. 9. The Service provider shall provide for Free Latching to other Service providers in circles / areas where they do not have services. 10. The tenderer shall arrange for any software/hardware required for satisfactory execution of work. 11. Any and all such terms which are not acceptable to the tenderer shall be clearly mentioned separately at the time of submitting tender in a separate heading LIST OF DEVIATIONS 12. IIFCL reserve the rights to switch the data plan to another better data plan which comes into existence within the contract period with the same value offered in the contract. 13. These 3G Data Cards are meant for data uses only. Tenderer should ensure that no voice charges, SMSs charges or any other value added service charges are included in the monthly bills generated. No amount will be paid for any services other than data Uses in any case. 14. For Successful bidders under Rate Contract, any revision of rates during period of contract shall be revised with mutual consent between the successful bidder and IIFCL, as under 3

4 a) In case of Increase of Cost / Rates during period of Rate Contract Only in event of new tariff and / or directives being notified by the Government of India during the period of contract & that it exceeds atheist by 10 % of the contract rate. b) In case of new notification, directives and guidelines issued by Government of India regarding lowering of tariff or applicable rates, the notified rates or rate contract rate, whichever is lower shall be applicable. 15. Bidders quoting for 3G Broadband Internet Services with Unlimited Usage Plans within the maximum Usage limit as specified in the Annexure -1 shall be preferred. 16. The bidder shall provide for facility for viewing monthly bills online for the all the connections. 17. Change of address for billing for the connections as & when required shall be incorporated in the next billing cycle. 18. Hard copy of monthly bills shall be submitted to IIFCL Office address for processing the payments as notified at the time of award of work. The bidder shall provide itemized billing charges, for each connection. 19. The Bidders shall sign & rubber stamp on all pages of the tender and quotations. 20. Successful bidder shall provide for change of plans for all connections within the quoted plans, on as & when basis. 21. A Refundable & Interest free Earnest Money Deposit (EMD) of Rs.1,000/- (Rupees Two thousand five hundred only) by way of Demand draft in favour of India Infrastructure Finance Company Ltd. payable at New Delhi, shall accompany with each bid. Bids not accompanied by EMD shall be liable for rejection. 22. EMD shall be forfeited in event of any invasion, refusal, or delay on part of the successful bidder to sign & execute service contract. 23. The Bidders shall provide Name, Contact address, Mobile & phone numbers, Fax number & Id of at least two authorized Personnel (hence called Nodal Officers) responsible for Liaison, coordination, addressing complaints, matters related to billing, disconnection, change of location etc. with IIFCL. 24. A certificate to the effect from the Business Head / Director of the firm on the letter- head of the bidder shall accompany each bid stating that the person signing on the quotations & bid documents is authorized and competent to quote rates, sign on documents, & the Service Contract and for conduct of day to day business on behalf of the firm. 4

Successful bidder shall have to execute a two year Rate Contract for period from the date of acceptance of the bid by IIFCL on a Non - Judicial Stamp paper of Rs.100/ The final Rate Contract shall be extendable for a period of one year beyond the Rate Contract period or till finalization of new tender, whichever is earlier. 27. Successful bidders shall submit Performance guarantee (PG) along with the duly Signed & sealed Rate Contract. PG shall be an amount of Rs.25,000/- (Rupees Twenty Five Thousand only) by way of Demand Draft (DD) payable at New Delhi pledged for two years from date of acceptance of the bid, in favour of India Infrastructure Finance Company Ltd. 28. The PG by way of DD shall be liable to be forfeited in the event of any invasion, refusal, or non-compliance of terms & condition of Service Contract. 29. The copy of the terms & conditions of the Rate Contract shall be provided separately to the successful bidders along with the letter of acceptance of the bid. 30. Copy of ITCC (Income Tax Clearance Certificate) & STCC (Sales Tax Clearance Certificate) for last two years shall be enclosed along with the Bids. 31. All decisions taken by the Purchase committee of IIFCL appointed by Competent authority with regard to General Terms & Condition of Contract, Contract agreement, Performance Guarantee, & matters related to this tender shall be conclusive, final & binding to all the bidders. 32. IIFCL, reserve the right to disqualify a bidder without assigning any reasons. The decision of IIFCL shall be final and no correspondence shall be entertained in this regard. 33. Any disputes arising out of this tender shall be settled under Delhi Jurisdiction only. 34. If any of the 3G dongle gets faulty within the contract period, tenderer has to arrange for repair/ replacement of the data cards within 7 working days from the date of getting information or no billing for the month will be done by the tenderer. 35. Bidders should provide an activated dongle for demo on the date of opening of bids for evaluation for a week s time. 36. Billing Cycle should be monthly, ending on the last day of the month and bills should be raised at the end of the billing cycle with due date of at least 15 days from the date of receipt of bills. 37. In case of any delay in payments, late payment charges may be levied, but services should not be discontinued due to late payment on any occasion. 5

6 38. Any queries regarding the tender may be sought at within a week after the release of the tender. 39. No Locking Period should be imposed by the Service Providers on IIFCL. 40. In case of the Authorised Partner of a Service Provides also participates in the Bid, the partner has to submit the Authorization Letter from Service Provider stating that the partner is authorised to participate in the Tender on the mentioned terms and conditions in the Tender Document. Note: Any other taxes extra should be mentioned clearly. Signature of the Bidder Date: TENDER EVALUATION: Totals / Gross totals of prices should be indicated both in words as well as in Figures. If there is any difference between prices quoted in words and Figures or if there is any other price discrepancy, values in words will be considered for Evaluation or ordering. L1 will be decided on the total Expenditure for 24 months. Rates quoted should be firm for two years. However, if rates for data cards having downward trend then same shall be applicable for this also. The submitted offer should be valid for 60 days from the date of tender opening. 7
