1 Terms and Cnditins fr dmestic energy supply (including Deemed Terms and Cnditins) Certain wrds in these terms and cnditins have initial capitals. This is because we have given these wrds specific meanings. A list f these wrds and their meanings can be fund at the end. 1. D these terms and cnditins apply t yu? i. These terms and cnditins apply t yu if yu re a Dmestic Custmer. ii. If yu stp being a Dmestic Custmer and start using the Supply fr cmpletely r mainly business purpses yu agree t let us knw within seven days f the change taking place. 2. Deemed Cntracts i. Where a Deemed Cntract exists these terms and cnditins tgether with ur Deemed Charges and Change f Tenancy letter frm the entire agreement between us. ii. Clauses 3, 4, 6, and 10 f these terms and cnditins dn t apply t Deemed Cntracts. iii. A Deemed Cntract exists frm the date yu becme respnsible fr Premises that we Supply r where Ofgem has appinted us as yur supplier. iv. Yu re respnsible fr the Premises: a) as a tenant r ccupier frm the earliest f either the start date n yur tenancy agreement r the date yu ccupied the Premises b) as a Landlrd frm the date the tenant r ccupier mved ut c) frm the date yu agreed t take respnsibility fr the Premises; r d) frm the date when, fr any ther reasn, yu becme respnsible fr the Premises. v. We may calculate yur Charges based n ur Deemed Charges, the detail f which can be btained by ing us at cntact@geffrtless.c.uk. We may change ur Deemed Charges frm time t time. When we d s we ll ntify yu f thse changes if yu re n a Deemed Cntract. vi. The terms and cnditins f this Deemed Cntract shall cntinue t apply until: a) yu enter int a Cntract (see clause 3.i belw) b) yu switch t an alternative supplier c) a new landlrd, tenant r ccupier becmes respnsible fr the Premises d) yur supply is Discnnected/De-energised at yur request and cst. 3. The Cntract

These terms and cnditins tgether with any dcuments referred t, including the Welcme Pack, create a legally binding cntract (the Cntract ) between yu (ur Custmer) and us, (Effrtless Energy Ltd). ii. This Cntract will start frm the earliest f the fllwing dates (the Cntract Date ), n the date: a) we prcess yur telephne applicatin; b) we receive and prcess yur signed applicatin frm; c) we prcess yur nline applicatin made n ur website r d) we prcess yur applicatin which yu made via a brker either nline r by telephne. iii. We will endeavur t prcess yur applicatin within 5 wrking days f receipt. iv. We will send yu yur Welcme Pack the same day that we prcess yur applicatin t switch yur Supply t us. v. By entering int this Cntract yu cnfirm that: a) yu re the wner r ccupier f, r fr any ther reasn have respnsibility fr, the Premises (r will be n the date yu want yur Supply t start) b) the Premises is cnnected t mains electricity and/r gas, r cnnected thrugh anther cnnectin t mains electricity and/r gas c) yu re aged 18 r ver, r, if the Premises are in Sctland, yu re aged 16 r ver. 4. Changing yur mind i. If yu change yur mind yu have 14 days frm the day after the Cntract Date t tell us yu want t cancel this cntract. This 14 day perid is called the Cling Off Perid. We will tell yu when yur Cling Off Perid ends in yur Welcme Pack. ii. It s easy t cancel. Simply cntact us during the Cling Off Perid with yur accunt number r yur name and address and tell us yu ve changed yur mind. Yu can d this by ing us at cntact@geffrtless.c.uk. iii. This clause des nt affect yur right t terminate the Cntract under clause If smething ges wrng i. We hpe yu ll never need t, but if yu d like t make a cmplaint, please cntact us at cmplaints@geffrtless.c.uk.

3 6. Supplying yu i. Yur Supply Start Date will usually be within 21 days f the expiry f the Relevant Date unless yu ve requested a later Supply Start Date. ii. Yur Supply Start Date may be delayed if we have difficulties taking ver yur Supply frm yur previus supplier. There culd be difficulties if: a) yur current supplier bjects t yu switching yur Supply because yu haven t prperly terminated yur cntract with them under a fixed term agreement b) yur current supplier bjects t yu switching yur Supply because they cnsider yu we them mney c) we haven t received r dn t have all f the infrmatin required t take ver the Supply, despite taking reasnable steps t btain it d) yu re cnnected t a private gas r electricity netwrk and: a. a physical cnnectin needs t be made t the Distributin Netwrk fr the electricity and/r gas and that cnnectin has nt yet been made b. yur ld supplier has tld yu abut the way yur metering needs t be arranged t allw anther supplier t start supplying yu and yur meter has nt yet been changed t allw this e) yu d smething that prevents us frm taking ver yur Supply f) Ofgem prevents us taking ver yur Supply g) there are any ther circumstances beynd ur cntrl. 7. Yur electricity supply (Natinal Terms f Cnnectin) i. When we supply yu with electricity under this Cntract r Deemed Cntract yu re als entering int the Natinal Terms f Cnnectin ( NTC ) with yur lcal electricity Netwrk Operatr. ii. By this Cntract yu and yur Netwrk Operatr accept the NTC and agree t keep these cnditins. The NTC is a legal agreement. It sets ut rights and duties in relatin t hw yur Netwrk Operatr delivers electricity t, r accepts electricity frm the Premises. The electricity supplied may be subject t the variatins permitted by the Electricity Supply Regulatins 1998, which means that a cnsistent supply f electricity cannt be guaranteed. 8. Yur gas supply i. The gas supplied t yu under this Cntract shall be at the pressure laid dwn in the Netwrk Operatr s cde.

4 ii. Yur gas supply may be interrupted r be f lwer quality due t circumstances utside f ur cntrl r the cntrl f the Netwrk Operatr. iii. In an emergency, r if we re required by law, we r the Netwrk Operatr may need yu t stp using gas. If ntified yu must stp using gas immediately and yu may nly resume ding s nce we r yur Netwrk Operatr have given yu the g ahead. 9. Depsit i. If yu re a returning custmer and yu previusly had debt with us f ver 750 at any time we may ask yu t pay a Depsit. If we require a Depsit we ll explain the prcedure when we cntact yu. ii. If there are Arrears f mre than 250 n yur accunt at any time we shall, n each and every ccasin, be entitled t deduct an equal sum frm the Depsit t discharge the Arrears. Yu may then be required t tp the Depsit up t its agreed riginal level. iii. Subject t clause 10.v belw we ll repay yur Depsit t yu within 10 wrking days f the date that we stp supplying yu r at any time, at ur discretin, during the Cntract. iv. We dn t pay interest n the Depsit. v. When we repay yur Depsit we may deduct frm it any sums that yu we us. 10. Our prices i. Yur Supply Prices are set ut in the Welcme Pack. Yu can als find detail f ur Prices n yur bill, by visiting us nline at ii. We ll charge yu fr the amunt f gas r electricity supplied t yu in kilwatt hurs. iii. The Price and ur Charges includes a Standing Charge and a single Unit Charge (per time band). Standing Charges will apply, whether r nt yu have used the Supply, frm the earlier f either: a) the date a Deemed Cntract arises b) frm the Supply Start Date. iv. Where yu receive electricity frm us thrugh an Ecnmy Meter, the relevant times fr calculating any day/evening/night/weekend Prices will be thse prescribed by the Netwrk Operatr. If yu re nt sure what relevant times apply t yur meter please cntact us by at inf@geffrtless.c.uk. Please nte that unless yu have an Ecnmy 7 meter we may nt be able t ffer yu variable Unit Charges fr yur day/evening/night/weekend usage. 11. Changes t ur prices r this cntract

5 i. We may change ur Prices r ther terms f this Cntract. If we make a change that significantly disadvantages yu (such as an increase in Prices), we ll tell yu abut the changes and the effective date(s) at least 30 days befre they re due t apply. If yu dn t agree t the changes yu may end this Cntract and change supplier. ii. If yu dn t accept the changes, and chse t switch away, the changes wn t apply as lng as: a) within 20 wrking days f (but nt including) the date that the changes are due t cme int effect, we receive ntice frm anther supplier that they will begin supplying the Premises within a reasnable time b) if we bject t yu leaving due t debt but yu settle yur accunt within 30 wrking days f this bjectin and we ve received the required ntice as detailed abve. iii. When we change ur Prices we ll ask yu t give us a meter reading fr the day the change is due t apply. If yu dn t we ll estimate the meter reading fr yu. We ll apply the new Prices frm this meter reading nwards. 12. Changes t this cntract by mutual agreement i. In exceptinal circumstances we may agree t vary this Cntract by mutual cnsent rather than under the prcedure in clause 11 abve. ii. Where we require yur cnsent under this clause 12, we ll write t yu setting ut the prpsed change, tgether with an explanatin f what this will mean fr yu, and ask yu t cntact us. iii. Once we ve received cnfirmatin f yur agreement t the change(s), we ll cnfirm the agreed changes in writing within five wrking days. 13. Yur bill i. We aim t send yu yur bills at least quarterly. If yu have a Pre-Payment Meter yu may receive yur bill less frequently. ii. We may base yur bills n ur reasnable estimate f yur usage relying n the infrmatin we have abut the Premises, the Estimated Annual Cnsumptin and yur histrical usage. If yu believe an estimate is incrrect please cntact us with yur wn meter reading. Yu can d this by ing us at cntact@geffrtless.c.uk r visiting us nline at We ll revise yur bill t yur meter reading prvided that yur meter reading is in line with previus accurate readings. iii. If yu dn t give us a meter reading n yur Supply Start Date r, in the case f a Deemed Cntract, n the date yu becme respnsible fr the Premises, yur accunt may be pened n an estimated meter reading. iv. Meter readings carried ut will be evidence f yur cnsumptin fr the purpses f us calculating yur bills, unless the meter is fund t be recrding inaccurately r yu re able t prvide evidence that the meter has been read

6 incrrectly. 14. Payment terms i. Yu agree t pay us fr the Charges billed by us in respect f the Supply. ii. Yu agree t pay all bills by mnthly Direct Debit, unless we agree therwise. iii. Any persn named n the Supply accunt is respnsible fr paying ur bills and we may claim any mney wed t us under this Cntract fr ne r all f the peple named. iv. If yu pay yur bills by fixed Direct Debit we may adjust the final amunt that we debit frm yur bank accunt t include any sums wing t us at the end f the Cntract. v. We may use any sums that yu pay us t ffset ther sums yu may we us such as: a) we may allcate yur payment against the ldest sum due even if yu tell us that the payment related t anther amunt yu we us b) if yu re in credit in relatin t a particular Supply r Premises we may allcate this credit against a debit balance n anther part f yur accunt, r against ther Premises, e.g. if yur gas accunt is in credit we can use this credit t pay ff a debit n yur electricity accunt c) if we receive a payment intended t pay fr mre than ne Supply r Premises we may allcate this payment t different accunts against the ldest sums yu re due t pay us. vi. If yu dn t pay yur bill we may als recver frm yu any csts incurred recvering the sums due including: a) the cst f visiting yur hme b) administratin csts incurred by us r ur agents when trying t cntact yu c) the cst f applying fr a warrant f entry and carrying it ut d) the cst f tracing yu if yu mve hme and dn t prvide a frwarding address e) any ther csts reasnably incurred t recver the debt. vii. If yu dn t pay yur bills n time we may require yu t pay any sums utstanding by anther payment methd, such as an Instalment Plan (see clause 15 belw) r a Pre-Payment Meter (see clause 16 belw). 15. Instalment plans i. If yu re finding it difficult t pay yur bills we ll try and help yu. We may allw yu t spread the mney yu we us ver a perid f time and at a rate agreed by us ( Instalment Plan ). T discuss payment ptins with us, including any Instalment Plans, please us n cntact@geffrtless.c.uk.

7 ii. Any Instalment Plan will be cnditinal n yu making the agreed scheduled payments and cntinuing t pay fr the n-ging Supply. Yu ll be able t pay the utstanding balance n the Instalment Plan at any time befre it ends. iii. We ll bject t yu switching the Supply t anther supplier during any Instalment Plan unless yu pay any sums utstanding in full. iv. If yu fail t cmply with any Instalment Plan we may terminate it. In these circumstance we may install a Pre-Payment Meter (clause 16) r Discnnect the Supply (clause 17). 16. Pre-Payment meters i. If yu re finding it difficult t pay yur bills we may ffer t install a Pre- Payment Meter fr yu. Different Charges may n ccasin be applied t a Pre- Payment Meter. T discuss the installatin f a Pre-Payment Meter please us at cntact@geffrtless.c.uk. ii. If yu dn t speak t us, r if yu ve failed t cmply with any Instalment Plan, we may apply t Curt fr a warrant t install a Pre-Payment Meter at the Premises withut yur permissin, particularly if it means we can avid Discnnectin (clause 17). iii. We ll send yu a key r card in rder that yu may apply credit t yur Pre- Payment Meter. Yu must keep this safe. If yu lse it we may require yu t pay ur reasnable csts, r thse f the Netwrk Operatr, assciated with a replacement. iv. We may set the Pre-Payment Meter t cllect any utstanding sum due t us. We ll tell yu if we d s and at what rate the utstanding sum will be cllected. v. Yu ll need t buy enugh credit t cver bth any sum we ve set the Pre- Payment Meter t cllect and yur n-ging usage. If yu dn t buy enugh credit yur Supply may stp and yu risk being Discnnected (clause 17). vi. If we change ur Prices there may be a shrt delay befre they re applied t yur Pre-Payment Meter. The Prices will update when yu next tp-up using a key r card. vii. We may recver frm yu ur reasnable csts f: a) visits t yur Premises if yu cntact us r the Netwrk Operatr t tell us yu ve run ut f credit due t a fault with the Pre-Payment Meter (r the key r card) and we can t find a fault b) changing a Pre-Payment Meter t a credit meter. viii. If we ve installed a Pre-Payment Meter t help yu manage yur bills we may ask yu t pay a Depsit (clause 9) befre we change yur Pre-Payment Meter t a credit meter.

8 17. Cutting ff the supply (discnnectin) i. We have the right t Discnnect the Premises in the fllwing circumstances: a) in an emergency r if we re required t d s by law b) where we r the Netwrk Operatr need yu t stp using yur gas supply as yur hme, r the public, may be in danger. Yu agree t take all reasnable steps t avid its use immediately: c) where yu ve failed t pay yur bills in accrdance with this Cntract and: i. yu ve refused ur ffer f an Instalment Plan r yu ve failed t cmply with an agreed Instalment Plan (clause 15) ii. yu ve refused ur ffer f a Pre-Payment Meter (clause 16) r yu ve refused t allw us access t the premises t install a Pre-Payment Meter iii. it s therwise nt reasnably pssible fr us t install a Pre-Payment Meter d) it isn t reasnable, in all circumstances, fr us t supply yu and we give yu 7 days ntice that we re ending the Cntract and cutting the Supply. ii. iii. If yu re a Dual Fuel Custmer we ll treat each Supply as if it s dealt with under a separate cntract. We wn t Discnnect bth yur gas and electricity unless ne f the reasns in 17.i abve applies t bth. Yu must pay ur reasnable csts if we have t Discnnect r recnnect yur Supply if we ve discnnected fr the reasns set ut at 17.i (c) r 17.i (d). 18. Meters and access t yur hme i. When we ask yu t, yu ll allw safe access t the metering equipment n the Premises t the fllwing: a) us b) ur agents c) meter peratrs d) the Netwrk Operatrs e) Relevant Industry Bdies f) any ther persn nminated by us. ii. Yu must allw the parties in clause 18.i access t the Premises:

9 (a) t install, repair, replace r remve a meter (b) t read, test r inspect a meter (c) t discnnect, recnnect, de-energise, islate r re-energise a Supply (d) at any time in the case f an emergency (e) fr any ther reasn permitted under ur Supply Licences. iii. Yu must nt damage r tamper with yur meter. If yu d we ll charge yu fr the reasnable csts f repairing r replacing the meter. iv. If yur meter is, r appears t be, running backwards, r is in any way failing t recrd yur usage accurately due t a micr-generatin system installed at the Premises, yu agree t ntify us immediately and we may charge yu fr the reasnable csts f repairing r replacing the meter. v. If the meter at the Premises fails r fails accurately t register usage r cnsumptin f Supply fr whatever reasn (including a defective meter r where yu ve had a micr-generatin system installed at the Premises) yu agree t pay fr the amunt we reasnably estimate has been used during the perid in questin. vi. Either f us can ask fr the meter t be tested t make sure that it s recrding yur usage accurately: a) if yu request the test and the meter is fund t be recrding accurately (within permitted tlerances) yu will bear the csts f the accuracy test b) but if, regardless f wh requests the test, the meter is fund t be recrding inaccurately (utside the permitted tlerances) we ll bear the cst f the accuracy test and will arrange fr the meter t be replaced. vii. Yu re respnsible fr and will maintain all pipes, wires, cables, equipment and fittings n the Premises frm the pint the Supply leaves yur meter and the meter has recrded it. viii. We may als recver frm yu any csts that we incur: a) if yu ask us t mve r exchange the meter unless yu re f state pensin age, disabled r chrnically ill and currently unable t use the meter b) if yur meter is, r appears t be, running backwards, r is in any way failing t recrd yur usage accurately, due t a micr-generatin system installed at the Premises c) if yu ask us t arrange an appintment fr the meter t be repaired, exchanged r inspected and yu fail t attend r allw us access t the Premises. 19. Smart meters

10 i. If yu have a Smart Meter installed at the Premises by a previus supplier, we ll endeavur t use it as such but we may have t treat it as a traditinal meter until such time as we ntify therwise. ii. If yu ve agreed t have a Smart Meter installed we ll cntact yu t arrange a cnvenient time fr installatin. Yu may change this appintment with mre than 48 hurs ntice withut charge. If fr any reasn we re unable t gain access t the Premises, r yu ve nt cntacted us t change the appintment mre than 48 hurs befre, we may recver frm yu ur reasnable csts fr the failed visit. iii. Once we ve ntified yu that we re able t use the Smart Meter functins yu agree that we may use it t manage yur accunt t: a) take meter readings which we may use t calculate yur bill b) mnitr yur usage c) repair and update the Smart Meter d) n written ntificatin, change yur Smart Meter t a Smart Pre-Payment Meter r change yur Smart Pre-Payment Meter t a Smart Meter e) Discnnect yur Supply prvided the circumstances in clause 17 apply f) identify any faults r interference with the Smart Meter. iv. If fr any reasn yur Smart Meter fails t recrd yur usage r fails t recrd it accurately, r we re unable t btain a meter reading frm the Smart Meter fr any reasn beynd ur cntrl, then we may estimate yur usage in accrdance with clause 13.ii abve. v. The Smart Meter display may shw the cst f yur usage but wn t shw the ttal Charges due under this Cntract. vi. This clause 19 is in additin t yur bligatins in respect f meters generally under clause 18 abve. 20. Ending the cntract i. Yu may terminate this Cntract at any time by giving us 28 days written ntice prvided that: a) yu ve paid us all sums yu we t us b) n the final day f the ntice perid yur Supply is switched t an alternative supplier r is Discnnected/De-energised. If yur Supply has nt been switched t anther supplier and the meter is still cnnected/energised yu ll be mved t a Deemed Cntract (clause 2). ii. We may bject t yu transferring t anther supplier where:

11 a) yu have any sums utstanding t us b) yur new supplier has cntacted us and it s agreed the applicatin was made by mistake r withut yur prper cnsent c) the new supplier s applicatin relates t a metering pint that is a Related Meter and the new supplier has nt applied t register all f the Related Meters n the same wrking day fr the same start date d) yu ve asked us t. iii. If yu re mving, r fr any ther reasn will n lnger be respnsible fr the Premises, yu must: a) ntify us at least tw days befrehand in writing by t mving@geffrtless.c.uk. b) prvide us with yur new address (if applicable) c) prvide a final meter reading s we can accurately prduce yur final bill. Prvided that yu ve cmplied with this clause this Cntract will end n the date that yu mve ut f the prperty. iv. If yu fail t give us the crrect ntice and infrmatin under clause 20.iii abve, this Cntract will cntinue and yu ll remain respnsible under it until the earlier f either: a) tw days after yu tell us that yu ve mved b) when we re cntacted by the persn nw respnsible fr the Premises (clause 2.iii) v. We can end this cntract in any circumstances by giving yu 30 days ntice. If during this perid yu haven t switched t an alternative supplier and yur meter remains cnnected/energised yu ll be mved t a Deemed Cntract (clause 2) in which case we ll ntify yu in accrdance with clause 11 (Changes t ur Prices r this Cntract). vi. This cntract may be terminated immediately in the fllwing circumstances: a) yu cmmit a serius breach f this Cntract (e.g. meter tampering) b) we n lnger hld the relevant Supply Licences c) Ofgem has tld anther supplier t Supply yu. 21. Data prtectin i. This sectin explains hw we may use yur persnal infrmatin, including any Sensitive Persnal Infrmatin. ii. We, ur Grup Cmpanies, ur agents and Relevant Industry Bdies may

12 use and share yur persnal infrmatin t d the fllwing: a) btain yur Supply details r ther relevant infrmatin frm ther suppliers, Relevant Industry Bdies r ther industry standard cmpanies b) verify yur identity when yu make enquiries by phne, r letter. Calls may be mnitred t make sure we re meeting ur legal and regulatry requirements and fr staff training c) help us set up and therwise administer yur accunts fr services and prducts that we, r ur Grup Cmpanies, prvide yu nw r in the future, including imprving ur service t yu and cllecting debts d) t cntact yu in any way (including by , phne, SMS r ther frms f electrnic cmmunicatin) with up-t-date infrmatin n prducts and special ffers frm us, Grup Cmpanies and affiliates with whm we have a partnership e) fr market and statistical analysis f) fr demnstrating and testing cmputer systems g) help detect debt, fraud and lss h) enable us t prtect yur health and safety, r the health and safety f anybdy wh ccupies the Premises i) cntact yu in any way (including thrugh yur Smart Meter, using electrnic cmmunicatin, SMS r telephne) unless yu have specifically asked us nt t. iii. If we re cntacting yu with details f prducts and/r special ffers (clause 21.ii (d)) we will, as far as pssible, d s in line with any marketing preferences that yu ve prvided t us. Yu can ask us nt t send further details f prducts and/r special ffers at any time by cntacting us and giving us yur accunt details. Please cntact us by ing cntact@geffrtless.c.uk. iv. Where yu wish t transfer the Supply t/frm us, we ll share yur infrmatin with the ther supplier and any Relevant Industry Bdies. v. Where yu ve given us yur prir cnsent in each case, we may share yur infrmatin with third parties including: a) yur landlrd r letting agent b) jint accunt hlders c) a jint bank accunt hlder named n a Direct Debit instructin d) any ther third party yu ve authrised us t speak t e) credit reference agencies t prevent and detect fraud r lss as set ut in clause 21.vi belw.

13 vi. If we believe that yu, r smene wh ccupies the Premises, is in need f extra care (maybe because f age, health r a disability) we may recrd this Sensitive Persnal Infrmatin abut yu. This Sensitive Persnal Infrmatin will be held by us t ensure we dn t stp yur Supply r ensure that in the event that yur Supply is interrupted yur Netwrk Operatr priritises yu and makes sure yur Supply is restred at the earliest pprtunity. In rder t be able t d this we ll need t share this Sensitive Infrmatin with yur Netwrk Operatr. vii. If yur accunt falls int arrears and yu dn t cntact us t discuss this we may check yur details with ne r mre credit reference agency r fraud prtectin agency. viii. If yu d like t see a cpy f the infrmatin we hld abut yu please us at cntact@geffrtless.c.uk An administrative charge f 10 may be payable. ix. Fr the purpses f administering yur accunt we may send infrmatin t cmpanies based utside f the Eurpean Ecnmic Area (EEA). If we d we ll ensure that adequate prtectin is in place t ensure yur infrmatin is prcessed in accrdance with this clause Our liability t yu i. We cannt guarantee an uninterrupted Supply. If we cannt Supply yu fr sme reasn beynd ur reasnable cntrl yu wn t be able t claim that we re in breach f this Cntract r a Deemed Cntract. ii. De-energise/Islate physically terminating the Supply, fr example by remving the fuse and the Meter r capping the supply. Estimated Annual Cnsumptin the estimated cnsumptin f electricity and/r gas in a year. Netwrk Operatrs the lcal electricity distributrs and gas transprters that manage the Distributin Netwrks. Ofgem the Office f Gas and Electricity Markets wh regulate the gas and electricity markets in Great Britain r any regulatry rganisatin that replaces it. Premises each dmestic prperty that yu d like us t prvide a Supply t r which we already supply under a Deemed Cntract. Pre-Payment Meter a meter that enables yu t pay-as-yu-g fr yur Supply. Credit is applied using a key, tken r card. Prices the prices specified by us and agreed by yu, r deemed as being due frm yu, in respect f the Supply including Unit Charges and Standing Charges.
