2 The Beginning Where d I start? Prir t a frmal submissin, it is strngly suggested that applicants review the Zning Ordinance thrughly alng with requirements and prcedures cntained herein. Yur preparatin f a cmplete submittal will greatly facilitate the review f yur develpment and/r applicatin. Hw can I btain feedback prir t finalizing my plans? There are a few different ways f receiving feedback n my site plan prir t submissin. Yu may: Cntact the Planning & Zning Department Via Phne r A phne call r t the planner can ptentially answer questins yu may have cncerning rdinance requirements r specific questins cncerning yur submittal. Engineering Meeting Applicants may als set an appintment fr an Engineering Meeting. These meeting are beneficial in prviding yu with infrmatin cncerning existing utility lcatins, prpsed utility imprvements yu will be respnsible fr, r any existing site cnditins that may pse a prblem with the develpment f the site. The Twnship Engineer, DPW Superintendent, Fire Inspectr, Building Administratr, Planning Directr alng with available Twnship Officials attend these meetings. They are held every Thursday mrning starting at 9:30 A.M. in 30 minute increments. Yu may set up an appintment by calling (586) extensin #6447. Meet with the Planner Please cntact the Planning & Zning Department t set a meeting with the Planning Directr. Explaining the ratinale behind the need fr the meeting will allw the planner t prepare fr the meeting and have any ther staff which might be helpful at the meeting. 3 Site Plan - Prcedures The fllwing prcedures are intended t prvide applicants and the public with general infrmatin regarding the develpment prcess in the Twnship. Here yu will find descriptins f applicatin requirements, submittal checklists, review flwcharts and answers t cmmnly asked questins. Site Plans When is a Site Plan Required? A site plan is required fr review and apprval by the Planning Cmmissin: Whenever a building permit is required fr erectin r alteratin f a structure ther than ne and tw family What is the Site Plan Review Prcess? The site plan review prcess generally cnsists f ne stage. There is als an administrative stage that may be applied fr if the prject is very mderate in scpe. Fr the cnstructin, use r establishment f new r additinal parking r strage Fr all Special Land Uses Fr any substantial change in use r class f use Why is Site Plan Review Required? Site Plan review prvides the Twnship the pprtunity t review the prpsed site use in accrdance with all applicable Twnship rdinances and plans. The impact n health, safety and welfare is f the utmst cncern as it relates t vehicular circulatin, landscaping, parking, screening, and ther relevant factrs that make a site develpment a desirable additin t the Twnship. There may be ther cunty and state apprvals required. Cntact them fr mre infrmatin. 3

4 Site Plan - Checklist What infrmatin must be included n a Site Plan? All site plans submitted fr review must include the infrmatin required by Sectin f the Charter Twnship f Chesterfield Zning Ordinance. Site Plans must cnfrm t current Twnship regulatins and thse f any ther agency having jurisdictin. Incmplete site plans will nt be accepted fr review. The fllwing checklist will assist applicants in preparing a cmplete site plan. Twenty ne (21) cpies f the site plan and all dcuments. Existing and prpsed rights-f-way fr all abutting rads. The seal with signature f the engineer r prfessinal wh prepared it. Lcatin and dimensins f all driveways and street appraches. Cmplete legal descriptin with designated pint f beginning at a quarter sectin line. Type f surface (paving) fr access and circulatin areas. Parking lcatin, number f spaces, aisle dimensins, type f surfacing, landscaped island dimensins. Zning f site and surrunding prperty. Existing and prpsed tpgraphy at tw (2) ft cnturs. Lcatin and extent f wetland and fldplain areas if applicable. Landscape plan including lcatin, number, type and size f all existing and prpsed plantings and methd f irrigatin. Lcatin f existing and prpsed structures and imprvements. Lcatin and details f all greenbelts, walls and berms. Existing ff-site imprvements within 200 f all prperty lines. Lcatin and screening f trash receptacles. Site lighting lcatin, height, type, intensity and shielding. Architectural building elevatins and type f exterir surface materials and design. Lcatin f freestanding sign. (Signs are apprved under separate review submittal) Dimensined flr plans fr all buildings. Develpment Impact Statement and/r Traffic Impact Study, if applicable. 4

5 Site Plan - Cmmn Questins D I need t attend any meetings? Yu will be ntified f all meetings with yur site plan n the agenda. It is strngly recmmended that yu have representatin at all meetings at which yur site plan will be discussed. The Planning Cmmissin may take actin n a site plan whether the applicant is in attendance r nt. Hwever if the Planning Cmmissin has questins fr the applicant the petitin may be pstpned. What happens after site plan apprval? Once site plan apprval is given the next step is t make any necessary changes t the plans as required by the Planning Cmmissin. Upn revisin, the applicant must submit seven (7) cpies f the revised plan clearly highlighting the revisins. Plan will be reviewed, signed and ne cpy returned t the applicant. Des site plan apprval allw me t begin cnstructin? N. Site plan apprval indicates yu have cmplied with the Zning Ordinance. It des nt satisfy engineering r building requirements. There may als have ther cunty and state apprvals needed. Hw lng is site plan apprval valid? Site Plan apprval is valid eighteen (18) mnths frm the date f apprval. The applicant must have made applicatin fr a building permit and have engineering apprval. The site plan will becme null and vid if an extensin is nt granted by the Planning Cmmissin befre the deadline f 18 mnths. If an extensin is nt applied fr in writing and apprved, a new site plan applicatin and apprval shall be required. 5

6 What is a Special Land Use? Special Land Use What is required fr SLU submissin? Special Land Uses are uses that may be permitted in a certain zning district with a special apprval frm the Planning Cmmissin which includes a public hearing. There are certain cnditins and standards that must be met alng with a site plan review by the Planning Cmmissin What is the Special Land Use Prcess? All Special Land Use submissins must be accmpanied by a cmplete site plan package that includes all the infrmatin required by the Twnship Zning Ordinance. Incmplete submissins will nt be accepted fr review. Use the check list n page 3 t make sure yur submissin is cmplete. Alng with the site plan submissin a written narrative addressing the eight standards fr special land use must accmpany the package. The Special Land Use prcess includes the site plan review prcess with the additin f a Public Hearing befre the Planning Cmmissin. 7 Special Land Use What are the Review Standards fr Special Land Use? The prpsed use shall be f such lcatin, size and character that is will be in harmny with the apprpriate and rderly develpment f the surrunding neighbrhd and applicable regulatins f the zning district in which it is t be lcated. The prpsed use shall be f a nature that will make vehicular and pedestrian traffic n mre hazardus than is nrmal fr the district invlved, taking int cnsideratin vehicular turning mvements in relatin t rutes f traffic flw, prximity and relatinship t intersectins, adequacy f site distances lcatin and access f ff-street parking and prvisins fr pedestrian traffic, with particular attentin t minimizing pedestrian-vehicle cnflicts. The prpsed use shall be signed as t the lcatin, size, intensity, site layut and perids f peratin f any such prpsed use t eliminate any pssible nuisance emanating therefrm which might be nxius t the ccupants f any ther nearby uses permitted, whether by reasn f dust, nise, fumes, vibratin, smke r lights. The prpsed use shall be such that the prpsed lcatin and height f buildings r structures and lcatin, nature and height f walls, fences and landscaping will nt interfere with r discurage the apprpriate develpment and use f adjacent land and buildings r unreasnably affect their value. The prpsed use shall relate harmniusly with the physical and ecnmic aspects f adjacent land uses as regards prevailing shipping habits, cnvenience f access by prspective patrns, cntinuity f develpment and need fr particular services and facilities in specific areas f the twnship. The prpsed use is necessary fr the public cnvenience at the prpsed lcatin. The prpsed use is s designated, lcated, planned and t be perated that the public health, safety and welfare will be prtected. D I need t attend any meetings? Planning Cmmissin apprval des nt authrize yu t start cnstructin. Yu first must submit seven (7) cpies f the revised and/r crrected plans highlighting any and all revisins. Then yu must apply fr Engineering and Building Department apprval and btain any and all permits that are necessary frm all agencies. Hw lng is apprval valid? Special Land Use apprval is gd fr 270 days. The applicant shall have engineering apprval and applied fr building permits. Failure t d s will result in the apprval being null and vid. The applicant may apply fr an extensin befre the expiratin f the 270 day perid. If apprval is nt extended, a new applicatin and apprval shall be required. Wh d I cntact if I have mre questins? 8 Planned Unit Develpment What is a Planned Unit Develpment? The Planned Unit Develpment (PUD) cncept is intended t prvide a greater degree f flexibility in the regulatin f land develpment and the arrangement f uses. Thrugh this ptin, mre creative appraches t develpment can be utilized which take advantage f the special characteristics f the land than wuld therwise be pssible thrugh the strict enfrcement f the rdinance. The specific bjectives f this article are t: Encurage innvatin in land use and variety in design, layut and type f structures cnstructed; while preserving the intent and integrity f the twnship master plan. Preserve significant natural resurces. Achieve ecnmy and efficiency in the use f land, natural resurces, energy, and the prvisin f public services and utilities. Apprval Denial What is the PUD review prcess? The Planned Unit Develpment prcess is a tw step prcess. The first step is a pre-applicatin phase. During this phase basic site infrmatin and sketch plans are submitted and discussed at a public hearing befre the planning cmmissin. If it is deemed the prject has merit and ptential t meet the rdinance requirements, an applicatin may be submitted A cmplete package must be submitted fr the applicatin phase alng with a written narrative respnding t the special land use review standards. This phase will als cntain a public hearing. After the planning cmmissin has cmpleted their review they will frward the applicatin t the Twnship Bard fr final apprval f the prpsal. What is required fr PUD review? A Planned Unit Develpment is ne f the mst innvative develpment tls in the zning rdinance. It is als scrutinized clser than ther develpment methds, therefre, it is suggested that yu fllw sectin f the zning rdinance clsely befre submitting any plans. Submittals that are nt cmplete will nt be accepted. Yu will be ntified by mail when yur prpsal is n the agenda s yu can arrange t have a representative in attendance. Individual site plans will be submitted fr apprval during develpment f the PUD. Sectin f the rdinance utlines the prcess and requirements f the PUD apprval. 8

9 Cndminium Subdivisin Review What is the intent f Cndminium Subdivisin review? The intent f the site cndminium subdivisin requirements is t ensure that all site cndminium subdivisins are develped in cmpliance with accepted planning and engineering standards applicable t similar frms f detached single family develpment in the Twnship. Submit Applicatin Package Preliminary Review By Planning Cmmissin Preliminary Apprval Denial Engineering Review And Apprval Final Review By Planning Cmmissin What is the cndminium subdivisin review prcess? The cndminium subdivisin review prcess cnsists f preliminary and final review. The planning cmmissin has authrity ver bth steps. After preliminary review apprval, the applicant must apply fr and btain engineering apprval fr all site imprvements. Once that is accmplished the applicant may apply fr final cndminium subdivisin apprval. Yu must submit all lcal and state apprvals alng with a cpy f a recrdable master deed and by-laws fr review. Fllw the site plan checklist fr all further requirements. This is nt the green flag fr cnstructin. Yu still must btain permits frm twnship, state and cunty gvernments. Apprval Denial 9

10 Subdivisins What is the Subdivisin review prcess? The subdivisin review prcess has been established by the State f Michigan Land Divisin Act While the flwchart prvides an verview f the Twnship apprval prcess, applicants shuld clsely review the Twnship Subdivisin Regulatins and the State Land Divisin Act fr all requirements f the apprval prcess. 11 Subdivisin - Preliminary Plat What is required fr tentative preliminary plat review? The fllwing must be submitted: One (1) cmpleted Applicatin Frm with riginal signatures f the legal wner and applicant. One (1) cmpleted Applicant Infrmatin Frm. Prf f wnership. Fifteen (15) cpies f the preliminary plat, sectin map (at 200 scale) with subdivisin superimpsed, USGS, aerials and tree inventry, street name apprval. Fifteen (15) cpies f the Develpment Impact Statement and/r Traffic Impact, if applicable. Prf plat was submitted t the schl district. Cmments frm Macmb Cunty Plat Crdinating Cmmittee. Review Fees. What infrmatin must be included n a preliminary plat? Plats submitted fr tentative apprval must include the infrmatin required by Article IV, Sectin f the Chesterfield Twnship Land Divisin Regulatins. Fr final apprval, preliminary plats must include infrmatin required by Sectin Plats must cmply with the subdivisin design standards, ther Twnship regulatins and thse f any ther agency having jurisdictin. The prprietr shuld btain cpies f the Twnship Zning Ordinances, Master Plan, Subdivisin Regulatins, Engineering Design Standards, and any ther rdinances r cntrls relative t the develpment f land. What is required fr final preliminary plat review? The fllwing must be submitted fr final preliminary review f preliminary plat: One (1) cmpleted Applicatin Frm with riginal signatures f the legal wner and applicant. One (1) cmpleted Applicant Infrmatin Frm. Prf f wnership. Fifteen (15) cpies f the preliminary plat, sectin map (at 200 scale) with subdivisin superimpsed, and tree inventry. Summary f changes incrprating all cmments made during tentative review. Cmments frm Macmb Cunty Plat Crdinating Cmmittee. Department f Envirnmental Quality apprval (if applicable). Review Fees. Submit subdivisin restrictins fr apprval. What are the submissin deadlines fr tentative and final preliminary plat review? Fifteen (15) Preliminary Plats must be submitted at least twelve (12) days prir t a regularly scheduled Planning Cmmissin meeting. Applicatins fr subdivisin review shall be filed with the Twnship Planning Department. Please make sure all yur dcumentatin is present. The Twnship will nt accept yur submittal if it is nt a cmplete submittal. 11

12 Develpment Review Handbk Subdivisin - Final Plat What is required fr final plat review? The fllwing must be submitted: Six (6) cpies f the cmpleted Applicatin Frm with riginal signatures f the legal wner and applicant. Six (6) cpies f the Final Plat. One (1) mylar (include easements fr subdivisin entrance signs) fr addressing. One (1) 200 scale mylar. Grading Plan. Title Plicy. Letter frm yur engineer certifying t the number f mnuments and irns r, if nt installed, prvide escrw at $35.00 per mnument and $15.00 per irn. Review Fees. Written recmmendatin frm Twnship Planner and Engineer. Minutes frm previus plat apprvals. S.A.D. established fr entrance street light. The final plat shall cnfrm t the preliminary plat as apprved. The final plat shall als cmply with the State f Michigan Land Divisin Act. N plat will be accepted unless it is submitted with all items listed. Yu will be ntified by mail f all meetings with yur prpsal n the agenda. Yu shuld have representatin at all meetings. Actin may be taken by the Planning Cmmissin r Twnship Bard whether the applicant is in attendance r nt. If there are questins, the prpsal may be pstpned until the applicant is available t answer them. 12

13 Develpment Review Handbk Reznings Overview What is a rezning f prperty? A rezning is a change in the zning classificatin f a specific prperty and is an amendment t the Twnship s fficial Zning Map. The Planning Cmmissin is a recmmending bdy in the case f a rezning. The apprval authrity rests with the Twnship Bard. What is a cnditinal rezning? As part f the request fr rezning, an wner may ffer vluntarily in writing, a specific use and/r develpment f the land as a cnditin f the apprval f the rezning. The Twnship Bard may apprve the cnditinal rezning if the request is reasnable and ratinal and meets the Twnship Zning Ordinance and all applicable sectins f the Michigan Zning Enabling Act. What are the prcedures fr requesting a rezning? After receiving a cmpleted applicatin fr rezning, the Planning Cmmissin will set a public hearing, review the request and make their recmmendatin t the Twnship Bard. The Twnship Bard has final apprval authrity n a rezning request. 14 Develpment Review Handbk Reznings Requirements What are the applicatin requirements? Twelve (12) cmpleted applicatin frms with riginal signatures f legal wner and applicant. One (1) cmpleted applicatin infrmatin frm. Twelve (12) cpies f a feasibility sketch plan cntaining lt number, size and shape f parcel, size and lcatin f building(s), parking area with number f parking places alng with aisle widths, adjacent buildings with lcatin and use, number f emplyees expected at peak. Legal descriptin f the prperty t be rezned. Sketch f the prperty with legal descriptin fr newspaper publicatin. Rezning Signs Once yur public hearing has been set it is required that a sign, indicating the prperty is prpsed fr rezning, be placed n the prperty. The sign must be placed n the prperty by the petitiner r prperty wner nt mre than twenty (20) nr less than fifteen (15) days befre the public hearing date. After the public hearing is held the petitiner has fifteen (15) days t return the sign t the Twnship t receive a refund n the bnd that was psted. Cntact the Planning Department fr mre infrmatin n where t pick up and return the sign. If the sign is nt returned, r is damaged when returned, the bnd mney submitted at the time f applicatin will be used t replace it. Twelve (12) cpies f the Traffic Study fr Rezning (if applicable). All required fees. D I need t attend any meetings? Yu will be ntified f all meetings that yur zning request in n the agenda. It is strngly recmmended that yu have representatin at all meeting that yur applicatin will be discussed. The Planning Cmmissin and the Twnship Bard may take actin n an applicatin whether the applicant is an attendance r nt. The applicatin may als be pstpned if the applicant is nt available fr questins. 14

15 Develpment Review Handbk Zning Bard f Appeals Overview What is the Zning Bard f Appeals? The Zning Bard f Appeals (ZBA) is a quasijudicial bdy appinted by the Twnship Bard The ZBA is authrized t hear and decide matters as required by the Michigan Zning Enabling Act and the Chesterfield Twnship Zning Ordinance. What are the pwers f the Zning Bard f Appeals? The Zning Bard f Appeals has the fllwing pwers: Grant variances frm the prvisins f the Zning Ordinance. Hear and decide appeals f any rder, decisin, determinatin, r requirement made by the Planning Cmmissin r any ther bdy r fficial charged with administratin r enfrcement f the Zning Ordinance. FYI Variance requests fr setbacks, height, area and bulk are the mst cmmn requests brught befre the Zning Bard f Appeals. Interpret the Zning Ordinance and Map. Permit temprary structures. What are the prcedures fr submitting an applicatin t the ZBA? Applicatins t the Zning Bard f Appeals are required t be submitted a mnth befre the meeting due t State regulatins n publishing and mailing ntices. The type f request yu submit will determine the prcedure fllwed by the ZBA. 15

16 Develpment Review Handbk Zning Bard f Appeals - Variances Hw d I request a variance? One cmpleted Applicatin Frm with riginal signatures f the legal wner and applicant. One cmpleted Applicant Infrmatin Frm. Letter f Intent clearly explaining the variance request and cnfrmance with the review standards belw. Twelve cpies f a survey r site plan, drawn t scale, shwing all buildings existing and prpsed, prperty bundaries and variance request clearly indicated. Review Fee. What are the standards fr ZBA review? The strict enfrcement f the prvisins f the rdinance wuld cause practical difficulty and/r unnecessary hardship and deprive the wner f rights enjyed by all ther prperty wners wning prperty within the same zning district. What is the variance prcess? A variance request is the result f a cnditin unique t a particular prperty r structure and nt the result f an administrative actin. Therefre, a denial is nt a required precedent t an applicatin. Prjects that require site plan review must be first be cnsidered by the Planning Cmmissin befre an applicatin is submitted t the Zning Bard f Appeals. FYI Applicatin t Planning & Zning Department 30 Days Prir t Meeting Variance requests fr setbacks, height, area and bulk are the mst cmmn requests brught befre the Zning Bard f Appeals. Request Published and Mailed per State Statute Requirements Public Hearing and Review by the Zning Bard f Appeals Cnditins and circumstances are unique t the prperty which is nt applicable t ther prperties in the same zning district. Apprval Denial The cnditins and circumstances unique t the prperty were nt created by the wner r his predecessr. The requested variance will nt cnfer special privileges r right upn the applicant. The requested variance will nt be cntrary t the spirit and intent f the Ordinances. FYI Variances may nt be applied fr nr granted fr any apprved Special Land use r Planned United Develpment. A cncurring vte f the majrity f the Bard is necessary t grant a variance. The Bard cnsists f seven members s fur affirmative vtes are required fr apprval. 16

17 Develpment Review Handbk Zning Bard f Appeals Interpretatins and Appeals Hw d I request an interpretatin f the Zning Ordinance r Zning Map? Fllw the variance prcedures when submitting a request fr an interpretatin. The Bard may pstpne the request t get ther prfessinal cnsultant s input. Otherwise the prcedure f apprval r denial will be the same as the variance request prcedure. Hw d I initiate an appeal t the ZBA? Fllw the variance prcedures when an appeal request. Alng with the regular required dcuments, please submit any ther dcumentatin that may be f imprtance. After a public hearing and review the Zning Bard f Appeals may reverse r affirm, in whle r in part, r may mdify the rder, requirement, decisin, r determinatin being appealed. In making its decisin, the ZBA has the authrity t assume all pwers and duties f the bdy r fficial frm whm the appeal was taken. D I need t attend any meetings? Yu will be ntified by mail f all meetings yur request will be heard. It is recmmended that yu have a representative present at any meeting yur request will be discussed. Des actin by the ZBA allw me t begin cnstructin? Zning Bard f Appeals actin des nt authrize cnstructin. Permits must still be btained thru the prper Twnship Departments. Can I appeal a decisin f the Zning Bard f Appeals? All decisins f the Zning Bard f Appeals are final. A part aggrieved by a decisin may appeal t circuit curt in accrdance with the prcedures established by State Law. FYI Did yu knw that the ZBA is a quasi-judicial bdy? Yu culd call them a mini-curt. They have mre pwer than the Twnship Bard as they are the nly Bard that can grant yu apprval t vary frm the requirements f the Zning Ordinance. 17
