That street vacatin prceedings pursuant t the Public Streets, Highways and Service Easements Vacatin Law be instituted fr the vacatin f the public rightf-way indicated belw and shwn clred blue n the attached Exhibit A : A 15-ft wide prtin f the nrtherly side f Abbt Kinney Bulevard frm apprximately 120 feet t 200 feet westerly f Westminster Avenue. C. D. E. F. That the Cuncil find that the vacatin is exempt frm the Califrnia Envirnmental Quality Act f 1970, pursuant t Article III, Class 5(3) f the City s Envirnmental Guidelines. That the City Cuncil find that there is a public benefit t this street vacatin. Upn vacatin f the street, the City is relieved f its nging bligatin t maintain the street. In additin, the City is relieved f any ptential liability that might result frm cntinued wnership f the invlved street easements. That, in cnfrmance with Sectin 556 f the City Charter, the Cuncil make the finding that the vacatin is in substantial cnfrmance with the purpses, intent and prvisins f the General Plan. That, in cnfrmance with Sectin 892 f the Califrnia Streets and Highways Cde, the Cuncil determine that the vacatin area is nt necessary fr nnmtrized transprtatin facilities.

That the City Clerk schedule the vacatin fr public hearing at least 30 days after the Public Wrks and Gang Reductin Cmmittee apprval based n the Rule 16 mtin adpted by City Cuncil n December 1, 2015, s the City Clerk and Bureau f Engineering can prcess the Public Ntificatin pursuant t Sectin 8324 f the Califrnia Streets and Highways Cde. FISCAL IMPACT STATEMENT: The petitiner has paid a fee f $47, fr the investigatin f this request pursuant t Sectin 7.42 f the Administrative Cde. DISCUSSIN: Request: The petitiner, Brady McShane f Manatt, Phelps and Philips, LLP, representing Secnd Cmmunity Baptist Church f Venice, the wner f the prperty shwn utlined in yellw n Exhibit A, is requesting the vacatin f the public street area shwn clred blue. The purpse f the vacatin request is t allw fr the cntinued use f the area by the adjining parcels fr parking. This vacatin prcedure is being prcessed under prcedures established by Cuncil File N adpted by the Ls Angeles City Cuncil n March 5, Reslutin t Vacate: The Reslutin t Vacate will be recrded upn cmpliance with the cnditins established fr this vacatin. Previus Cuncil Actin: The City Cuncil n December 1, 2015, under Cuncil File N adpted a Rule 16 Mtin initiating street vacatin prceedings. Zning and Land Use: The prperties adjining the area t be vacated t the nrth are zned C2-1-CA, and are develped with a church facility and accessry parking. Descriptin f Area t be Vacated: The area sught t be vacated is the 15-ft wide prtin f the nrtherly side f Abbt Kinney Bulevard frm apprximately 120 feet t 200 feet westerly f Westminster Avenue adjining Lts 4 and 5 f cean Park Villa Tract N. 2. The area t be vacated is nt imprved as a street and is currently used fr parking fr the site. Adjining Street: Abbt Kinney Bulevard is a Mdified Avenue III, dedicated 70 feet wide with a 50-ft wide radway with 4-ft wide parkway and 5-ft wide sidewalk n the nrtherly side. Effects f Vacatin n Circulatin and Access: The vacatin f the 15-ft wide prtin f the nrtherly side f Abbt Kinney Bulevard frm apprximately 120 feet t 200 feet westerly f Westminster Avenue shuld have n effect n circulatin r access since it is currently being used as parking fr the adjining lt and is nt imprved as part f the street. The area t be vacated is in excess f the required 70 feet fr Abbt Kinney Bulevard as a Mdified Avenue III.

Castal Develpment Permit: Castal Develpment Permit N was issued n May 29, 2015 fr this vacatin pursuant t the public hearing held n May 14, 2015 and Ntice f Decisin n May 18, N appeals were filed. bjectins t the vacatin: There were n bjectins t the vacatin submitted fr this prject. Reversinary Interest: N determinatin f the underlying fee interest f the vacatin area has been made as t title r reversinary interest. Dedicatins and Imprvements: It will be necessary that the petitiner prvide fr the imprvements as utlined in the cnditins f this reprt. There are n dedicatins required. Sewers and Strm Drains: There are n existing sewer r strm drain facilities within the area prpsed t be vacated Public Utilities: There are n public facilities in the area prpsed t be vacated. Tract Map: Since there are n dedicatins required, and the necessary imprvements can be cnstructed under separate permit prcesses, the requirement fr the recrdatin f a new tract map culd be waived. Hwever, it will be necessary that the petitiner recrd an agreement satisfactry t the Bureau f Engineering t hld the adjining parcel f land under the same wnership, and its adjining prtin f the area t be vacated, as ne parcel t preclude the creatin f substandard r landlcked parcels.
