32 29.9 (a) Size / Quantum for construction of Hotel in Non Processing Area Item No: 29.9 (a) The Zone is having a notified area admeasuring ha of which the non-processing area is 0.66 ha (6600 Sq. Mt.) Ministry of Commerce vide letter No. F.2/82/2005-EPZ dated 29/08/2006 had granted following authorized activities in the non-processing area: 1. Hotels/Service Apartments (as per size / quantum determined by the Approval Committee). 2. Housing (as per size / quantum determined by the Approval Committee). The Developer, vide letters dated and , has submitted a request (Ref 29.9.a.1) for approving the Size / Quantum for construction of Hotels in the Non Processing Area. Mt. multiplied with 3.25) As per MoC Instruction No. 30 dated 03/08/2009 (Ref ), only 15% of the FAR may be utilized for commercial activity in NPA. Hence, the Developer may construct hotels with a maximum total FAR Area of Sq. Mt. (i.e. 15% of Sq. Mt.) Observations: 1. Developer s request to build hotel of FAR area of Sq. Mt. is 10.5 times more than the ceiling for commercial activity (i.e Sq. Mt) and 1.6 times of overall ceiling of FAR area of NPA( i.e Sq. Mt.) 2. The Zone houses only one unit. It may be intended mainly for the use general public than for the Zone s utilization. 3. MoC approval was issued in However, since then there has been lots of development with respect to hotel infrastructure in Bangalore. 4. The need for 2 hotels is not justified. 33 Item No: Review of Letter of Approvals (issued to setup SEZ units by shifting existing business). Further to deliberation of case 28.8 of 28 th Unit Approval Committee, following are the updates and action taken. 1. As decided in the 28 th UAC, On , DC s Office issued addendums to the LoAs of M/s. Geometric Ltd Unit II and M/s. Stratify Software India Pvt. Ltd Unit II to include the following condition. xvi) You shall abide by the decision/approval of the Ministry of Commerce with respect to the clarification sought by this office regarding shifting of existing STP operations / business to this SEZ unit and downsizing the STP operations The copies of addendum to LoAs are enclosed at Ref: & The issue of addendum has been communicated to Ministry of Commerce. Other related information A. Based on the earlier UAC decisions, the LoA for companies who already has operations were issued condition. (i)(b) The existing business of the company should not be extended into the proposed business activity of the company under SEZ unit. On , MoC had sought clarification (orally) from the DC s office for including such condition which is not there in standard format of LoA. The Development Commissioner (IT/ITES) vide dated 28/09/2010 (ref & 4), explained and justified the reason for inclusion of the condition (i)(b) in LoA. Subsequent reply received from the Additional Secretary, DoC, MoC is enclosed at (Ref: ). B. Similarly, the application of M/s. Msource has been rejected by DC s Office vide letter no. STPIB/GEN/SEZ/243 dated 27/08/2010 based on the fact that they intended to shift existing business. Subsequent communications & clarifications received from the Zonal DC are enclosed at Ref: , 7, 8 & 9 Observations: Both the clarifications presented at seen in A & B above are the opinion of a Individual Officer or of an Office. As the matter in question (of shifting business to SEZ) is related to SEZ Act, it has to be discussed and deliberated in BoA. Hence it is proposed to proceed towards revoking the LoAs of SEZ units which are approved for shifting of existing STP operations. Unit may then approach BoA. Put up for further deliberation of UAC 33
