SEZ-II ADMINISTRATIVE OFFICE: CSEZ: KAKKANAD KOCHI Minutes of the 33 rd Meeting of the Unit Approval Committee (1/2015series) of Bagmane Developers Pvt. Ltd. SEZ-II held on The 33 rd meeting (1/2015 series) of the Unit Approval Committee of Bagmane Developers Pvt. Ltd. SEZ-II, at Mahadevapura, K.R. Puram, Bangalore North, Karnataka, constituted under Section 13 of Special Economic Zones Act, 2005, was held on at a.m. The meeting was chaired by Dr. Safeena A.N., Development Commissioner at SEZ Bhavan, Whitefield, Bangalore. 2. The Chairperson noted the lack of quorum for the meeting. Since the transaction of SEZ cannot be held up, the Chairperson has taken up the agenda items as per procedure laid down for the Approval Committee. 3. At the outset the Chairperson welcomed the members of the Approval Committee. 4. The following items in the agenda, circulated in advance, were thereafter taken up for consideration. A. Confirmation of the minutes: The minutes of the 32 nd meeting of the Unit Approval Committee (8/2014 series) held on was confirmed. Contd.2 5

Action Taken on the decisions of the previous meeting: The Chairperson informed the members that the following decisions of the last meeting had been communicated: Sl No 1 2 Approvals Application for approval for list of goods for carrying out authorised operation (Plug & Play facility to be procured from M/s Infosys Ltd. (SEZ unit)), submitted by Bagmane Developers Pvt. Ltd. SEZ II (Developer), Bangalore. Application for approval of additional list of services, submitted by M/s Wells Fargo India Solutions Pvt. Ltd., Bangalore C. Consideration of applications: Date of issue of Approval Application for approval of service items viz. Health Services and Management Consultants Services, submitted by M/s Microland Ltd. Bangalore. The Chairperson informed the Committee that M/s Microland Ltd., a unit in a Bagmane Developers Pvt. Ltd. SEZ II, Bangalore vide their letters dated and has submitted applications for approval of service items viz. Health Services and Management Consultants Services, required for carrying out authorised operation. These services are not covered in the default list of services issued by Department of Commerce, Govt. of India and circulated by this office, as per Notification No.12/2013-ST dated The unit has submitted the nature of services, name of vendors and justification in relation to authorised operation of the said services. Decision of the Committee: The Committee after deliberation approved the service item viz Health Services and Management Consultants Services, as follows, which are not covered in the default list of services, to enable the unit to avail the Service Tax benefit for carrying out authorised operation. Life Insurance services, submitted by M/s Wells Fargo India Solutions Pvt. Ltd., Bangalore. The Chairperson informed the Committee that M/s Wells Fargo India Solutions Pvt. Ltd., a unit in a Bagmane Developers Pvt. Ltd. SEZ II, Bangalore vide their letters dated and has submitted applications for approval of additional name of vendors under Management or Business Consultant Service and Business Auxiliary Services required for carrying out authorised operation and approval of service item viz. Life Insurance Service. The unit has also furnished the name of vendor, nature of services and detailed justification in relation to authorised operation in respect of Life Insurance Service, which is not covered in the earlier approvals and default list of services issued by the Department of Commerce, Govt. of India, as per Notification No.12/2013-ST dated and circulated vide this office Circular No.2/2014 dated As directed by the last UAC held on , the unit has furnished the quantum of service tax amount as Rs. 20 lakh (Approx.) related to Life Insurance Services. Decision of the Committee: The Committee after deliberation noted that the service item viz., Life Insurance Service as sought for by the Unit cannot be permitted vis-à-vis their authorised operations and approved the name of additional vendors under service items viz Management or Business Consultants Services and Business Auxiliary Service as follows, which are not covered in the earlier approved list of services, to enable the unit to avail the Service Tax benefit for carrying out authorised operation. Ltd. has submitted an application dated for setting up of a new unit at Bagmane Developers Pvt. Ltd. SEZ - II, Bangalore for carrying out authorized operation of Information Technology Enabled Services. M/s GCC Services India Pvt. Ltd. was incorporated on under the companies Act GCC Services India Pvt. Ltd. ( GCC India ) is a company constituted as a subsidiary of Interbrew International B. V. ( Interbrew ). The Netherlands and intends to be engaged in providing IT Enabled Services to group companies across the globe. GCC India and Interbrew are part of the Anheuser-Brush InBev group. GCC India intends top develop a center which would enable the development of new capabilities such as advanced automation and global end-to-end process design, and IT enabled services, making use of the expertise, infrastructure and talent pool that the company can rely on by establishing this center in Bangalore. The company will avail the external commercial borrowing from holding company or group comapanies out side India in accordance with the guidelines of the Reserve Bank of India. The present proposal for setting up of a unit in Bagmane Developers Pvt. Ltd. SEZ - II, Bangalore has a projected export turnover of Rs lakh and NFE of Rs lakh for the next five years. Ltd. SEZ II, Bangalore. M/s Bagmane Developers Pvt. Ltd. SEZ - II (Developer) vide their letter dated Nil received by this office on has submitted a request for permission to lease a portion of built up space having an area of 3211 sq. ft. for a term of 5 years at the building Onyx for M/s Indian Overseas Bank. The building named Onyx has been constructed exlusivily for the purpose of common amenity services in the processing area. The request of the Developer can be considered in terms of proviso to Rule 11 (5) of SEZ Rules and Instruction No 50 (Sl. No 25) of authorised activites which can be undertaken by the Developer by default from the date of notification. It is also clarified by the DoC vide Notification published in Gazettee of India dated vide SO 527 (E) that the provisions of clause (u) of Sec.2 of SEZ Act, 2005 would not apply to SEZ in so far as they relate to setting up of (i) offsite Automatic Teller Machine (ATM) in the SEZs and (ii) branches in SEZs by banks, not licensed as offshore Bnaking unit with perior permission of RBI under Sec.23 of Banking Regulation Act In view of the above and as per proviso to Rule 11 (5) of SEZ Rules, the request of the unit is placed before the Committee for consideration and approval.. 10
