Proceeding Varied Code of Conduct Regulation Compliance Plan Application A001 1 Introduction 1. On November 17, 2017, the Mayerthorpe and District Rural Electrification Association Ltd. (Mayerthorpe) filed an application with the Alberta Utilities Commission requesting approval for changes to its varied code of conduct compliance plan (compliance plan). Mayerthorpe proposed to revise the compliance plan by expanding the list of retailers in paragraph 8 of the compliance plan to include ATCO Energy Ltd., ATCO Energy Ltd. 1, and XOOM Energy Canada, ULC. Mayerthorpe also made minor edits to correct retailer names and wording in the compliance plan. 2. The Commission issued a filing announcement on November 21, The Commission has determined that no person will be directly and adversely affected by its decision on the proceeding, and has proceeded to the issuance of the decision without further notice or process on this basis. 4. The Commission considers the record of this proceeding to have closed on November 21, In reaching the determinations set out within this decision, the Commission has considered all materials comprising the record of this proceeding. 2 Commission findings 5. In Decision D , 1 the Commission approved Mayerthorpe s compliance plan, including a list of retailers, pursuant to the Code of Conduct Regulation and Rule 030: Compliance with the Code of Conduct Regulation. 6. Section 32(2) of the Code of Conduct Regulation states: Changes to compliance plan (2) A change to a compliance plan must be submitted to the Commission for approval (a) within 60 days following a change in circumstances or an amendment to this Regulation that requires a change to a compliance plan, or (b) as soon as practicable when a change to the plan is made for a reason other than a reason referred to in clause (a). 7. The Commission acknowledges receipt of Mayerthorpe s proposed wording revisions and changes to its list of retailers in the compliance plan, pursuant to Section 32 of the 1 Decision D : Mayerthorpe and District Rural Electrification Association Ltd., Varied Code of Conduct Regulation Compliance Plan, Proceeding 21941, Application A001, December 14, Decision D (January 31, 2018) 1

5 Varied Code of Conduct Regulation Compliance Plan Mayerthorpe and District Rural Electrification Association Ltd. Code of Conduct Regulation. It finds the proposed changes to be minor, or administrative in nature, and approves the proposed changes as filed. 8. In addition, Section 32(5) of the Code of Conduct Regulation requires: Changes to compliance plan (5) Each distributor, regulated rate supplier and affiliated provider of a distributor or regulated rate supplier shall, as soon as practicable after receiving the Commission s approval of changes to its compliance plan, send a copy of the changes to the compliance plan (a) in the case of a distributor or regulated rate supplier, to the affiliated providers of the distributor or regulated rate supplier, (b) in the case of an affiliated provider of a distributor or regulated rate supplier, to the distributors or regulated rate suppliers of which it is an affiliated provider, and (c) to its officers, employees, agents and contractors affected by the plan. 9. The Commission expects Mayerthorpe to provide copies of the compliance plan approved in this decision to its officers, employees, agents and contractors affected by the compliance plan, in accordance with the requirements of Section 32(5) of the Code of Conduct Regulation. 3 Order 10. 7 MAYERTHORPE AND DISTRICT RURAL ELECTRIFICATION ASSOCIATION LTD. Code of Conduct Regulation (AR 58/2015) Compliance Plan Introduction 1. Mayerthorpe and District Rural Electrification Association Ltd. is a distributor of electricity. This compliance plan has been prepared as a varied compliance plan in accordance with Section 3 of AUC Rule 030: Compliance with the Code of Conduct Regulation. 2. Mayerthorpe and District Rural Electrification Association Ltd. has 1,300 customers to which it provides energy services or retail services which is less than the 5,000 limit, as specified in Subsection 3(1) of Rule The system is operated by FortisAlberta Inc. on behalf of Mayerthorpe and District Rural Electrification Association Ltd. The operator currently does not have a code of conduct compliance plan which includes compliance provisions for the services provided to Mayerthorpe and District Rural Electrification Association Ltd. It is contemplated that subsequent operating agreements between the parties will contain compliance provisions for the services provided. 4. Mayerthorpe and District Rural Electrification Association Ltd. is the regulated rate supplier, as defined in Paragraph 1(1) (o) of the Code of Conduct Regulation, to Mayerthorpe and District Rural Electrification Association Ltd. customers. 8. These Retailers: Enmax Commercial Energy Marketing Inc., Enmax Energy Corporation, Just Energy Alberta L.P., Utility Network & Partners Inc., Hudson Energy Canada Corporation, Alta Gas Energy Limited Partnership, Direct Energy Partnership, ATCO Energy Ltd,. ATCO Energy Ltd. 1, and XOOM Energy Canada, ULC provide retail energy services, as defined in Paragraph 1(1)(q) of the Code of Conduct Regulation, to Code of Conduct Compliance Plan January 31,

8 Mayerthorpe and District Rural Electrification Association Ltd. customers and are not affiliated with Mayerthorpe and District Rural Electrification Association Ltd. 3(3)(b) Description of how the notice required by Section 34 of the Code of Conduct Regulation will be given to the public (Paragraph 30(4)(i)) of the Code of Conduct Regulation) 9. Mayerthorpe and District Rural Electrification Association Ltd. will provide notice to the public that complaints about contraventions of the Code of Conduct Regulation or this compliance plan may be made to the Commission or the Market Surveillance Administrator by an individual mail out to all members to ensure that the greatest number of people will become aware of it. Complaints about contraventions of the Code of Conduct Regulation may be made to the Alberta Utilities Commission or the Market Surveillance Administrator. Mayerthorpe and District Rural Electrification Association Ltd. will follow the process outlined below for voluntary resolution of complaints about non-compliance with the Code of Conduct Regulation. 1. Initial contact to REA Board Secretary 2. The Board Secretary has 5 business days to acknowledge receipt of the complaint, and initiate a process to resolve the complaint. 3. The Board Secretary initiates an investigation of the complaint, with a ten business day limit on the time to investigate. The ten days starts after notification of receipt in step 2 above. 4. If upon due investigation, the complaint is not valid, or is a result of a failure of a retailer, the Board Secretary will communicate the result of the investigation to the complainant and close the file. 5. If after due investigation, the complaint is valid, and the result of the action (or inaction) of the REA, the Board Secretary will communicate the results to the REA Board, and establish a timeline to resolve the issue. This will be communicated to the complainant. 6. If after due investigation, the complaint is valid, and the result of the action (or inaction) of a load settlement agent, the Board Secretary will communicate the results to the REA Board, file a complaint with the load settlement agent, and establish a timeline to resolve the issue. This will be communicated to the complainant. 7. When the issue is resolved, the REA Secretary will close the file. Code of Conduct Compliance Plan January 31,
