3 INTRODUCTION: NOMINEES The Ontari Immigrant Nminee Prgram (OINP) ffers an pprtunity fr skilled freign wrkers with a jb ffer t permanently live and wrk in Ontari. Prspective nminees (the applicant) can nly apply if they have received an apprved permanent full-time jb ffer frm an Ontari emplyer, r frm a business making an apprved and endrsed investment in Ontari. IMPORTANT: BEFORE APPLYING AS A NOMINEE In rder t apply as a nminee, the applicant must have a jb ffer that has been apprved by OINP. T d this: Ontari emplyers must first submit a Pre-screen Applicatin t have the psitin they wish t fill apprved by OINP. Fr infrmatin n the Pre-screen apprval prcess fr Ontari emplyers, visit the Emplyer sectin f the OINP website. Cmpanies making an investment in Ontari under the Investment Cmpnent f OINP must first have their investment apprved and endrsed by an Ontari ministry. They can then submit a Pre-screen Applicatin. Fr mre infrmatin, visit the Investr sectin f the OINP website. Fr applicants with a jb ffer frm an Ontari emplyer, the nminee applicatin fee is $2,000 fr thse with jb ffers in the Greater Trnt Area, and $1,500 fr thse with jb ffers utside f the Greater Trnt Area. 1 Fr applicants with a jb ffer frm a freign cmpany making an investment under the Investment Cmpnent in Ontari, the nminee applicatin fee is $3,500. This fee can be paid by either the applicant r the emplyer, but must be included in the nminee applicatin package. OINP n lnger accepts incmplete nminee applicatins, and will return them t applicants. In cases where OINP returns incmplete applicatins t applicants, OINP will als return the enclsed applicatin fees. Applicants submitting applicatins in persn must nte that receptin staff are nt authrized t prvide applicatin advice r review the cmpleteness f applicatins. 1 Greater Trnt Area is defined as the City f Trnt, Durham, Haltn, Yrk and Peel Regins. 1

ELIGIBILITY T be eligible t apply, a freign wrker must have a jb ffer that meets the fllwing criteria: be an apprved 2 permanent, full-time jb ffer in a highly skilled ccupatin (NOC 0, A r B) 3, and meets the prevailing wage levels in Ontari fr that ccupatin. 4 IMPORTANT: DEFINITION OF FULL-TIME A full-time psitin is cnsidered t be a psitin that cnsists f 1,560 hurs f paid emplyment in a 12 mnth perid. The fllwing are nt cnsidered permanent, full-time emplyees even if they wrk 1,560 hurs in a 12-mnth perid: seasnal r part-time emplyees regardless f their wrking hurs; subcntractrs, independent cntractrs, business wners r agency wrkers; and emplyees wh d nt wrk n the cmpany s premises, such as emplyees wh wrk frm hme, r emplyees wh wrk in a virtual lcatin, and wrk fr the emplyer by telecmmuting. The freign wrker must als: have tw years f relevant wrk experience in the last five years, r the relevant mandatry licensing in Ontari fr a regulated ccupatin, and be residing abrad r residing, wrking r visiting Canada n a valid wrk permit, study permit r visitr recrd. 2 The jb ffer must be fr a psitin apprved by OINP thrugh the Emplyer Pre-screen Applicatin. 3 Fr infrmatin the Natinal Occupatin Classificatin and hw t find it, see the Appendix: Finding the Psitin NOC Cde and Skill Level n Page 20 f this Applicatin Guide. 4 Infrmatin abut wage levels in different ccupatins can be fund n the Gvernment f Canada Jb Bank ( and selecting Explre Careers: Wages. 5 IMPORTANT: RELEVANT WORK EXPERIENCE Fr wrk experience btained in Canada, Ontari Immigrant Nminee Prgram will accept full-time wrk experience that is verifiable, relevant, paid and btained with prper wrk authrizatin frm Citizenship and Immigratin Canada (e.g., wrk permit) within the mst recent five years. Unpaid, unauthrized r vlunteer experience will nt be accepted. Overseas wrk experience is als accepted prvided that it was full-time, verifiable, relevant and paid. Refugee claimants with an applicatin t remain in Canada that is pending are nt eligible t apply fr OINP. A refugee claimant whse claim has been rejected, abandned r withdrawn must exit Canada prir t applying fr OINP. Refugee claimants may nly apply t OINP nce they have left Canada. PREPARING THE APPLICATION Applicants can begin their nminee applicatin nce they have received the fllwing dcuments frm their prspective emplyer: a cpy f the Emplyer Pre-screen Apprval letter, riginal jb ffer letter signed by the emplyer which includes the prspective ccupatin title, duties and respnsibilities, wage t be paid and that the ffer being made is fr a permanent, full-time psitin, riginal Pre-screen Psitin frm signed by the emplyer and the applicant, and riginal Jint Verificatin frm signed by the emplyer and the applicant (See Sectin 3.3 fr infrmatin n cmpleting this frm). Nminee applicatins must be received within 60 days f the date the Pre-screen Psitin frm is issued t the emplyer, as indicated n the psitin frm. If the nminee applicatin is nt received in cnnectin with the psitin after 60 days, the apprved psitin is n lnger eligible and the emplyer will be required t reapply shuld they wish t secure anther apprved psitin. If the deadline t submit the applicatin falls n a weekend r a statutry hliday, the deadline t submit the applicatin will be extended t the next wrking day. 2.1 OBTAINING THE FORMS The Nminee Applicatin frm is available fr free dwnlad n the OINP website. The frm has tw parts which are dwnladed separately: Nminee Applicatin Frm with a Jb Offer (Required) Authrizing r Cancelling a Representative Frm (Optinal) Detailed instructins fr cmpleting the Nminee Applicatin can be fund in Sectin 3.1: Cmpleting the Nminee Applicatin Frm. 2.2 AUTHORIZING A REPRESENTATIVE Applicants are nt bliged t hire a representative. 4

7 Hwever, if the applicant receives help frm an individual in applying fr OINP and the applicant wishes t authrize this individual t act n their behalf with OINP, the applicant must submit the Authrizing r Cancelling a Representative frm with their applicatin. An applicant may nly have ne representative at a time, and this representative may nly be appinted thrugh the Authrizing r Cancelling an Emplyer Representative frm. If a new representative is appinted, the previus representative will n lnger be authrized t cnduct business n behalf f the applicant, r receive infrmatin abut the applicatin. Paid Authrized Representatives must be authrized representatives as defined by the Immigratin and Refugee Prtectin Act f Canada (IRPA). Paid Authrized Representatives are: immigratin cnsultants wh are members in gd standing f the Immigratin Cnsultants f Canada Regulatry Cuncil (ICCRC); lawyers wh are members in gd standing f a Canadian prvincial r territrial law sciety, alng with students-at-law under their supervisin; and, Ntaries wh are members in gd standing f the Chambre des ntaires du Quebec. If an applicant authrizes a paid representative wh des nt qualify as a paid Authrized Representative, the applicant will be cntacted by OINP and advised that the individual must be remved r replaced as the representative. If the applicant designates a new authrized representative, any cmmunicatins will be frwarded t the new representative. Otherwise, prcessing f the applicant s file will cntinue withut representatin. See Sectin 3.2 fr mre infrmatin n cmpleting the Authrizing r Cancelling a Representative Frm. 2.3 SUPPORTING DOCUMENTS The Nminee Applicatin frm must be accmpanied by a number f supprting dcuments which help establish that the applicant meets OINP eligibility criteria. 5

8 Applicants can use this checklist t ensure that they have included all f the supprting dcuments within their applicatin package. IMPORTANT: DOCUMENT TRANSLATION If a supprting dcument is nt in English r French, the applicant must prvide a cpy f the dcument and a cmplete, certified translatin f the dcument. If the applicant is applying frm within Ontari, the translatins must be cmpleted by a certified translatr accredited by the Assciatin f Translatrs and Interpreters f Ontari (ATIO). Fr mre infrmatin n certified translatrs in Ontari, visit If the applicant is applying frm utside Ontari, the translatin can be cmpleted by any translatr. Hwever, the translatin must be ntarized. OINP reserves the right t require applicants t submit translatins cmpleted by a certified translatr accredited by ATIO if the ntarized translatin is deemed insufficient by fficers assessing the applicatin. Applicatins with translatins that are nt cmplete, certified r ntarized are cnsidered incmplete and will nt be prcessed. Translatins that are cmpleted by the applicant, the applicant s representative, r ther individuals with persnal ties t the applicant are nt acceptable in any case even if these individuals are certified translatrs. 9 CRITERIA SUPPORTING DOCUMENTS CHECK Jb ffer that is an apprved permanent, full-time psitin in a highly skilled ccupatin (NOC 0, A r B) that meets the prevailing wage levels. Each f the fllwing dcuments must be included: Cpy f the Emplyer Pre-screen Apprval letter indicates that the emplyer has been apprved fr the psitin being ffered, as well as the date f apprval and the expiry f the apprval. Original jb ffer letter signed by the emplyer which meets the fllwing requirements: Printed n cmpany letterhead and identify cmpany address, telephne/fax numbers, , and website addresses; Identify the respnsible Officer/Supervisr and include his/her signature; Stamped with the cmpany s crprate seal (if applicable); AND includes: Occupatin title Wage fr full-time, permanent psitin being ffered Duties and respnsibilities Number f hurs per week and a number f weeks f wrk per year Number f days/weeks f vacatin Wrkplace lcatin Emplyment start date, and an indicatin that the ffer being made is fr a permanent, full-time psitin Original Pre-screen Psitin frm identifies the psitin that the emplyer was apprved t fill; this frm will include the Pre-screen File 7

10 CRITERIA SUPPORTING DOCUMENTS CHECK Number, psitin title, NOC Cde, date f emplyer pre-screen apprval, expiry date f psitin apprval. This frm must be signed by the emplyer signing fficer and the applicant. Original Jint Verificatin frm identifies the cmpany name, name f authrized signing fficer, title f the psitin, the name f the emplyee (applicant), rate f pay per hur r week, number f hurs wrked per week, the number f weeks per year. This frm must be signed by the emplyer s cmpany signing fficer and the applicant. Applicant must be residing abrad r be residing in Canada temprarily n a valid wrk permit, study permit r with a visitr recrd. Cpy f applicant s entire passprt must include clear cpies f each page including all blank pages, Temprary Resident Visas, entry stamps, and/r any ther immigratin stamps. Yu must als include cpies f Wrk Permits, Study Permits, and/r any ther Canadian immigratin dcuments. passprt must have been valid fr at least tw years prir t submissin f the nminee applicatin. If the passprt has nt been valid fr at least tw years (i.e. the previus passprt expired less than tw years befre the submissin f the nminee applicatin), then cpies f all f the pages f the previus passprt must als be included. the passprt shuld be valid fr at least tw mre years. If the applicant is unable t renew the passprt prir 8

Applicant must have tw years f relevant wrk experience in the last five years r the relevant mandatry licensing in Ontari. Cpy f current wrk permit, temprary resident visa, visitr recrd and/r any ther Canadian immigratin dcument r entry stamp frm principal applicant include cpies f previus Canadian immigratin dcuments (if applicable). Cpy f applicant s current résumé. Indicates relevant wrk experience. Cpy f relevant university degree(s), cllege diplma(s), transcripts and/r ccupatinal certificates (if applicable). Prf f certificatin and/r license if applicant intends t wrk in an ccupatin that requires licensing in Ontari. Cpies f letters f emplyment frm previus/current emplyers. The letters must meet the fllwing requirements: Printed n cmpany letterhead and identify cmpany address, telephne/fax numbers, , and website addresses; Identify the respnsible Officer/Supervisr and include his/her signature; Stamped with the cmpany s crprate seal (if applicable); AND Specify: emplyment perid; psitins held, duties and respnsibilities during the emplyment perid fr each psitin, and the time spent in each psitin (if applicable); ttal annual salary plus benefits; Number f hurs wrked per week; 9

If the applicant is currently wrking in Canada: Cpies f emplyment cntracts; Cpies f all wrk permits issued by CIC and all immigratin recrds authrizing emplyment fr the perid f wrk stated in the applicatin; Emplyer reference letters fr all perids f wrk stated in the applicatin; Cpies f Canada Revenue Agency T4 Statement f Remuneratin Paid and Ntice f Assessment (NOA) statements (if applicable) fr the perids f wrk experience stated in the applicatin; AND Pay statements and any relevant dcumentatin that can supprt the applicant s wrk experience. Any unauthrized perids f wrk in Canada cannt be cnsidered. Other Infrmatin Required Cpy f applicant s birth certificate. r an acceptable natinal dcument where an riginal birth certificate is nt available (i.e. letter frm apprpriate gvernment authrity indicating why birth certificate is nt available). Cpy f each dependent s passprt page shwing his/her pht and persnal infrmatin. 10

13 CRITERIA SUPPORTING DOCUMENTS CHECK Tw riginal phts f the applicant: Dimensins: final frame size f the pht must be at least 35mm by 45mm (1 3/8 x 1 3/4 ), shwing full frnt view f the head, with the face in the middle f the phtgraph and including the tp f the shulders. Head, frm chin t crwn, must be between 31mm and 36mm (1 1/4 r 1 7/16 ). The backgrund f the pht must be white. The applicant s name and date f birth must be written n the back f each pht. The phts must be placed in a small envelpe and attached t the first page f the applicatin t enclse with the applicant s applicatin package submissin. Nte that phts that are nt clear r are lw-quality will nt be accepted. Applicants must nly send cpies f supprting dcuments unless therwise stated. D nt submit riginals f civil dcuments (i.e. birth certificate r passprt), as the applicatin will nt be returned. Applicants are strngly encuraged t create a cpy f their cmplete applicatin package prir t submissin. Officers assessing the applicatin may request ther dcuments nt listed abve if they deem that these dcuments are necessary t assess the applicatin. Failure t prvide the requested dcuments in the timelines requested by fficers will result in the refusal f the applicatin. 11

14 IMPORTANT: PRIVACY AND CONFIDENTIALITY Althugh the applicant may cnsider sme infrmatin in the applicatin frm r the supprting dcuments submitted t OINP t be prprietary r cnfidential, any such material may be disclsed t a third party, in accrdance with the applicant s cnsent, and where required by law r if required f a curt r tribunal. 3. COMPLETING THE APPLICATION 3.1: Cmpleting the Nminee with a Jb Offer Frm Please print clearly. All fields in the frm must be cmpleted. If questins are nt applicable, mark the space with N/A, with the exceptin f date and number fields, which must be left blank. The applicatin will nt be prcessed if it is illegible r incmplete. The Nminee with a Jb Offer applicatin frm is lcked and data cannt be entered nt the frm until the applicant enters a valid Pre-screen file number. This number can be fund n the Pre-screen Psitin Frm prvide by the prspective emplyer after their Pre-screen Emplyer Applicatin has been apprved. IMPORTANT: PRE-SCREEN FILE NUMBER Individuals withut a valid Pre-screen file number are nt eligible t use this frm. Nminee applicatins with a jb ffer frms frm individuals withut pre-apprved psitins with an Ontari emplyer r an endrsed investr will be returned. N recrd will be kept f the submissin. Individuals fund using this frm fraudulently may be disqualified frm future participatin in any immigratin prgram with the Gvernment f Ontari. 19 Part H: Fees The fee schedule is as fllws: Nminees with a Jb Offer (within the Greater Trnt Area): $2,000 Nminees with a Jb Offer (utside the Greater Trnt Area): $1,500 Nminees with a jb ffer frm a freign cmpany making an investment under the Investment Cmpnent in Ontari: $3,500 The applicatin fee is per applicatin. The fee must be submitted with the applicatin package, r the applicatin will nt be prcessed. All fees must be made payable t the Ontari Minister f Finance. Payments must be made in Canadian dllars nly. N ther currency will be accepted. Check the apprpriate bxes t indicate the methd f payment and the amunt enclsed. Acceptable Methds f Payment: Mney Order Cashier/Certified Cheque Pstal Mney Order Bank Draft Please nte that OINP will nt accept: Cash Persnal cheques Credit card payments Any amunt f funds ther than thse in the fee schedule abve IMPORTANT: NON-REFUNDABLE APPLICATION FEES Fees are nn-refundable. The prvince f Ontari charges fees t partially recver the cst f administering OINP. Since the applicatin fee helps pay fr the cst f prcessing applicatins, it will nt be refunded even if the applicatin is nt successful, if the applicant withdraws the applicatin at any stage f the prcess, r if the prvince cancels r withdraws the nminatin. 17

Part J: Applicant s Statements and Authrizatin Applicants shuld carefully read and understand the authrizatins and certificatins set ut in this applicatin. Any applicant that des nt agree with any f these, r is nt prepared t abide by them, shuld nt submit an applicatin. If any amendments are made t the authrizatins and certificatins in the frm, the applicatin will be treated as an incmplete applicatin and will be returned t the applicant. Part K: Accmpanying Spuse r Cmmn-Law Partner s and Accmpanying Dependents (aged 16 and ver) Statement and Authrizatins. Applicant s accmpanying spuse r cmmn-law partner, and accmpanying dependents (aged 16 years and ver) must read and understand the Statements and Authrizatins and enter their full name(s) and sign and date the apprpriate sectin. 3.2 COMPLETING THE AUTHORIZING OR CANCELLING A REPRESENTATIVE FORM Review Sectin 2.2 fr infrmatin n Authrizing Representatives. Applicant must check the apprpriate bx t indicate whether they are appinting a representative r cancelling an appintment f a representative. Applicants appinting a representative must cmplete Sectins B, CEB, C and E. Applicants cancelling a representative must cmplete Sectins B, D and EB, D and E. Infrmatin n hw emplyers can cmplete this sectin is included in the OINP Applicatin Guide: Emplyers dcument. 3.4 SUBMITTING THE COMPLETE NOMINEE APPLICATION PACKAGE Cmpleted nminee applicatin frms must be submitted within 60 days f the date that the Emplyer Pre-screen Applicatin is apprved (as indicated in the Prescreen Apprval letter that the emplyer will receive). If the deadline t submit the applicatin falls n a weekend r a statutry hliday, the deadline t submit the applicatin will be extended t the next wrking day. The applicatin may be deemed incmplete if: the Nminee Applicatin Frm is illegible r incmplete (all fields must be cmpleted and questins that are nt applicable shuld be marked N/A ), the required supprting dcuments are nt prvided, dcuments requiring translatin are nt certified r ntarized, r 20

23 The applicatin fee is nt included in the applicatin package r is submitted in an incrrect amunt. Applicatin fees included in the applicatin package will als be returned t the applicant if the applicatin is deemed incmplete. Applicants submitting applicatins in persn must nte that receptin staff are nt authrized t prvide applicatin advice r review applicatins fr cmpleteness. When submitting the applicatin in persn, applicants must place the cmplete applicatin package in a drp bx in the receptin area. Applicants will receive crrespndence frm OINP by mail. 4. AFTER SUBMISSION OINP aims t cmplete assessment f nminee applicatins within 90 calendar days f receipt f a cmplete applicatin. Applicants will receive an acknwledgement letter t indicate that their applicatin has been received if the applicatin is cmplete. Case-specific status inquiries must be made in writing and addressed t OINP at ntarinminee@ntari.ca r sent by mail t the address abve. Enquiries made within 90 calendar days f the date the applicatin was received by OINP will nt be answered as this perid is the usual prcessing perid fr applicatins and Prgram resurces will be cncentrated n cmpleting applicatin evaluatins. 4.1 CHANGES IN PERSONAL INFORMATION OINP must be ntified if there are any changes t the infrmatin prvided n the nminee applicatin frm, including (but nt limited t): change in immigratin status (expiratin r change in wrk/study permit), change in emplyment status (lss f emplyment r new emplyer), change in cntact infrmatin, and change in family cmpsitin due t marriage r cmmn/law relatinship birth f a child change f custdy f a child 21

24 divrce/separatin death. The applicant must cmplete the Change f Persnal Infrmatin frm if there are any changes t their persnal infrmatin. This frm can be dwnladed frm the OINP website. Cmpleted frms shuld be submitted t OINP by mail, fax r attachment. Failure t ntify OINP f any changes t persnal infrmatin will impact the utcme f OINP and CIC applicatins. Additinal supprting dcuments may be submitted by mail, fax r if they are related t changes in the applicant s mailing address, cntact address, accmpanying dependents, designated representatives, and educatin, r if the additinal infrmatin is specifically requested by OINP. Hwever, sending sensitive persnal infrmatin thrugh unsecured channels is risky, and is strngly discuraged by OINP. Users assume the risk assciated with any electrnic transfer f infrmatin t OINP and OINP is nt liable fr any damages that may arise frm interceptin, lss, theft r ther actin regarding the applicant s persnal infrmatin while in transit. 5. AFTER NOMINATION If the applicatin is successful, the applicant will receive a Letter f Nminatin alng with the applicant s (nw nminee) Ontari Immigrant Nminee Prgram Cnfirmatin f Nminatin dcument. Successful nminees must apply t CIC fr Permanent Resident status within six (6) mnths f being nminated by OINP. CIC prcesses and apprves wrk permits and applicatins fr permanent residence in Canada. Extensins t Cnfirmatin f Nminatin dcuments will nly be granted in cases where applicants can demnstrate that the deadline fr applying t CIC cannt be r was nt met because f mitigating circumstances. The nminee must include a cpy f the Letter f Nminatin and a cpy f the Ontari Immigrant Nminee Prgram Cnfirmatin f Nminatin dcument n tp f the Permanent Residency Applicatin submitted t CIC. IMPORTANT: FEEDBACK FOR THE PURPOSES OF PROGRAM EVALUATION OINP may seek feedback frm the nminee and the emplyer up t 5 years after the nminatin fr permanent residency. 22
