1 Deadline fr Submissin: February 26, DERELICT GEAR RETRIEVAL PROJECT This wrk is funded by the Maryland Department f Transprtatin State Highway Administratin (MDOT SHA) and is being implemented by the Oyster Recvery Partnership (ORP). MDOT SHA is funding the remval and permanent dispsal f derelict crab pts t accmplish cmpensatry mitigatin f wetland impacts assciated with the US 40 Bridges replacement prject ver the Gunpwder and Little Gunpwder Rivers in Baltimre Cunty. The prgram is intended t supprt active, cmmercial watermen wrking and residing in the Upper Bay area; specifically Baltimre, Cecil, Harfrd and Kent cunties. The amunt f wrk we are able t prvide will depend upn the number f watermen wh apply and ORP cannt guarantee a specific number f wrk days. We anticipate a large respnse, but will nt be able t determine wh is accepted and fr hw lng until all applicatins are submitted. Thse selected will be ntified by ORP r a designated representative via a letter and/r a phne call. Weather depending, we anticipate the wrk perid t begin in mid-march and last fr apprximately ne week. Derelict Gear Retrieval Prject Overview: As planned, the prject will cllect derelict crab traps using a lng line with grappling hks frm an apprximately 3,000 acre area at the muth f the Gunpwder River. Participants in this prgram will be required t attend an hur f training befre wrk begins. Date, time and lcatin f training will be sent t thse that are accepted fr this prgram. Captains will receive $425 per day and are authrized ne crewman wh will be paid $150 per day. Captain refers t the individual wh is in charge f vessel. A U.S. Cast Guard captain s license is nt required fr this prgram. Wh is Eligible t Participate: T be cnsidered, Bat Captains must have a current Maryland Tidal Fish License (TFL) r Limited Crab Catcher (LCC) cmmercial fishing license and reprted harvest t DNR in Harvest reprts submitted after December 31, 2017 will nt be cnsidered fr participatin in this prgram. Captain and crew must be able bdied t haul lines and participate in physically demanding wrk. Participating vessels must be a minimum f 32 in length and have a cabin. Selectin Prcess: Bat captains will NOT be eligible t participate in this prgram if starting in January 1, 2010 t present, yu have any f the fllwing vilatins. Pending vilatins need t be satisfied with a nt guilty verdict r PBJ befre yu will be cnsidered fr participatin. (These vilatin criteria are cnsistent with thse established by the Maryland Department f Natural Resurces (MDDNR) fr eligibility t participate in any cmmercial industry advisry cmmissin r cmmittee and ther similar wrk prgrams (This wrk is nt a MDDNR sanctined prgram). One (1) vilatin pertaining t crabbing n mandatry days ff, exceeding mature female crab bushel limit by 10 r mre bushels, r crabbing during clsed seasn;

2 Tw (2) vilatins pertaining t: pssessin f undersize crabs, pssessing mre than 8 female crabs per bushel when the seasn is clsed t females, setting pts in restricted areas, and exceeding the time limit fr crabbing by mre than 60 minutes. One (1) vilatin pertaining t wrking ver an yster line by mre than 150 feet, a time vilatin fr taking ysters mre than 2 hurs after sunset, and any time befre sunrise, r a cull vilatin f mre than 15% while harvesting ysters. Tw (2) vilatins pertaining t: wrking ver an yster line by less than 150 feet, r a cull vilatin f 10% t 15% while harvesting ysters. Received 10 r mre pints n their cmmercial license thrugh the new pint system. Received fur (4) r mre PBJ pertaining t any crab and/r yster vilatins. Please include cpies f citatin t dcument that they were issued fr a vilatin at a level that permits participatin in the prgram (example, include cpies f citatin fr a cull vilatin less than 15%, r exceeding the mature female crab bushel limit by less than 10 bushels). If mre bats apply than are needed fr this prject, watermen will be selected via randm selectin with initial preference given t thse Captains wh reprted (t MDDNR) eighty (80) r mre days f crabbing fr the time perid April 1, 2017 t December 15, Please include cpies f Crab Harvest Reprts when returning yur applicatin. While there are n eligibility requirements fr crewman, pririty will be given t applicants wh have a cmmercial license. All crewmen will be held t the same vilatin criteria as bat captains.

3 Applicatin Prcess: When submitting yur applicatin, please read the directins and criteria carefully. Captains wh wish t prvide their wn crew must submit bth applicatins tgether. Crew members must have a separate applicatin frm stating the desired Captain they wish t wrk fr. T participate in the prgram, bat captains must agree t underg a drug test if yu are randmly selected. Once yu are ntified f yur acceptance int the wrk prgram, yu will be directed t g and have a drug test cmpleted at an apprved labratry at n charge t yu. Yu must pass the test prir t cmmencing wrk. If yu are in pssessin f a Cast Guard Captain s license, then yu are already in a randm sampling prgram as part f the Cast Guard maritime randm drug testing prgram. Yu will be requested t submit a cpy f yur Cast Guard license with yur applicatin s we are aware f yur enrllment status. By submitting an applicatin fr wrk yu are agreeing t the cnditins put in place by the Maryland Department f Transprtatin State Highway Administratin and the Oyster Recvery Partnership. If yu are accepted int the prgram, yu will be acting slely as an independent cntractr and nt as an emplyee f the State f Maryland r the Oyster Recvery Partnership and as such are nt liable fr any incidents r accidents that ccur as a result f this emplyment. It is advised that cntractrs carry vessel and r persnal liability insurance and keep it in full frce fr the duratin f the prgram. If liability insurance is nt carried it is required that all cntractrs sign a waiver releasing the MDOT SHA and ORP frm all liability prir t cmmencing wrk. Prgram managers and/r Natural Resurce Plice fficers may be n statin and be allwed t bard and inspect yur bat at any time and will be ding s t ensure that these rules are being abided by. NO OYSTERS, CRABS OR ANY OTHER SEAFOOD ARE TO BE REMOVED FROM THE WORK AREA OR TAKEN ASHORE BY ANY INDIVIDUAL UNDER PENALTY OF ELIMINATION FROM THIS AND FUTURE MITIGATION PROGRAMS. 5 T participate in the prgram, the Captain and Crewman agree t the fllwing: Captain and crew must be able bdied t haul lines and ther physical labr. A crewmember is nt required. The Captain, named abve wh is accepted int the prgram, must be nbard the vessel at all times during the wrk perid. If the Captain r crewman is fund t be misrepresenting themselves in anyway, yu will be remved frm the prgram and nt be cmpensated. Captain s cmpensatin is $425 per day fr the Derelict Gear Retrieval prgram fr an 8-hur wrkday that includes use f the vessel, fuel, slip rental, and use f all bat gear. Captain will be dcked $50.00 per hur fr starting late, stpping wrk any amunt f time during the day r if the bat leaves the wrksite early. The number f wrkdays will depend n the amunt f bats signing up. The Captain and Crewman will be acting slely as an independent cntractr. The State f Maryland and ORP are nt liable fr any incidents r accidents that ccur as a result f this emplyment. A cpy f yur vessel s certificate f liability insurance shuld be carried at all times while perating in this prgram and may be requested. Vessels nt carrying liability insurance will be required t sign a waiver releasing the MDOT SHA and ORP frm all liability prir t cmmencing wrk and the waiver will be shuld be carried at all times while perating in this prgram and may be requested.
