Using the information submitted we have determined that a revision to the flood hazards depicted in the Flood Insurance Study (FIS) report and/or National Flood Insurance Program (NFIP) map is warranted. This document revises the effective NFIP map as indicated in the attached documentation. Please use the enclosed annotated map panels revised by this LOM for floodplain management purposes and for all flood insurance policies and renewals in your community. any questions about this document please contact the FMA Map Information exchange toll free at (1-877-FMA MAP) or by letter addressed to the LOMC Clearinghouse 847 South Pickett Street Alexandria VA Additional information about the NFIP is available on our Web site at Luis odriguez P.. 3 Page 3 of 5 Issue ate: November ffective ate: April Case No.: Federal mergency Management Agency Washington.C LTT OF MAP VISION TMINATION OCUMNT (CONTINU) COMMUNITY INFOMATION APPLICABL NFIP GULATIONS/COMMUNITY OBLIGATION We have made this determination pursuant to Section 26 of the Flood isaster Protection Act of 1973 (P.L ) and in accordance with the National Flood Insurance Act of 1968 as amended (Title XIII of the Housing and Urban evelopment Act of 1968 P.L ) 42 U.S.C and 44 CF Part 65. Pursuant to Section 1361 of the National Flood Insurance Act of 1968 as amended communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These criteria including adoption of the FIS report and FIM and the modifications made by this LOM are the minimum requirements for continued NFIP participation and do not supersede more stringent State/Commonwealth or local requirements to which the regulations apply. COMMUNITY MINS We based this determination on the 1-percent-annual-chance flood discharges computed in the effective hydrologic model without considering subsequent changes in watershed characteristics that could increase flood discharges. Future development of projects upstream could cause increased flood discharges which could cause increased flood hazards. A comprehensive restudy of your community s flood hazards would consider the cumulative effects of development on flood discharges subsequent to the publication of the FIS report for your community and could therefore establish greater flood hazards in this area. Your community must regulate all proposed floodplain development and ensure that any permits required by Federal or State/Commonwealth law have been obtained. State/Commonwealth or community officials based on knowledge of local conditions and in the interest of safety may set higher standards for construction or may limit development in floodplain areas. If your State/Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria those criteria take precedence over the minimum NFIP requirements. We will not print and distribute this LOM to primary users such as local insurance agents or mortgage lenders; instead the community will serve as a repository for the new data. We encourage you to disseminate the information in this LOM by preparing a news release for publication in your community's newspaper that describes the revision and explains how your community will provide the data and help interpret the NFIP maps. In that way interested persons such as property owners insurance agents and mortgage lenders can benefit from the information. any questions about this document please contact the FMA Map Information exchange toll free at (1-877-FMA MAP) or by letter addressed to the LOMC Clearinghouse 847 South Pickett Street Alexandria VA Additional information about the NFIP is available on our Web site at Luis odriguez P.. 4 Page 4 of 5 Issue ate: November ffective ate: April Case No.: Federal mergency Management Agency Washington.C LTT OF MAP VISION TMINATION OCUMNT (CONTINU) Because the FIS report establishing the BFs for your community has been completed certain additional requirements must be met under Section 1361 of the National Flood Insurance Act of 1968 as amended within 6 months from the date of this letter. Prior to the effective date of this revision your community is required as a condition of continued eligibility in the National Flood Insurance Program (NFIP) to adopt or show evidence of adoption of floodplain management regulations that meet the standards of Paragraph 6.3(d) of the enclosed NFIP regulations (44 CF 59 etc.). These standards are the minimum requirements and do not supersede any State or local requirements of a more stringent nature. It must be emphasized that all the standards specified in Paragraph 6.3(d) of the NFIP regulations must be enacted in a legally enforceable document. This includes adoption of the current effective FIS report and FIM to which the regulations apply and other modifications made by this map revision. Some of the standards should already have been enacted by your community in order to establish initial eligibility in the NFIP. Your community can meet any additional requirements by taking one of the following actions: 1. Amending existing regulations to incorporate any additional requirements of Paragraph 6.3(d). 2. Adopting all the standards of Paragraph 6.3(d) into one new comprehensive set of regulations. 3. Showing evidence that regulations have previously been adopted that meet or exceed the minimum requirements of Paragraph 6.3(d). Communities that fail to enact the necessary floodplain management regulations will be suspended from participation in the NFIP and subject to the prohibitions contained in Section 22(a) of the Flood isaster Protection Act of 1973 (Public Law ) as amended. We have designated a Consultation Coordination Officer (CCO) to assist your community. The CCO will be the primary liaison between your community and FMA. For information regarding your CCO please contact: STATUS OF TH COMMUNITY NFIP MAPS Mr. Timothy P. Crowley irector Mitigation ivision Federal mergency Management Agency egion II 26 Federal Plaza 13th floor New York NY (212) We will not physically revise and republish the FIM for your community to reflect the modifications made by this LOM at this time. When changes to the previously cited FIM panels warrant physical revision and republication in the future we will incorporate the modifications made by this LOM at that time. any questions about this document please contact the FMA Map Information exchange toll free at (1-877-FMA MAP) or by letter addressed to the LOMC Clearinghouse 847 South Pickett Street Alexandria VA Additional information about the NFIP is available on our Web site at Luis odriguez P.. 5 Page 5 of 5 Issue ate: November ffective ate: April Case No.: Federal mergency Management Agency Washington.C LTT OF MAP VISION TMINATION OCUMNT (CONTINU) PUBLIC NOTIFICATION OF VISION A notice of changes will be published in the Federal egister. This information also will be published in your local newspaper on or about the dates listed below and through FMA s Flood Hazard Mapping Web site at LOCAL NWSPAP Name: The Poughkeepsie Journal ates: 11/26/213 and 12/3/213 Within 9 days of the second publication in the local newspaper a citizen may request that we reconsider this determination. Any request for reconsideration must be based on scientific or technical data. Therefore this letter will be effective only after the 9-day appeal period has elapsed and we have resolved any appeals that we receive during this appeal period. Until this LOM is effective the revised flood hazard information presented in this LOM may be changed. any questions about this document please contact the FMA Map Information exchange toll free at (1-877-FMA MAP) or by letter addressed to the LOMC Clearinghouse 847 South Pickett Street Alexandria VA Additional information about the NFIP is available on our Web site at Luis odriguez P..
