CONSIDERATION OF AGENDA ITEMS Drinking Water Source Protection Lead Authority Re: Report 6a RECOMMENDATION: THAT Saugeen Valley Conservation Authority (SVCA) be requested to, in cooperation with Grey Sauble Conservation Authority (GSCA) and the Municipality of Northern Bruce Peninsula, take steps to transfer the Lead Authority designation under the Source Water Protection Program from SVCA to GSCA; and further, THAT SVCA and GSCA request that the Ministry of Environment and Climate Change (MOECC) allow for the 2016/2017 Grant Funding Page 1 of 9

Salen THAT the minutes of Source Protection Authority Meeting No , July 23, 2012 be adopted as distributed. BUSINESS ARISING FROM THE MINUTES 1. No Business Arising From the Minutes for Source Protection Meeting No REPORTS Mr. Mike Traynor gave a brief history of the process for the Assessment Report and the Source Protection Plan Consultation Report Mr. Carl Seider and Ms. Emily Vandermeulen presented a power point presentation on Source Protection 101 to update new Council of the process. The purpose of the Clean Water Act is to protect existing and future sources of drinking water. The principles of source protection are prevention (safeguard drinking water), multibarrier (preventing contaminants from entering the drinking water system) and shared responsibility (multiple stakeholders). The key stakeholders would be the Source Protection Authorities and the Source Protection Committee. The types of vulnerable areas were listed as wellhead protection areas, intake protection zones, significant recharge areas and highly vulnerable aquifers. Three approaches to identify significant drinking water threats under the technical rules are threat approach, issues approach and event-based approached. Ms. Vandermeulen noted that the Municipality of Northern Bruce Peninsula has no issues. Page 4 of 9

Salen THAT the Municipality of Northern Bruce Peninsula Source Protection Authority receive the Revised Assessment Report for the Municipality of Northern Bruce Peninsula Source Protection Area dated June 30, 2015, pending minor modifications; AND THAT Staff be directed to submit the Revised Assessment Report to the Ministry of the Environment and Climate Change as required by O. Reg. 287/ Updated Proposed Source Protection Plan Submission Re: Report 6c Moved by T. Boyle Resolution # Seconded by R. 7 Municipality of Northern Bruce Peninsula Source Protection Authority REPORT #6a TO: NORTHERN BRUCE PENINSULA SOURCE PROTECTION AUTHORITY DATE: JANUARY 25, 2016 SUBJECT: DRINKING WATER SOURCE PROTECTION LEAD AUTHORITY The Saugeen Valley, Grey Sauble and Northern Bruce Peninsula Source Protection Area is administered by Saugeen Valley Conservation Authority (SVCA), Grey Sauble Conservation Authority (GSCA) and the Municipality of Northern Bruce Peninsula. Since the inception of the Source Water Protection Program (SWP), SVCA has been the designated Lead Authority. The main responsibilities of the Lead Authority include: Provide oversight to ensure SWP meets provincial requirements and program deliverables Serve as liaison with the Ministry of Environment and Climate Change (MOECC) Process and pay accounts as contained in the approved budget The specific logistical duties of the Lead Authority include: Prepare annual budget and sign Grant Funding Agreement Monitor the budget to ensure no over-spending Negotiate and sign vendor contracts; pay all supplier invoices; pay Source Protection Committee members Prepare employee contracts; prepare bi-weekly payroll; administer group benefits and OMERS pension; T4 statements, etc. Banking; maintaining separate bank account Health & Safety inspections at GSCA office Prepare in-year financial reports and year-end report The SWP contract employees, currently numbering five, down from 7-8 earlier in the program, have always worked out of the GSCA office while being supervised by and under contract to SVCA. Now that the Source Protection Plan has been approved, much of the emphasis switches to the Risk Management Office (RMO) part of the program. That means less of a workload and responsibility for SWP staff and more for municipalities. GSCA has decided to offer RMO services NBP SPA Mtg #01-16 January 25, 2016 Lead Authority Report 6a Page 7 of 9
8 to all interested municipalities in the Source Protection Area. Several municipalities have signed on with GSCA for those services and others are considering the option. As a result of the reduced workload going forward, the current SWP employees will not be required on a full-time basis. GSCA intends to hire those same SWP employees to work for GSCA parttime in GSCA s delivery of RMO services. Under this arrangement, those employees would be working for both SVCA and GSCA. At a meeting held on January 6, 2016, the Drinking Water Source Protection Management Committee passed the following motion: THAT: the Saugeen, Grey Sauble, Northern Bruce Peninsula Drinking Water Source Protection Management Committee supports the change of the Lead Authority for this Region s Drinking Water Source Protection program from Saugeen Valley Conservation to Grey Sauble Conservation; and further, THAT a report be brought forward at the next Board of Directors meetings for Saugeen Valley Conservation and Grey Sauble Conservation respectively, and the next Council meeting for Northern Bruce Peninsula supporting the transfer of the Lead Authority designation and responsibilities under the Drinking Water Source Protection program from Saugeen Valley Conservation to Grey Sauble Conservation; and further, THAT with the support of the respective Boards and Council, the Ministry of the Environment and Climate Change be directed to transfer the designation and responsibilities of the Lead Authority from Saugeen Valley Conservation to Grey Sauble Conservation; and that the 2016/2017 Grant Funding Agreement, and all subsequent agreements, be between the Ministry of the Environment and Climate Change and Grey Sauble Conservation. The factors considered by the Management Committee included: Sharing of employees between two employers, two programs; the prospect of some conflict between SVCA and GSCA regarding workload and priorities Difference in Personnel Policies between SVCA and GSCA e.g. hours of work, paid holidays, sick days, etc. Likely overlap in some activities between SWP and RMO work Employee location; the challenge of supervising off-site employees In summary, it was considered that whatever the original rational was to have SVCA as the Lead Authority while GSCA was the location of the employee activity, that rationale is no longer evident. The MOECC has indicated its willingness to support the proposed change in Lead Authority. According to MOECC, the formal change in Lead Authority requires a regulatory amendment which takes some time to implement. MOECC has indicated that an interim option is to have the NBP SPA Mtg #01-16 January 25, 2016 Lead Authority Report 6a Page 8 of 9
9 proposed new Lead Authority sign the 2016/2017 Grant Funding Agreement. That agreement covers the period of April 1, 2016 to March 31, 2017; in which case, GSCA would become responsible for all the logistical duties noted earlier in this report. The SWP employees would report to one employer, GSCA, instead of two. RECOMMENDATION: THAT Saugeen Valley Conservation Authority be requested to, in cooperation with Grey Sauble Conservation Authority and the Municipality of Northern Bruce Peninsula, take steps to transfer the Lead Authority designation under the Source Water Protection Program from SVCA to GSCA; and further, THAT SVCA and GSCA request that the Ministry of Environment and Climate Change allow for the 2016/2017 Grant Funding Agreement to be an agreement between MOECC and GSCA.
