Part B xpected development and demand for public facilities he relationship between expected development and the demand for public facilities is established through: he population projections undertaken by the Bureau of ransport tatistics indicate a forecast growth in population of Parramatta LG (excluding CB) of 93,809 people from the 2011 population of 164,797 to 258,606 in his represents an annual growth rate of almost 2% over 30 years. he expected development associated with this projected population growth. he likely population growth will require the provision of additional public facilities. he likely population growth will diminish the enjoyment and standard of public facilities for the existing population unless new facilities are provided to meet the additional demand. he new public facilities to be provided to meet the expected future demand are set out in summary form in chedule 1 in Part of this Plan. ppendix C contains a detailed schedule of works and ppendix contains the Public Facilities Location aps. Part C dministration and operation of the Plan 3.1 hat is the name of this Plan? his Plan is called the ection 94 evelopment Contributions Plan (mendment o. 4). 3.2 pplication of this Plan his Plan applies to all land within the local government area of Parramatta as shown on the Land pplication ap (see Figure 1, ppendix ) but does not apply to the Land excluded from this Plan. (see Figure 2 ppendix ) his Plan applies to applications for development consent and applications for complying development certificates under Part 4 of the nvironmental Planning and ssessment ct 1979 (ct). If a development application has been made but not finally determined before this Plan comes into effect, the application will be determined in accordance with this Plan. 3.3 epeal of other contributions plans applying to the land his Plan repeals ection 94 evelopment Contributions Plan (mendment 3) dated 11 ecember hen does this Plan commence? his Plan was adopted by Council on 27 pril 2015 and commenced on 20 ay hat are the purposes of this Plan? he primary purposes of this Plan are: o authorise the imposition of a condition on certain development consents and complying development certificates requiring the payment of a development contribution pursuant to section 94 of the ct. o assist the council to provide the appropriate public facilities which are required to maintain and enhance amenity and service delivery within the area covered by this Plan. o publicly identify the purposes for which the development contributions are required. 3.6 re there any exemptions to the development contribution? he Plan will not impose development contributions in respect of development: where the proposed cost of carrying out the development is $100,000 or less; for the purpose of disabled access; for the sole purpose of providing affordable housing; for the purpose of reducing a building s use of potable water (where supplied from water mains) or energy; for the sole purpose of the adaptive reuse of an item of environmental heritage; that has been the subject of a condition under section 94 under a previous development consent relating to the subdivision of the land on which the development is to be carried out. 8 ection 94 evelopment Contributions Plan (mendment o. 4) 3.7 Pooling of development contributions evelopment contributions paid for different purposes may be pooled and applied (progressively or otherwise) for those purposes. he priorities for the expenditure of the development contributions are shown in the etailed orks Program (see ppendix C). 3.8 Construction certificates and the obligation of accredited certifiers In accordance with clause 146 of the egulation a certifying authority must not issue a construction certificate for building work or subdivision work under a development consent unless it has verified that each condition requiring the payment of development contributions has been satisfied. 3.9 How will development contributions be calculated? he development contribution is calculated as follows: evelopment contribution = x B where B If the cost of works is $100,000 is 0 (zero) If the cost of works is >$100,001 but $200,000 is 0.5% (half a percent) If the cost of works is >$200,001 is 1% (one percent) is the cost of the development he cost of the development is determined in accordance with clause 25J of the egulation. In the absence of errors, the development contribution amount will be calculated based on the cost of works information relied upon at the time of determination Cost summary reports must accompany development applications or applications for complying development certificates development application or application for a complying development certificate must be accompanied by a Cost ummary eport (where development cost is less than $750,000) or Quantity urveyors eport (where the development cost is more than $750,000) that provides the cost of development in accordance with clause 25J of the egulation. his information is to be provided at the time of lodgement of the application. ppendix B outlines the matters to address in the preparation of cost estimates hen is the development contribution payable? development contribution must be paid to Council prior to the issue of a construction certificate, complying development certificate or subdivision certificate. 9 ection 94 evelopment Contributions Plan (mendment o. 4) 3.12 How will the development contribution be adjusted? he development contributions will be adjusted each quarter in accordance with the following: djusted evelopment Contribution = + B where is the original development contribution required by the development consent B is the adjustment amount which is = where: $ x (Current CPI - Previous CPI ) (Previous CPI) Current CPI is the ydney ll Groups Consumer Price Index as published by the ustralian Bureau of tatistics at the time of the review of the development contribution. Previous CPI is the ydney ll Groups Consumer Price Index as published by the ustralian Bureau of tatistics for the quarter for the quarter preceding the Current CPI. ote: In the event that the Current CPI is less than the Previous CPI, the Current CPI shall be taken as not less than the Previous CPI Can deferred or periodic development contribution payments be made? Council may (at its absolute discretion): efer payment of any development contribution to such time as it thinks fit; or Permit payment of any development undertaken by way of instalments it thinks fit. here a deferred or periodic payment is accepted, 50% of the required development contribution will be required to be paid prior to the issue of a construction certificate (or complying development certificate or subdivision certificate where relevant), and the remaining 50% to be paid prior to the issue of any occupation certificate (interim or final) or as otherwise determined by Council. Prior to the issue of the construction certificate (or complying development certificate or subdivision certificate where relevant) Council will require the applicant to provide a bank guarantee to Council s satisfaction for the outstanding balance. he outstanding balance will continue to be indexed quarterly in accordance with movements in the ydney ll Groups Consumer Price Index as published by the ustralian Bureau of tatistics. Interest will be charged on the outstanding balance at the time of the staged/final payment in line with industry recognised investment benchmarks inisterial irections under ection 94 of the ct Conditions authorised by this Plan are subject to any direction given by the inister under ection 94 of the ct. his Plan authorises the imposition of conditions in accordance with any such direction. 10 ection 94 evelopment Contributions Plan (mendment o. 4) 3.15 Complying development certificates and the obligation of accredited certifiers In accordance with ection 94C of the ct, if a complying development certificate has been granted, then this Plan requires an accredited certifier to issue a complying development certificate in respect of development to which this Plan applies subject to a condition requiring payment to Council of a development contribution in accordance with this Plan. If a inisterial direction under ection 94 of the ct is in force, this Plan authorises the certifying authority to issue a complying development certificate subject to a condition which is in accordance with that direction. 15 ection 94 evelopment Contributions Plan (mendment o. 4) ppendix B Procedure to determine the cost of the development development application or application for a complying development certificate must be accompanied by an estimate of the cost of development prepared in accordance with clause 25J of the egulation. he following should be provided at the time of lodgement: Cost ummary eport for works with a value no greater than $3 million. Quantity urveyor s etailed Cost eport prepared by a registered Quantity urveyor for works with a value greater than $3 million. emplates for the Cost ummary eport and the Quantity urveyor s etailed Cost eport are provided in chedule and B. Council may review the cost of the development provided and may seek the services of an independent person to verify the costs. In these cases, all costs associated with obtaining such advice will be at the expense of the applicant. o avoid doubt, section 25J of the egulation sets out the process for determining the cost of the development. as is detailed below. (1) he proposed cost of carrying out development is to be determined by the consent authority, for the purpose of a section 94 levy, by adding up all the costs and expenses that have been or are to be incurred by the applicant in carrying out the development, including the following: (a) if the development involves the erection of a building, or the carrying out of engineering or construction work the costs of or incidental to erecting the building, or carrying out the work, including the costs (if any) of and incidental to demolition, excavation and site preparation, decontamination or remediation, (b) if the development involves a change of use of land the costs of or incidental to doing anything necessary to enable the use of the land to be changed, (c) if the development involves the subdivision of land the costs of or incidental to preparing, executing and registering the plan of subdivision and any related covenants, easements or other rights. (2) For the purpose of determining the proposed cost of carrying out development, a consent authority may have regard to an estimate of the proposed cost of carrying out the development prepared by a person, or a person of a class, approved by the consent authority to provide such estimates. (3) he following costs and expenses are not to be included in any estimate or determination of the proposed cost of carrying out development: (a) the cost of the land on which the development is to be carried out, (b) the costs of any repairs to any building or works on the land that are to be retained in connection with the development, (c) the costs associated with marketing or financing the development (including interest on any loans), (d) the costs associated with legal work carried out or to be carried out in connection with the development, (e) project management costs associated with the development, (f) the cost of building insurance in respect of the development, P CIY CUCIL CI 94 VLP CIBUI (. 4)

16 ection 94 evelopment Contributions Plan (mendment o. 4) (g) the costs of fittings and furnishings, including any refitting or refurbishing, associated with the development (except where the development involves an enlargement, expansion or intensification of a current use of land), (h) the costs of commercial stock inventory, (i) any taxes, levies or charges (other than G) paid or payable in connection with the development by or under any law, (j) the costs of enabling access by disabled persons in respect of the development, (k) the costs of energy and water efficiency measures associated with the development, (l) the cost of any development that is provided as affordable housing, (m) the costs of any development that is the adaptive reuse of a heritage item. (4) he proposed cost of carrying out development may be adjusted before payment, in accordance with a contributions plan, to reflect quarterly or annual variations to readily accessible index figures adopted by the plan (such as a Consumer Price Index) between the date the proposed cost was determined by the consent authority and the date the levy is required to be paid.
