Call to rder B. pproval of inutes 11/1/2018 C. ld Business. ew Business 1. ubdivision he and urveyors, Inc requests plat approval for subdivision of rundle roperty 3150 Boyds Creek ighway (lanning egion). his is a subdivision in the lanning egion creating three lots out of an existing one. ot 1 as shown on the plat had previously been subdivided out of the larger tract. taff is waiting on a revision showing the flood hazard boundary on the north side of the property, but fully expects to have this completed and submitted prior to the meeting date. o long as the correction is submitted, staff can recommend approval. 2. ubdivision.c. haley, Inc requests plat approval for subdivision of enderson roperty 135 obert enderson oad (City). his is a four lot subdivision where obert enderson oad runs between astgate oad and olly arton arkway. roposed ot 1 is currently occupied with a car wash, and roposed ot 3 with a vacant building. he other two lots remain undeveloped. roposed ots2-4 would require utility extension prior to any further development. he plat does meet regulations and staff can recommend approval. 3. ite lan orvell & oe ngineers, C requests site plan approval for gle Bros. rading ost 1640 arkway (City). his is a site plan to redevelop the old amon s building and surrounding area. he proposed site plan shows a farmer s market area, an inhabitable silo, a stage, and a smoker area to be developed along with an addition to the old amon s building. leased area line may require adjustment, but if so, will be accomplished prior to the lanning Commission meeting. taff can recommend approval. 4. ite lan Cantrell ngineering & urveying, C requests site plan approval for iverside Village partments ax ap 49, arcel 25.01, ardin ane (City).

4 his is a site plan for 2 buildings consisting of 32 apartment units to be located off ast ardin ane. taff has received some concerns from adjoining owners regarding buffering, additional traffic volumes on ast ardin ane, and stormwater runoff concerns. buffer from the adjoining properties is being provided through a privacy fence, landscaping, and natural vegetation. he site designers have configured the stormwater system in such a way that it will catch a portion of additional water from the aine ake ubdivision and discharge it to the stream. t this time the City does not have a requirement that a residential use must perform a traffic study on a local road prior to development. he City is also looking into potential traffic improvements for the area. he apartments are a use by right and meet all City requirements for a edium ensity esidential zone, therefore staff can recommend approval. 5. ight-of-ay bandonment onald. gle requests abandonment iddle idge oad & Veterans Boulevard (City). his is a request by r. gle to abandon an unused right-of-way off Veterans Boulevard and iddle idge oad. taff can recommend approval. lease see the map and staff report below for full details. 6. Boundary eduction evierville lanning egion. s per request of the lanning Commission this is an effort to reduce the evierville lanning egion boundary. staff report and map has been included with full details, you may also use the following link to access an online interactive map to view the boundaries in closer detail: b6c0b4fbb93e92ffea501fc2f taff would recommend approval. 7. Zoning rdinance mendment taff requests approval of the proposed Building etback and eparation equirements for lanned Unit evelopments (U) mendment (City). his is a request to amend a portion of the lanned Unit evelopment section of the zoning ordinance that requires a 20-foot separation in buildings where there are multiple buildings on one lot. It is staff s understanding this standard was implemented prior to the sophistication of building codes as a life and fire safety standard. ue to the sophistication and implementation of the newer codes a 20- foot separation is not a necessity so long as other safety measures in the building code can be met. rior to approving a separation of less than 20 feet, means of how the life safety standards will be met must be provided. taff can recommend approval.. taff eport F. djournment

V F IU motion was made by r. oberts, and seconded by r. elton, to approve the minutes from the ctober 4, 2018 meeting. he motion passed with a unanimous vote.

6 BUI one BUI FF QU V F CI (CI). taff ecommendation Chairman verbay commended the staff and advisory committee on the work put into developing the master plan. r. arker explained that the Board of ayor and ldermen had already viewed the master plan in a workshop the previous month. taff recommended approval. ction aken r. rwood made a motion to approve the master plan. he motion was seconded by r. illiams and passed unanimously. he motion was certified to the Board of ayor and ldermen. Forkner explained that a camping resort is the proposed development on this site, including yurts, treehouses, and tent sites for rental. hile in the planning region, this parcel is adjacent to the City limits and includes river frontage. urrounding properties in the planning region are also zoned for commercial use. he also noted that when the site plan is prepared, the designer will need to consider the flood hazard region of the property and an appropriate point of access onto ewport ighway. taff recommended approval of this rezoning. ction aken r. rwood made a motion to approve the rezoning. he motion was seconded by r. oberts and passed unanimously. he motion was certified to the evier County Commission.. age 2 of 4

Forkner stated that this proposed rezoning would be to allow a landscape business on the parcel. he property is currently surrounded by County -1 zoned parcels, containing low density housing. r. arrett reasoned that this is a downzone to -1, attempting to find the best use for the property. e stated that the owner is not looking to do a commercial development, but rather a rural business as allowed by the -1 zone. s. Forkner clarified for the commission the purpose for City approval for land located in the planning region. r. mith stated that staff could recommend approval for this rezoning request only if adjacent property was added and increased the size of the -1 zone. ction aken r. oberts made a motion to deny the rezoning, unless adjacent property owners were included in the rezoning. he motion was seconded by r. rwood, which passed unanimously. he motion was certified to the evier County Commission. UBIVII CIVI & VI CU, IC QU II V F UBIVII F I 62, C 98.01, (I I). taff ecommendation r. mith explained that this subdivision is proposed to develop 22 housing units. he plan calls for duplexes on the front of the land and triplexes in the back of the property. he subdivision plat is preliminary, for financing purposes, to create individual lots to be sold separately. e also stated that staff s understanding is that the evier County lanning office will permit each building individually, not requiring a U plan submittal. he County office has also provided a letter stating that the preliminary plan appears to meet their requirements. taff recommends approval. ction aken r. rwood made a motion to approve the preliminary subdivision plat and seconded by r. elton. he motion passed unanimously. age 3 of 4

It ranges in width from 50 +/- to 75 +/- and is curved with a length of 255 +/. he right-of-way is not in use as a means of access from Veterans Boulevard into the residential neighborhood that lays along iddle idge oad. he present improved and signalized intersection of iddle idge oad with Veterans Boulevard occurred as the result of the construction of Veterans Boulevard. taff Comments ue to the improvement of the point of access into the residential neighborhood laying along iddle idge oad noted in the Background section above, this right-of-way is not needed to provide a means of access to that neighborhood. he Veterans Boulevard corridor management plan agreement (C) indicates that abandonment of this r-o-w owners could be considered to allow the adjoining property owners receiving this property to have a joint use ingress/egress point to their respective properties at this point along Veterans Boulevard which aligns with a median cut. site plan for a retail/office development planned by r. gle on his property presently has an in-only, out-only driveway entrance 166 south of the median cut that aligns with the r-o-w proposed for abandonment. he ocinski property is not presently under development. ublic Comments one to date. taff ecommendation taff can recommend approval of the requested r-o-w abandonment as it presents an opportunity for the property owners adjoining the right-of-way to have a joint point of access onto Veterans Boulevard.

In 1962 and 1978, evier County did not have land use regulations in areas beyond any municipality s planning region. By 2002, the County had formed a planning commission, adopted subdivision regulations for the areas outside of municipal planning regions, but had no zoning in unincorporated areas. he County enacted zoning in 2006 and has its lanning epartment. ince that time, atlinburg has eliminated its planning region, igeon Forge and evierville have planning regions, and ittman Center has never established a planning region. (atlinburg previously had zoning in its planning region under the provision of state law which permits cities to enact zoning within their planning regions when the county has not adopted zoning.) otifications: ill be provided in accordance with the practice of the B and the C. xhibit: ap taff: amela Caskie, Judi Forkner, ustin mith Current Circumstance: he evierville lanning Commission (C) is a municipal planning commission which has been designated by the tate s ocal overnment lanning dvisory Committee (C) to also serve as the regional planning commission for an area outside of, but contiguous to the city limits. he C reviews and approves/denies subdivision plats within the planning region and provides a recommendation to the evier County Commission regarding requests to rezone property in the planning region and to amend the provisions of the evier County Zoning esolution. roposal: Following the creation of the City s urban growth boundary (UB) in 2001 in accordance with the requirements of the 1998 Comprehensive rowth lan law (often referenced as 1101 ), the City requested an expansion of its planning region boundary to be coincident with the UB. he County had no zoning in the planning region at that time and it was thought that expanding the planning region boundary thereby allowing the C to review subdivision plats and comment on other growth related issues within its planning region would help achieve the goals of the tate law. he proposed reduction in the planning region boundary retains those areas which have a development pattern similar to, or are expected to have a development pattern similar to, that within nearby areas inside the City. his proposal also returns to the County planning staff and planning commission the more rural areas of the current planning region within which development standards in the County zoning code and subdivision regulations are more appropriate. change in the planning region boundary will not change the UB. taff ecommendation: Because the County adopted countywide zoning in 2006 and has increased its lanning epartment staff, it is appropriate to now return the more rural areas of the planning region to the County s jurisdiction as the County subdivision regulations and zoning requirements are more appropriate to those areas. he staff, therefore, recommends the approval of the proposed planning region boundary. If approved, the matter will move to the Board of ayor and lderman as a esolution requesting a change in the planning region boundary, and if adopted will be presented to the C at a quarterly meeting in ashville. he C is the only body which can act to change the planning region boundary.

Chapter 8.0 dministration and nforcement, ection 8.5 lanned Unit evelopment lan, ubsection b. Building and etback and eparation equirements, ubsections i. and ii, are hereby amended by deleting them in their entirety and substituting therefor the following: i. esidential or onresidential U on one tract. (a.) Building setback from exterior property boundary. o freestanding building shall be closer than twenty-five (25) feet from the exterior property boundary and no closer than twenty-five (25) feet from any street or road rightof-way unless severe topographic difficulties affect the site; except that, if the requirement of a particular zoning district requires a greater exterior boundary setback related specifically to building height which exceeds the minimum setback in this section, then the setback requirement of that zoning district shall prevail. (b.) eparation of buildings. o freestanding building within a U shall be closer than twenty (20) feet from any other freestanding building within the U. In the event that a twenty (20) foot building separation is undesired or difficult to obtain, the U applicant may submit architectural support documents which show the IBC fire ratings relative to the building separation proposed have been achieved in the building design.
