2 DRAFT MOAB CITY PLANNING COMMISSION MEETING :: MINUTES: APRIL 05, 2018: Members Present: Members Absent: City Councilmembers: City Staff: Wayne Hoskisson, Jeanette Kopell, Joe Downard Laura Uhle None Planning Director- Jeff Reinhart, Development Services Coordinator Sommar Johnson, Deputy Recorder I- Stephanie Haycock Members of the Public: 0 The Moab City Planning Commission Planning Commission workshop on the above date in the Council Chambers of Moab City Offices, located at 217 East Center Street, Moab, Utah. Temporary Planning commission Chair Jeanette Kopell called the workshop to order at 5:38pm. Planning Commission Workshop-5:30pm Assured Housing & Feasibility Analysis Planning Director Reinhart urged the Planning Commission to look at the document item by item and read through it. This was a study funded by the County and City, it should help to come up with a structure for this portion of the code once we get it adopted. Director Reinhart did discuss item 16 on page 2, that there are relatively very few multifamily rentals in the Moab Area. He is hopeful that this will help with trying to get more multifamily units. Commissioner Kopell relegated it to kids in urban areas not needing cars to today s adult s not needing to buy a home. She stated that we need apartments in Moab. She stated that it is a mindset, but we need the density. Commissioner Hoskisson stated that it is regional that rentals have increased in urban areas. And in the West we have always been land rich and he isn t sure when it will catch up. But in SLC and surrounding areas apartment rentals have gone up. Director Reinhart stated that also on 16 it states that this type of housing isn t feasible due to having to compete with nightly rentals and hotels. He stated that is not true within City limits because our code is pretty stringent on those buildings and rentals in residential areas. Commission Kopell asked if we are headed toward a direction that the condos that are going in as a timeshare that years down the road will those turn into apartments. Director Reinhart stated that he didn t see that happening. Development Services Coordinator Johnson stated it would all depend on the market, who knows what the future holds. Commissioner Hoskisson said that in the past yes that happened but he doesn t see that happening in the future. Commissioner Downard asked if the new stop lights have jammed up the traffic in town or is that just the perception. Director Reinhart stated that he didn t think so, he stated that the technology on the new lights is advanced enough. Director Reinhart urged the Commissioners again to read through the packet. Director Reinhart stated that at the next council meeting there will be new Planning Commissioner appointed. The board will go from a 5 to a 7 panel. April 24 th would be the joint Planning Commission and City Council meeting starting at 6. Director Reinhart stated he wasn t sure when the study would be out and once it is they will look at ordinances. He guesses within 5-6 weeks. 3 DRAFT The Planning Commission meeting was called to order by Temporary Planning Chair Kopell at 6:00pm 1. Citizens to be Heard There were no Citizens to be heard. 2. Action Item Approval of Minutes February 8, 2018 March 8, 2018 Commissioner Downard motioned to approve the Minutes from February 8, 2018 and March 8, Commissioner Hoskisson seconded the motion. There was no further discussion. The motion carried 3-0 Aye. 3. Public Hearing Proposed Ordinance An ordinance amending the City of Moab Municipal Code, Sections amending the definition pertaining to flag shaped or panhandle lots and amending , Policy pertaining to flag-shaped or panhandle lots, with the addition of the design standards Director Reinhart stated that this goes hand in hand with the last flag lot amended that we had. This came in on an application and they started reviewing the language. The pole portion would not be built on it was access only and the lots would have a greater separation from adjacent structures. Development Services Coordinator Johnson wanted to point out that they did make some changes in the actual policies pertaining to flag shape lots. Commissioner Hoskisson had brought up in previous conversation via that it made more sense for the information to be in the policy not the definition. Director Reinhart stated that the dimensions were in the definition. So the Planning Department did come up with a definition which is: Flag shaped/pan handle flag lot all mean a lot or building site having its only vehicular access by way of a long narrow drive entry access way which serves no other property. Director Reinhart stated that they added a fourth requirement in in which the setbacks were talked about, setbacks or structures on a flag lot shall be those applied to any other standard lot in the underlying zone and the exception is that single story dwellings constructed on a flag lot may be constructed within five feet of the side lot line adjacent to the pole site of the lot. So that is either one of the lots. Commissioner Kopell stated that they did receive some public comment. Chair Kopell opened the public hearing at 6:05pm. No one chose to speak during the Public Hearing. Chair Kopell closed the public hearing at 6:06pm. 4. Action Item Planning Resolution A resolution recommending to City Council approval of Ordinance amending the definition pertaining to flag-shaped or panhandle lots in the City of Moab Municipal Code, Section and amending , Policy pertaining to flag-shaped or panhandle lots, with the addition of design standards Commissioner Hoskisson stated that the only thing he could see that would be problematic would be rights of way or clearances required for water and sewage if things were already in place if it was going to be subdivide. Director Reinhart stated that it is automatic right now that you cannot build on an easement. That would have to Moab City Planning Commission, Minutes Page 2 of 3 Meeting, April 5, 2018

4 DRAFT be taken into consideration if you were doing a flag lot. That would be looked at beforehand. Commissioner Hoskisson said in that case the five feet would be adequate then. That it is probably covered in the platting. If it becomes a problem we may have to do something. Development Services Coordinator Johnson asked if he was concerned about it being able to achieve the separations or if it s possible located on one or both of the lots. Commissioner Hoskisson just pointed out that the flag lot would have to come in on someone else s property. Development Services Coordinator Johnson stated that typically they have been able to get sewer and water to the actual property. She did state that that would have to be addressed in their subdivision plan. Commissioner Hoskisson made a motion to send ordinance to City Council, Commissioner Downard seconded the motion. There was no further discussion. Motion carries 3-0 aye. Future Agenda Items Director Reinhart said consolidation of code sections is the big one we will be addressing. Parking requirements and subdivision standards need to be moved on at the advice of the City Attorney. Director Reinhart also stated that there would be more development applications also. The Moab City Planning Commission held a joint City Council/Planning Commission workshop on the above date in the Council Chambers of Moab City Offices, located at 217 East Center Street, Moab, Utah. Mayor Emily Niehaus called the meeting to order at 6:00 pm. Conditional Use Changes: The Joint City Council-Planning Commission Meeting began with a Discussion regarding conditional use changes. City Planner Reinhart made a brief introduction and conveyed his understanding that the conditional use mechanism was known to be legally and functionally problematic and therefore the Council had directed the Planning Commission and staff to remove conditional uses from the code and to review uses in all zoning districts. Reinhart described examples of proposed changes. Mayor Niehaus asked if there was a deadline and Brown stated the group had been working on the project for nearly two years and anticipated completion. Councilmember Knuteson-Boyd asked about C-5, the neighborhood commercial zone, and the maximum size of businesses. Johnson stated small retail was changed to 1500 square feet (sf) and grocery/convenience stores did not change. Reinhart explained the substance of the document under review represents existing code and is not not new material. Kopell explained the structure as an alphabetical list and Jones spoke about repetition in the descriptions for each use in each zone and went on to explain how the County code was organized. Kopell explained the motivation for repetition was to simplify for the casual reader. Hoskisson explained there was an effort to include all applicable code in each zone section so the reader did not need to navigate various parts of the code. Derasary asked about definitions, and mentioned boarding houses and rooming houses. Reinhart explained the confusion regarding interchangeable terms. Everitt offered that the document would clarify definitions. Derasary also asked for clarification regarding which types of residences would charge Transient Room Tax (TRT). Johnson further explained the definitions. Duncan brought up a citizen complaint regarding employee bunkhouses in an R-2 neighborhood. Reinhart explained the history of employers purchasing single-family homes and providing employee housing. He stated the definition of family and the Fair Housing Act were considerations. McAnany explained that a legitimate concern regards maximum occupancy limits. Reinhart explained square-footage per person and associated concerns were at issue. Duncan brought up the matters of noise, parking, and lack of landscape maintenance and the impacts on neighbors. He added there are edits that need to be made to the proposed ordinance before adoption. Guzman-Newton pointed many points raised about bunkhouses are compliance issues regarding what happens at the exterior of homes. 6 DRAFT issues regarding residential versus commercial zones. She expressed concerns about nightly rentals that impact the stock of permanent residential areas. Guzman-Newton asked about the definition of custom personal services and services establishments. Discussion ensued and it was expressed that areas of the code need cleanup. Derasary brought up about bed and breakfasts in residential zones. Reinhart said the currentlyproposed code allows bed and breakfasts in the R-3 and R-4 zone. The Mayor stated she was not in favor of this use. She continued that the next step was for the Council to review and revise what has been completed to move toward approval. She requested guidance from the City Attorney and asked to schedule a workshop for Council to discuss further revisions. McAnany explained the process begins with the Planning Commission and then the council amends and approves. He explained the limits on the role of the Council in the process without remanding to the Commission. Duncan offered to be a liaison between Council and the Planning Commission. Brown clarified that the role of the Planning Commission was not to make decisions regarding uses but rather to reorganize the code for better interpretation. Mayor Niehaus asked for a separate dedicated workshop meeting for further discuss the code. Councilmember Knuteson-Boyd suggested budget workshops are a priority in the coming month. Land Use Development Code Revisions: The time frame for revising the land use development code was briefly discussed, as was apprising the new commissioners of the history and operations of the planning process.
