1 325 East Hopkins St. Hart Properties & The IML Group San Marcos, Texas Criteria for Residency (512) There is a $40 application fee per person. All occupants 18 and older must complete an application. During the application process the property will remain on the market. General Requirements: 1. Positive picture ID is required. 2. All applicants 18 and over must complete an application. 3. Applications must be completely filled out and signed. Incomplete applications will not be processed. 4. Each person 18 years and older, excluding any grantor if applicable, must pay a $40 application fee prior to processing the rental application; checks or money orders should be made out to IML Group. 5. Property will remain on the market during the application process. 6. Applicant acknowledges and accepts that Hart Properties represents the owner as the Landlord. Rental Requirements: 1. One year verifiable, favorable rental history from a third party landlord. We will send a rental history verification form to your current/previous landlord. Must provide current phone number and fax number on the applications. 2. If no rental history a parent grantor will be required and or additional security deposit. 3. A criminal background check will be performed. 4. The following factors will be considered in denying an applications: a. Having been given a three (3) day notice to vacate. b. Giving insufficient funds check(s). c. Previous property damage. d. Failure to give proper notice to vacate/breach of lease. e. Previous rude or disruptive behavior. f. Making false statements on application. Income requirements: 1. Monthly income must equal approximately three (3) times the amount of the rent. 2. If application is unemployed the applicant must show proof of funds for at least three (3) months worth of rent from bank statements or other sources provided. 3. Proof of income though pay-stubs may be required. 4. Self-employed applicants must provide one year s tax return or 3 months Bank statement acceptable to Hart Properties. 5. Good credit is required or may be required to pay additional security deposit. Employment Requirements: 5. Verifiable employment

2 6. We will send job verification form to current employer. Must provide current phone number and fax number on the applications. Automatic Denials: 1. Application will be denied if applicant: a. Has a felony offense within the last ten years. b. Has a criminal conviction and been out of jail/prison less than five (5) years. c. Was convicted of a criminal offense that was physical or violent in nature against another person or property. d. Is a multiple offender. e. Is a sex offender. f. Has had a foreclosure in the past 7 years. g. Has ever been evicted. Please acknowledge that you have read and understand Hart Properties & The IML Group Policies and Procedures. All occupants 18 and older must complete an application. Signing the lease and/or possession of the unit is scheduled during normal business hours (Monday through Friday, 8:30am-5:30pm). Payment of deposit and signing of the lease is due immediately once you have been notified that your application has been approved. All payments including application fee, security deposit, and rent must be paid in check or money order only. Rent MUST be paid all in one payment. No individual payments will be accepted. NO EXCEPTIONS. Required funds must be paid prior to move-in, that includes pro-rated rent/rent, security deposit, pet deposit and all fees applicable. Utilities must also be switched to tenants name prior to move-in. Failing to do so may result in delayed move-in. Receipt must be provided to Hart Properties/IML Group. Any person approved to reside in the property as a Tenant-At-Will is not financially responsible under the lease, but must abide by the terms of the lease. Rental payments are due in our office on the 1 st of the month with a two day grace period. If the due date falls on a weekend or a holiday, funds are due on the next business day without being late. If not received by the due date a late fee must be included and will continue to accrue until paid in full. Hart Properties late fee s - $50 late charge and $10 per day, till paid in full. NO EXCEPTIONS! The IML Group late fee s - $40 late charge and $10 per day, till paid in full. NO EXCEPTIONS! Renters insurance is not required but highly recommended! The owners insurance will not cover any of tenant's personal property nor is the management responsible for any loss for any reason.

4 ALL pets must be pre-approved by Management BEFORE bringing onto the property. Dogs/Cats must be one year old and weigh 35LBS or less. No puppies/kittens allowed. A non-refundable fee of $300 will be charged per pet. The following breeds will not be accepted on the property: Dobermans, Chow, Pit Bull (Mixes too), Rottweiler and other large aggressive breeds. Management may require breed and weight information from your veterinarian. (Certain exceptions may be made for special needs assistance animals such as seeing-eye dogs.) Properties where no pets are allowed, there are no pets allowed. NO EXCEPTIONS! If you are in a non-pet property and a pet is found, there will be a $250 fine plus $10 per day the animal is there until removed. Per pet. NO EXCEPTIONS! Applicant acknowledges that they are taking possession of the unit as-is unless items stipulated in the special provisions section of the lease and are agreed to by the property manager. No verbal agreements by anyone at Hart Properties or any outside agent will be honored. ALL WORK ORDERS FOR MAINTENANCE MUST BE IN WRITING! If a repair is needed due to tenants/occupants negligence, the tenant will be billed back for the repair. No subletting allowed unless pre-approved by management. This is a lease violation and fees will apply. All occupants living on the property must be preapproved and be on the lease. No guests for longer than 5 days unless preapproved by management or rent can be increased.
