6 PART 5: CONDITIONS AND REGULATIONS OF SUPPLY I/We..hereby request that Electricity will be supplied in accrdance with the Electric Pwer Sectr Refrm Act 2005 f the Federal Gvernment f Nigeria and all the relevant Cdes and Regulatins as apprved by the Nigerian Electricity Regulatry Cmmissin (NERC). ABUJA ELECTRICITY DISTIBUTION PLC (AEDC) (hereinafter called The Operatr ) will supply Electricity subject t the fllwing terms and cnditins. 1. SYSTEM OF SUPPLY The Operatr s system is alternating Current at a Frequency f 50 hertz. The medium vltage will be either 230 Vlts single phase r 400 Vlts three phase. 2. INSTALLATIONS Wiring installatins shall be executed t the satisfactin f the Operatr which will inspect and/r test installatin. 3. SERVICE LINE The nature and lcatin f service lines and ther supply facilities shall be determined by the Operatr. The Operatr shall be at liberty at any time t take branch services ff the service lines whether n the custmer premises r nt, fr the purpse f supplying electricity t any ther premises. The custmer shall btain all the facilities required by the Operatr fr the installatin f the service line including the necessary Right f Way ver his wn and/r adjacent prperty which the Operatr may require. Any service line r ther facilities prvided by r dnated by a cnsumer shall be treated in the line with Investment in Netwrks Regulatin by the Cmmissin 4. ACCESS TO THE PREMISES The custmer shall give the Operatr all reasnable and necessary access t the custmer s premises fr the purpse f cnnecting, discnnecting, inspecting, testing, altering, replacing, maintaining r remving any service line, meter and/r ther apparatus r any part theret and fr reading the meter. The Operatr s fficial will prduce the Operatr identity card, upn demand. The custmer shall pay a fee fr each special meter reading made n request. 5. ADDITIONAL EQUIPMENT After the installatin referred t in schedule 2.1 heref has been tested and passed by the Operatr, the custmer shall nt have any additinal equipment cnnected t his installatin withut submitting an Applicatin Frm AEDC 74 t the Operatr giving at least seven days ntice f his intentin t d s, and shall nt use such additinal equipment until the installatin has been re-tested and passed by the Operatr. Neglect f this precautin may cause interruptin f supply and damage t AEDC Equipment. A penalty may be impsed fr default. 6. TESTING AND ACCURACY OF METERS Shuld the custmer r the Operatr give ntice disputing the accuracy f a meter, such meter shall be tested by the Nigerian Electricity Management Services Agency (NEMSA). If the Custmer cnsiders his meter inaccurate, his ntice t that effect shall be accmpanied by a depsit t cver the cst f the test. In the event f the meter

7 having an errr exceeding the line f errr as may be allwed by the regulatin in frce, the amunt payable fr electricity charge fr the perid fr which the custmer is charged n the last invice rendered prir t the ntice f dispute shall be determined in line with the prvisins f NERC s Regulatin n Meter Reading, Billing, Cash Cllectin and Credit Management. 7. DISCONTINUANCE OF SUPPLY Nt less than seven days ntice in writing must be given t the Operatr by the Custmer r landlrd befre vacating the premises. In default f such ntice the Custmer shall be liable t the Operatr fr all accunts arising until such ntice is received r until the Operatr accepts an applicatin fr the supply t the same installatin frm anther Custmer. The Operatr reserves the right t discntinue supply f electricity fr purpses f safety, when ther Custmers are being cnnected r when the Operatr s mains r equipment are being tested, repaired, r in cases f unavidable interruptin due t fire, fld, tempest, accident and breakdwn f machinery. 8. PAYMENT FOR ELECTRICTY SUPPLY Frm the date supply is made available, the Custmer must pay mnthly fr all electricity billed in accrdance with the applicable rate. Official Receipts are issued by the Operatr fr all payment made t it. Custmers are advised n each ccasin t check that the amunt n their receipt crrespnds with the sum paid. SPECIAL NOTE: Whenever any custmer f electricity supplied by the Operatr leaves the premises where such electricity has been supplied t him withut paying the charges fr electricity r meter rental due t him, the Operatr shall be entitled t recver frm the Landlrd in accrdance with Clause RESPONSIBILITY FOR AEDC APPARATUS The custmer shall ensure the safety against damage r destructin by fire and shall be slely respnsible fr the safe custdy f the meter and ther apparatus belnging t the Operatr that were installed at his premises and shall nt damage, alter, remve the same r bliterate r remve any marks, wrds, r numbers theren, r permit any such damage. The Custmer shall make gd any such damage r reimburse the Operatr t the extent f any lss the Operatr may sustain by reasn f any breach f these cnditins and regulatins. The custmer shall give ntice t the Operatr f any breakdwn, failure, lss, injury, r damage t the meter f any apparatus belnging t the Operatr installed in his premises. 10. NON-LIABILITY OF OPERATOR The Operatr will nt be respnsible fr any lss r damage ccasined t any persn r Prperty whether belnging t the custmer r nt arising ut f any defects in r accident t the wiring installatin r by the use f the electricity supplied r any apparatus that belngs t the Operatr r thrugh any default arising n the Operatr s system r fr any cause beynd their cntrl. This prvisin is subject t the peratr putting in place in place all safety measures t ensure a duty f care in the discharge f its respnsibility t the custmer. 11. THE IMPROPER USE OF SUPPLY If the custmer makes use f the supply in such a way as t interfere with the general distributin f the electricity, immediate steps shall be taken t remedy the defect cmplained f r supply discntinued.

BREACH OF AGREEMENT If the custmer shall neglect r refuse t pay the electricity supplied in accrdance with these cnditins and regulatins, r becmes subject under the bankruptcy laws r enters int liquidatin, r suffers executin t be made n his effects r cmmits any ther breach f this agreement, the Operatr may terminate this agreement and/r discntinue the supply f electricity and/r remve the apparatus belnging t them subject t the prvisins f NERC s Regulatin n Cnnectin and Discnnectin f Electricity Services. 13. REVISION OF CONDITIONS OF SUPPLY The Operatr may frm time t time, n giving ntice t the custmer in writing r by public ntice amend r alter any f the abve cnditins f supply r their scale f charges and such amendment r alteratins shall take effect frm the date specified in the said ntice as apprved by NERC. 14. The custmer and the peratr als herby agree t abide by and exhaust all administrative remedies as cntained in the NERC Custmer Cmpliant Handling: Standards and Prcedures Regulatins befre resrting t any ther dispute reslutin r adjudicatry prcess.
