3 Ozaukee County Board AGENDA INFORMATION SHEET AGENDA DATE: June 7, 207 DEPARTMENT: Administrator DIRECTOR: Jason Dzwinel PREPARER: Jason Dzwinel Agenda Summary County Administrator's Report - June Ozaukee County Forward Focused It is my honor and privilege to present the County Administrator s Report to the County Board of Supervisors for the month of June. June 8 th is our employee appreciation event. This is always a great time for camaraderie among staff. More importantly, it provides an opportunity to say thank you to our employees for all of their efforts accomplishing wonderful things for Ozaukee County. If any Board members are available to attend I would urge you to join us at either event at the Justice Center or the Administration Center. The Administrator s Office dedicated a great deal of effort to items related to the radio system upgrade, the ongoing effort to fill our Finance Director position and the 208 budget process. The Finance Committee discussed the subject of municipal subscriptions to the radio system as the Board directed in the resolution approving the system upgrade. Many of the county s municipal partners in the system attended and the Committee coalesced on two options for action at their June meeting. A status quo option and an option to amortize the costs of the dispatch consoles for municipalities operating dispatch centers. The cost of the consoles does not exceed $45,000 for any municipality. In addition to the discussion on the municipal subscriptions, the committee approved a change order to construct a new communications tower in Mee Kwon Park. The current tower suffers from structural and foundation issues and requires replacement. Finally, the approach to financing the radio backbone was approved and is presented to the Board for approval. Our Project Manager will present an update on the project at this meeting. As I reported last month, the search for a Finance Director is actively underway. A management team identified finalists for the position. I anticipate an employment offer will be made in short order with Board appointment anticipated on July 5 th. A budget kickoff meeting with staff is planned for June 5 th. All departmental budget staff have worked to prepare capital and staff projections in advance of the meeting. As our respite from budget planning ended in early spring! Request is to transfer the $936 from the General Fund back into the ADRC Budget so dementia related safety items can be purchased. 7 RESOLUTION NO. 7-9 AUTHORIZATION OF SALE OF TAX DEED PROPERTY WHEREAS, Ozaukee County through its annual tax settlement with all property tax jurisdictions paid out $6, in delinquent taxes and $4, in current taxes on parcel # , located at 609 Dellwood Court, in the Village of Grafton; and WHEREAS, Ozaukee County Treasurer subsequently was unable to collect the delinquent taxes, special assessments/charges along with the accrued interest and penalty through an installment or any other measures; and WHEREAS, the Ozaukee County Treasurer initiated in rem foreclosure proceedings in an attempt to recover the delinquent taxes and Ozaukee County was eventually granted ownership via Circuit Court on September 6, 206 to recover the value of the delinquent taxes; and WHEREAS, the Finance Committee has overseen the management of the delinquent tax parcel and determined that the County Treasurer should auction the property and all of its contents to the highest bidder in an as is condition; and WHEREAS, the Treasurer posted public notice for auction, sought professional auctioneer support for building contents, and the Finance Committee reviewed the property bid results obtained from interested parties to purchase the property and recommends disposition to the Ozaukee County Board. NOW, THEREFORE, BE IT RESOLVED that the Ozaukee County Board of Supervisors, authorize the sale of the property as is to the highest bidder. 13 RESOLUTION NO. 7-0 TO AUTHORIZE THE EXECUTION OF A TAX -EXEMPT LEASE PURCHASE AGREEMENT AND RELATED DOCUMENTS FOR RADIO BACKBONE UPGRADE NOW, THEREFORE, BE IT RESOLVED, by the Ozaukee County Board of Supervisors as follows:. Determination of Need. Ozaukee County Board of Supervisors has determined that a true and very real need exists for the acquisition of the Equipment described on Exhibit A of Schedule No. 0 to the Master Lease Purchase Agreement dated as of May, 207, between Ozaukee County (Lessee) and Tax-Exempt Leasing Corp. (Lessor). 2. Approval and Authorization. The Ozaukee County Board of Supervisors has determined that the Master Lease Purchase Agreement and Schedule, substantially in the form presented to this meeting, are in the best interests of the Lessee for the acquisition of such Equipment, and the Ozaukee County Board of Supervisors hereby approves the entering into of the Agreement and Schedule by the Lessee and hereby designates and authorizes the following person(s) to execute and deliver the Agreement and Schedule on Lessee s behalf with such changes thereto as such person(s) deem(s) appropriate, and any related documents, including any Escrow Agreement, necessary to the consummation of the transaction contemplated by the Agreement and Schedule. FURTHER RESOLVED, that the Ozaukee County Board of Supervisors directs the County Board Chairperson and County Clerk to execute the Master Lease Purchase Agreement dated as of May, 207 and related documents, between Ozaukee County (Lessee) and Tax- Exempt Leasing Corp. 15 Finance Committee AGENDA INFORMATION SHEET AGENDA DATE: June 7, 207 DEPARTMENT: Administrator DIRECTOR: Jason Dzwinel PREPARER: Jason Dzwinel Agenda Summary To Authorize the Execution of a Tax -Exempt Lease Purchase Agreement and Related Documents for Radio Backbone Upgrade BACKGROUND INFORMATION: In June of 206, the County Board approved a contract to upgrade the countywide radio system. The resolution directed the Executive Committee to recommend an approach to funding the upgrade in concert with the approval of the 207 budget. The 207 budget assumed radio project funding in two phases. The first phase of funding providing for the backbone phase of the radio system upgrade. The backbone includes all of the networking and transmission equipment required to transmit the radio signals between the towers located that the Justice Center, Mee Kwon Park, the Belgium Tower Site on Willow Valley Road in Belgium and a new site at Harrington Beach recently constructed by the State of Wisconsin to improve coverage along the shore of Lake Michigan. The cost of the backbone phase is approximately $3,000,000 ANALYSIS: Staff worked with the Finance Committee to review options for acquiring the backbone phase and recommended that the county pursue a vendor lease obligation. The interest rates were lower than rates available from the State of Wisconsin s Office of Land Commissioners. The recommended term is 0 years at 3.09% interest annually. Debate of the financing option at the Committee and Board level must consider three additional items of importance. First, Board approval of funding of the backbone radio upgrade will require a simple majority vote of members present through the budget process on an annual basis. There is no indebtedness incurred or mandatory payment obligation created beyond the current fiscal year. A tax-exempt lease obligation is distinct from municipal bonding because tax-exempt leasing is not debt and does not require a three-quarters vote of members elect. The tax-exempt leasing approach collateralizes the radio backbone with the assumption that the County Board will approve a lease payment annually during the budget process. Second, The Board s authorization to execute a contract with Harris, the radio vendor, bound the county to make payments on the radio system upgrade. Similarly, the Board s approval of the financing assumption in the 207 budget removed the funds required to make payments under Packet Pg. 5

16 our contract in 207. The project is well underway per the terms of the contract; our vendor has graciously provided flexibility in significant payment milestones already met in the project timeline. The county is obligated to make payment for these services rendered. Third, the Committee and Board should separate the discussion of municipal cost sharing agreements from this debate on funding the backbone. The recommendation for phased acquisition deliberate. Resolution 6- directed the Finance Committee to study and make recommendations regarding the radio equipment distribution, operating policies, and municipal subscriptions to the Ozaukee County radio network with a resolution presented to the full County Board for their review and consideration by July, 207. The Committee will make a recommendation at their June Meeting for review by the Board in July. FISCAL IMPACT: $353,27 annually FUNDING SOURCE: County Levy: $353,27 RECOMMENDED MOTION: Staff respectfully requests that the Committee approve the resolution to finance $2,988,000 in funding from the Tax Exempt Leasing Corporation.
