5 SECTION 2 ELIGIBILITY CRITERIA 1. The Bidder should have an established firm/shop (Certificate of Incorporation/Shop Establishment License Certificate)(Copy to be enclosed). 2. Attested copy of deed of partnership, if the firm is a partnership concern/ Memorandum and Articles of Association duly certified in case of Company (Copy to be enclosed). 3. PAN CARD of the firm (Copy to be enclosed). 4. The Bidder must not be blacklisted/suspended or any service related dispute with any organisation/govt. Organisations/Semi Govt org/ Banks in India or out side India. Annexure The Bidder should accept RFP Terms & Conditions- Annexure The Bidder should mention Annual Business Turnover and filed ITR for last two years i.e. A.Y & A.Y Annexure-3. 6 SECTION 3 INSTRUCTIONS TO BIDDERS 1. Submission of Offer: 1.1. Tender MUST BE ENCLOSED IN A SEALED COVER superscribing Tender number / due date & should reach the undersigned on or before due date mentioned in the tender notice. If the quotation cover is not sealed, it will be rejected Tender should be dropped in the tender box kept in the office of Joint Registrar (MM), Materials Management Division, IIT Bombay, Powai, Mumbai No tender is to be handed over to our staff personally unless otherwise specified. All communications are to be addressed to the undersigned only. In case due date happens to be holiday the tender will be accepted and opened on the next working day Tender can be submitted in person or through post/ courier (IIT Bombay shall not be responsible for any postal delays or any other reason for not submitting the bid in the specified time and resulting in disqualification / rejection of any bid) so as to reach on or before the due date and time Any information furnished by the bidder found to be incorrect either immediately or at a later date, would render him liable to be debarred from tendering/taking up of work in IIT Bombay. 2. Cost of Bidding 2.1. The Bidder shall bear all costs associated with the preparation and submission of its Bid and the Purchaser shall not be responsible or liable for those costs regardless of the conduct or outcome of the bidding process. 3. Amendment of Bidding Documents 3.1. At any time prior to the deadline for submission of bids, IIT Bombay may, for any reason, whether on its own initiative or in response to the clarification request by a prospective BIDDER may modify the bid document All prospective BIDDERs who have downloaded the bidding document may visit IIT Bombay, website for amendments / modifications which will be binding on them. 4. Bid Opening Process: 4.1. The Technical Bid will be opened in the first instance in the presence of representatives of the bidders at IIT Bombay Financial bids of only those bidders, whose bids are found technically qualified, by the Technical Evaluation Committee, will be opened in the presence of the vendor s representatives subsequently at a later date for further evaluation. 7 4.3. One authorized representative of each of the bidder would be permitted to be present at the time of aforementioned opening of the bids The authorized representative of bidders, present at the time of opening of the bids shall be required to sign an attendance register as a proof of having attended the Price bid opening. 5. Cancellation of tender: 5.1. Not withstanding anything specified in this tender document, Purchaser / IIT Bombay in his sole discretion, unconditionally and without assigning any reason, reserves the rights: i) To accept OR reject lowest tender or any other tender or all the tenders. ii) To accept any tender in full or in part. iii) To reject the tender offer not confirming to the tenders terms. iv) To give purchase preference to Public Sector undertakings when applicable as per Govt. Policy/ Guidelines The conditional bid will be summarily rejected. 6. Late tenders : 6.1. IIT Bombay will not be responsible: i) For delayed / late tender submitted / sent by post / courier etc. ii) For submission / delivery of quotations at wrong places other than the mentioned in the tender. iii) Fax / / Telegraphic / Telex tenders will not be considered. iv) Any bid inadvertently received by IIT Bombay after the deadline i.e. due date & time for submission of bids, will not be accepted and returned unopened to the BIDDER. 7. Validity of the offer : Days from the date of opening of the Technical bid. 8. Transfer and subletting : 8.1. The bidder shall not sublet, transfer, assign or otherwise part with the acceptance to the tender or any part thereof, either directly or indirectly, without the prior written permission of the Purchaser. 8 9. Financial Evaluation : 9.1. The financial bid shall be opened of only those bidders who have been found to be technically eligible. The financial bids shall be opened in presence of representatives of technically eligible bidders, who may like to be present. The institute shall inform the date, place and time for opening of financial bid Arithmetical errors shall be rectified on the following basis. If there is a discrepancy between the unit price and total price that is, the unit price shall prevail and the total price shall be corrected by the institute. If there is a discrepancy between words and figures, the lesser amount shall be considered as valid. If the Supplier does not accept the correction of the errors, his bid shall be rejected. 10. Deadline for Submission of Bids : Bids must be received by IIT Bombay before the due date and time at the address specified in the tender document. In the event of the specified date for the submission of bids being declared as a holiday for IIT Bombay the bid-closing deadline will stand extended to the next working day up to the same time. Georjet Polyester Saree of peach Colour (Range Rs ) with peach Colour Blouse of 1 meter each as per sample. 5. Khaki Saree with black border with Blouse of 1 meter each as per sample. 6. Measurement of all the staff for uniforms should be taken at IIT Bombay. Information for taking measurement must be communicated to the concerned section well in advance. 7. The stitching should be of good quality with interlocking stitching pattern. 8. Supplier must be required to give assurance regarding quality and color of the clothes. 10 9. Material needs to be used for the stitching should be as mentioned below : (a) Thread made of Madura Coats only. (b) Zip made of Modi only. (c) Buttons of Paras and Press Buttons of Poni only. (d) All Uniforms must be embossed/woven label with the name IIT Bombay in bilingual i.e. Hindi and English. 10. All complaints related to fitting of uniform should be attended within a week, failing which appropriate amount will be deducted from the bill. 11. Single quotation for all the items will be preferred. However if any firm desires to supply part items such as shoes etc can also apply. 12. The supplier has to submit sample cloth to be used for uniform to IIT Bombay, along with the technical bid. The sample will be inspected by committee members. The committee can reject the tender on the basis of submitted samples. 13. No complaint regarding stitching of uniform or any complaint regarding quality of cloth or other material should be received from staff member. 14. If the complaint is received by staff member or NASA the Security Deposit will be forfeited and no payment for the material supplied will be made. 15. Empaneled suppliers will be required to provide various types of Uniforms and Liveries to all the eligible staff members of IIT Bombay including security. 16. It is mandatory to submit the original bills for purchase of cloths from authorised shop or factory outlet of Raymond only. 17. Institute reserves the right to send the sample of cloths for verification to the company concerned and also reserves the right to cancel the tender on basis of samples. 18. If the quality of product and service provided is not found satisfactory, IIT Bombay reserves the right to cancel or amend the contract. 19. Please visit Materials Management Division for samples. In the event of any dispute over this contract, IIT Bombay's decision shall be final and binding. MMD, IIT BOMBAY Page no. 10 of 25

11 1. Award of Contract SECTION 5 : TERMS & CONDITIONS OF CONTRACT 1.1. The Empanelment and Rate Contract will be valid for a period of ONE year from the date of signing the Contract and may be extended up to two years subject to annual revision, if performance found satisfactory Item wise L1 will be determined and L2 & L3 bidders will be allowed to match L1 rates. If L2 and L3 bidders are not ready to match L1 rates then L4 & L5 will be allowed to match L1 rates IIT Bombay reserves right to keep number of firms in Rate contract for the supply and stitching of Uniform & Liveries If the service provided is not found satisfactory, IIT Bombay reserves the right to cancel or amend the contract. We may remove or add any suppliers during the contract without prior notice. 1.5.The Empaneled supplier will be abide by all the Terms & Conditions of the Tender Document It is not necessary that IIT Bombay will place orders to your firm/organisation for all our requirements. We are free to select other supplier for placement of orders among Panel of suppliers in the Rate Contract and also other suppliers. 2. Prices 2.1. Bid Prices MUST BE SUBMITTED IN ENCLOSED PRICE BID FORM ONLY If the price is not quoted in Price Bid Form provided in tender document then, IIT Bombay will reject bid along with forfeiting Earnest Money Deposit. If supplier wish to give pricing details may be attached in separate sheet The quote must include stitching charges of the uniform & liveries. 2.4.The price must be inclusive of all taxes and charges The supplier shall pay and bear all other liabilities, taxes and duties not specifically agreed by the Purchaser in the contract VAT/Other Govt. Taxes : Excise Duty (ED), other taxes, levies, like Service Tax (ST), Education Cess, etc., are to be indicated in separate sheet if required We are not authorised to issue any Sales Tax forms like form C & D. 3. Terms of payment : 3.1. Payment within 30 days from the date of delivery and & Acceptance Certificate of concerned Department / Section / Materials Management Division. 12 Guarantee only. RFP for Empanelment & Annual Rate Contract for the Supply and Stitching of Uniform & Liveries 3.2. Payment shall be made by Cheque or such other mode / electronic fund transfer offered by the Bank. 4. Delivery schedule : 4.1. Free delivery at IIT Bombay. Delivery of the uniforms must be done within 120 days from the date of measurement at IIT Bombay. Non-availability of the stock should be informed in writing immediately. No part-supply will be allowed. Defective items or items not as per given brands or samples, if any supplied must be taken back and be replaced with no additional cost. 5. Earnest Money Deposit & Security Deposit: While submitting bid, the BIDDER shall deposit an amount mentioned in tender document as Earnest Money, with the IIT Bombay through the following instruments: 5.1. Earnest Money Deposit (EMD) of Rs.75,000/- (Rs. Seventy Five Thousand Only) in the form of Demand Draft in the favour of 'The Registrar, IIT Bombay' payable at Mumbai to be submitted in Technical Bid. Failing which, submitted bid will be Rejected The Earnest Money shall be valid upto a period of 180 days or the complete conclusion of the contractual obligations to the complete satisfaction of both the BIDDER and the BUYER, including warranty period, whichever is later No interest shall be payable by the BUYER to the BIDDER on Earnest Money for the period of its currency EMD of unsuccessful bidders will be returned within 30 days after the award of the contract. 5.5 For successful tenderer/ bidder Earnest money deposit will be converted to Security Deposit and will be retained with IIT Bombay till the expiry / termination of rate contract without interest. 5.6 EMD of a tenderer will be forfeited, if the tenderer withdraws or amends its tender or derogates from the tender in any respect within the period of validity of its tender. Further, if the successful tenderer fails to furnish the required performance security within the specified period, its EMD will be forfeited. 6. Penalty : 6.1. Timely delivery is essence of the contract and hence if any consignment be delayed, liquidated damages at that rate 0.5% of the price of the delayed consignment, for each week or part whereof shall be leived and recovered subject to maximum of 5% of total purchase order value. 7. Force Majeure : 7.1. Force Majeure will be accepted on adequate proof thereof. MMD, IIT BOMBAY Page no. 12 of 25
