Per Month 7.5x16 PR = 60 approx. Per Month 215/75 R17.5 tubeless = 20 approx. Per Month Extra Tube and Flap as per requirement (P.O.) of PRTC. and quantity of any item can be increased /decreased as per requirement of the Department during the validity period of contract on the same rates and terms and conditions 1. INTRODUCTION In reference to the tender notice published in the Punjab Kesari, Indian Express and Hindustan Times (All edition) sealed tenders are hereby invited by the undersigned from reputed tyre manufacturers. The tyre manufacturer may specify the name of their distributor, if any, for executing the supplies of tyres, tubes & Flaps to PRTC Patiala. The tender Document may be read in conjunction with the Tender Notice published and in case of any seeming conflict between the two, this Tender Document shall prevail. Name of work Supply of Tyre, Tubes & flaps 1 Due date for the submission of upto Technical and Financial Bids. 2 Technical Bid to be opened on at 15:00 3 Financial Bid to be opened on at 16:00 2. SUBMISSION OF BIDS. Sealed tenders for the supply of Tyre, Tubes & flaps to Pepsu Road Transport Corporation will be submitted in three separate envelopes, namely Envelope-'A' 'B' and 'C'. The envelopes will be addressed to the Managing Director, Pepsu Road Transport Corporation, Nabha Road, Patiala and will contain the following details on the envelopes also: Name of firm and full address outside the cover of the envelope.

2 2 Each of these envelopes shall be superscribed as: Envelope-'A': Technical Bid for the supply of Tyre Tubes & flaps to Pepsu Road Transport Corporation. Envelope- 'B' Earnest money for sealed tender for the supply of Tyre Tubes & flaps to Pepsu Road Transport Corporation. Envelope- 'C' Financial Bid for the supply of Tyre Tubes & flaps to Pepsu Road Transport Corporation. Envelope 'C' will be opened only of those technically qualified bidders who also deposit earnest money). (Envelop- C will be opened only of those technically qualified bidders who also deposit earnest money.) 3. TECHNICAL BID (In Envelope - 'A') (A) Financial Parameters (i) The average turnover of the firm should be minimum of Rs crore during the last three financial years certified by Chartered Accountant. (copy be enclosed) (ii) Previous clients. Previous main clients during the past three years, name of organization/stus, type of Tyres supplied and approximate value thereof. The bidders are free to highlight any superior features/ equipment that they may possess. EARNEST MONEY IN ENVELOPE _B i) The bidders shall deposit earnest money Rs. 2,00,000/- in the shape of a demand draft payable in favour of the Managing Director, PRTC, Patiala (Punjab). In case any bidder has deposited EMD in previous tender and has not been refunded by PRTC will also be considered and the bidder shall submit the proof of the previous EMD. Any tender without earnest money will be rejected. The earnest money deposited by the successful bidder (s) will be released after six months from the completion of successful contract. Financial bid (Envelope-C) of only those bidders will be opened who deposit earnest money and are found technically qualified. v) Earnest money may be forfeited if :- A bidder violates the conditions of this Tender Document or withdraws his bid during the period of its validity or does anything that may prove prejudicial to this tender.

5 5 6. SPECIFICATIONS OF TYRE TUBES & FLAPS. Tyres Tubes & Flaps as per firm s standard, ASRTU and DGS&D as the case may be. 7. GENERAL TERMS & CONDITIONS: For submitting tender: 1. The contract could be awarded to two or more parties to maintain regular supply and to compare the quality. PRTC reserves the right to change the share keeping in view quality of the product. Risk Purchase Clause: 2. The successful tenderers shall execute the supply of required items strictly as per delivery schedules specified in the supply orders from time to time. The delay in supply of material beyond stipulated period will be treated as non-execution of supply and as such earnest money as well as security amount already deposited with PRTC shall be forfeited. In case of non-supply as per delivery schedule, the risk purchases at the cost of supplier will be resorted to if the supplier fails to supply any item in accordance with the terms and conditions herein provided and those agreed by us or fails to replace the items as may be rejected by the Stores Inspection Committee of this organization, the PRTC shall at the risk and cost of supplier and without any notice or reference to the concerned firm be entitled to purchase such stores items of the same from other sources. If the cost of purchases made from other sources exceeds, the supplier shall be liable to pay the difference of a mount to PRTC. The risk purchase and payment of difference in terms thereof shall not absolve the supplier from the liability to pay damage as may be suffered and claimed by PRTC due to the failure of the supplier to make timely and proper delivery of the required/contracted items. 3. Performance Bank Guarantee / Security: 10% of the total value of the order valid for 20 month to be submitted within of issue of LOI. This is liable to be revoked in case of failure to meet the contractual obligations including timely supply of the material. 4. Eligibility Criteria: The tyre manufacturer should be having valid TS-16949:2002 or latest certification and should be holding valid type approval or BIS certification IS 15636:2012 as notified in the CMVR for tyres and the tubes or latest (Attach Proof). 5. Specifications Tyre, Tube and Flaps should meet the latest as under i) Tyre: AS per AS 97:68:2004 ii) Tube: AS 66:71: Dec.2006 iii) Flaps: As 306:63: Feb 2002.

6 6 In case of forced majeure condition, like strike, riots, natural calamity etc. and if the Corporation is satisfied that the delay is beyond the control of the supplier the delay may be condoned by the M.D., PRTC and the penalty waived off. 6. Conditional tenders will be summarily rejected. 7. The Managing Director PRTC, Patiala reserves the right to accept/ reject any tender or all tenders without assigning any reason whatsoever at any stage. 8. All the disputes will be subject to the jurisdiction of court at Patiala. 9. If the material is not supplied in accordance with the specification/samples, the same will be rejected. 10. Payment for damaged/rejected material will not be made. 11. The entire responsibility of rejected/short supply detected at any stage will be of the supplier. In such cases the cost of the material will be recovered from the pending bills for payment or the earnest money as the case may be. 12. Tenders received after due date & time will not be entertained. The decision of the Technical Bids Evaluation Committee regarding acceptance or otherwise in respect of a technical bid shall be final and shall not be called upon to question under any circumstances. 13. Technical and Financial Bids shall be submitted on the specified formats only. 14. Tenders shall be signed by an authorized signatory alongwith the seal of the firm on each page of the tender 15. Clarification, if any, must be sought timely. 16. The rates should be quoted FOR Destination/Workshop of PRTC in Punjab. 17. The rates should be quoted inclusive of all charges such as sales tax/vat, excise duty and other taxes. Any change in Govt. levies, shall be applicable at the time of execution of supplies. 18. The rates should be written both in words and in figures. In case of over writing, tenders will be liable to be rejected if the cuttings are not duly attested. 19. The bank charges and other incidental charges if any will be borne by the supplier. 20. In case good received short on inspection, the supplier will make the loss good. 21. Payment will be made after 30 days from the receipt of the material and inspection thereof. 22. The photocopies, which are required to be attached with the tender should be self attested with rubber seal of the firm. 23. The Managing Director, PRTC, reserves the right of negotiations of rates, terms and conditions with the tenderers in such cases only where deemed necessary.

7 24. The firm will stand guarantee against the defective material and workmanship. For premature failure of Tyres, Tubes, Flaps the same shall be at the costs of the supplier after joint inspection by the consignee and representatives of the firm, the testing of the same can be carried out at CIRT, Pune at supplier s cost. On receipt of any defective report from the users on pre-mature failure of the tyres Tubes & Flaps joint investigation will be carried out by the representatives of PRTC and the firm, in the concerned unit of PRTC. In case the defect attributed to defective material, design, faulty workmanship, the firm shall provide double compensation to cost of material/tyre. The PRTC can stop further purchases from the party in case of defective supply. 25. The quoted rates of tender shall be valid for the period of one year from the date of finalization of tender in the first instance and can be extended if mutually agreed. 26. The purchase will be made on the basis of lowest rates (CPKM) Cost Per KM. In case any of the bidder has not supplied tyres to PRTC during the last three years he must submit the mileage record of atleast 500 tyres of similar supplied to any of the STU. The certificate should be duly verified by the Technical Head of the respective STU 27. Price Fall Clause: The offer of rates by the tenderer will be subject to the Price Fall Clause i.e., if an item is offered at a lower rate by the tenderer to any other State/place in India, he shall not charge higher rate for the item offered in the tenders. In the event of higher rates offered by such tenderers, the rates so offered by such party can be rejected at any stage besides taking action such as blacklisting, of debarring the tenderer for future participation in tenders. 28. Brand and Specification of item /products offered for supply may be indicated in the offer/quotation. O.E status, if any shall also be indicated and proof thereof be sent alongwith tender. 29. Weightage points for computation of any penalty based on shortfall in performance of tests shall be as per weightage marks for the items provided in the specification by ASRTU from time to time and criteria for levy of penalty /compensation payable by supplier will also remain the same as laid down by the ASRTU, if the sample fails to meet the requirements of any one or more Parameters specified in the applicable to each item. This shall also be applicable to those firms, which are not on rate contract with ASRTU/DGS&D. 30. Delay Penalty: Delayed consignment / delivery schedule will be subjected to 2% penalty per consignment per month of delay or 7

8 8 part thereof recoverable on the value of stores supplied after the schedule date 31. Warranty:- The supplied tyres, tubes and flaps should be free from manufacturing defects and manufacturer should offer free replacement for manufacturing defects. In respect of premature failure of new tyre due to manufacturing defect (on the basis of wear and tear of non skid depth) the claim should be settled on prorate basis after a joint inspection by the representative of the department and the firm within three months. 32. The company should not have ever been black listed by any STU's or any of the Government Department 33. Arbitration Clause: All the disputes and differences arising out in any way touching or concerning this deed whatsoever shall be referred to the sole arbitrator i.e. the Managing Director, Pepsu Road Transport Corporation, Patiala acting as such at the time of the reference. The Managing Director PRTC or any authority nominated by MD, PRTC shall act as Arbitrator for settling any dispute arising between the parties. There will be no objection to such appointment that the arbitrator so appointed and in the course of his duties as such Government/Corporation servant he has expressed his views on all or any of the matters in dispute. The award of such arbitrator shall be final and binding on the parties to the agreement 34. Tenders should be accompanied with the following declarations regarding acceptance of terms & conditions contained in the tender document that may be submitted with technical bids:- I/we have carefully gone through the terms & conditions contained in the Tender Documents No. dated regarding the supply the Tyres, Tubes, Flaps to Pepsu Road Transport Corporation (Punjab).
