Counsel in international arbitration have until now been subject to a diversity of rules and norms regarding their conduct. The possiblyapplicable laws include those of the counsel s home jurisdiction, those at the arbitral seat and those at the place of the hearing. Does this diversity lead to unfairness? Will a set of common rules be the cure? Who would enforce any common rules? As the IBA has recently adopted its Guidelines on Party Representation in International Arbitration, the 17th Annual IBA International Arbitration Day will consider whether and how international standards of conduct can improve the fairness and efficiency of the arbitral procedure. Is it the role of the arbitral tribunal to ensure that all parties play by the same rules with respect to the gathering and production of evidence or testimony? When (if ever) does it become improper or unethical to contact, prepare and coach witnesses? Conference sell-outs The IBA places its conference in venues of a suitable size for the event; however there are times when our conferences may sell out. Should this happen, prospective delegates will be informed and a waitlist will operate. The IBA will not be liable for any travel or accommodation expenses incurred by an individual who travels to the conference without a confirmed place at the event. Cancellation of registration If cancellation is received in writing at the IBA office by 17 January 2014, fees will be refunded less a 25 per cent administration charge. 9 Young Practitioners Symposium Thursday 13 February As part of its contribution to the development of arbitration best practice, the IBA Arbitration Committee, through its Young Arbitration Practitioners (YAP) Subcommittee, organises symposia for the younger members of the arbitration community in cooperation with young practitioners groups. Arbitration Committee The Arbitration Committee focuses on laws, practice and procedures relating to the arbitration of transnational disputes. Through its publications and conferences, the committee seeks to share information about international arbitration and promote its use and improve its effectiveness. The committee has four subcommittees, namely Recognition and Enforcement of Arbitral Awards, Investment Treaty Arbitration, Conflicts of Interest, and Rules of Evidence. The committee also has established two task forces: the Task Force on Attorney Ethics in Arbitration; and the Task Force on Arbitration Agreements. The committee publishes a newsletter which is issued twice a year. The newsletter is packed with articles from practitioners worldwide. The committee s publications include the IBA Guidelines Advert on Conflicts of Interest in International space Arbitration and the IBA Rules on the Taking of Evidence in International Commercial Arbitration. Committee members also receive the IBA s Dispute Resolution International journal which is issued twice a year. The committee has more than 2,300 members from over 90 countries. Young Arbitration Practitioners ( YAP ) Subcommittee Following the success of recent symposia hosted by the Arbitration Committee aimed at young practitioners coinciding with the annual IBA conference in Dublin and the Arbitration Day Conferences in Stockholm and Bogota, this initiative reflects the Arbitration Committee s aim of engaging more actively with the younger members of the arbitration community. It is inspired by the success enjoyed by the IBA s Young Lawyers Committee established in 2004 which has enabled young lawyers to join the association and become active and engaged in its various committees, groups and initiatives. The YAP Subcommittee will leverage the wide reach of the Arbitration Committee s membership to provide a platform for the younger members of the global arbitration community to meet, exchange ideas and learn from peers and more experienced practitioners. The YAP Subcommittee will become one of the permanent subcommittees of the Arbitration Committee. In addition to organising symposia to coincide with the annual IBA and Arbitration Day conferences, the YAP subcommittee will enjoy a broad mandate to organise other standalone events and training seminars, establish task forces dealing with issues of specific interest to young practitioners, and to educate practitioners on the use of the IBA s rules and guidelines. European Regional Forum overview The European Regional Forum has been developing and strengthening the existence of the IBA within the whole of Europe by promoting the goals of the IBA to members, non-members and others, disseminating professional know-how, and assisting the committees and other constituencies of the IBA to increase their presence in the different sub-regions of Europe, including parts of North Africa and the Middle East. The goals of the forum include addressing current and long-term needs of professional organisations and individual members within the geographical reach of the Forum, as well as increasing membership and participation in the IBA and integrating them within the organisation. The Forum will also facilitate cross-border activity between lawyers and bars in different European countries. The Forum has a particular focus on cross-disciplinary activities. The forum seeks to facilitate relevant networking and information/experience sharing opportunities and encompasses the social and collegial interests of both members and potential members with other regional fora, the Corporate Counsel Forum and the Young Lawyers Committee and all LPD committees in general. At present the forum has 7,700 members and its numbers continue to increase as it becomes one of the most integrated and dynamic fora of the IBA.
