After review the following determinations were made: 1) The amendments are consistent with the MPO Board adopted Regional Transportation Plan (RTP). Such amendments further the goals of the RTP by providing for the expeditious completion of all projects while also providing additional clarity for those projects that are the subject of the amendments. 2) Funding Sources are listed below with each project. 3) Other The amendment and reaffirmation demonstrates the FY TIP is a subset of the Board adopted 2040 RTP. Inter-agency Consultation While the proposed amendments did not require an Air Quality Conformity report, inter-agency consultation review was requested via on March 24, 2016 and concurrence occurred on, March 31th and April 1st. Individual TIP project pages have been included in the complete TIP document. The MPO has determined that the amendment of these projects into the TIP will not result in the loss of any funding or the increase of any expenses; therefore the FY TIP remains fiscally constrained.
3 Date: May 6, 2016 Subject: Conformity Report Amendment to the Memphis Urban Area FY Transportation Improvement Program (TIP) From: Pragati Srivastava, Administrator Memphis MPO This report was prepared to document how air quality conformity issues associated with the attached amendments to the FY Memphis Urban Area Transportation Improvement Program (TIP) were addressed. This report provides the information needed to address the Transportation Conformity Checklist provided to the MPO by FHWA to aid in their review of TIP amendments. The TIP, as amended, this report, and attachments to this report should be used to document compliance. The FY TIP, as amended, conforms to the State Implementation Plan (SIP), the transportation Conformity Regulations, the Statewide and Metropolitan Planning Regulations and all other applicable Federal and state requirements. The TIP, as amended, is a subset of the adopted 2040 Regional Transportation Plan (RTP) and the conformity determination made on that plan also applies to the TIP, as amended. The requirements of 40 CFR (e) state that a TIP may rely on a previous regional emissions analysis for a plan if that analysis also applies to the TIP. This requires a demonstration that: (i) The TIP contains all projects, which must be started in the TIP's timeframe in order to achieve the highway and transit system envisioned by the transportation plan; (ii) All TIP projects which are regionally significant are included in the transportation plan with design concept and scope adequate to determine their contribution to the transportation plan's regional emissions at the time of the transportation plan's conformity determination; and (iii) The design concept and scope of each regionally significant project in the TIP is not significantly different from that described in the transportation plan. The amendment(s) listed here meet all three of these requirements. The Memphis MPO Transportation Policy Board (TPB) adopted this amendment at its meeting on May 5, 2016; a copy of the Board resolution is attached. This Resolution also specifically finds that the amendments and resulting TIP conform to the 2040 RTP. While the proposed amendments did not require an Air Quality Conformity report, inter-agency consultation review was requested via on March 24, 2016 and concurrence occurred on, March 31th and April 1st. The adopting Board Resolution found that the public participation process for amending the TIP followed the TPB adopted Public Involvement Plan. A notice was published in several regional newspapers of the proposed amendment s availability for public review and the time, date and location of a public hearing for the TIP amendment was listed. No public comments on the TIP amendments were received. The TIP amendments were developed according to the consultation procedures for the development of the appropriate SIP. The SIP, which creates the emissions budget for the TIP, has not changed, so the prior consultation procedures used for development remain sufficient and appropriate.

5 May 2016 TIP Amendments a. TIP Amendment TN-NHPP : I-240 Bridges The Tennessee Department of Transportation (TDOT) is requesting to amend the FY TIP by adding $3,600,000 in National Highway Performance Program (NHPP) federal funds and $400,000 in state funds to FY 2016 for Preliminary Engineering Design (PE-D) and $50,000,000 in Advance Construction (ACNHPP) state funds to FY 2016 for construction to the I-240 Bridges project. b. TIP Amendment FLAP : Naval Facility Connector The City of Millington is requesting to amend the FY TIP by adding the Naval Facility Connector project into the TIP. The Naval Facility Connector project was awarded a Federal Lands Access Program (FLAP) grant of $2,389,359 in federal funds and $585,590 in local matching funds to make improvements to a 0.5 mile a section of Astoria Avenue by reconstructing the existing two-lane roadway to improve the existing pavement conditions, the horizontal and vertical geometry and to provide access for bicycles and pedestrians.

The addition of the Naval Facility Connector project will required a new 14 day IAC review period. Per previous correspondence with IAC members, the Memphis MPO believes the Naval Facility Connector Project is exempt from regional emissions analysis as it does not change the vehicular capacity of the roadway and is consistent with the 2040 Regional Transportation Plan. Also, since this is a local road and is not a route of regional significance, it is not a project that can be evaluated using the regional travel demand model. A cover letter is included in the attached packet describing the three proposed amendments along with the relevant before and after TIP pages. Also attached is an Air Quality Track Sheet, which identifies the tracking number, proposed 1
16 changes, funding and conformity status for the proposed amendments.
