Interested parties will need to sign-up and obtain user ID and password on the portal as well as remit EMD/ e-service fee through online payment on or before by 5:00 PM. 2. Successful bidder will be required to make payment towards security amounting to Rs. 10,00,000/- after adjustment of EMD within one day of issue of Letter of Intent (LOI) by HSIIDC. In case, successful bidder fails to remit the security amount, the EMD deposited shall stand forfeited at 9:00 AM and will close on at 03:00 PM 3. Bidders/ tenderers are advised to submit their offer per KG/number valid for 1 year from the date of opening of tender/ bid. 4. 2 TENDER e-tender is invited for providing, storage, transportation supply and use of explosives for excavation of stone at Khanak Stone Mining at Village Khanak, Tehsil Tosham, District Bhiwani (under rules 25 of Punjab Minor Mineral Concession Rule 1964) as per the provision of Metalliferous Mines Regulations, 1961 (Amended up-to-date) under Mines Act 1952 for a period of One year extendable at the option of HSIIDC. INVITATION TO BID 1 Haryana State Industrial & Infrastructure Development Corporation Limited (A Government of Haryana Undertaking), hereinafter referred to as HSIIDC or the Company, invites e-tenders from prospective Bidders for Providing, storage, transportation, supply and use of explosives for excavation of stone at Village Khanak, Tehsil Tosham, District Bhiwani, through deployment of a Financially Strong and Technically Competent person through a transparent competitive bidding process. 2 The detailed Scope of Work has been described in this bid document. 3 Bid Process: The bids shall be submitted online in two separate envelop/parts, 1. Envelop 1/Part 1 The bidder shall upload the following details online in the prequalification bids - Scanned copies of payment receipt generated online towards cost of bid document, Explosive Use License granted under the Indian Explosive Rules 2008 and possessing the qualified blasting staff as per provisions of Indian Explosives Act and Mines Act, 1952 and shall upload the same online on the Techno-commercial bid - Techno Commercial bids ; 2. Envelop 2/Part-2 The bidder shall quote the prices in price bid format under Financial Bid - Price bid Envelop 1/Part-1 bids will be opened on at 04:00 PM at HSIIDC Office # Plot No. C-13 & 14, Sector 6, Panchkula, Haryana (INDIA). The Bidders Authorized Representative may remain present at the time of opening of Part 1 bid and Part-2 of the Bid at their own cost. ELIGIBILITY FOR PARTICIPATION:- 1. Any legal entity competent to enter into a contract can participate in the e-tender. 2. The agency should have requisite explosive magazine and explosive license for possession for use of explosive in form LE-3 of explosive rules 2008 for minimum license capacity of kg. of 83mm dia high slurry Explosives in cartridge form and should have license to purchase minimum 20 times of the license capacity (i.e. 3,00,000 kg) in a calendar month and should also have requisite licenses for procurement, storage, transportation and use of other related accessories given in the scope of work and any other permit if required to take up such jobs as per Mines Act 1952 and rules and regulations made there under. 3. The agency should have requisite number of approved explosive vans for transportation of explosives & related accessories items from godown to the blasting site and vice versa, as per directions of the Mine Manager/Mining Engineer. 4. The agency should have requisite member of Technically qualified manpower having qualified manpower having qualifications prescribed under Mines Act 1952 and rules and regulations made there under in the regulations framed under the Explosives Act &. Rules and also have to maintain its accounts of explosive received in Form 32 of Schedule V of Explosive Rules No bid shall be accepted in the name of any other person(s) unless the name of all the persons making the bid is given with complete specification of shares and the person making the bid produces a valid legal power of attorney authorizing him to bid on their behalf along with copy of PAN card of the applicant. 6. In case of bid on behalf of a firm or company or an association etc., the bidder shall furnish the certified copies of Board Resolution/Authorization in favor of the person making the bid along with the certified copy of Memorandum of Association/Articles of Association of Company, partnership deed, HUF etc as the case may be and that the bidder has the authority to bid and enter into an agreement of sale of its behalf. 7. The HSIIDC shall reserve to himself the right to accept any bid subject to approval of the Competent Authority or reject any bid even the lowest or withdraw the site from tender without assigning any reason. 8. Bidder shall not be under a declaration of ineligibility for corrupt & fraudulent practices issued by any State Government/ Government of India/ Union Territory. Page 6 of 16

7 B. HOW TO PARTICIPATE: 1. Intending bidders will be required to sign-up and obtain user ID and password on the portal The Payment for Tender Document Fee INR 1,000/- (Rupees One Thousand Only) and eservice Fee INR. 1000/- (Rupees One Thousand only (both Non-refundable) can be made by eligible bidders online directly through Debit Cards & Internet Banking Accounts and there after deposit Rs.2,00,000/- towards Earnest Money Deposit (EMD) for participation in the e-tender. The intending bidders shall be required to deposit the EMD amount online through RTGS/NEFT/OTC, as detailed in Annexure-I. 2. The intending bidders must ensure that the afore-said amounts are remitted as specified above before 5:00 PM on so as to be eligible to participate in the e-tender. In case of remittance of the afore-mentioned amounts after 5:00 PM on , for any reason whatsoever, the bidder will not be permitted to participate in the e-tender. 3. The agency whose total bid amount is lowest shall be the lowest/ Successful bidder Note : ** The above quantity is the tentative projected quantity which may vary with level of production at site and the bidder will have no claim against variation in production level. The actual payment shall be made based on the quantity of the material used at site. The bidder shall be required to give rates for all the descriptive items separately and inclusive of all applicable taxes. 1. However, the actual payments shall be made as per the actual quantity of the material used at site. The bidder whose bid results (Total) in the overall lowest Fee as per detailed above shall be declared as Selected Bidder and to whom Letter of Intent will be issued by HSIIDC. 2. PAYMENT TERMS: A. The successful/lowest bidder shall be required to remit an amount equivalent to Rs. 10,00,000/- as security (after adjustment of EMD) within one day of issue of Letter of Intent (LOI) by HSIIDC by way of online payment via RTGS/NEFT as detailed in Annexure-I. In case the successful/lowest bidder fails to deposit the said amount as specified above, his bid shall stand rejected and the EMD deposited by him for participation in the e-tender shall stand forfeited by the Corporation and the bid/tender shall be awarded to second lowest bidder at the L-1 rate. In addition to the above said payment as security amount the successful/lowest bidder shall be required to furnish the below mentioned documents: (a) Self-certified copy of PAN card and passport sized photo of applicant/authorized signatory alongwith address details and telephone numbers. 9 (b) In the case of bid on behalf of a firm or company or an association etc., the bidder shall furnish the certified copies of Board Resolution/Authorization in favour of the person making the bid along with the certified copy of Memorandum of Association/Articles of Association of Company, Partnership Deed, HUF document etc. as the case may be and that the bidder has the authority to bid and enter into an agreement of sale of its behalf. (c) The above said documents would be required to be sent by the successful bidder(s) at the registered office of the Corporation within a period of 3 days of close of e-tender and LOI / Work Order in favour of the bidders would be issued only after the Corporation receives the said documents to its satisfaction. 3. OTHER TERMS & CONDITIONS: I.The work will be carried out strictly in accordance with the provision of Metalliferous Mines Regulations 1961 (Amended upto-date) under Mines Act Further, it is clarified that Khanak stone mine is under Prohibitory Order under Section 22 (3) of the Mines Act, Therefore, all work will be carried out strictly in accordance with direction issued by the Director Mines Safety from time to time in supervision of Mines Manager. It will work in close coordination with the agency executing rectification work, if any, in the Khanak mines area. II.The agency will take all safety measure in accordance with the directions issued by the Chief Controller of Explosives, Govt. of India and Director Mines Safety, Ghaziabad in this regard from time to time. III.Purchase of explosives & related accessories, maintaining the necessary records, payment of all related taxes, supply and storage at mining site will be the responsibility of the agency and HSIIDC will make payment only on the quantity of the items used in actual at site. However, it is mandatory for the agency to maintain & produce the record to HSIIDC and all other related Govt. agencies whenever called upon. IV.The bidder shall abide by the local laws & regulations governing labour applicable from time to time. During continuance of the contract, the Bidder shall abide at all times by all existing labour enactments and rules made there, under regulations, notifications and bye- laws of State or Central Government or local authority and any other labour law (including rules), regulations, bye-laws that may be passed or notification that may be issued under any labour law in future either by the State or the Central Government or the local authority. V.HSIIDC shall not be liable to pay for any loss and damages on any account done due to rains, floods, earthquakes or any other natural calamity and any circumstance beyond the control of HSIIDC. The rate will be firm and binding on the agency during the currency of contract including extended time period. No escalation shall be paid for any increase in cost of material etc. VI. Quantity mentioned in the tender is the tentative projected quantity which may vary with level of production at site. The payment will, however, be made according to actual quantity of explosives/items used in the process. VII.No conditional tender will be accepted. VIII.Work Contract Tax/Service Tax, if applicable, and Income Tax will be deducted from all the bills as applicable time to time. Page 9 of 16

10 IX.No charges over and above the quoted and accepted rates of the agency will be paid to the agency on any account whatsoever. X.Non-fulfilment of any of the conditions of the contract on the part of the agency would amount to violation and gives the right to HSIIDC to terminate the contract or impose such penalty as it may deem fit. XI.The time period of the work is one year. The time period can be extended on the same terms and conditions at sole discretion of HSIIDC. XII.The agency shall not be allowed, whatsoever the reasons may be, to sublet the contract. XIII.The security shall be refundable after one month from the completion of contract period to the satisfaction of HSIIDC. XIV.In the event of default or breach or non-compliance of any of the terms and conditions as indicated or for furnishing any wrong or incorrect information at the time of tender, HSIIDC shall have the right to cancel the bid and forfeit whole or any part of the amount paid. XV.The EMD of unsuccessful bidders shall be refunded through electronic mode directly in their account as per detail provided by them at the time of payment of EMD. XVI.The EMD and Security deposit shall not bear any interest. XVII. In case of any dispute regarding any terms or condition of the contract or otherwise, the decision of MD, HSIIDC shall be final and binding. XVIII. HSIIDC reserves the right to terminate the contract at any point of time without assigning any reason. 4. PENALTY CLAUSE : In case bidder fails to supply of the items as per the Schedule provided by Mines Manager, HSIIDC, Khanak, the Security deposit shall be forfeited. 5. RATES: The rates shall be quoted F.O.R site, village Khanak, Tehsil Tosham, District Bhiwani, Haryana. 6. SALES TAX: Rates will be inclusive of all taxes and Sales tax etc. if any, prevailing at the time of delivery of the items shall be borne by the agency/successful bidder. 7. PROCEEDING FOR PAYMENT: The agency may claim bills for supplies, duly certified by Mines Manager, HSIIDC Mining Project, Village Khanak, Tehsil Tosham, District Bhiwani, Haryana, for payment fortnightly & the payment shall be released on expiry of one month from the date of submission of such certified bills. 8. COMMENCEMENT OF THE WORK : The agency shall be required to provide the material from the date of issue of L.O.I. Failure to do so would invite the cancellation of LOI and forfeiture of security/earnest money. Page 10 of 16

FIRM S RESPONSIBILITIES: a) No labour below the age prescribed under law shall be employed on work. b) Transportation, conveyance for the labour, equipments/machinery required for the purpose would be arranged by the firm(s) at its risk and cost. c) The firm(s) shall provide safety protection to its labour failing which firm shall be fined by Chief Safety Officer/ Mines Manager. d) It shall be the responsibility of the firm(s) to keep his labour in the specified area daily. Strict action would be taken against labour and firm(s) if found at other places or including in unlawful activities. e) In the event of any fatal accident / non fatal incidents involving payment towards compensation/treatment etc. to any of the labour on duty, the firm shall be solely liable to pay such compensations under workmen s compensation act 1923/Mines Act etc. and shall keep HSIIDC indemnified from all such risk and liabilities, if any, incurred by it. f) The agency shall have to arrange his own transportation vehicle required for supply of material. g) In case of any equipment belonging to HSIIDC/Authorized Agency is damaged during loading/shifting from HSIIDC premises, the firms will have to pay the charges for the same. h) The agency shall also be liable for and shall keep indemnified the Deptt. against the damage to any property of HSIIDC or other occasioned by accident due to negligence of the agency or its workman. i) All the liabilities due to the labour engaged by the firm(s) shall be entirely of its own. 10. AGENCY REPRESENTATIVE: The agency shall communicate in writing the name of its Authorized responsible representative who shall always be present at site during the execution of the contract and any order/instructions given by the HSIIDC, or his authorized representative to the firm s representative shall be deemed have given to the firm. 11. PARTNERSHIP AGREEMENT: In case, two or more magazine holder agency are participating in the tender, each agency must fulfil the eligibility criteria individually/ jointly and it shall furnish copy of the partnership/ agreement as the case may be for information/ record of HSIIDC 12. EXECUTION OF AGREEMENT: The successful agency shall execute an agreement on a non judicial stamp paper of prescribed value. The contract agreement shall be submitted in duplicate and the firm(s) can have the second copy duly signed for use and its reference and record within 3 days. Page 11 of 16

SETTLEMENT OF DISPUTE: In the event of any dispute arising out in connection with this contract, efforts will be made to settle by mutual discussions, if it is still not resolved it will be referred to MD, HSIIDC whose decision will be final and binding. All causes of action in relation to this tender will deemed to have been arisen within jurisdiction of Panchkula, Haryana. 14. AWARD OF PARALLEL CONTRACT AND PRE-MATURE TEMINATION OF CONTRACT: The HSIIDC will be at liberty to give contract to some other Agency or person in case it is felt by the HSIIDC that due to any reason, the agency is not able to provide the desired quantity/service on daily basis as requisitioned by the Mines Manager. The contract can be cancelled at any stage and the security shall be forfeited in addition to other claims for damages. 15. PERIOD OF CONTRACT: The period of contract is one year from the date of issue of LOI/ Work Order, which can be extended on sole discretion of HSIIDC. 16. Compliance of all statutory requirements of the DGMS, Department of Mines, Haryana State Pollution Control Board, Labour department, Transport Department and /or any other agencies or departments of Govt. of Haryana and Govt. of India. 17. 13 Annexure- I Guideline for Online Payments at e-procurement Portal of Govt. of Haryana Post registration, bidder shall proceed for bidding by using his Password. Bidder shall proceed to select the event he is interested in. On the respective Department s page in the e-procurement portal, the Bidder would have following options to make payment for tender document fee & EMD: A. Debit Card B. Net Banking C. RTGS/NEFT Operative Procedures for Bidder Payments:- A) Debit Card The procedure for paying through Debit Card will be as follows. (i) Bidder selects Debit Card option in e-procurement portal. (ii) The e-procurement portal displays the amount and the card charges to be paid by bidder. The portal also displays the total amount to be paid by the bidder. (iii) Bidder clicks on Continue button (iv) The e-procurement portal takes the bidder to Debit Card payment gateway screen. (v) Bidder enters card credentials and confirms payment (vi) The gateway verifies the credentials and confirms with successful or failure message, which is confirmed back to e-procurement portal. (vii) The page is automatically routed back to e-procurement portal (viii) The status of the payment is displayed as successful in e- Procurement portal. The e-procurement portal also generates a receipt for all successful transactions. The bidder can take a print out of the same, (ix) The e-procurement portal allows Bidder to process another payment attempt in case payments are not successful for previous attempt. Page 13 of 16

14 B) Net Banking The procedure for paying through Net Banking will be as follows. (i) Bidder selects Net Banking option in e-procurement portal. (ii) The e-procurement portal displays the amount to be paid by bidder. (iii) Bidder clicks on Continue button (iv) The e-procurement portal takes the bidder to Net Banking payment gateway screen displaying list of Banks (v) Bidder chooses his / her Bank (vi) The Net Banking gateway redirects Bidder to the Net Banking page of the selected Bank (vii) Bidder enters his account credentials and confirms payment (viii) The Bank verifies the credentials and confirms with successful or failure message to the Net Banking gateway which is confirmed back to e- Procurement portal. (ix) The page is automatically routed back to e-procurement portal (x) The status of the payment is displayed as successful in e-procurement portal. The e-procurement portal also generates a receipt for all successful transactions. The bidder can take a print out of the same. (xi) The e-procurement portal allows Bidder to process another payment attempt in case payments are not successful for previous attempt. C) RTGS/ NEFT/OTC The bidder shall have the option to make the EMD payment via RTGS/ NEFT/OTC. Using this module, bidder would be able to pay from their existing Bank account through RTGS/NEFT. This would offer a wide reach for more than 90,000 bank branches and would enable the bidder to make the payment from almost any bank branch across India. i. Bidder shall log into the client e-procurement portal using user id and password as per existing process and selects the RTGS/NEFT payment option. Page 14 of 16

15 ii. Upon doing so, the e-procurement portal shall generate a pre-filled challan. The challan will have all the details that is required by the bidder to make RTGS-NEFT payment. iii. The Bidder shall be required to take a print of this challan and make the RTGS/NEFT on the basis of the details printed on the challan. v. The bidder would remit the funds at least T + 1 day (Transaction + One day) in advance to the last day and make the payment via RTGS / NEFT to the beneficiary account number as mentioned in the challan. vi. Post making the payment, the bidder would login to the e-tendering portal and go to the payment page. On clicking the RTGS / NEFT mode of payment, there would be a link for real time validation.
